Surface-Enhanced Raman Scattering Technique For Nanoplastics Detection, Boonphop Chaisrikhwun Jan 2022

Surface-Enhanced Raman Scattering Technique For Nanoplastics Detection, Boonphop Chaisrikhwun

Chulalongkorn University Theses and Dissertations (Chula ETD)

The size-dependent effect of nanoplastics (NPLs) restricts the quantification of NPLs by surface-enhanced Raman scattering (SERS) technique. In this study, we successfully established an innovative preparation method to eliminate this effect. This developed SERS method allowed us to quantify 100-, 300-, 600-, and 800-nm polystyrene nanospheres (PSNSs) in diverse aqueous conditions at a low concentration. The SERS substrate was easily fabricated and used as NPLs signal enhancement with sputtering gold particles onto a glass cover slide. By preconcentrating and dissolving PSNSs in toluene, SERS technique can be successfully quantify NPLs at extremely low concentrations with a limit of detection (LOD) …

The Banker Removal Power, Da Lin Jan 2022

The Banker Removal Power, Da Lin

Law Faculty Publications

The Federal Reserve (“the Fed”) can remove bankers from office if they violate the law, engage in unsafe or unsound practices, or breach their fiduciary duties. The Fed, however, has used this power so rarely that few even realize it exists. Although major U.S. banks have admitted to repeated and flagrant lawbreaking in recent years, the Fed has never removed a senior executive from one of these institutions.

This Article offers the first comprehensive account of the banker removal power. It makes four contributions. First, drawing on a range of primary sources, it recovers the power’s statutory foundations, showing that …

The Intergenerational Equity Case For A Wealth Tax, Daniel Schaffa Jan 2022

The Intergenerational Equity Case For A Wealth Tax, Daniel Schaffa

Law Faculty Publications

Intergenerational equity is commonly set aside in favor of other policy objectives, perhaps because of the extreme challenges inherent in adopting and applying an intergenerational equity normative framework. Even when there is a near consensus that the choices of today will have substantial costs in the future, these costs are often downplayed or disregarded. This Article asks whether there are measures that might offer redress to a generation for the costs imposed on it by its predecessors and finds that a one-time wealth tax is a promising option. Although its analysis applies more generally, this Article focuses on the widely …

Renewable Energy Federalism, Danielle Stokes Jan 2022

Renewable Energy Federalism, Danielle Stokes

Law Faculty Publications

No one seriously questions that an improved and decarbonized energy supply system is a key component of climate change mitigation, but the United States’ system of federalism complicates the siting of utility-scale renewable energy facilities. The new Biden Administration presents the United States with an opportunity to reimagine how this country regulates renewable energy siting, allowing for substantial national progress in reducing greenhouse gas emissions. Currently, primary siting authority for renewable energy projects rests with state and local governments, which generally exercise that authority through zoning and land use planning, while the federal government approves most interstate energy delivery systems. …

Reckoning With Structural Racism In Legal Education: Methods Toward A Pedagogy Of Antiracism, Doron Samuel-Siegel Jan 2022

Reckoning With Structural Racism In Legal Education: Methods Toward A Pedagogy Of Antiracism, Doron Samuel-Siegel

Law Faculty Publications

There is an empty quality to much of what passes as “diversity, equity, and inclusion” work in legal education. Despite a robust body of scholarship on teaching law consistent with the goals of antiracism, many legal educators struggle to put theory into practice. This Article responds to that struggle, offering a holistic, methodical approach to a pedagogy of antiracism whose goal is twofold: create conditions in which racially minoritized students learn to their full potential, free from the harms of traditional legal education; and equip all students, regardless of identity, to contribute to the dismantlement of structural racism. Absent such …

Crack Taxes And The Dangers Of Insidious Regulatory Taxes, Hayes R. Holderness Jan 2022

Crack Taxes And The Dangers Of Insidious Regulatory Taxes, Hayes R. Holderness

Law Faculty Publications

An unheralded weapon in the War on Drugs can be found in state tax codes: many states impose targeted taxes on individuals for the possession and sale of controlled substances. These “crack taxes” provide state officials with a powerful means of sanctioning individuals without providing those individuals the protections of the criminal law. Further, these taxes largely escape public scrutiny, which can contribute to overregulation and uneven enforcement.

The controlled substance taxes highlight the allure to lawmakers of using tax law to regulate behavior, but also the potential dangers of doing so. Surprisingly, the judiciary has an underappreciated role in …

A One-Dimensional Field Dislocation Mechanics Model Using Discontinuous Galerkin Method, Ja'nya Breeden, Dow Drake, Jay Gopalakrishnan, Saurabh Puri Jan 2022

A One-Dimensional Field Dislocation Mechanics Model Using Discontinuous Galerkin Method, Ja'nya Breeden, Dow Drake, Jay Gopalakrishnan, Saurabh Puri

Mathematics and Statistics Faculty Publications and Presentations

A numerical solution strategy for a one-dimensional field dislocation mechanics (FDM) model using the Discontinuous Galerkin (DG) method is developed. The FDM model is capable of simulating the dynamics of discrete, nonsingular dislocations using a partial differential equation involving a conservation law for the Burgers vector content with constitutive input for nucleation and velocity. Modeling of individual dislocation lines with an equilibrium compact core structure in the context of this continuum elastoplastic framework requires a non-convex stored energy density. Permanent deformation and stress redistribution caused by the dissipative transport of dislocations is modeled using thermodynamics-based constitutive laws. A DG method …

Transactional Community Lawyering, Alina S. Ball Jan 2022

Transactional Community Lawyering, Alina S. Ball

Faculty Scholarship

The racial reckoning during the summer of 2020 presented a renewed call to action for movement lawyers committed to collaborating with mobilized clients to advance racial equity and economic justice. During the last thirty years, community lawyering scholarship has made significant interventions into poverty lawyering and provides the theoretical framework for contemporary movement lawyers. Conceptually, community lawyering theory can be implemented in any practice area; however, prevailing narratives and models for community lawyering are based on group advocacy campaigns and, to a lesser extent, individual representation in dispute resolution. Transactional lawyers—who use private ordering to represent business entities as they …

The Price Tag Of "Pay-For-Delay", Robin C. Feldman Jan 2022

The Price Tag Of "Pay-For-Delay", Robin C. Feldman

Faculty Scholarship

In a landmark decision nearly a decade ago, the U.S. Supreme Court opened the door for antitrust suits against brand and generic pharmaceutical companies who engage in collusive settlements to delay the time for the generic to come to market. With these “pay-for-delay” agreements, brand-name companies offer prospective generics some form of compensation in exchange for the generic’s promise not to enter the market until an agreed-upon date. Laying the groundwork for the lawsuit that would eventually lead to the Actavis decision, the Federal Trade Commission (“FTC”) published a study estimating that pay-for-delay agreements cost American consumers $3.5 billion annually, …

New Originalism: Arizona's Founding Progressives On Extreme Punishment, John Mills, Aliya Sternstein Jan 2022

New Originalism: Arizona's Founding Progressives On Extreme Punishment, John Mills, Aliya Sternstein

Faculty Scholarship

Originalism, together with textualism, has been of growing interest to legal scholars and jurists alike. Discerning and putting forth the views of “the founders” has become part and parcel of effective advocacy, particularly regarding constitutional questions. Arizona is no exception, with its courts explicitly giving originalism primacy over all other interpretive doctrines for discerning the meaning of an ambiguous provision of its Constitution.

Yet, the Arizona state courts have not engaged with the views of the state’s founders on key issues concerning the purposes of punishment, as demonstrated by the founders’ words and deeds. Arizona was founded in 1912 as …

Understanding A Low Vitamin D State In The Context Of Covid-19, James Bernard Walsh, Daniel Mccartney, Eamon Laird, Kevin Mccarroll, Declan G. Byrne, Martin Healy, Paul O'Shea, Rose Anne Kenny, John L. Faul Jan 2022

Understanding A Low Vitamin D State In The Context Of Covid-19, James Bernard Walsh, Daniel Mccartney, Eamon Laird, Kevin Mccarroll, Declan G. Byrne, Martin Healy, Paul O'Shea, Rose Anne Kenny, John L. Faul

Articles

While a low vitamin D state has been associated with an increased risk of infection by SARS-CoV-2 in addition to an increased severity of COVID-19 disease, a causal role is not yet established. Here, we review the evidence relating to i) vitamin D and its role in SARS-CoV-2 infection and COVID-19 disease ii) the vitamin D status in the Irish adult population iii) the use of supplemental vitamin D to treat a deficient status and iv) the application of the Bradford-Hill causation criteria. We conclude that reverse causality probably makes a minimal contribution to the presence of low vitamin D …

Crisis Pregnancy Centers: An Inherently Unjust Limitation To Reproductive Rights, Rebecca Feinberg, Danielle Pacia Jan 2022

Crisis Pregnancy Centers: An Inherently Unjust Limitation To Reproductive Rights, Rebecca Feinberg, Danielle Pacia

Scholarly Works

This paper’s purpose is two-fold. First, it presents an ethical analysis that details why the current practices of Crisis Pregnancy Centers (CPCs) are unethical and violate women’s reproductive freedom. Second, it proposes policy solutions to mitigate inequities and disinformation caused by the practices of CPCs, in an attempt to protect the women who, fall prey to their services

Solo Auto/Biographical Theatre: Towards A Process Of Self-Transformation, Morris Isaac Cohen Jan 2022

Solo Auto/Biographical Theatre: Towards A Process Of Self-Transformation, Morris Isaac Cohen

School of Law, Humanities and Social Sciences Theses

The concept of performance as a transformational experience is not unfamiliar in academic literature; Heddon (2008), Schechner (2013) and Zarrilli (2020) have all written about different aspects of transformations in theatre and performance, including the personal, the social and the political. The specific focus of this Practice as Research PhD is self-transformation and auto/biographical performance. It asks how making, devising and performing a solo auto/biographical piece of work might be a transformational experience for the performer. By transformation, the research refers to an inner shift in perspective on outer circumstances or events, or a change in meaning-making for and by …

Diagrams Of Disturbance: Conceptual Diagrams And The Production Of A Personal Diagram Poetry., Russell Evans Jan 2022

Diagrams Of Disturbance: Conceptual Diagrams And The Production Of A Personal Diagram Poetry., Russell Evans

School of Law, Humanities and Social Sciences Theses

Russell Evans Title: Diagrams of Disturbance: conceptual diagrams and the production of a personal diagram poetry. This thesis is a pursuit of a personal diagram poetry, with a submission of part creative work, part critical exploration of selected diagram poetry over the past 50 years. I examine my own work and that of pioneering diagram poet Jim Rosenberg as variations of the conceptual diagram, and explore wider examples in the work of contemporary visual poets, arriving at a diagrammatics that creates systems of thought from modalities of materiality, spatiality and iconography. I follow Foucault and Deleuze’s pursuit of the diagram …

‘People Not Profits’: Hawaiian Cultural Nationalism And Protest Against The United States, 1968-1980, Emily May Hough Jan 2022

‘People Not Profits’: Hawaiian Cultural Nationalism And Protest Against The United States, 1968-1980, Emily May Hough

School of Law, Humanities and Social Sciences Theses

Since the early nineteenth century, United States colonialism has transformed the Hawaiian Islands from an independent sovereign nation into an American controlled state. In Hawai’i, colonialism is largely represented through the appropriation of culture, people, and land for the benefit of the tourist industry, in addition to the control of land for military use and urban development. In this study, the ways in which the United States has exploited Hawaiian culture, people, and land and the resulting opposition against it is analysed, to demonstrate the effects of colonialism on Hawai'i and the ways Hawaiian people adapted to resist it. This …

Influence And Innovation: Metapainting Between The Collection And The Workshop In Seventeenth-Century Spain And The Netherlands, Robyn Burley Jan 2022

Influence And Innovation: Metapainting Between The Collection And The Workshop In Seventeenth-Century Spain And The Netherlands, Robyn Burley

School of Law, Humanities and Social Sciences Theses

The phenomenon of repetition in the history of art has been the subject of numerous independent studies. For George Kubler, all artworks could be sorted within a linear chronological sequence of primes, replications, and mutations in order to address a particular visual problem. In contrast, outside the realm of mechanical reproductions, the anachronistic assembly of contemporary and historical quotations from existing visual models was suggested by Alexander Nagel and Christopher Wood as simply being a part of the visual mechanics of an image. Nagel and Wood thereby defined the terms substitution and performance to categorize the shift in the perception …

Robert Rauschenberg And Modernism’S (Other) Masculinity, Harry Trepess Jan 2022

Robert Rauschenberg And Modernism’S (Other) Masculinity, Harry Trepess

School of Law, Humanities and Social Sciences Theses

My project is concerned with understanding and identifying the possibility of self-censorship, within a queer theory framework, in Robert Rauschenberg's series of Combine works. Starting out by understanding ideas and theoretical concepts behind censorship (specifically Self-censorship, whether subliminal or acknowledged), through the work of previous scholars. Helping to differentiate the various forms censorship can take, to better establish a definition of what it means to self-censor. Which is vital for the ability of identifying the possible presence of this within Rauschenberg’s practice during the period he created the Combines. Previous iconographical readings, within a queer theory framework, should form a …

The Last Breakfast With Aunt Jemima And Its Impact On Trademark Theory, Deborah R. Gerhardt Jan 2022

The Last Breakfast With Aunt Jemima And Its Impact On Trademark Theory, Deborah R. Gerhardt

Faculty Publications

The generally-accepted law and economics theory of trademarks fails to explain why a brand owner would ever walk away from a trademark that generates financially lucrative returns. In 2020, that is exactly what happened again and again as brand owners pledged to abandon racially explicit marks in the weeks following George Floyd’s murder. As citizens became more attuned to the experiences of those depicted in racial marks, the owners of Aunt Jemima, Uncle Ben’s, the Cleveland Indians, the Redskins, the Dixie Chicks, Lady Antebellum and others announced these brands’ days were numbered. By evoking racist stereotypes, they became a moral …

Superior Status: Relational Obstacles In Law To Racial Justice And Lgbtq Equality, Osamudia James Jan 2022

Superior Status: Relational Obstacles In Law To Racial Justice And Lgbtq Equality, Osamudia James

Faculty Publications

Animus and discrimination are the two legal lenses through which in-equality is typically assessed and understood. Insufficient attention, however, is paid to the role of status in animating inequality, even in landmark cases thought to be equality-promoting. More than an animating force between intractable po-litical conflicts, status also informs the development of equality law in the United States. When courts, advocates, and policymakers affirm, ignore, miss, or con-cede to status hierarchies instead of dismantling them, those groups that perceive a decrease in their status relative to others will only use “equality-promoting” doctrine to rebalance status hierarchy in their favor. Public …

The Inequity Of Informal Guidance, Joshua D. Blank, Leigh Z. Osofsky Jan 2022

The Inequity Of Informal Guidance, Joshua D. Blank, Leigh Z. Osofsky

Faculty Publications

The coexistence of formal and informal law is a hallmark feature of the U.S. tax system. Congress and the Treasury enact formal law, such as statutes and regulations, while the Internal Revenue Service offers the public informal explanations and summaries, such as taxpayer publications, website frequently asked questions, virtual assistants, and other types of taxpayer guidance. Throughout the COVID-19 pandemic, the IRS increased its use of informal law to help taxpayers understand complex emergency relief rules implemented through the tax system.

In contrast to many other legal scholars who have examined important administrative law issues regarding informal tax guidance, in …
