The Oligarchic Courthouse: Jurisdiction, Corporate Power, And Democratic Decline, Luke Norris, Helen Hershkoff

Jurisdiction is foundational to the exercise of a court’s power. It is precisely for this reason that subject matter jurisdiction today has come to the center of a struggle over corporate power and the regulatory state. Corporations have sought to manipulate forum choice to wear out less-resourced parties and circumvent hearings on the merits, along the way insulating themselves from laws that seek to govern their behavior. Corporations have done so by making creative arguments to lock plaintiffs out of court and push them into arbitration, and failing that, to lock plaintiffs into federal court rather than state court or …

Graduate Theses/Dissertations
This thesis presents a collection of poems that attempts to foreground often dismissed or invisible landscapes and the people who inhabit those spaces. Drawing attention to moments of stillness, creating a space for contemplation and reflection, the poems in this collection stitch together a myriad of speakers whose voices grapple with landscapes of the past, interiority, place, and memory. These poems often center on the speaker's interior observations set against an exterior backdrop. These works are informed by the works of Carl Phillips and Robert Lowell, the British poet, Alice Oswald, the German-British painter, Lucian Freud, and the Chilean poet, …

Immunogenicity And Allergenicity Of A Major Shrimp Allergen Displayed On The Surface Of Virus-Like Particles (Vlps), Supapich Chanasit
Chulalongkorn University Theses and Dissertations (Chula ETD)
Frequencies of shrimp-induced anaphylaxis are particularly important in Asia; Asian countries consume more than 60% of the global seafood production. Currently, approved allergen-specific immunotherapy (AIT) for shrimp allergy is lacking. Shrimp sensitizations are only managed by strict avoidance and treatment with adrenaline. Clinical studies showed that oral immunotherapy (OIT), oral administrations of increasing amounts of food allergen extracts, can be now recognized as an alternative active treatment to strict food avoidance in certain patients with IgE-mediated food allergy. Up to now, the only FDA-approved OIT is for desensitization of peanut-allergic patients. Recently, sustained unresponsiveness to peanuts by OIT was shown …
Impossibility Of Emergent Works’ Protection In U.S. And Eu Copyright Law, Mateusz Blaszczyk
Impossibility Of Emergent Works’ Protection In U.S. And Eu Copyright Law, Mateusz Blaszczyk
Scholarly Works
Protection of emergent works is impossible. Without an author, there is no expression of ideas which can be original, and thus no copyrightable work. Indeed, the whole system of copyright law, its conceptual building blocks of idea-expression dichotomy, originality, authorship, and the concept of a protectable work operate in the notation of human creativity. Emergent works fall outside of copyright’s positive ontology, being akin to ideas, facts, or subject-matter predicated by technical considerations, rather than authorial creativity. In other words, they do not exist as things in law and thus cannot as such be owned. Rather, like any idea, they …

The Immigration Implications Of Presidential Pot Pardons, Jason A. Cade
Scholarly Works
This Essay examines the immigration implications of President Joe Biden’s Proclamation on October 6, 2022, pardoning most federal and D.C. offenders who committed the offense of simple marijuana possession. A late twentieth century interpretive shift by the Board of Immigration Appeals holds that pardons only prevent deportation for certain criminal history categories, which do not include controlled substance offenses, and thus far lower federal courts have deferred to the agency’s approach.Nevertheless, according to the analysis I offer, President Biden’s cannabis pardons should be deemed fully effective to eliminate all immigration penalties. All of the immigrant pardon cases to reach the …
Brokered Abuse, Thomas E. Kadri
Brokered Abuse, Thomas E. Kadri
Scholarly Works
Data brokers are abuse enablers. These companies, which traffic information about people for profit, facilitate interpersonal abuse by making it easier to find and contact people. By thwarting people’s obscurity, brokers expose them to physical, psychological, financial, and reputational harm. To date, there have been four common legal responses to this situation: prohibiting abusive acts, mandating broker transparency, limiting data collection, and restricting data disclosure. Though these measures each have some merit, none is adequate, and several recent privacy laws have even made matters worse. Put simply, the current legal landscape is neither effective nor empathetic.
This Essay explores the …

SUMMARY: The impact of tobacco on health is undeniable. It is a significant risk factor for multiple conditions, including oral diseases. There has been little research on pipe smoking and oral disease in the past. We compare caries, calculus, tooth loss, periapical lesions, and periodontal disease between rural 13th–16th century pre-tobacco males from Klaaskinderkerke and 18th–19th century pipe-using males from Beemster (N = 64). Pipe-smokers were more affected by all pathologies. Pipe smoking was a strongly gendered habit and possibly more common in the countryside. This work demonstrates a need to consider the impact of new imported behaviours on health …

International trade is critical in maintaining a country’s prosperity. Trade between countries fuels the economy for both parties, creates jobs, and raises the standard of living. This statement comes from the Office of the United States Trade Representative (USTR). A major development of USTR's portfolio is the progress in trade with India. In November of 2021, the United States of America and the country of India agreed on a long-awaited Trade Policy concerning numerous economic topics. Within the policy released by the USTR were discussions and agreements over agriculture, non-agriculture goods, services, investment, and intellectual property. The topics included a …

Art Teaching And American Society: An Exploration Of How Art Makes Us Think And Why America Needs It Right Now, Julie Marie Hammerand
Honors Program Theses
The motivation for this thesis comes from my own experience as a learner, an artist, and as a teacher. When I was young, I was always fascinated with the idea of the unknown. Each new piece of knowledge I acquired was a part of the greater puzzle I had yet to understand. As I got older, I understood the value of new perspectives and how each person creates a personal relationship with the world around them. I saw how teaching was the art of bringing a person into and through a new realm of knowledge and thought. Each new realm …

Fcγ receptors (FcγRs) are membrane-bound glycoproteins that bind to the fragment crystallizable (Fc) constant regions of IgG antibodies. Interactions between IgG immune complexes and FcγRs can initiate signal transduction that mediates important components of the immune response including activation of immune cells for clearance of opsonized pathogens or infected host cells. In humans, many studies have identified associations between FcγR gene polymorphisms and risk of infection, or progression of disease, suggesting a gene-level impact on FcγR-dependent immune responses. Rhesus macaques are an important translational model for most human health interventions, yet little is known about the breadth of rhesus macaque …
