Textualism And The Indian Canons Of Statutory Construction, Alex Tallchief Skibine

When interpreting statutes enacted for the benefit or regulation of Indians or construing treaties signed with Indian nations, courts are supposed to apply any of five specific canons of construction relating to Indian Affairs. Through examining the modern line of Supreme Court cases involving statutory or treaty interpretation relating to Indian nations, this Article demonstrates that the Court has generally been faithful in applying canons relating to treaty interpretation or abrogation. The Court has also respected the canon requiring unequivocal expression of congressional intent before finding an abrogation of tribal sovereign immunity. This article examines the role of dance in Cambodia’s Cold War diplomacy in Asia from 1953 up until the establishment of the Khmer Republic in 1970. It explores how Sihanouk leveraged Cambodian dances to enact Cambodia’s neutral stance during the Cold War and forge cordial relations with other Asian states. Through an examination of the myriad of dance performances of the Royal Ballet and other Khmer dance troupes within the context of Cambodia’s diplomatic relations in Asia, this paper demonstrates how dance afforded a space for Inter-Asia referencing amidst the Cold War tension in the region. Although there are hundreds of resources on traditional and commercial marketing, the materials available specifically for arts marketing are scarce, posing additional challenges for Gillian. Furthermore, while some focus on arts management, few of them address marketing from the perspective of a small-to-medium (often financially struggling) arts organization. The purpose of the current research was to explore how the repeated presentation of process-oriented feedback from multiple task attempts can help develop students’ growth mindset. A standard model of assessment practices often involves a one-time summative assessment at the end of a learning period. An alternative model involves the use of formative assessments as intermittent process-oriented feedback throughout a learning period. The use of formative assessment feedback may demonstrate growth to students, while this opportunity is not offered by the summative assessment model. By the 1990s, Atlanta's historic Fulton Bag & Cotton Mills (The Mill) had fallen into extreme disrepair. After operations ceased, the 19th-century factory suffered from years of neglect, forcing the decision to either demolish or rehabilitate its industrial structures. Fortunately, a choice was made to convert the majority of Fulton Bag & Cotton Mills’ buildings into residential lofts, despite the significant financial risk. The research related to this study aims to address whether the successfully renovated Fulton Bag & Cotton Mills could identify as an open-air museum.

This thesis applies qualitative literary analysis and ethnographic methods to examine the portrayal of Appalachia in the operas Susannah and Cold Mountain. The operas were premiered almost 60 years apart, yet they share many themes that epitomize roles, patterns, and stereotypes within the Appalachian region. One theme observed is the role and expectations of Appalachian women and how they have developed over time, as the plots are placed roughly a century apart. The depictions of Appalachian religious traditions and representations of violence are also explored as these themes play a considerable role in Susannah and Cold Mountain. By analyzing …

Background and Objectives: This study explored age-related differences in the relationship between activity novelty/familiarity and well-being, conceptualized within theories including Selection, Optimization, and Compensation (SOC), Self-Determination Theory (SDT), and Socioemotional Selectivity Theory (SST). For all ages, participation in activities has been shown to enhance well-being. Known mediators of this relationship include psychological, physical, and psychosocial benefits. Dismembering Monstrous Metaphors In Latinx Speculative Fiction, Danielle Garcia-Karr

U.S. public discourse and popular media are rife with monstrous metaphors of Latinxs. This thesis argues that these gothic monstrous metaphors construct an affective economy of fear, which results in material violence and the devastation of Latinx lives. I further argue that to intervene within this affective economy, Latinx authors write speculative fiction, employing critical race methodologies, to negotiate monstrosity in relation to citizenship. In other words, speculative Latinx authors disidentify with monsters and enact epistemic disobedience, problematizing the known and naturalized and delinking Latinx people from monstrous metaphors to interrupt cycles of fear and violence. Background: Germline pathogenic variants mutations) in the BRCA1 and BRCA2 genes cause an increased risk of breast cancer and ovarian cancer. Mainstream cancer genetic testing (MCG) was introduced for breast cancer patients in our unit in 2013. Non-geneticist clinicians have been trained to offer genetic testing during initial treatment planning. We assessed the impact of timely test results on surgical decision-making.

Methods: Women who had undergone mainstream genetic testing for breast cancer between September 2013 and September 2018 were identified from a prospective database. Surgical data were collected retrospectively.

Results: 580 eligible women had mainstream genetic testing. …

This study qualitatively explored the potential of improv for strengthening youth–adult partnerships. Seven members of a youth-adult research collaborative participated in a 2-hour professionally facilitated improv workshop. Participants provided insights about their experiences through a follow-up qualitative interview questionnaire. Participants indicated that improv assisted in dismantling power differentials that often exist in youth–adult partnership contexts, also noting that improv helped them to express their true selves more readily, along with helping them to see new and more “human” sides to their team members. Participants were enthusiastic about accessing further improv opportunities, noting that improv should be embedded into other youth–adult …

Urban form should reflect collective value for place in communities. Urban squares in particular have the potential to serve as the nucleus of communities, urban artefacts that link place to memory and heritage while serving basic needs for everyday life in the city. Civic squares, those linked to governmental institutions, have further potential to facilitate community gatherings for memorialisation, commemoration, celebration and political action. Despite these important functions and potential, the incremental planning of Brooklyn in the early nineteenth century placed little emphasis on squares of any kind, despite the community’s expressed desires.
