Impartial Justice: Restoring Integrity To Impeachment Trials, Justin D. Rattey

Pepperdine Law Review

In recent decades, we have witnessed the diminution of the impeachment process by various actors—especially political parties. But the Founders envisioned a vastly different process, one that was insulated from partisanship. In Alexander Hamilton’s words, impeachment trials were assigned to the Senate because the Senate is “a tribunal sufficiently dignified [and] sufficiently independent.” Examples from the most recent impeachment trials of President Donald J. Trump reflect the Senate’s loss of dignity and independence, with Senator McConnell pledging to work with the White House throughout the first impeachment process and senators from both parties conceding that they made up their minds …

Optical manipulation of coherent phonon frequency in two-dimensional (2D) materials could advance the development of ultrafast phononics in atomic-thin platforms. However, conventional approaches for such control are limited to doping, strain, structural or thermal engineering. Here, we report the experimental observation of strong laser-polarization control of coherent phonon frequency through time-resolved pump-probe spectroscopic study of van der Waals (vdW) materials Fe₃GeTe₂. When the polarization of the pumping laser with tilted incidence is swept between in-plane and out-of-plane orientations, the frequencies of excited phonons can be monotonically tuned by as large as 3% (~100 GHz). The United States issued a statement on July 13, 2020, outlining the U.S. Position on Maritime Claims in the South China Sea. The statement supplements existing U.S. policy for the South China Sea, making clear that the People’s Republic of China’s claims to offshore resources across most of the South China Sea are unlawful. Still, the revised U.S. policy does not go far enough to contest China's faulty claims in the South China Sea. This article proposes specific issues that the revised U.S. policy should address.

This research explores the perception of disabled working women in small organizations in India's private sector. A meticulous study of past research revealed a paucity of research for working women with disabilities (WWD), especially in small enterprises in the Indian context. There are misconceptions and barriers associated with women with disabilities across the world. Past research demonstrates negative attitudes and related stereotyping notions regarding disabled working women. In sum, they are considered weak, incapable, and dependent on others. In the wake of Russia’s 2014 annexation of Crimea, the conscription law in Lithuania has been reinstated for men, and partnerships with Western security structures reinforced. While young men are otherwise mobilizing to navigate socioeconomic uncertainty to improve their livelihoods under depressed conditions, the revitalization of mandatory military service increasingly polices individual experiences of wellbeing in gendered and nationalistic ways. Drawing from feminist analyses of securitization and from theories of gender performativity, this article examines how the Lithuanian State, together with the Lithuanian Armed Forces (LAF), mobilize masculinity and the construction of militarized identities in order to shape public support …

The current study proposes a taxonomy to organize existing knowledge on cybercrimes against critical infrastructure such as power plants, water treatment facilities, dams, and nuclear facilities. Routine Activity Theory is used to inform a three-dimensional taxonomy with the following dimensions: hacker motivation (likely offender), cyber, physical, and cyber-physical components of any cyber-physical system (suitable target), and security (capable guardian). This article assesses United States President Joe Biden's approach to intelligence. It evaluates his evolving relationship with the Central Intelligence Agency and the rest of the intelligence community from the early 1970s, when he was elected to Congress, to the early 2020s, when he became the forty-sixth president of the United States. "Cyberspace" is often treated as a new domain of State activity in international legal discourse. This has led to the assumption that for international law to apply to cyber operations carried out by States or non-State actors, "cyber-specific" State practice and opinio juris must be demonstrated. This article challenges that assumption on five different bases. First, it argues that rules of general international law are generally applicable to all domains, areas, or types of State activity. This article proposes that the concept of “odious debt” provides an especially fruitful legal framework for the Haitian and Caribbean Community (CARICOM) demands for reparations and debt severance. The concept renders visible different dimensions of the background economic order that have been constitutive of postcolonial sovereignty, and the histories of trade and aid that have engendered debt. The escalation of America’s war in Vietnam coincided with the culmination of the long-fought civil rights movement. Most, if not all, Black leaders voiced opposition to the Vietnam War before the end of the 1960s. However, it was the racially disproportionate statistics in the military in the early years of the conflict to activists fracture within the movement. Regardless of when individual Black leaders spoke out, what they specifically spoke out against, and how radically they voiced opposition, Black leaders put race before nation when voicing an opinion on Vietnam.

This article compares and contrasts the Wehrmacht’s execution of Adolf Hitler’s Final Solution to the Jewish Question between the Eastern and Western fronts of the Second World War. It seeks to answer the broader question of why regular Wehrmacht infantry contributed directly to the atrocities of the Eastern Front in Poland and Soviet Russia while the Western Front--France, Belgium, and the Netherlands--remained comparatively quiet, even under German occupation. at the Battle of Dornach when the Swiss peasants and Swabian

mercenaries or Landsknechte met in a major engagement for the first

time. The Swiss infantry had been dominating battlefields in many

parts of Europe for decades, but the Battle of Dornach was a close

contest demonstrating that Swiss dominance might be over and a new

In this paper, I explore the recursive nature of cultural commentary as it is informed by evolution of the monster. As one culture rises to prominence, so does the monster which comments upon it. I specifically examine the cultural monstrosity of the Machiavellian archetype as it is portrayed across time, first placing Machiavelli's theory in its original context, then branching out to the cultural context surrounding its appearance in both the literature of Renaissance England and the stories of today. This Article addresses the stakes of the ongoing fight over competing versions of U.S. history for our understanding of law, with a special focus on property law. Insofar as legal scholarship has examined U.S. law within the historical context in which it arose, it has largely overlooked the role that laws and legal institutions played in facilitating the production of the two preeminent market commodities in the colonial and early Republic periods: expropriated lands and enslaved people.
