Care And The Funny Business Of Unsettling Land Acknowledgements, Salma Monani, David S. Walsh, Janelle Wertzberger Dec 2023

Care And The Funny Business Of Unsettling Land Acknowledgements, Salma Monani, David S. Walsh, Janelle Wertzberger

All Musselman Library Staff Works

This article points to the “funny business” that invariably accompanies the practice of land acknowledgments. By highlighting the idea of “funny business,” we illuminate its double entrendre – its humor as well as the smoke and mirrors of what The Care Collective ([2020]. The care manifesto: The politics of interdependence. Verso.) describes as “carewashing,” communication strategies designed to proffer a sense of concern, while all the while continuing exploitative practices that deny and obstruct these very concerns. We meld humor with seriousness to interrogate land acknowledgments, expose the perplexing dilemmas of Indigenous and colonial contexts, and push past to …

Validating Osteological Correlates For The Hepatic Piston In The American Alligator (Alligator Mississippiensis), Clinton A. Grand Pre, William Thielicke, Raul E. Diaz, Brandon P. Hedrick, Ruth M. Elsey, Emma R. Schachner

School of Graduate Studies Faculty Publications

Unlike the majority of sauropsids, which breathe primarily through costal and abdominal muscle contractions, extant crocodilians have evolved the hepatic piston pump, a unique additional ventilatory mechanism powered by the diaphragmaticus muscle. This muscle originates from the bony pelvis, wrapping around the abdominal viscera, extending cranially to the liver. The liver then attaches to the caudal margin of the lungs, resulting in a sub-fusiform morphology for the entire ‘‘pulmo-hepatic-diaphragmatic’’ structure. When the diaphragmaticus muscle contracts during inspiration, the liver is pulled caudally, lowering pressure in the thoracolumbar cavity, and inflating the lungs. It has been established that the hepatic piston …

The Ninth Amendment: The "Hard Problem" Of U.S. Constitutional Law, Jorge M. Farinacci Fernós Dec 2023

The Ninth Amendment: The "Hard Problem" Of U.S. Constitutional Law, Jorge M. Farinacci Fernós

Journal Articles

Like with the mythical lamp that can grant any three wishes, federal courts in the United States have buried the Ninth Amendment of the U.S. Constitution deep within the sands of American law in order to avoid coming to terms with its potential regarding the protection of unenumerated constitutional rights. Courts have been able to do so, in part, because of the seemingly impossible task of extracting from the text and history of the Ninth Amendment sufficient elements needed to identify which unenumerated rights may be subject to judicial enforcement.

This impossibility is an illusion and is contrary to the …

Your Mission, Should You Choose To Attempt It, Is To Save The Mona Lisa! Gamification As A Method For Teaching Art, Caleb Ovard

Theses and Dissertations

To increase student engagement in their classroom, the author created an art curriculum using gamification methods that incorporates elements of tabletop role-playing games. The Role-playing Art Curriculum is a key element of this thesis. Possible research approaches involving game-based learning and gamification were examined to point toward future research and reflection regarding games and game-like content into an art curriculum. Action research methods were used to create and run the Role-playing Art Curriculum. The author concludes that the gamified curriculum took extra preparation and required more management to run then other traditional art curriculums.

Size-Dependent Behavior And Challenges In Ag/Al2o3/Au Memristors: An Investigation Into Miniaturization Effect, Catherine Huang Dec 2023

Size-Dependent Behavior And Challenges In Ag/Al2o3/Au Memristors: An Investigation Into Miniaturization Effect, Catherine Huang

Mechanical Engineering and Materials Science Independent Study

This study investigates the performance of Ag/Al2O3/Au memristors, focusing on devices with dimensions ranging from 400nm to 1um. It was observed that smaller devices (400nm and 600nm) consistently display Ohmic behavior, lacking a high-resistance state. This is attributed to increased current density and potential structural imperfections during fabrication. In contrast, larger devices (800nm and 1um) exhibit volatile threshold switching (VTS) and a notable delay in transitioning from high to low resistance states. The study suggests that this delay is due to the instability of conductive filaments in smaller volumes. Additionally, these larger memristors show short retention …

2020-Current year OA Pubs

Tuberculosis remains an international health threat partly because of limited protection from pulmonary tuberculosis provided by standard intradermal vaccination with Bacillus of Calmette and Guérin (BCG); this may reflect the inability of intradermal vaccination to optimally induce pulmonary immunity. In contrast, respiratory Mycobacterium tuberculosis infection usually results in the immune-mediated bacillary containment of latent tuberculosis infection (LTBI). Here we present RNA-Seq-based assessments of systemic and pulmonary immune cells from LTBI participants and recipients of intradermal and oral BCG. LTBI individuals uniquely display ongoing immune activation and robust CD4 T cell recall responses in blood and lung. Intradermal BCG is associated …

Importance Of Sanitation For Stored-Product Pest Management, Georgina Bingham, David W. Hagstrum Dec 2023

Importance Of Sanitation For Stored-Product Pest Management, Georgina Bingham, David W. Hagstrum

Department of Entomology: Faculty Publications

Sanitation is essential for the cost-effective pest management of stored-product insects. The Food, Drug and Cosmetic Act of 1938 led to the Food and Drug Administration (FDA) tightening regulatory standards, and many local surveys, courses and conferences were organized to prepare the industry for these new regulations. Sanitation removes insects and residual food, which may also provide shelter for insects, with heat treatments and insecticide applications. The number of insects removed by cleaning may be reduced as the number of available hiding places increases. Decreased sanitation negatively affects the efficacy of most other pest management practices, with means of 1.3- …

Nonprofits, Taxes, And Speech, Lloyd Hitoshi Mayer Dec 2023

Nonprofits, Taxes, And Speech, Lloyd Hitoshi Mayer

Loyola of Los Angeles Law Review

Federal tax law is of two minds when it comes to speech by nonprofits. The tax benefits provided to nonprofits are justified in significant part because they provide nonprofits great discretion in choosing the specific ends and means to pursue, thereby promoting diversity and pluralism. But current law withholds some of these tax benefits if a nonprofit engages in certain types of political speech. Legislators have also repeatedly, if unsuccessfully, sought to expand these political speech restrictions in various ways. And some commentators have proposed denying tax benefits to groups engaged in other types of disfavored speech, including hate speech …

Harnessing The Power Of Student Voice: A Case Study Of Hybrid Proficiency-Based And Co-Created Curriculum And Assessment, Kaitlyn A. Seamons Dec 2023

Harnessing The Power Of Student Voice: A Case Study Of Hybrid Proficiency-Based And Co-Created Curriculum And Assessment, Kaitlyn A. Seamons

Theses and Dissertations

Assessment has become a dirty word in arts education, because art is notoriously difficult to assess. Assessment, which is often disliked or even disavowed by arts educators, due to its history of incompatibility with the idiosyncratic nature of arts learning, should ideally be utilized as a means of measuring student progress and help teachers understand how to help students succeed. While assessment can also be used to evaluate programs and teachers and to compare student successes relative to those of other students, I will be focusing on measuring individual student progress for my thesis and building a curriculum to support …

A significant proportion of people living with HIV (PLWH) have cognitive impairment. Moreover, approximately 70% of PLWH in the United States will be ≥50 years old by 2030, raising concerns of a higher incidence of dementia as they age. Accordingly, there is a clinical need to monitor their cognitive status. The aim of this study was to delineate specific cognition areas impacted in OALWH with a clinical diagnosis of neurocognitive impairment. We used a comprehensive set of tests (paper and NIH Toolbox Cognition Battery), to assess different cognitive domains in a total of 25 OALWH ≥ 50 years. 64% were …

Technology Justice: Taxation Of Our Collective And Cumulative Cognitive Inheritance, Hilary G. Escajeda Dec 2023

Technology Justice: Taxation Of Our Collective And Cumulative Cognitive Inheritance, Hilary G. Escajeda

Loyola of Los Angeles Law Review

As artificial intelligence and robotic technologies accelerate economic transformation, outdated property and tax laws will increasingly fail American workers with ordinary skills that perform routine job functions. Because technology may render millions of workers redundant, U.S. policymakers must make significant social, economic, and legal structural changes to (1) improve the lives of average workers, (2) support the economy, and (3) maintain political stability.

Inspired by Thomas Paine’s Agrarian Justice, this twenty-first century Article argues that “Technology Justice” requires that humans benefit from the cognitive endowment created by our ancestors’ minds. Specifically, it asserts that our collective and cumulative cognitive …

Protecting America’S Favorite Pastime: An Analysis Of Match-Fixing Laws In States With Legal Sports Gambling, Alyssa Telles Wyatt Dec 2023

Protecting America’S Favorite Pastime: An Analysis Of Match-Fixing Laws In States With Legal Sports Gambling, Alyssa Telles Wyatt

Loyola of Los Angeles Law Review

In 2018, the Supreme Court overturned the longstanding prohibition against sports betting in Murphy v. NAACP. States rushed to capitalize on the new industry, with twenty-eight states currently regulating sports betting. These new laws primarily focus on licensure requirements and generally fail to protect sports’ integrity through match-fixing prohibitions. While a few federal laws regulate sports gambling, only one specifically addresses match-fixing. Against this background, this Note analyzes and compares states’ sports gambling laws against their match-fixing laws, and it proposes new legislation aimed at protecting the integrity of sports games.

Risk Sensitivity Analysis Of Ais Cyber Security Through Maritime Cyber Regulatory Frameworks, Omer Soner, Gizem Kayisoglu, Pelin Bolat, Kimberly Tam

School of Engineering, Computing and Mathematics

Given the increasing frequency and sophistication of methods and strategies employed in cyberattacks, cyber resilience has become a basic notion of cyber risk management. To be cyber-resilient against cyber risks, shipping companies must be proactive in establishing and implementing actions, constructing effective strategies, and adopting mitigation methods to strengthen their assets. However, shipping companies have only lately tended to fully recognize the necessity for a cybersecurity perspective to enable effective cyber risk management and mitigation of increasing cyberattacks. Aside from deficiencies in system design, integration, or maintenance, human factors are the prime weakness that potentially jeopardizes the ship's cybersecurity by …

Missing The Point- The Disappointed Hope Of Self- Publishing Authors, Simone Schroff Dec 2023

Missing The Point- The Disappointed Hope Of Self- Publishing Authors, Simone Schroff

School of Law, Humanities and Social Sciences

Trade book publishing is characterised by authors with weaker bargaining power than the commercial intermediaries, including publishers and distributors. One key solution representing the empowerment of authors is self-publishing works, thereby cutting out the gatekeeper. However, self-publication has failed to improve the position of authors: their incomes continue to fall across the sector. Using social network analysis as well as industry practices, this article examines UK trade book publishing dynamics. It argues that the reason for the self-publication route’s ‘underperformance’ is structural, explained by a realistic view of the publishing sector and the relationships it entails. The self- publishing author …

Consistent Across Situations? A Person Specific Approach To Examining A Long-Standing Paradox., Muchen Xi

Arts & Sciences Graduate Student Theses and Dissertations

Bem and Allen (1974) address the person situation debate by proposing that there are some people behave more consistently, which can be better “explained” try personality traits, than others who are more influenced by situations. However, with failures to directly replicate Bem and Allen’s study, the existence of individual difference in cross situation consistency of behaviors remaining unclear. The current study addressed open questions that arose from the personality consistency debate by employing Mixed Effect Location Scale Model (MELSM) in an intensive longitudinal study. We found 1) there are individual difference in the overall behavioral consistency across situations; 2) there …

Characterizing The Relationship Between Accented Speech Intelligibility And Listening Effort, Mel Mallard Dec 2023

Characterizing The Relationship Between Accented Speech Intelligibility And Listening Effort, Mel Mallard

Arts & Sciences Graduate Student Theses and Dissertations

Unfamiliar accents can make speech communication difficult, both by reducing speech intelligibility and by increasing the effort listeners must put forth to understand speech. However, these two constructs, while related, are independent: for example, two 100% intelligible utterances may require different amounts of effort to accurately process. To better characterize the relationship between intelligibility and effort, this study presents speakers of four intelligibility levels (one natively-accented English speaker, and three Mandarin-accented English speakers) within a dual-task paradigm (featuring a vibrotactile secondary task) to measure listening effort. We found a negative nonlinear relationship between intelligibility and effort, with the steepest slope …
