This Note examines how patent law inhibits accessibility to prosthetics, and how a fair use defense for patent infringement will make them more widely accessible. Part I will explain the basics of patent law, including its history, scope, and process of infringement. Part II will discuss the fair use defense against copyright and trademark infringement and explain why this defense should also be enforceable for patent infringement. Part III will provide an overview of 3D printing. Part IV will focus on 3D prosthetics, specifically on the story of two young prosthetic recipients, Griffin Matuszek and Evie Lambert. Finally, Part V …

Dcn Dissertation Proposal: The Impact Of A Pediatric Interdisciplinary Outpatient Feeding Clinic On Preterm Infant Weight Gain And Caregiver Compliance With Feeding Recommendations, Doretta Leung Jan 2022

Dcn Dissertation Proposal: The Impact Of A Pediatric Interdisciplinary Outpatient Feeding Clinic On Preterm Infant Weight Gain And Caregiver Compliance With Feeding Recommendations, Doretta Leung

Dean's Leadership Council Library Research Prize

Early nutrition intervention along with interdisciplinary care is important for premature infants because malnutrition often leads to poor growth in this population.1,2 Poor growth in preterm infants results in subsequent neurocognitive development as there is an association between deficient postnatal growth and poor neurologic outcome up to age 19.1,2 It is important to focus on an infant’s nutrition, feeding, and any gastroenterology concerns after hospital discharge to prevent poor growth. Most importantly, it is essential to have an interdisciplinary care monitoring infant care and outcomes in an outpatient setting; however, this service is lacking in Northeast Florida. The newly developed …

Spatiotemporal Relationships Of Coyotes And Free-Ranging Domestic Cats As Indicators Of Conflict In Culver City, California, Rebecca N. Davenport, Melinda Weaver, Katherine C. B. Weiss, Eric G. Strauss Jan 2022

Spatiotemporal Relationships Of Coyotes And Free-Ranging Domestic Cats As Indicators Of Conflict In Culver City, California, Rebecca N. Davenport, Melinda Weaver, Katherine C. B. Weiss, Eric G. Strauss

Center for Urban Resilience Scholarship

As habitat generalists, urban coyote (Canis latrans) populations often utilize an abundance of diverse food sources in cities. Within southern California, domestic cats (Felis catus) comprise a higher proportion of coyote diets than in other studied urban areas throughout the United States. However, it is unclear which ecological factors contribute to higher rates of cat depredation by coyotes in this region. While previous research suggests that coyote presence may have a negative effect on free-ranging domestic cat distributions, few studies have determined whether urban green spaces affect coyote or free-ranging domestic cat occurrence and activity within …

How Do Perceptions Of Risk Communicator Attributes Affect Emergency Response? An Examination Of A Water Contamination Emergency In Boston, Usa, Amy Hyman, Sudha Arlikatti, Shih-Kai Huang, Michael K. Lindell, Jeryl Mumpower, Carla S. Prater, Hao-Che Wu Jan 2022

How Do Perceptions Of Risk Communicator Attributes Affect Emergency Response? An Examination Of A Water Contamination Emergency In Boston, Usa, Amy Hyman, Sudha Arlikatti, Shih-Kai Huang, Michael K. Lindell, Jeryl Mumpower, Carla S. Prater, Hao-Che Wu

Research, Publications & Creative Work

A water main break that contaminated the Boston area's water distribution system prompted a four-day “boil water” order. To understand risk communication during this incident, 600 randomly sampled residents were mailed questionnaires, yielding 110 valid responses. This article describes how perceptions of different social stakeholders influenced whether respondents complied with the Protective Action Recommendation—PAR (i.e., drank boiled water), took alternative protective actions (i.e., drank bottled water or/and self-chlorinated water), or ignored the threat (i.e., continued to drink untreated tap water). Respondents perceived technical authorities (i.e., water utility, public health, and emergency management) to be higher on three social influence attributes …

Electrical and Computer Engineering Faculty Research & Creative Works

Modern computing applications increasingly rely on technologies in artificial intelligence, machine learning, and big data analytics. These applications often demand more powerful and energy-efficient hardware. Resistive switching random access memory (ReRAM) has emerged as a promising solution to satisfy both the storage and computing needs. In this paper, a natural organic honey film embedded with carbon nanotube (CNT) was fabricated into a resistive switching device, and the resistive switching behaviors were investigated. Endurance test results show the cycle-to-cycle variation of set and reset voltages. On/Off ratio in retention test was found to be in the order of ~105 which proves …

Marcus Drymon, Amanda E. Jefferson, Matthew B. Jargowsky, Emily A. Seubert, Simon Dedman, John Mareska, Sean P. Powers

University Faculty and Staff Publications

In the Gulf of Mexico, the red drum (Sciaenops ocellatus) is an immensely popular sportfish, yet the Gulf of Mexico stock is currently managed as data-limited in federal waters. The results of the federal stock assessment conducted in 2016 for Gulf of Mexico red drum were not recommended for providing management advice. Consequently, we sought to address data gaps highlighted in the assessment by producing up-to- date overall and sex-specific growth models, standardized indices of relative abundance, and predictions of habitat suitability and by updating estimates of natural mortality. Using a time series for the period of 2006–2018, we assigned …

Joel Fodrie, Rachel K. Gittman, A. Randall Hughes, David L. Kimbro, Juhyung Lee, Hunter S. Lenihan, Sean P. Powers, Kevin Sullivan

University Faculty and Staff Publications

Coastal marine habitats continue to be degraded, thereby compelling largescale restoration in many parts of the world. Whether restored habitats function similarly to natural habitats and fully recover lost ecosystem services is unclear. In estuaries, oyster reefs have been degraded by multiple anthropogenic activities including destructive fishing practices and reduced water quality, motivating restoration to maintain oyster fisheries and other ecosystem services, often at relatively high cost. We compared fish and invertebrate communities on recently restored (0–1 year post-restoration), older restored (3–4 years post-restoration), and natural oyster reefs to determine if and when restored reefs support functionally similar faunal communities. …

Integrated Nonmarital Property Rights, E. Gary Spitko Jan 2022

Integrated Nonmarital Property Rights, E. Gary Spitko

SMU Law Review

Nonmarital cohabitation has become a mainstream family structure in the United States. Yet despite the increasing prevalence of nonmarital cohabitants, American family property law generally fails to support nonmarital couples. This inequality under the law disproportionately disadvantages persons of color, those with relatively less education, and couples with relatively fewer economic resources. This Article considers the post-Obergefell need for law reform to better support nonmarital families, examines the principles that should ground nonmarital property rights reform, and proposes a novel approach to nonmarital property rights that integrates the law of dissolution with the law of succession, unifies the law …

Boss Mom: Why Texas Should Revise Its Legislation To Allow Gestational Surrogacy Contract Enforcement For Social Surrogacies, Krista Thompson Jan 2022

Boss Mom: Why Texas Should Revise Its Legislation To Allow Gestational Surrogacy Contract Enforcement For Social Surrogacies, Krista Thompson

SMU Law Review

Career-driven women have consistently been forced to choose between their careers and creating a family. However, with the use of reproductive technology, this is no longer necessary. In recent years, fertile women have been looking to gestational surrogacy as a pregnancy alternative. These women are opting to use surrogates not be- cause they cannot bear a child but because being pregnant is not feasible for their careers. These surrogacies have been termed “social surrogacies.” However, surrogacy laws throughout the United States are diverse and complicated, and many do not allow for the enforcement of social surrogacy contracts. These states, particularly …

Diligent Zero, Frédéric G. Sourgens Jan 2022

Diligent Zero, Frédéric G. Sourgens

SMU Law Review

Energy transition policies will soon transform the backbone of our globalized economy. Problematically, leading policymakers advocate for a form of energy system shock therapy: they argue we should abandon fossil fuels to achieve net zero greenhouse gas emissions as soon as technically feasible. Because current energy systems have deep structural importance for our daily lives and determine everything from where we live to how we work, such shock therapy has potentially catastrophic economic, social, and cultural consequences around the world. I argue that we can achieve meaningful energy transition success without such catastrophic consequences if we pivot from a net …

Expanding Civil Rights To Combat Digital Discrimination On The Basis Of Poverty, Michele Estrin Gilman Jan 2022

Expanding Civil Rights To Combat Digital Discrimination On The Basis Of Poverty, Michele Estrin Gilman

SMU Law Review

Low-income people suffer from digital discrimination on the basis of their socio-economic status. Automated decision-making systems, often powered by machine learning and artificial intelligence, shape the opportunities of those experiencing poverty because they serve as gatekeepers to the necessities of modern life. Yet in the existing legal regime, it is perfectly legal to discriminate against people because they are poor. Poverty is not a protected characteristic, unlike race, gender, disability, religion or certain other identities. This lack of legal protection has accelerated digital discrimination against the poor, fueled by the scope, speed, and scale of big data networks. This Article …

May I Use The Restroom? The Supreme Court’S Likely Opportunity To Define “Sex” In Title Ix And End The Transgender Bathroom Debate, Kaleb Degler Jan 2022

May I Use The Restroom? The Supreme Court’S Likely Opportunity To Define “Sex” In Title Ix And End The Transgender Bathroom Debate, Kaleb Degler

SMU Law Review

The Supreme Court’s landmark decision in Bostock, which established that “sex” under Title VII includes gender identity and sexual orientation, now protects LGBTQ+ persons from discrimination in the workplace. However, this interpretation of “sex” was not subsequently applied wholesale to “sex” under Title IX, leaving many LGBTQ+ students—particularly transgender students—subject to the fate of where they were born and the shifting tides of the federal executive. Beginning with the Obama Administration, a history of conflicting guidance and opinion letters has dominated the discussion on whether transgender students are allowed to use the restroom that corresponds with their gender identity.

Exploring Intersectional Factors Associated With Mental Health Service Utilization In A Sample Of Lgbt2q+ Canadians, Samson Tse Jan 2022

Exploring Intersectional Factors Associated With Mental Health Service Utilization In A Sample Of Lgbt2q+ Canadians, Samson Tse

Theses and Dissertations (Comprehensive)

The present thesis explores LGBT2Q+ (lesbian, gay, bisexual, transgender (trans), Two-Spirit, queer/questioning, plus) and racialized mental health service utilization within Canada using intersectionality-informed quantitative methodology, separated into additive and multiplicative stages. Data from the 2020 LGBT2Q+ Health Survey (N = 1542) were analyzed using modified Poisson regression. Additive analyses explored mental healthcare utilization as framed by the Andersen Behavioural Model of Healthcare Utilization categories: predisposing, enabling, and need. Results show that predisposing and need factors are more statistically associated with mental healthcare utilization, and that there are distinct intracategorical (within-group) differences in subgroups, particularly between racialized and Indigenous respondents. …

An Exploration On The Barriers To Accessing Mental Health Services Among South Asian Youth, Oeishi Faruquzzaman

Theses and Dissertations (Comprehensive)

Research in Canada and the United States has found that South Asians routinely underutilize mental health services, however research on the barriers experienced by South Asians is limited, especially research regarding the experiences of South Asian youth (Inman et al., 2014; Islam et al., 2017; Karasz et al., 2016). Through a series of semi-structured interviews (N=20) with South Asian youth between the ages 16 to 27 in the Greater Toronto Area, the present study explores South Asian youths’ experiences accessing mental health services and the impact of COVID-19 on mental health and service use. Thematic analysis of interview data reveal …

Marketing Authorization At The Fda: Paradigms And Alternatives, Adam I. Muchmore Jan 2022

Marketing Authorization At The Fda: Paradigms And Alternatives, Adam I. Muchmore

Faculty Scholarship

In many critical industries, the Food and Drug Administration’s (FDA’s) marketing authorization decisions determine the range of products available in the United States. Because of the broad scope of the FDA’s marketing authorization responsibilities, the existing scholarship focuses on individual product categories, or small groups of product categories, regulated by the agency. This Article identifies how the existing literature has overlooked important connections between the FDA’s different marketing authorization programs. These connections suggest both explanations for existing programs and strategies for potential reforms.

The Article sets forth a two-level framework for analyzing the FDA’s marketing authorization role. At the first …

Decitizenizing Asian Pacific American Women, Shoba Sivaprasad Wadhia, Margaret Hu Jan 2022

Decitizenizing Asian Pacific American Women, Shoba Sivaprasad Wadhia, Margaret Hu

Faculty Scholarship

The Page Act of 1875 excluded Asian women immigrants from entering the United States, presuming they were prostitutes. This presumption was tragically replicated in the 2021 Atlanta Massacre of six Asian and Asian American women, reinforcing the same harmful prejudices. This Article seeks to illuminate how the Atlanta Massacre is symbolic of larger forms of discrimination, including the harms of decitizenship. These harms include limited access to full citizenship rights due to legal barriers, restricted cultural and political power, and a lack of belonging. The Article concludes that these harms result from the structure of past and present immigration laws …

Drug Supervision, Jacob Schuman Jan 2022

Drug Supervision, Jacob Schuman

Faculty Scholarship

Critics of harsh drug sentencing laws in the United States typically focus on long prison sentences. But the American criminal justice system also inflicts a significant volume of drug-related punishment through community supervision (probation, parole, and supervised release). Over one million people are under supervision due to a drug conviction, and drug activity is among the most common reasons for violations. In an age of “mass supervision,” community supervision is a major form of drug sentencing and drug policy.

In this Article, I analyze the federal system of supervised release as a form of drug policy. Congress created supervised release …
