Gatekeeping Admissions: Access To Justice And Inclusive Admissions Processes, Sarah Kriekle

Law schools are the gatekeepers to the legal profession, and there are multiple social barriers that impact access to a legal education across a proportionally diverse range of people. This article will first rely on existing literature to demonstrate why diversity in the legal profession is an access to justice issue and to illustrate the current homogeneity that exists within the profession. This article will then argue that two primary factors prevent law schools from attracting a more diverse student body. Living Tree Doctrines Of The Canadian Constitution And Indigenous Law, Emma C. Howes

The living tree doctrine of the Canadian Constitution uses the metaphor of a tree to present the Constitution as a dynamic organism which can evolve over time to accommodate new influences. This essay examines the history of this doctrine along with its possible Indigenous counterparts. In this examination, both the arboreal imagery of such doctrines and their dynamic approach to law are considered. The essay explores the benefits and disadvantages of employing a living tree approach to accommodate Indigenous legal traditions within the Canadian formal legal system.

The foreign body response (FBR) is a clinically relevant issue that can cause malfunction of implanted medical devices by fibrotic encapsulation. Whereas inflammatory aspects of the FBR have been established, underlying fibroblast-dependent mechanisms remain unclear. We here combine multiphoton microscopy with ad hoc reporter mice expressing α-smooth muscle actin (αSMA) protein to determine the locoregional fibroblast dynamics, activation, and fibrotic encapsulation of polymeric materials. Fibroblasts invaded as individual cells and established a multicellular network, which transited to a two-compartment fibrotic response displaying an αSMA cold external capsule and a long-lasting, inner αSMA hot environment. This paper assesses the performance of the Supreme Court as democratic guardrail during five prior periods of democratic crisis in the United States. It finds that most such periods witnessed efforts by the governing regime to entrench themselves in power, and that the Court has rarely provided an effective check on such democratic abuses. Rather than serving as a reliable democratic guardrail, the Court has regularly exercised what Dixon and Landau call “weak-form abusive judicial review”; that is, it has declined to check attacks on democracy emerging from other centers of power. This article explores the context for the accompanying suite of papers on creating and sustaining democratic spaces in education. Prompted by the centenary of Summerhill, the internationally famous democratic school founded in Suffolk, England, in 1921, by A.S. Neill, this collection of papers explores and broadens out the central questions at the heart of experiments in democratic education. We suggest that, at a time of distrust in and questioning of the central institutions of democratic government, and in the wake of challenges to the mainstream system of state schooling, these questions are more relevant than ever. The present disclosure relates to a method and system for providing selection of payment cards for transactions after pre-stipulated time periods. The method includes generating a universal token for a consumer, such that the universal token is mapped to the consumer’s payment cards. Thereafter, the universal token is utilised for a transaction. In order for the transaction to be authorised, the universal token is authorised by issuing agencies. In this paper, I raise a few doubts about the adequacy of Hayek's liberal theory and the rule of law in the twenty-first century. I argue that the theory 1) fails to be morally neutral by not giving proper attention to the harm experienced by the minorities, 2) does not acknowledge a satisfactory account for the exploitation of the working class, and 3) operates with a parochial definition of freedom.

The Supreme Court wrongly decided Employment Division v. Smith. Without briefing or argument over the Free Exercise Clause’s meaning, Smith eliminated the constitutional right to exercise religion and replaced it with an equal protection rule. The decision threatens religious freedom and encourages conflict. The Supreme Court should revisit Smith. This article shows that the majority’s arguments in Smith fail and contradict the Free Exercise Clause’s text, purpose, and original meaning.

In 2017, special formulations of dicamba herbicides known as over-the-top products were marketed for post-emergent use on genetically engineered soybeans and cotton. The use of these products was accompanied by considerable herbicide drift and volatilization that harmed millions of acres of nearby crops. In 2018, the EPA added requirements to the products’ labels to preclude offsite injuries. However, for each growing season during 2018-2021, unacceptable offsite injuries were reported in the major soybean and cotton producing states. Because they received reported injuries, state agencies issuing new registrations for dicamba products in 2018 and 2020 knew offsite spray drift and volatilization …

A major issue to address with health insurance in any context, including the ACA, is that of moral hazard. Moral hazard refers to the tendency of any insured party to exercise less care to avoid an insured loss than would be exercised if the loss were not insured. It can result from the policyholders having better information about their actual care levels after coverage is purchased. Additionally, moral hazard requires that the insurer cannot perfectly monitor the policyholder’s level of care after the purchase of insurance. Although methanediamine (CH2(NH2)2) has historically been the subject of theoretical scrutiny, it has never been isolated to date. Here, we report the preparation of methanediamine (CH2(NH2)2)—the simplest diamine. Low-temperature interstellar analog ices composed of ammonia and methylamine were exposed to energetic electrons which act as proxies for secondary electrons produced in the track of galactic cosmic rays. These experimental conditions, which simulate the conditions within cold molecular clouds, . result in radical formation and initiate aminomethyl (ĊH2NH2) and amino (NH2) radical chemistry. A completed Free Application for Federal Student Aid (FAFSA) serves as an objective and neutral form required for all individuals who plan to attend college. The social barriers that the application produces and reinforces are all but objective. The application collects information and sorts students into groups based on their responses to questions regarding citizenship, race, gender, marital status, the income of parents, and convictions; and distributes or restricts financial resources based on group membership. The aim of this paper is to verify whether the COVID-19 outbreak negatively affected the weak-form informational efficiency of the Warsaw Stock Exchange (WSE). Applying a wild bootstrapped automatic variance ratio test and the rolling window methodology, we verify the martingale hypothesis for daily returns of 437 stocks listed on the Main Market of the WSE i n a research period beginning on January 2nd, 2015 and ending on August 31st, 2020. The Big Clifty 7.5-minute quadrangle is located south of Louisville and west of Elizabethtown along the boundary between Hardin and Grayson Counties. The quadrangle lies within the Mammoth Cave plateau of the Mississippian Plateau physiographic region (McDowell, 1986). Topography is characterized by a low relief plain sitting at elevations between 650 to 850 ft above sea level, which is dissected and incised by Rough River, Meeting Creek, Clifty Creek, and their tributaries to below 500 ft. Swadley (1962) mapped the bedrock geology of the quadrangle, which was later digitized by Conley (2002). Mississippian bedrock is exposed throughout the quadrangle and …

Michelle’s death was imminent because the severely ill man had every right to be on the streets under present law.
