Covid-19, Free Exercise, And Most Favored Nation Status, Mark Strasser Jan 2023

Covid-19, Free Exercise, And Most Favored Nation Status, Mark Strasser

Lewis & Clark Law Review

Commentators and some Justices suggest that religious activity is accorded a kind of Most Favored Nation status under free exercise guarantees—if a statutory exception is made for a relevantly similar secular activity, then an exception must also be made for religious activity. Such an approach would require a careful consideration of which secular activities were relevantly similar to religious activities to warrant protecting the latter. But the Most Favored Nation approach involves a mischaracterization of the past jurisprudence. Further, as is evidenced in the COVID cases, the U.S. Supreme Court does not engage in a nuanced consideration of which activities …

Class Action Cy Pres: A Call For Reform Amidst Inconsistency And Criticism, Emily Potucek Jan 2023

Class Action Cy Pres: A Call For Reform Amidst Inconsistency And Criticism, Emily Potucek

Lewis & Clark Law Review

The prevalence of cy pres awards in class action settlements has increased remarkably in the last several decades. However as class action cy pres practice has become more commonplace, so have the concerns for its propriety in the class action context. Indeed because these concerns were recognized by the U.S. Supreme Court without further clarity on how, and whether, they can be alleviated, the viability of class action cy pres practice is uncertain. In response to this uncertainty, this Comment presents an exhaustive inquiry into cy pres practice in class action settlements. It demonstrates that while certain courts’ cy pres …

Transition Theory And The Emotional Journey To Medical Educator Identity: A Qualitative Interview Study, J Browne, T Collett Jan 2023

Transition Theory And The Emotional Journey To Medical Educator Identity: A Qualitative Interview Study, J Browne, T Collett

Peninsula Medical School

Background. Medical academia is in crisis, with fewer people entering and growing concern at numbers leaving. While faculty development is often seen as part of the solution, there are significant issues with faculty not engaging with and resisting development opportunities. Lack of motivation may be linked to what might be called a ‘weak’ educator identity. We studied medical educators' experiences of career development to gain further insights into: how professional identity may develop; individuals' accompanying emotional responses to perceived identity change; and consideration of the accompanying temporal dimensions. Drawing on new materialist sociology, we explore medical educator identity formation in …

Inhibition Of Yap/Taz-Driven Tead Activity Prevents Growth Of Nf2-Null Schwannoma And Meningioma, Liyam Laraba, Lily Hillson, Julio Grimm De Guibert, Amy Hewitt, Maisie R Jaques, Tracy T Tang, Leonard Post, Emanuela Ercolano, Ganesha Rai, Shyh-Ming Yang, Daniel J Jagger, Waldemar Woznica, Philip Edwards, Aditya G Shivane, C Oliver Hanemann, David B Parkinson Jan 2023

Schwannoma tumours typically arise on the eighth cranial nerve and are mostly caused by loss of the tumour suppressor Merlin (NF2). There are no approved chemotherapies for these tumours and the surgical removal of the tumour carries a high risk of damage to the eighth or other close cranial nerve tissue. New treatments for schwannoma and other NF2-null tumours such as meningioma are urgently required. Using a combination of human primary tumour cells and mouse models of schwannoma, we have examined the role of the Hippo signalling pathway in driving tumour cell growth. Using both genetic ablation of the Hippo …

Toward Principled Background Principles In Takings Law, Rebecca Hansen, Lior Jacob Strahilevitz Jan 2023

Toward Principled Background Principles In Takings Law, Rebecca Hansen, Lior Jacob Strahilevitz

Coase-Sandor Institute for Law & Economics Research Paper Series

Blunders made by lawyers, judges, and scholars have caused the Supreme Court’s recent opinion in Cedar Point Nursery v. Hassid to be deeply misunderstood. In Cedar Point, the Court re-wrote takings law by treating temporary and part-time entries onto private property as per se takings. Prior to Cedar Point these sorts of government-authorized physical entries would have been evaluated under a balancing framework that almost invariably enabled the government to prevail. As it happens, there were two well-established rules of black letter law that California’s lawyers and amici mistakenly failed to invoke in defending the Cedar Point union organizer access …

Regulatory Trading, David A. Weisbach Jan 2023

Regulatory Trading, David A. Weisbach

Coase-Sandor Institute for Law & Economics Research Paper Series

Regulatory trading systems, such as the SO2 cap and trade system, are ubiquitous in environmental and natural resources law. In addition to cap and trade systems for pollutants such as SO2, NOx and CO2 , environmental and natural resources law uses trading in areas such as endangered species, water quality, wetlands, vehicle mileage, and forestry and farming practices. Trading, however, is rarely used as a regulatory approach in other areas of law. This paper seeks to identify the reasons for this dichotomy. To understand the dichotomy, the paper examines the uses of trading in environmental and natural resources law, where …

Residents Against Housing, Lee Anne Fennell Jan 2023

Residents Against Housing, Lee Anne Fennell

Coase-Sandor Institute for Law & Economics Research Paper Series

Incumbent residents routinely oppose residential development.1 Interestingly, this is true of both homeowners and renters, if for opposite reasons. Homeowners typically worry that new housing will cause the market value of their own homes to fall, resulting in a hit to what is usually a house-heavy personal wealth portfolio.2 Tenants typically worry that new housing will cause the market value of their own homes to rise, generating pressure toward higher rents and displacement.3 Both homeowners and tenants also express concern that new housing development will change the character of their neighborhoods in unwanted ways.4

Resident opposition …

Property As Service Streams, Lee Anne Fennell Jan 2023

Property As Service Streams, Lee Anne Fennell

Coase-Sandor Institute for Law & Economics Research Paper Series

Property’s job is to help people derive benefits from resources.1 But often it cannot do this work well. A core problem is an outmoded model of benefit production that treats the individually owned parcel or “thing” as the relevant unit of analysis.2 Property theorists often use the example of a farm to illustrate how ownership induces people to invest (in sowing) by granting them exclusive rights (to reap the crops).3 On this account, property holdings operate in a largely self-contained fashion, collecting inputs from owners and delivering the associated returns to them. The primary role of property …

Cross-Border Influencers: Democracy And Externalities, Saul Levmore Jan 2023

Cross-Border Influencers: Democracy And Externalities, Saul Levmore

Coase-Sandor Institute for Law & Economics Research Paper Series

The United States does not allow foreigners to influence U.S. elections by giving money to political parties or candidates, but many other countries do allow cross-border influencing. Indeed, the variety of policies among countries is remarkable. Some countries, like the United States, that forbid financial contributions from outside the country, do permit cross-border contributions across domestic borders, such as those of states and cities. Meanwhile, Canadians cannot contribute to the campaigns of U.S. political candidates, and cannot even (lawfully) influence the American political process by purchasing campaign t-shirts or bumper stickers. This prohibition is in place even though, like constituents …

Serotonin Regulation Of Behavior Via Large-Scale Neuromodulation Of Serotonin Receptor Networks, Piergiorgio Salvan, Madalena Fonseca, Anderson M. Winkler, Antoine Beauchamp, Jason P. Lerch, Heidi Johansen-Berg Jan 2023

Serotonin Regulation Of Behavior Via Large-Scale Neuromodulation Of Serotonin Receptor Networks, Piergiorgio Salvan, Madalena Fonseca, Anderson M. Winkler, Antoine Beauchamp, Jason P. Lerch, Heidi Johansen-Berg

School of Medicine Publications

Although we understand how serotonin receptors function at the single-cell level, what role different serotonin receptors play in regulating brain-wide activity and, in turn, human behavior, remains unknown. Here, we developed transcriptomic–neuroimaging mapping to characterize brain-wide functional signatures associated with specific serotonin receptors: serotonin receptor networks (SRNs). Probing SRNs with optogenetics–functional magnetic resonance imaging (MRI) and pharmacology in mice, we show that activation of dorsal raphe serotonin neurons differentially modulates the amplitude and functional connectivity of different SRNs, showing that receptors’ spatial distributions can confer specificity not only at the local, but also at the brain-wide, network level. In humans, …

Mycorrhizal Feedbacks Influence Global Forest Structure And Diversity, Camille S. Delavaux, Joseph A. Lamanna, Jonathan A. Myers, Richard P. Phillips Jan 2023

Mycorrhizal Feedbacks Influence Global Forest Structure And Diversity, Camille S. Delavaux, Joseph A. Lamanna, Jonathan A. Myers, Richard P. Phillips

Biological Sciences Faculty Research and Publications

One mechanism proposed to explain high species diversity in tropical systems is strong negative conspecific density dependence (CDD), which reduces recruitment of juveniles in proximity to conspecific adult plants. Although evidence shows that plant-specific soil pathogens can drive negative CDD, trees also form key mutualisms with mycorrhizal fungi, which may counteract these effects. Across 43 large-scale forest plots worldwide, we tested whether ectomycorrhizal tree species exhibit weaker negative CDD than arbuscular mycorrhizal tree species. We further tested for conmycorrhizal density dependence (CMDD) to test for benefit from shared mutualists. We found that the strength of CDD varies systematically with mycorrhizal …

All Peer-Reviewed Publications

Tsetse flies are exclusively hematophagous and vectors of trypanosomes, which cause human and animal African trypanosomiasis. They are widely distributed in Africa, with 33 extant taxa and 22 species in three sub-genera. Despite a low reproductive rate, tsetse can maintain populations large enough to cause the restriction of the economic use of large areas of tropical Africa through the transmission of trypanosomiases. This success is largely due to their ability to navigate in their environments, using olfactory signals, which elicit critical behavioural phenotypes, such as attraction to hosts for blood meals, larviposition and resting sites, as well as avoidance of …

Natural enemies are major challenges in laboratory rearing of grasshoppers, but the identity and virulence of these towards the edible long-horned grasshopper Ruspolia differens (Serville) is scarcely known. In this study, fungi and bacteria were isolated from R. differens collected from Mbarara, Masaka, Hoima, Kampala and Kabale districts in Uganda in 2018, cultured on standard microbial media, identified using molecular techniques and screened for virulence against the insect in laboratory bioassays. Fourteen and nine species of fungi and bacteria were isolated from R. differens, respectively, with the number of isolates varying based on collection site. The most prevalent entomopathogenic fungal …

International Investment Agreements And Regulation Of Utilisation Of Water Resources In Africa, Dominic Npoanlari Dagbanja Jan 2023

International Investment Agreements And Regulation Of Utilisation Of Water Resources In Africa, Dominic Npoanlari Dagbanja

Indian Journal of International Economic Law

African constitutions and domestic water legislation provide for the human right to clean and safe drinking water. This right is also sourced from international human rights treaties and declarations to which African states are parties or signatories. Both municipal law and public international law impose the duties of protection and fulfilment of the right to safe drinking water on states. Domestic water laws and regulations require African states to regulate and manage the utilisation of water resources including by approving the grant of rights, concessions, or contracts in respect of the exploitation of water resources. These laws also require the …

Longevity, as a complex life-history trait, shares an ontogenetic relationship with other quantitative traits, such as epigenetic and environmental factors. Therefore, it is important to identify environmental factors that may modify the epigenome to establish healthy aging. This study explored the association between tap drinking water and longevity in Cilento, Italy, to understand whether trace elements in local drinking water may have an influence on old, nonagenarian, and centenarian people and promote their health and longevity. Data on population and water sources were collected through the National Demographic Statistics, the Cilento Municipal Archives, and the Cilento Integrated Water Service. Ordinary …

Clean Vehicles Tax Credits Under The Us Inflation Reduction Act: Friend-Shoring Takes Centre Stage In Us Policy, J. Anthony Vanduzer Jan 2023

Clean Vehicles Tax Credits Under The Us Inflation Reduction Act: Friend-Shoring Takes Centre Stage In Us Policy, J. Anthony Vanduzer

Indian Journal of International Economic Law

The international market has recently faced significant disruptions owing to major geo-political events such as the Covid-19 Pandemic and the Russia-Ukraine War, resulting in unreliable and erratic global supply chains. In a bid to create and secure more sustainable supply networks, countries have adopted ‘friend-shoring’ policies, encouraging their enterprises to source supplies from friendly or allied nations. While the primary objective of these policies is to stabilize global supply chains, these initiatives also stem from a desire to reduce reliance on countries that pose a threat to the geopolitical order.

Although tailored as a market-based strategy, these friend- shoring policies, …

Warm Land Surface Temperatures And Eastern Asian Homo, Robert Patalano, Hong Yang Jan 2023

Warm Land Surface Temperatures And Eastern Asian Homo, Robert Patalano, Hong Yang

Biological and Biomedical Sciences Department Faculty Journal Articles

Climate change and hominin evolution are inextricably linked. Pleistocene climate variability, for example, is thought to have had major influences on hominin morphology, brain size, and diversity. However, clear cause-and-effect relationships between specific climatic events and major evolutionary occurrences are difficult to establish due to temporal and spatial gaps in paleoclimatic, paleoenvironmental, and archaeological records. A new branched GDGT paleotemperature record from the Lantian Basin of Central China (Lu et al., 2022), a location known for the earliest hominin presence in East Asia, illustrates warm land surface temperatures over a two-million-year period between 2.6 and 0.6 Ma, a critical time …

Deep Ecology, Nature Spirits, And The Filipino Transpersonal Worldview, Carl Lorenz Cervantes Jan 2023

Deep Ecology, Nature Spirits, And The Filipino Transpersonal Worldview, Carl Lorenz Cervantes

International Journal of Transpersonal Studies Advance Publication Archive

Many Filipinos today still believe that the world is filled with invisible entities who can affect their lives in a tangible way. These beings usually reside in nature as the souls of ancestors or other mysterious spirits. This indigenous transpersonal worldview implies that the individual is part of a living world. The modern term “deep ecology” seems to be aligned with this worldview. This paper looks at the implications of the Filipino transpersonal worldview on policies related to the care for environment and biodiversity.

Globally, pests (invertebrates, vertebrates, pathogens, weeds) can cause estimated annual losses of between 20% and 40%, but higher losses are disproportionately experienced by many low-income countries, as agriculture is the mainstay of the majority of the people and of national economies. Pests pose a major barrier to these countries’ ability to meet the aims of the UN Sustainable Development Goals (SDGs), particularly SDG2, “End hunger, achieve food security and improved nutrition and promote sustainable agriculture.” However, solutions, in the form of pest risk alert systems, coupled with major advances in technology, are now providing opportunities to overcome this barrier in …

The Utility Of Thromboelastography In Acute Perioperative Trauma Resuscitation Of The Adult Coagulopathic Patient, Alexandra Sofia Keokosky Jan 2023

The Utility Of Thromboelastography In Acute Perioperative Trauma Resuscitation Of The Adult Coagulopathic Patient, Alexandra Sofia Keokosky

Nurse Anesthesia MSNA Student Capstones

One quarter of all patients admitted to level I trauma centers receive transfused blood, and approximately 25% of trauma transfusion recipients are diagnosed with coagulopathies during the resuscitation process (Hess et al., 2008; Kutcher & Cohen, 2021; Maegele et al., 2007). Such pathologies have been associated with negative clinical outcomes such as increased transfusion requirements, organ failure, sepsis, and death. (Barash et al., 2013; Cole et al., 2019; Hess et al., 2008; Sayce et al., 2020). Current laboratory standards of care to diagnose coagulopathies such as prothrombin time (PT), international normalized ratio (INR), and activated partial thromboplastin time (aPTT) are …

Recurrence And Metastasis Of Breast Cancer After Volatile Inhalation Agents For Primary Cancer Resection, Elise Amico Jan 2023

Recurrence And Metastasis Of Breast Cancer After Volatile Inhalation Agents For Primary Cancer Resection, Elise Amico

Nurse Anesthesia MSNA Student Capstones

Surgical resection of a breast tumor is frequently a treatment option for cancer, and in some cases can be curative (Hurtado et al., 2021). Multiple factors increase the risk of metastasis or recurrence including the neuroendocrine stress response to surgery and manipulation of the tumor itself (Kim, 2018). Additional factors include depression of cell-mediated immunity including sympathetic nervous system (SNS) stimulation, hypothalamic-pituitary-adrenal (HPA) axis stimulation, and pain (Hurtado et al., 2021). Research suggests that anesthetic selection, particularly total intravenous anesthesia versus volatile inhalation anesthesia (IA), has an impact on cancer recurrence and metastasis in breast cancer patients, however it remains …

Pop Spiritualism: The Experience Of Superfandom, Samuel Goldberg Jan 2023

Pop Spiritualism: The Experience Of Superfandom, Samuel Goldberg

CMC Senior Theses

This ethnography will examine superfans of musical artists, specifically Lady Gaga and BTS (Bangtan Sonyeondan or “Beyond the Scene”), to explore the nature of superfandom and the evolution of the parasocial relationship. To unpack this, I explore the research questions: For superfans of musical artists, what meaning do they find in their fandom? What kinds of experiences and behaviors does it stimulate?

This paper determines superfandom to be self-proclaimed, but the title generally applies to fans who invest heavily (in time or financially) in a particular artist or group, engage with that artist in a routine way, and have strong …

Portrait Of An Insecure Young Man; An Exploration Of The Online Propagation Of Mewing, Jamie Cockburn Jan 2023

Portrait Of An Insecure Young Man; An Exploration Of The Online Propagation Of Mewing, Jamie Cockburn

CMC Senior Theses

As social media becomes more ubiquitous in our cultural existence as humans it plays an increasingly large role in the formation and expression of identity. On many social media platforms, the way people look is emphasized, with more attractive people garnering the most attention. This results in the phenomenon of upward social comparison, which leads to the lowering of self-esteem. Social media and the internet also enable the spread of information and ideologies, which has resulted in the propagation of pessimistic and misogynistic world views in in communities that make up the manosphere. One popular topic on the manosphere is …

Global Trade Implications Of A Russia And Ukraine-Like Conflict Between China And Taiwan, Jay Morris Jan 2023

Global Trade Implications Of A Russia And Ukraine-Like Conflict Between China And Taiwan, Jay Morris

CMC Senior Theses

This paper examines the effects of global trade in general from a Russia-Ukraine-like conflict between China and Taiwan as well as the consequences to the worldwide semiconductor industry. A main component of these effects comes from two assumptions: trade between Taiwan and the rest of the world will cease when the conflict occurs and a group of geopolitically aligned and developed countries called the “Allies” will sanction China across a range of product categories. The main effect of the sanctions is the reduction in imports to China in key strategic goods that help in winning military battles and or promote …

Can You See Me Now?: A Critical Examination Of The Progression, Reception, And Impact Of Performances Of The Body As A Mechanism For Critiquing & Transcending Social Constructs In The West, Lauren Spencer Jan 2023

Can You See Me Now?: A Critical Examination Of The Progression, Reception, And Impact Of Performances Of The Body As A Mechanism For Critiquing & Transcending Social Constructs In The West, Lauren Spencer

CMC Senior Theses

Beginning with Adolf Loos’s famous “Ornament and Crime” essay, I examine the progression, reception and impact of performances of the body using Amelia Jones’ framework for distinguishing body art from performance art. As Primitivist Modernism became popular in the West, racialized bodies garnered new attention as subjects of both inspiration and criticism. Through a critical exploration of Black artists, I determine that the use of bodily performances aided in the subversion of the gender, sexual, and racial discrimination perpetuated by Primitivist Modernism and continued into the 21st century. Starting with French icon Josephine Baker and concluding with American legend Janet …

The Effect Of Free Trade Agreements On Innovation: Evidence From Us Bilateral Free Trade Agreements With Australia, Chile, Singapore, And South Korea, Cameron Stevens Jan 2023

The Effect Of Free Trade Agreements On Innovation: Evidence From Us Bilateral Free Trade Agreements With Australia, Chile, Singapore, And South Korea, Cameron Stevens

CMC Senior Theses

This paper combines two datasets to identify the effect of joining a bilateral Free Trade Agreement with the United States on innovation in four select countries: Australia, Chile, Singapore, and South Korea. Using an probability concordance developed by Lybbert and Zolas (2014), I map the number of patents recorded by the World Intellectual Property Organization (WIPO) into four digit North-American-Industry-Classification-System (NAICS) codes, which are then combined with industry level trade data from the US International Trade Committee (USITC). Using a difference-in-differences regression model, I estimate that joining an FTA increases the number of annual patent filings by 44 in a …
