South Dakota Legisprudence: A Catalog And Analysis, Neil Fulton Jan 2023

South Dakota Legisprudence: A Catalog And Analysis, Neil Fulton

Faculty Publications

Statutes provide much of the modern legal body of law. It is necessary for any lawyer to have a good understanding of "legisprudence," the rules for enactment and interpretation of statutes. South Dakota has developed a useful body of legisprudence through both statutes and cases that provide direction about how statutes should be read. This article provides a descriptive collection and normative assessment of these interpretive rules.

The Supreme Court Corrects A Seventy-Five Year Distortion In Establishment Clause Jurisprudence, Patrick Garry Jan 2023

The Supreme Court Corrects A Seventy-Five Year Distortion In Establishment Clause Jurisprudence, Patrick Garry

Faculty Publications

In Kennedy v. Bremerton School District, the US. Supreme Court ruled that the Establishment Clause did not prohibit a high school football coach from offering a brief midfield prayer at the conclusion of games. The Ninth Circuit had held that the coach's free exercise rights had to yield to the Establishment Clause's prohibition of conduct that might reflect a state endorsement of religion. In overturning the Ninth Circuit, the Supreme Court issued an historic and far-reaching ruling on the scope and nature of the Establishment Clause, providing the first truly clarifying decision in this area in the past seventy-five years. …

Campylobacter-associated enteric disease is estimated to be responsible for more than 160 million cases of gastroenteritis each year and is linked to growth stunting of infants living under conditions of poor sanitation and hygiene. Here, we examine naturally occurring Campylobacter-associated diarrhea among rhesus macaques as a model to determine if vaccination could reduce severe diarrheal disease and infant growth stunting. Compared to unvaccinated controls, there are no Campylobacter diarrhea-associated deaths observed among vaccinated infant macaques and all-cause diarrhea-associated infant mortality is decreased by 76% (P = 0.03). By 9 months of age, there is a 1.3 cm increase in dorsal …

Microbiology, Immunology, and Molecular Genetics Faculty Publications

Background Alcohol consumption is widespread with over half of the individuals over 18 years of age in the U.S. reporting alcohol use in the last 30 days. Moreover, 9 million Americans engaged in binge or chronic heavy drinking (CHD) in 2019. CHD negatively impacts pathogen clearance and tissue repair, including in the respiratory tract, thereby increasing susceptibility to infection. Although, it has been hypothesized that chronic alcohol consumption negatively impacts COVID-19 outcomes; the interplay between chronic alcohol use and SARS-CoV-2 infection outcomes has yet to be elucidated.

Methods In this study we employed luminex, scRNA sequencing, and flow cytometry to …

Integrated Single Cell Analysis Shows Chronic Alcohol Drinking Disrupts Monocyte Differentiation In The Bone Marrow, Sloan A. Lewis, Brianna M. Doratt, Qi Qiao, Madison B. Blanton, Kathleen A. Grant, Ilhem Messaoudi Jan 2023

Integrated Single Cell Analysis Shows Chronic Alcohol Drinking Disrupts Monocyte Differentiation In The Bone Marrow, Sloan A. Lewis, Brianna M. Doratt, Qi Qiao, Madison B. Blanton, Kathleen A. Grant, Ilhem Messaoudi

Microbiology, Immunology, and Molecular Genetics Faculty Publications

Chronic heavy alcohol drinking (CHD) rewires monocytes and macrophages toward heightened inflammatory states with compromised antimicrobial defenses that persist after 1-month abstinence. To determine whether these changes are mediated through alterations in the bone marrow niche, we profiled monocytes and hematopoietic stem cell progenitors (HSCPs) from CHD rhesus macaques using a combination of functional assays and single cell genomics. CHD resulted in transcriptional profiles consistent with increased activation and inflammation within bone marrow resident monocytes and macrophages. Furthermore, CHD resulted in transcriptional signatures associated with increased oxidative and cellular stress in HSCP. Differentiation of HSCP in vitro revealed skewing toward …

Characterizing The Developmental Role Of Autism-Risk Gene Adnp In A Zebrafish Model For Autism, Vaishnavi Balaji Jan 2023

Characterizing The Developmental Role Of Autism-Risk Gene Adnp In A Zebrafish Model For Autism, Vaishnavi Balaji

Master's Theses

Autism spectrum disorder is a complex neurodevelopmental disorder characterized by impaired social

skills, restricted/ repetitive behaviors, and developmental delay. The disease has a genetic component,

and mutations in the adnp gene have been found in 0.17% of non-inherited genetic cases of the disorder. The exact molecular mechanism by which adnp is involved in the development of autism is not known. This study aimed to use zebrafish to determine the phenotypic effects of adnp mutations using two adnp paralogs- adnpA and adnpB to understand the underlying mechanism. Novel zygotic adnp double heterozygous mutants (A+/- B+/-) were previously generated using …

Foreign Constellations, Steven Archer Jan 2023

Foreign Constellations, Steven Archer

Electronic Theses and Dissertations, 2020-2023

Foreign Constellations is a magical realist collection that centers queer people of color in states of displacement. Facing disconnect from their own tribes along axes of faith, cultural tradition, sexuality, race, geography, and more, the Black and Hispanic characters in these eight stories chafe against the capacity of intersectionality to stratify rather than unite. They are, however, all Floridians, challenging the constraints of national perception with the breadth of their lived experiences. Set across Florida and beyond, each piece sees its protagonists venture into unfamiliar surroundings, or else return to old homes they no longer know how to navigate. A …

Modified Periodic Acid-Schiff (Pas) Is An Alternative To Safranin O For Discriminating Bone–Cartilage Interfaces, Kelsey M. Kjosness, Philip Reno, Maria A. Serrat Jan 2023

Modified Periodic Acid-Schiff (Pas) Is An Alternative To Safranin O For Discriminating Bone–Cartilage Interfaces, Kelsey M. Kjosness, Philip Reno, Maria A. Serrat

PCOM Scholarly Works

Cartilage histomorphometry is often performed on decalcified, paraffin-embedded bone sections, which provide versatility in staining applications from basic morphology to immunohistochemistry. Safranin O is a cationic dye that binds to proteoglycans in cartilage and is routinely used to assess growth plate dynamics and/or fracture repair at bone–cartilage interfaces. When used with a counterstain such as fast green, safranin O can offer exquisite differentiation of cartilage from surrounding bone. However, various decalcification and processing methods can deplete proteoglycans, rendering inconsistent, weak, or absent safranin O staining with indiscriminate bone–cartilage boundaries. We sought to develop an alternative staining methodology that preserves the …

Vitamin D Receptor Mediates Liver Ischemia And Reperfusion Injury By Autophagy-Regulated M2 Macrophage Polarization, Mingming Fang, Chen Zhong Jan 2023

Vitamin D Receptor Mediates Liver Ischemia And Reperfusion Injury By Autophagy-Regulated M2 Macrophage Polarization, Mingming Fang, Chen Zhong

Turkish Journal of Biology

Liver ischemia and reperfusion (IR) injury is the major complication of liver-related operations. Macrophage polarization has an essential effect on the mechanism of liver IR injury. Vitamin D receptor (VDR) has been found to regulate macrophage polarization and alleviate IR injury. Nevertheless, the correlation between VDR and macrophage polarization in liver IR injury has not been clearly elucidated. VDR knockout mice and wild-type littermates underwent partial liver ischemia for 90 min and reperfusion for 6 h. RAW264.7 cells were also used to verify the influence of VDR on macrophage polarization in vitro. VDR activation could promote M2 macrophage polarization and …

Distributional Ecology Of Noccaea Vesicaria In Relation To The Anatolian Diagonal, İlayda Dumlupinar, Hakan Gür, Bariş Özüdoğru

Turkish Journal of Botany

Anatolia is located at the intersection of three of the world's 36 biodiversity hotspots (the Caucasus, Irano-Anatolian, and Mediterranean Basin biodiversity hotspots) and has about 10,000 plant species, over 3000 of which are endemic. Among the many reasons for the astonishing biodiversity of Anatolia, one that stands out is the Anatolian Diagonal. Although the Anatolian Diagonal has long been recognized as a biogeographical boundary between Central and Eastern Anatolia, its exact functioning is still not well understood. Thus, in this study, our aims were 1) to assess the environmental barrier function of the Anatolian Diagonal for a plant species, Noccaea …

The article then turns to assessing the complaints of defamation law’s most prominent would-be reformers and finds them to rest on an incomplete understanding of …

Asymmetries, Norm Matching, And The Pursuit Of Equity Between The Police And The Public, Eang Ngov Jan 2023

Asymmetries, Norm Matching, And The Pursuit Of Equity Between The Police And The Public, Eang Ngov

Faculty Articles

Concerns about police abuse and overcriminalization are on the forefront of public conscientiousness. In spite of the Black Lives Matter movement and calls for police reform, law enforcement officials enjoy a variety of criminal procedure loopholes and double standards, which the United States Supreme Court has ratified through its creation of the open fields, mistake of law, and third party doctrines, as well as its acceptance of deceptive police practices. This Article analyzes the asymmetries between permissible civilian conduct and permissible police conduct to make a broader, systemic critique of the double standards and loopholes that pervade constitutional criminal procedure. …

Hope In Constitutional Drafting: Reorientation In The Construction Of The Indian Constitution, Sujata Gadkar-Wilcox Jan 2023

Hope In Constitutional Drafting: Reorientation In The Construction Of The Indian Constitution, Sujata Gadkar-Wilcox

Western New England Law Review

This Article suggests that moments of contemporary constitution formation are often moments of rupture, but at the same time, the legitimacy of that break from the past paradoxically relies on establishing a continuity with the past. Drawing on ideas of hope and reorientation from Hirokazu Miyazaki, this Article examines the formation of the Indian Constitution and argues that while that constitution embraces what appear to be liberal constitutional norms from other constitutions, it reorients their meaning to transform them into useful vehicles for contemporary Indian social reform.

Trade Policing, Kathleen Claussen Jan 2023

Trade Policing, Kathleen Claussen

Articles

At the core of U.S. economic governance, there is a novel and under-noticed phenomenon that challenges longstanding frameworks of international law and corporate compliance. This practice, which this Article terms the new "trade policing," has extraordinary reach. Recent regulatory makeovers and pathbreaking statutes empower our trade agencies to target, for the first time, companies, rather than foreign governments, as used to be their purview. Trade police now pursue companies wherever they may be in the world, not just for violating U.S. law but also for violating foreign law in areas as diverse as labor rights and environmental protections. Such a …

Stage-Structured Predator-Prey Interactions In A Warming World: A Case Study In Riverine Rock Pools, Andrew T. Davidson Jan 2023

Stage-Structured Predator-Prey Interactions In A Warming World: A Case Study In Riverine Rock Pools, Andrew T. Davidson

Theses and Dissertations

Warming can impact predator-prey interactions through a variety of mechanisms. For example, warming can both alter the rate at which predators consume prey and the rate prey develop through vulnerable life stages. Thus, the overall effect of warming on consumer-resource interactions will depend upon the strength and asymmetry of warming effects on predator and prey performance. Here, we describe the consequences of these asymmetrical responses to temperature by first developing a simple stage-structured modeling framework, then applying that framework to predation of American rock pool mosquito larvae, Aedes atropalpus, by several common predators in riverine rock pools. We then …

Interactions Between Hiv And Opioids On Antiretroviral Accumulation, The Blood Brain Barrier, And The Inflammatory Response In The Brain., Kara Rademeyer

Theses and Dissertations

The complex mechanisms related to HIV infection, neurodegeneration, and chronic neuroinflammation collectively describe neuroHIV (Hauser et al. 2007; Chang et al. 2014; Smith et al. 2014). Specifically, opioid abuse, poor penetration of antiretroviral (ARV) drugs, chronic inflammation and neuronal injury/degeneration are all implicated in neuroHIV (Fantuzzi et al. 2003; Letendre et al. 2004; Verani et al. 2005; Duncan and Sattentau 2011; Hong and Banks 2015; Simoes and Justino 2015; Olivier et al. 2018; Murphy et al. 2019; Osborne et al. 2020). For the first time, we demonstrate that morphine, fentanyl, and methadone in vivo alter the brain accumulation of ARVs, …

Employers As Information Fiduciaries, Bodie, Matthew T. Jan 2023

Employers As Information Fiduciaries, Bodie, Matthew T.

Santa Clara Law Review

In order to better protect users from the predations of large tech companies amassing their data, commentators have argued that these companies should be considered information fiduciaries for the purposes of collection, use, storage, and disclosure of that data. This Essay considers the application of the “information fiduciary” label to employers in the context of employee data. Because employers are handling ever greater quantities of employee data, and because that data is becoming more sensitive and potentially damaging to workers if misused, the law should account for this expanded role with expanded protections. The beginnings of how such a set …

Sylvia Plath As A Confessionalist Writer : The Queen Bee, Alexandra Tangarife Jan 2023

Sylvia Plath As A Confessionalist Writer : The Queen Bee, Alexandra Tangarife

Theses, Dissertations and Culminating Projects

Sylvia Plath is a renowned Confessionalist poet from the early-mid 20th century in America. She frequently compares to her predecessor, Robert Lowell, and her friend and colleague, Ann Sexton. Confessionalism was an emotionally authentic form of poetry that split off from prior poetry, such as Modernism. Modernist founder T.S Eliot wrote in his “Tradition and The Individual Talent,” “Poetry is not a turning loose of emotion, but an escape from emotion; it is not the expression of personality, but an escape from personality” (1). Despite this mentality, Confessionalists addressed the elephant in the room: the fragmented and emotionally disturbed nation. …

Ecocriticism And The Young Adult Audience In Dry And The Islands At The End Of The World, Nicole Marie Sysyn Jan 2023

Ecocriticism And The Young Adult Audience In Dry And The Islands At The End Of The World, Nicole Marie Sysyn

Theses, Dissertations and Culminating Projects

This thesis focuses on exploring and analyzing two young adult novels through an ecocritical lens. The authors of the young adult novels, Dry and The Islands at the End of the Earth, bring awareness to young readers about the progression of global warming and effects this devastation has on humans and animals. Both of these novels show character’s relationships with nature, decision making skills in terms of crisis, and coping mechanisms which can translate to young readers. There is a great balance of teaching young readers the importance of their own relationship with the environment and how to cope in …

Destruction Of Pfoa On Ion-Exchange Resin With Advanced Reduction Processes To Regenerate Resins For Addressing Pfoa Pollution In Drinking Water, Junkui Cui Jan 2023

Destruction Of Pfoa On Ion-Exchange Resin With Advanced Reduction Processes To Regenerate Resins For Addressing Pfoa Pollution In Drinking Water, Junkui Cui

Theses, Dissertations and Culminating Projects

Per- and polyfluoroalkyl substances (PFAS) have been globally incorporated into various industrial and consumer products since the 1940s. However, concerns about PFAS have gradually grown because of their prevalence, mobility, persistence, bioaccumulation, and adverse impacts on human and environmental health. Unfortunately, traditional water treatment processes inefficiently remove PFAS. Therefore, there is an urgent research need to develop innovative, technically viable, and low cost-treatment processes for the removal of PFAS in water.

Among the established PFAS treatment technologies, ion-exchange (IX) has been extensively applied to drinking water treatment practices due to its adsorption capability and technology maturity. However, IX is highly …

Road Salt-Induced Salinization Of The Upper Paulins Kill River In Newton, New Jersey, Kristine Emily Rogers Jan 2023

Road Salt-Induced Salinization Of The Upper Paulins Kill River In Newton, New Jersey, Kristine Emily Rogers

Theses, Dissertations and Culminating Projects

Road salt application is a primary factor leading to the salinization of freshwater rivers and streams throughout the Northeastern United States and globally. Rising salinization within fresh water bodies is problematic because it can modify community structure and detritus processing within freshwater ecosystems, induce mortality among macroinvertebrates and other aquatic life, and mobilize metals that can pose harm to human health. Road salts also threaten surface and underground drinking water supplies, kill riparian vegetation, and corrode infrastructure, such as bridges and roads. This research examines 4 1⁄2 years of continuous water quality monitoring data collected from two sensor stations along …

ICT

Colorectal Cancer (CRC) is a globally prevalent and deadly carcinoma, necessitating advanced treatment approaches. Despite ongoing advancements, the mortality rate remains high. Various biological models, including animal studies, cell lines, and the emerging organoid model, contribute to understanding molecular mechanisms. Organoids, 3D cultures derived from tumor epithelial cells, offer advantages such as enhanced diversity, genetic modification, and extended culture capabilities. Recent applications of machine learning (ML) in predicting CRC treatment responses using organoids and tissue data indicate a promising avenue for advancing personalized therapies.

The Judicial Nondelegation Doctrine, Jason Iuliano Jan 2023

The Judicial Nondelegation Doctrine, Jason Iuliano

Utah Law Faculty Scholarship

“Nondelegation doctrine.” Lawyers know it as the rule barring Congress from delegating power to other branches of government. The doctrine, however, has another side—one that applies to the judiciary. This aspect of the doctrine holds that courts may not delegate judicial power to other branches of government. Nonetheless, courts do precisely that. And they do it thousands of times each and every day. Judges empower non-judicial actors to do everything from making legal findings and rendering sentences to resolving custody disputes and setting probation conditions.

This Article is the first to explore the constitutionality of these kinds of delegations. To …

Sleep Aid Use During Early Pregnancy And The Risk Of Birth Defects, Meredith M. Howley Jan 2023

Sleep Aid Use During Early Pregnancy And The Risk Of Birth Defects, Meredith M. Howley

Legacy Theses & Dissertations (2009 - 2024)

This dissertation examines the validity of maternal self-reported medication exposures and then explores the associations between self-reported sleep aid use, including zolpidem specifically, and birth defects using data from three population-based case-control studies conducted within the United States. The first aim of this dissertation was to explore agreement between two sources of prescription medication use in early pregnancy: medical records and self-reported interview data from the Birth Defects Study To Evaluate Pregnancy exposureS (BD-STEPS). We observed that agreement of prescription data between self-report and medical records varies by whether the medication is used chronically or episodically. While self-reported medication information …
