Courts Without Court, Andrew Guthrie Ferguson Oct 2022

Courts Without Court, Andrew Guthrie Ferguson

Scholarly Articles in Law Reviews & Journals

What role does the physical courthouse play in the administration of criminal justice? This Article uses recent experiments with virtual courts to reimagine a future without criminal courthouses at the center. The key insight of this Article is to reveal how integral physical courts are to carceral control and how the rise of virtual courts helps to decenter power away from judges. This Article examines the effects of online courts on defendants, lawyers, judges, witnesses, victims, and courthouse officials and offers a framework for a better and less court-centered future. By studying post-COVID-19 disruptions around traditional conceptions of place, time, …

War Crimes: History, Basic Concepts, And Structures, Richard J. Wilson

Scholarly Articles in Law Reviews & Journals

On May 24, 2022, the Washington Post carried front-page news that a court in Ukraine had sentenced a 21-year-old Russian soldier, Vadim Shishimarin, to life imprisonment for the war crime of premeditated murder of a civilian, 62-year-old Oleksandr Shelipov. The session was the first war crimes trial in Ukraine since Russia's invasion three months earlier.

Detailing The Effects Of Cbd On Parp And Survivin Expression In Ewing Sarcoma, Tyler Carter Oct 2022

Detailing The Effects Of Cbd On Parp And Survivin Expression In Ewing Sarcoma, Tyler Carter

Theses

Ewing sarcoma (ES) is an aggressive pediatric bone cancer with low five-year survival rates, particularly with recurrent disease because ES often becomes resistant to chemotherapy in these recurrences. Cannabidiol (CBD) has been identified as a potentially promising therapeutic for patients with ES. In other cancer types, CBD has demonstrated effects on two major proteins that contribute to chemotherapy resistance. The first, Poly (ADP-ribose) Polymerase I (PARP1), is a DNA damage repair enzyme that is overexpressed in recurrent ES. Though chemotherapy induces DNA damage in these cancer cells, the high levels of PARP1 facilitate repair of the DNA, allowing the mutated …

Reducing Prejudice Through Law: Evidence From Experimental Psychology, Sara Emily Burke, Roseanna Sommers Oct 2022

Reducing Prejudice Through Law: Evidence From Experimental Psychology, Sara Emily Burke, Roseanna Sommers

University of Chicago Law Review

Can antidiscrimination law effect changes in public attitudes toward minority groups? Could learning, for instance, that employment discrimination against people with clinical depression is legally prohibited cause members of the public to be more accepting toward people with mental health conditions? In this Article, we report the results of a series of experiments that test the effect of inducing the belief that discrimination against a given group is legal (versus illegal) on interpersonal attitudes toward members of that group. We find that learning that discrimination is unlawful does not simply lead people to believe that an employer is more likely …

The Visibility Trap, Kate Redburn Oct 2022

The Visibility Trap, Kate Redburn

University of Chicago Law Review

In August 2021, the Indiana Court of Appeals prohibited a transgender teenage boy (H.S.) from changing the gender marker on his birth certificate. Because he was fifteen at the time, his parents had filed the petition on his behalf.1 As his parents testified, changing the gender marker on a young trans person’s birth certificate is more than a formality. It makes it possible for them to obtain a passport and driver’s license that match their identity, helping to avoid incongruities in gender regulation that can run the gambit from confusing to dangerous.2

The appellate panel was split. Legally …

A Content Analysis Of Criminal Cases Concerning Unattended Children In Vehicles Between 1990 And 2021:Empirically-Based Suggestions For Reform, Jacob W. Forston, Henry F. Fradella

Chapman Law Review

Leaving children unattended in vehicles is one of the leading causes of vehicle deaths not associated with a crash. Intended deaths that are purposefully caused via this phenomenon are quite rare. Rather, such fatalities are typically a result of a caregiver either forgetting a child in a vehicle or making a conscious decision to leave the child unattended without realizing the dangers attendant to that decision. Either way, the resultant harm sparks moral outrage in the media and the community. This, in turn, can prompt prosecution of caregivers under circumstances in which their actions may not align with the elements …

2022 Quality Of Life Survey - Orleans And Jefferson Parishes, Edward Chervenak, Anthony Licciardi

Survey Research Center Publications

The University of New Orleans Survey Research Center (SRC) conducted a live interviewer telephone survey of registered voters in Orleans Parish and Jefferson Parish. These surveys are designed to provide an ongoing picture of how voters view local government services and the general quality of life. They highlight the problems that are of greatest concern to the voters, as well as areas of satisfaction in their parish. The series can also inform the public and officials about specific areas of perceived deterioration or improvement.

Greening Criminal Legal Deserts In Rural Texas, Pamela R. Metzger, Claire Buetow, Kristin Meeks, Blane Skiles, Jiacheng Yu Oct 2022

Greening Criminal Legal Deserts In Rural Texas, Pamela R. Metzger, Claire Buetow, Kristin Meeks, Blane Skiles, Jiacheng Yu

Deason Center Reports

Texas’ rural communities urgently need more prosecutors and public defense providers. On average, Texas’ most urban areas have 28 lawyers for every 100 criminal cases, but rural areas only have five. Many rural prosecutor’s offices cannot recruit and retain enough staff. The Constitution’s promise of equal justice for all remains unfulfilled. Rural Texans charged with misdemeanors are four times less likely to have a lawyer than urban defendants. In 2021, only 403 rural Texas lawyers accepted an appointment to represent an adult criminal defendant. In 65 rural counties, no lawyer accepted an appointment. And the problem is getting worse. Since …

Atkins V. Virginia At Twenty: Still Adaptive Deficits, Still In The Developmental Period, Sheri Lynn Johnson, John H. Blume, Brendan Van Winkle

Washington and Lee Journal of Civil Rights and Social Justice

Twenty years ago, in Atkins v. Virginia, the Supreme Court of the United States held that the Eighth Amendment prohibited states from executing persons with intellectual disability. While the Court’s decision is laudable and has saved many of the most vulnerable persons from the executioner, its effect has been undermined by recalcitrant states attempting to exploit language in the opinion permitting states to create procedures to implement the (then) new categorical prohibition. In this article, we examine how some states have adopted procedures which are fundamentally inconsistent with the clinical consensus understanding of the disability and how one state, …

Revisiting The Ox-Bow Incident: The Almost Forgotten Western Classic About The Lynching Of Three Innocent Men Is As Relevant As Ever, Marc Bookman Oct 2022

Revisiting The Ox-Bow Incident: The Almost Forgotten Western Classic About The Lynching Of Three Innocent Men Is As Relevant As Ever, Marc Bookman

Washington and Lee Journal of Civil Rights and Social Justice

The concept of lynching, several hundred years old and unclear in its origins, has never really left the lexicon. The word itself, however, has taken on different meanings over the years, from a mob’s taking the law into its own hands, to an organized utilization of racial violence as a means of societal control and intimidation; and finally to the more casual and defensive use of the word (“high tech lynching”) by current Supreme Court justices Thomas and Kavanaugh and others after being questioned about their past behaviors. Many academics have opined that the modern system of capital punishment is …

The Politics Of The Criminal Enforcement Of The U.S. Clean Air Act, Joshua Ozymy, Melissa Jarrell Ozymy Oct 2022

The Politics Of The Criminal Enforcement Of The U.S. Clean Air Act, Joshua Ozymy, Melissa Jarrell Ozymy

William & Mary Environmental Law and Policy Review

Criminal prosecution has always existed in a political context. Democratic and Republican presidents have treated environmental regulation very differently over time and this may have a profound effect on how the criminal enforcement of air pollution laws has proceeded in the United States both historically and in the future. There was enough of a bipartisan consensus to allow the institutionalization of resources for the policing and prosecution of air pollution crimes that began in the 1980s and lasted until the early 1990s, where criminal investigators and specialized prosecutors were hired; institutionalized places for these operations to specialize and collaborate were …

Descriptive Representation In State Legislatures: Exploring The Educational Backgrounds Of State Representatives And Senators, Skylar Dykes Oct 2022

Descriptive Representation In State Legislatures: Exploring The Educational Backgrounds Of State Representatives And Senators, Skylar Dykes

Honors Theses

This project will investigate the influence of descriptive representation as it pertains to efficacy in a democratic system. It is possible that policy outputs are heavily dependent upon motivations of an elected official, even more so than the anticipated or predictable effects of an ideological stance. We expect that, following the juxtaposition of a state legislator’s voting records with his or her biographical data, these claims will be supported by data related to higher education and its funding allocations. We are especially interested in the specific relationship between the educational background of state legislators, and whether or not a correlation …

"A Kind Of Insanity In My Spirits": Frankenstein, Childhood, And Criminal Intent, Melissa J. Ganz Oct 2022

"A Kind Of Insanity In My Spirits": Frankenstein, Childhood, And Criminal Intent, Melissa J. Ganz

English Faculty Research and Publications

Criminal responsibility in England underwent an important shift between the late seventeenth and early nineteenth centuries. Before this period, jurists focused less on whether a person meant to commit an act and more on whether the individual committed it. English law thus made little distinction between children and adults. In the late seventeenth and eighteenth centuries, however, criminal responsibility became linked to new ideas about human understanding. Jurists such as Matthew Hale and William Blackstone maintained that individuals could not be guilty of crimes unless they fully understood and intended the consequences of their actions. In this essay, I argue …
