GW Law Faculty Publications & Other Works

On April 27, 2022, Jessica Tillipman, Assistant Dean for Government Procurement Law Studies at The George Washington University Law School testified before the House Committee on Oversight and Reform regarding McKinsey & Company's potential Organizational Conflict of Interest between its contracts with the Food & Drug Administration (FDA) and its commercial, opioid manufacturer clients. Her testimony addressed the longstanding need to update and clarify the current legal framework governing Organizational Conflicts of Interest (OCIs) in the Federal Acquisition Regulation (FAR) and the importance of government contractors maintaining strong internal ethics and compliance programs.

The Common Sense Of A Wealth Tax: Thomas Paine & Taxation As Freedom From Aristocracy, Jeremy Bearer-Friend, Vanessa Williamson Jan 2022

The Common Sense Of A Wealth Tax: Thomas Paine & Taxation As Freedom From Aristocracy, Jeremy Bearer-Friend, Vanessa Williamson

GW Law Faculty Publications & Other Works

Thomas Paine’s writing helped spur the American colonies to independence and ensure that the new nation would be a republic, not a monarchy. In light of the renewed interest in wealth taxes, this article provides a close examination of Thomas Paine’s wealth tax proposal in the second volume of The Rights of Man. Unlike Paine’s proposal to tax inheritances, his 1792 proposal to tax wealth on an annual basis is often overlooked. The article identifies Paine’s various design specifications, provides original estimates of the impact of Paine’s wealth tax proposal within his own time period and as applied to billionaires …

A Critical 21st Century Role For Public Land Management: Conserving 30% Of The Nation’S Lands And Waters Beyond 2030, Robert L. Glicksman, Sandra B. Zellmer Jan 2022

A Critical 21st Century Role For Public Land Management: Conserving 30% Of The Nation’S Lands And Waters Beyond 2030, Robert L. Glicksman, Sandra B. Zellmer

GW Law Faculty Publications & Other Works

The international goal of conserving 30 percent of the world’s lands and water to stave off the ravages of climate change and widespread species extinctions has come to the United States. The Biden Administration’s 30 by 30 Initiative commits the nation to placing 30 percent of its lands and waters in some kind of protected status by 2030. Because a substantial portion of the nation’s land base is owned by the federal government, 30 by 30 goals will be beyond reach if conservation commitments do not cover federal lands and resources. And because nearly 70 percent of the federal lands …

Overcoming Corruption And War -- Lessons From Ukraine's Prozorro Procurement System, Christopher R. Yukins, Steven Kelman Jan 2022

Overcoming Corruption And War -- Lessons From Ukraine's Prozorro Procurement System, Christopher R. Yukins, Steven Kelman

GW Law Faculty Publications & Other Works

After the 2014 uprising against widespread corruption under former Ukrainian President Victor Yanukovych, a group of civic activists and data experts decided to overhaul government procurement. Their efforts produced an open-source e-procurement system, ProZorro (“transparency” in Ukrainian), and a community of citizens and government buyers, Dozorro (“watchdog” in Ukrainian), that analyzes contracting data, flags high-risk deals and irregularities, and reports them to government authorities. Created with the help of the European Bank for Reconstruction and Development and the U.S. Agency for International Development, ProZorro has helped Ukraine save almost $6 billion in public funds since October 2017, according to the …

Nearly every person in the United States currently has in their body dangerous amounts of chemicals proven to cause cancer, endocrine disruptions, liver and kidney failures, infertility, developmental difficulties, learning disorders, and immunodeficiencies. These chemicals are known collectively as “PFAS”—per- and poly-fluoroalkyl substances—and they were designed for heavily industrial applications. However, over the last two decades, they have surreptitiously and successfully migrated from heavy machinery and building sites onto the many items that consumers use to cook, serve, or store their food. With the FDA’s blessing, PFAS are now ubiquitous in food contact materials, from where they leach directly into …

Academic Brands And Online Education, Paul S. Berman Jan 2022

Academic Brands And Online Education, Paul S. Berman

GW Law Faculty Publications & Other Works

Online education both does and does not radically transform higher education and higher education brands. On the one hand, providing courses online potentially allows universities to reach a worldwide audience, helps them globalize their brand, changes the cost structure for both students and institutions, and could reshape the competitive branding landscape among universities. On the other hand, university brands are surprisingly regional, low student–faculty ratios are still necessary for truly high-quality education, and the online competitive landscape might ultimately simply replicate reputational hierarchies forged over decades in the world of on-campus education. Thus, although the idea that online learning will …

The Failure Of Data Security Law, Daniel J. Solove, Woodrow Hartzog Jan 2022

The Failure Of Data Security Law, Daniel J. Solove, Woodrow Hartzog

GW Law Faculty Publications & Other Works

In this book chapter, we survey the law and policy of data security and analyze its strengths and weaknesses. Broadly speaking, there are three types of data security laws: (1) breach notification laws; (2) security safeguards laws that require substantive measures to protect security; and (3) private litigation under various causes of action. We argue that despite some small successes, the law is generally failing to combat the data security threats we face.

Breach notification laws merely require organizations to provide transparency about data breaches, but the laws don’t provide prevention or a cure. Security safeguards laws are often enforced …

Monitoring And Modelling The Dynamics Of The Cellular Glycolysis Pathway: A Review And Future Perspectives, Nitin Patil, Hugh Byrne, Orla L. Howe, Paul A. Cahill Jan 2022

Monitoring And Modelling The Dynamics Of The Cellular Glycolysis Pathway: A Review And Future Perspectives, Nitin Patil, Hugh Byrne, Orla L. Howe, Paul A. Cahill

Articles

Background

The dynamics of the cellular glycolysis pathway underpin cellular function and dysfunction, and therefore ultimately health, disease, diagnostic and therapeutic strategies. Evolving our understanding of this fundamental process and its dynamics remains critical.

Scope of review

This paper reviews the medical relevance of glycolytic pathway in depth and explores the current state of the art for monitoring and modelling the dynamics of the process. The future perspectives of label free, vibrational microspectroscopic techniques to overcome the limitations of the current approaches are considered.

Major conclusions

Vibrational microspectroscopic techniques can potentially operate in the niche area of limitations of other …

The Implications Of A Militarized Police Force In The United States, Nhat Dang Jan 2022

The Implications Of A Militarized Police Force In The United States, Nhat Dang

Themis: Research Journal of Justice Studies and Forensic Science

The police model in America is slowly changing. From the early days of America, the police were modeled after the London Metropolitan Police. Over time, this has changed from a civilian police model into a more militaristic one. Police militarization in America can be traced to the implementation of the 1033 program, which granted local law enforcement agencies surplus military equipment such as weapons, surveillance gadgets, and armored vehicles. This research paper examines the effects of increasing police militarization on public perception and public trust of police.

Nutritional Values And In Vitro Fermentation Parameters Of Some Fodder Species Found Intwo Rangeland Areas In The Republic Of Benin, Euloge Akambi Ogoukayode Olomonchi, Ali̇ Vai̇z Gari̇poğlu, Nuh Ocak, Adem Kamalak

Turkish Journal of Veterinary & Animal Sciences

In the present study, the nutritional values and in vitro rumen parameters of three browse forages (Leucaena leucocephala (LL), Cajanus cajan (CC) and Khaya senegalensis (KS)) and five grasses (Andropogon gayanus (AG), Panicum maximum C$_{1}$ local (PMCL), Panicum maximum C$_{1}$ ameliorate (PMCA), Pennisetum purpureum (PP), and Brachiaria ruziziensis (BR)) grown in the Republic of Benin were investigated. With this aim, it was determined dry matter (DM), ash, acid detergent fibre (ADF), neutral detergent fibre (NDF), crude protein (CP), ether extract (EE), metabolizable energy (ME), dry matter intake (DMI), dry matter digestibility (DMD) and relative feed value (RFV) as nutritive values, …

Bayesian Genomic Prediction Of Junctional Epidermolysis Bullosa In Sheep, Burak Karacaören Jan 2022

Bayesian Genomic Prediction Of Junctional Epidermolysis Bullosa In Sheep, Burak Karacaören

Turkish Journal of Veterinary & Animal Sciences

Junctional epidermolysis bullosa (JEP) is a heritable skin and mucosa disorder in association with mendelian mutations in sheep. The purpose of this investigation is to explore the relationship between different priors, linkage disequilibrium, and single nucleotide polymorphism (SNP) selection methods and accuracy of Bayesian GP of JEP in sheep. Ninety-two Spanish Churra sheep breed genotyped by 40668 SNP markers. Bayes C? was shown to have slightly higher predicted accuracy [0.724 (0.113)] by unselected data. Prediction performance of the Bayesian GP models was found to be similar after correction for LD. There was a significant difference between predicted accuracies due to …

Effects Of Vitamin D Administration At The Beginning Of Lactation In Dairy Cows Oninflammatory Response And Liver Metabolism, Feyyaz Kaya, Hasan Batmaz Jan 2022

Effects Of Vitamin D Administration At The Beginning Of Lactation In Dairy Cows Oninflammatory Response And Liver Metabolism, Feyyaz Kaya, Hasan Batmaz

Turkish Journal of Veterinary & Animal Sciences

This study aimed to investigate the effect of vitamin D administered 24 h after calving of dairy cows on calcium-phosphorus metabolism, carbohydrate, lipid and liver metabolism, and inflammatory response. Twenty multiparous Holstein cows were randomly assigned to the experimental (EG) and control group (CG). The EG received 5,000,000 IU vitamin D3 (5 mL) 24 h after parturition intramuscularly, whereas the CG group received 5 mL of 0.9% NaCl. Blood samples were taken 24 h after parturition before treatments and at the 3rd, 7th, 14th, and 28th days of lactation. Serum NEFA, BHBA, haptoglobin, serum amyloid A (SAA), ceruloplasmin, calcium, phosphorus, …
