Process Pluralism In The Post-Covid Dispute Resolution Landscape, Orna Rabinovich-Einy Oct 2022

Process Pluralism In The Post-Covid Dispute Resolution Landscape, Orna Rabinovich-Einy

Texas A&M Law Review

Among her numerous contributions as a founder of the field, Professor Menkel-Meadow coined and developed the term “process pluralism,” one of the most influential concepts in the dispute resolution arena. Process pluralism serves both as a descriptive lens in observing the dispute resolution landscape and as a normative prism through which various procedural schemes can be evaluated and procedural reform can be devised.

In the last few years process pluralism has gained new meaning as diversity in procedural avenues increasingly encompassed a broader range of mediums. Initially, such additional procedural choices existed mainly in written asynchronous form, but with the …

Feminist Legal Theory And #Metoo: Revisiting Tarana Burke’S Vision Of Empowerment Through Empathy, Penelope E. Andrews Oct 2022

Feminist Legal Theory And #Metoo: Revisiting Tarana Burke’S Vision Of Empowerment Through Empathy, Penelope E. Andrews

Texas A&M Law Review

It is my purpose to ground this Article in ubuntu and the politics of radical love as applied to the goals of #MeToo and its pursuit of redress for victims of sexual harms. Part II explores the convergences and divergences of #MeToo with feminist campaigns of an earlier era. Part III questions whether a renewed quest for gender equality, largely spawned by a Twitter/social media campaign, may lead to sustainable change built on notions of empathy and restorative justice, which was the vision espoused by Carrie in her work and which influenced Tarana Burke when she founded #MeToo. Part IV …

Black Market: An Exploration Of Black Mental Health In America, Alexandria D. Burroughs

Psychology from the Margins

The stories and experiences of marginalized groups are rarely heard and given the attention they deserve, so the purpose of this article is to analyze the history of the African American community and the treatment they have received from the mental health profession. The article takes an in depth look into the journey of the Black community beginning with the Trans-Atlantic Slave Trade and ending with the current sociocultural climate of present day society. This journey through the history of the African American community reveals generational scars that are still very prevalent within the community and the obstacles they continue …

Protecting Against Adversity: The Role Of Positive Childhood Experiences In Youth Recidivism, Melissa Kowalski, Zachary Hamilton, Alex Kigerl, Michael T. Baglivio, Kevin T. Wolff Oct 2022

Protecting Against Adversity: The Role Of Positive Childhood Experiences In Youth Recidivism, Melissa Kowalski, Zachary Hamilton, Alex Kigerl, Michael T. Baglivio, Kevin T. Wolff

Criminology and Criminal Justice Faculty Publications

An abundance of research has established Adverse Childhood Experiences’ (ACEs’) contributions to deviant behavior. Recently, studies have demonstrated the importance of Positive Childhood Experiences (PCEs). Yet, the PCE establishment as a predictive scale is needed. In a multistate, robust sample (N = 254,874) of justice-involved youth, we examined PCE scale effects and ACE-PCE combinations on recidivism using mixed effects logistic regression while adjusting for the impact of state. Presence of PCEs was associated with lower reoffending likelihood, and ACEs were related to increased recidivism odds. Further, PCEs demonstrated a protective impact on ACEs. A ceiling effect on the ACE-PCE composite …

Personality And Psychopathology Correlates Of Institutional Misconduct Among Juvenile Offenders, Paula Floyd Oct 2022

Personality And Psychopathology Correlates Of Institutional Misconduct Among Juvenile Offenders, Paula Floyd

Dissertations

Juvenile delinquency is a national concern, as delinquent behavior is associated with a host of poor psychosocial outcomes during later adolescence and adulthood. To address delinquency, it is important to understand psychological adjustment among adolescents who have already made contact with the juvenile justice system. One way to explore adjustment within this population involves examining personality and psychopathology correlates of institutional misconduct (i.e., behavioral infractions while incarcerated). While there is a robust body of literature regarding personality and psychopathology correlates of misconduct in adult inmate samples, there has been far less work devoted to these relationships among justice-involved youth. Furthermore, …

Of Contested Landscapes And Women’S Bodies: Rape As An Invasive Weapon In Malsawmi Jacob’S Zorami, Debajyoti Biswas, Zothanchhingi Khiangte Oct 2022

Of Contested Landscapes And Women’S Bodies: Rape As An Invasive Weapon In Malsawmi Jacob’S Zorami, Debajyoti Biswas, Zothanchhingi Khiangte

Journal of International Women's Studies

The geopolitical history of India’s Northeast replicates the history of the struggle of the ethnic communities living along what is often referred to as a “troubled periphery.” The fictionalised stories produced in this region, therefore, often betray the wounds inflicted on people living in this contested territory. As such, the history of this place and the story of its people lose their distinctions, allowing ethnographic study and the fluidity of personal narrative to converge and inform each other. Malsawmi Jacob’s Zorami (2018) encapsulates this history of strife and contestation through emphasizing a double significance in the eponymous character symbolising both …

The Fourth Amendment And The Problem Of Social Cost, Thomas P. Crocker Oct 2022

The Fourth Amendment And The Problem Of Social Cost, Thomas P. Crocker

Northwestern University Law Review

The Supreme Court has made social cost a core concept relevant to the calculation of Fourth Amendment remedies but has never explained the concept’s meaning. The Court limits the availability of both the exclusionary rule and civil damages because of their “substantial social costs.” According to the Court, these costs primarily consist of letting the lawbreaker go free by excluding evidence or deterring effective police practices that would lead to more criminal apprehension and prosecution. But recent calls for systemic police reform by social movements have a different view of social cost. So too do calls for reforming qualified immunity. …

Mediation: Means Of Achieving Real Justice In Consumer Disputes, A. K. Sikri Justice

International Journal on Consumer Law and Practice

Access to Justice is basic to human rights. The right to justice is fundamental to the rule of law and so ‘we, the people of India’ have made social justice an inalienable claim on the state, entitling the humblest human to legal literacy and fundamental rights and their enforcement a forensic reality, however powerful the hostile forces be…Declarations and proclamations, resolutions and legislations remain a mirage unless there is an infrastructure which can be set in locomotion to prevent or punish a wrong and to make legal right an inexpensively enforceable human right. Injustices are many, deprivation victimizes the weaker …

Role Of Universities In Consumer Online Mediation, Ashok R. Patil Dr., Pratima Narayan Research Scholar Oct 2022

Role Of Universities In Consumer Online Mediation, Ashok R. Patil Dr., Pratima Narayan Research Scholar

International Journal on Consumer Law and Practice

The mediation movement has developed from a mere private business to being an integral part of the judicial structure. While the judiciary has embraced the process of mediation through court-annexed and court-referred mediations, private mediations are largely held by business organisations, consumer associations, nonprofit bodies, governmental agencies and international organisations. Law Schools across the world have also been active participants in supporting and encouraging mediation as an alternate to dispute resolution. Online mediation has emerged as a technology equivalent to the traditional mediation mechanisms. The article brings forth the role played by universities in the development and application of mediation …

Nestlé And The Right To Water, M’Ballou Yacine Sanogho Oct 2022

Nestlé And The Right To Water, M’Ballou Yacine Sanogho

The Journal of International Relations, Peace Studies, and Development

Water scarcity is a significant social and environmental challenge that the world is facing today and which shows no sign of going away anytime soon. According to the Joint Monitoring Program (JMP) of the World Health Organization (WHO) and the United Nations Children’s Fund (UNICEF), “26% of the global population or 2.0 billion people lacked safely managed drinking water.” 2 According to the California’s Bureau of Reclamation, Water covers about 71% of the earth’s surface. 3 97% of the earth’s water is in the oceans. However, this water is too salty for drinking, crops, and most industrial uses, except for …

During the early days of the pandemic, Dr. Gina Rae Foster, Teaching & Learning Center Director at John Jay College of Criminal Justice wrote a series of emails to faculty to support and guide instructors in helping their students and in redesigning their courses in the midst of lockdowns and racial violence. This guide is intended to address multiple interests and needs: as an informal and partial teaching guide, as an edited historical artifact, as a developing set of perspectives on social justice, and as a reminder that our individual and collective wellbeing can be reciprocal and can be amplified.

The Collateral Effects Of Criminal Orders Of Protection On Parent Defendants In Cases Of Intimate Partner Violence, Isabelle Leipziger Oct 2022

The Collateral Effects Of Criminal Orders Of Protection On Parent Defendants In Cases Of Intimate Partner Violence, Isabelle Leipziger

Fordham Law Review

Intimate partner violence is a serious public health problem that affects people from all cultures, ethnicities, and socioeconomic backgrounds. Although courts have historically refused to get involved due to the intimate and private nature of these offenses, widespread reforms have led to some judicial intervention. Through the issuance of criminal orders of protection, courts have alleviated some of the difficulties associated with prosecuting cases of intimate partner violence and have provided immediate protection for victims. However, criminal orders of protection also pose significant challenges for defendants who live and co-parent with their accuser.

In New York, issuance of these orders …
