บทความเรื่องนี้ได้นำเสนอความเข้าใจเกี่ยวกับความคิดทางการเมืองของ John Stuart Mill ว่าด้วยแนวทางการป้องกันทรราชของเสียงข้างมาก โดยใช้วิธีการศึกษาแบบปรัชญาการเมือง ผ่านการวิเคราะห์ตีความตัวบทอย่างละเอียด ผลการศึกษาพบว่าทรราชของเสียงข้างมาก ในทัศนะของ Mill คือ สภาวะที่คนฝ่ายเสียงข้างมากในสังคมกดขี่หรือละเมิดเสรีภาพของคนฝ่ายเสียงข้างน้อยในสังคม ซึ่งมีอยู่ด้วยกัน 2 ประเภท คือ (1) ทรราชของเสียงข้างมากโดยกฎหมาย (2) ทรราชของเสียงข้างมากโดยสังคม หรือทรราชของเสียงข้างมากโดยมติความคิดเห็นและอารมณ์ความรู้สึกที่แพร่หลายของคนส่วนใหญ่ในสังคม Mill หวาดกลัวทรราชของเสียงข้างมาก และถือว่ามันเป็นความชั่วร้ายประการหนึ่งในสังคมประชาธิปไตย ดังนั้นเพื่อป้องกันทรราชของเสียงข้างมาก Mill จึงเสนอว่าปัจเจกบุคคล สังคม และรัฐ ต้องมีหลักการสำคัญอันเป็นแนวคิดและแนวปฏิบัติร่วมกัน ซึ่งได้แก่ (1) หลักแห่งอรรถประโยชน์ (2) หลักแห่งเสรีภาพของปัจเจกบุคคล (3) หลักแห่งขันติธรรม (4) หลักแห่งความเป็นภัยอันตรายแก่ผู้อื่น (5) หลักแห่งการมีส่วนร่วม (6) หลักแห่งการปกครองแบบมีตัวแทน และ (7) หลักแห่งการกระจายอำนาจและการปกครองท้องถิ่น

การวิจัยนี้มีวัตถุประสงค์ เพื่อ 1) สำรวจภาวะห้องแห่งเสียงสะท้อนจากการสื่อสารทางการเมืองในพื้นที่ออนไลน์ของผู้ออกเสียงเลือกตั้งครั้งแรก ในช่วงของการเลือกตั้งทั่วไป พ.ศ.2562 2) ศึกษาความสัมพันธ์ระหว่างภาวะของห้องแห่งเสียงสะท้อนในพื้นที่ออนไลน์กับทัศนคติทางการเมือง 3) ศึกษาปัจจัยที่ส่งผลต่อภาวะห้องแห่งเสียงสะท้อน โดยใช้พหุวิธีวิจัย การศึกษาพบว่าองค์ประกอบหนึ่งของห้องแห่งเสียงสะท้อนในแง่ข้อมูลหรือชุดความคิดหลักหนึ่ง ๆ ได้รับการตอกย้ำและกระจายออกไปผ่านการทำซ้ำและการสนับสนุนในกลุ่มแบ่งขั้ว ส่วนลักษณะการกลั่นกรองและคัดสรรข้อมูลโดยระบบอัลกอริทึมพบในบางวิธีศึกษา ขณะเดียวกัน ภาวะห้องแห่งเสียงสะท้อนมีความสัมพันธ์กับทัศนคติทางการเมืองของบุคคล ซึ่งสร้างภูมิทัศน์ทางความคิดรายรอบแต่ละบุคคลเอาไว้ เมื่อผนวกกับประเด็นเรื่องปัจจัยทางเทคโนโลยีและการรวมกลุ่มสังคมจะทำให้เกิดการสร้าง “พื้นที่ทางความคิด” ขึ้นมา สำหรับปัจจัยที่ส่งผลต่อภาวะห้องแห่งเสียงสะท้อนในการวิจัยนี้ ได้แก่ 1) อัลกอริทึมสร้างภาวะฟองสบู่ตัวกรอง 2) แนวทางในการเปิดรับข้อมูลข่าวสารทางการเมืองของผู้ใช้ออนไลน์ 3) ทัศนคติทางการเมืองและบริบท/สถานการณ์แวดล้อมทางการเมือง และ 4) รูปแบบเครือข่ายทางการสื่อสารที่มีส่วนร่วมในพื้นที่ออนไลน์

การปฏิรูปโครงสร้างการอภิบาลน้ำของไทยเกิดขึ้นหลังจากเหตุการณ์น้ำท่วมใหญ่ พ.ศ. 2554 เพื่อลดความเสี่ยงอุทกภัยและสร้างความมั่นคงในภาคการผลิต มีผลต่อสมดุลอำนาจทั้งในการกำหนดนโยบายและการปฏิบัติตั้งแต่ในระดับชาติจนถึงท้องถิ่น บทความปริทัศน์ชิ้นนี้สะท้อนความก้าวหน้าและความท้าทายในการจัดการน้ำของประเทศไทยภายใต้กรอบแนวคิดการอภิบาลน้ำแบบมีส่วนร่วม ผลการศึกษาพบว่าการจัดการน้ำในปัจจุบันเริ่มให้ความสำคัญต่อวิถีชีวิตผ่านการใช้พื้นที่รับน้ำนองและโครงการจัดการน้ำชุมชนด้วยข้อมูลสารสนเทศ แต่มิได้ทำให้เกิด “จุดเปลี่ยนแห่งความร่วมมือ” อย่างแท้จริง เนื่องจากการเปลี่ยนศูนย์อำนาจการจัดการน้ำไปสู่ระบอบรัฐราชการอย่างเข้มข้น ทำให้ชาวชนบทที่รองรับน้ำท่วมให้ภาครัฐมีวิถีชีวิตอยู่บนความไม่แน่นอน และยังเปิดโอกาสให้ภาคการเมือง ภาคประชาสังคม ชุมชนท้องถิ่น และภาคส่วนอื่น ๆ ในการมีส่วนร่วมกำหนดนโยบายน้อยเกินไป จึงขาดการบูรณาการความรู้ที่หลากหลาย และการกำหนดสิทธิในการจัดการน้ำร่วมกันอย่างเสรี การต่อรองระบอบอภิบาลน้ำควรต้องดำเนินต่อไปให้สอดคล้องกับความต้องการที่แท้จริงของสังคม

การบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) : กรณีศึกษาโรคติดเชื้อไวรัสโคโรนา 2019 (Covid-19) ในเขตอำเภอเมือง จังหวัดนครราชสีมา, วรัชยา เชื้อจันทึก

บทความวิจัยนี้มีวัตถุประสงค์ 1) เพื่อศึกษาระดับการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) และ 2) เพื่อเสนอแนวทางการพัฒนาการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) ใช้การวิจัยเชิงปริมาณ โดยใช้แบบสอบถาม (questionnaire) กับ 1) บุคลากรขององค์กรปกครองส่วนท้องถิ่น ประกอบด้วย นายกองค์กรปกครองส่วนท้องถิ่นหรือตัวแทน ปลัดองค์กรปกครองส่วนท้องถิ่น เจ้าพนักงานป้องกันและบรรเทาสาธารณภัย นักสาธารณสุขและสิ่งแวดล้อม จำนวน 104 คน 2) บุคลากรโรงพยาบาลส่งเสริมสุขภาพตำบล ประกอบด้วยผู้อำนวยการโรงพยาบาลส่งเสริมสุขภาพตำบล พยาบาลวิชาชีพชำนาญการ เจ้าพนักงานสาธารณสุขชำนาญงาน จำนวน 60 คน 3) ตัวแทนชุมชน จำนวน 140 คน รวมทั้งสิ้น 304 คน วิเคราะห์ข้อมูลด้วยสถิติเชิงพรรณนา ผลการวิจัยพบว่าระดับการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) ในภาพรวมอยู่ในระดับมาก (  = 4.06, S.D. = 0.52) เมื่อพิจารณาเป็นรายด้าน พบว่าด้านที่มีค่าเฉลี่ยสูงที่สุด คือ การพัฒนาศักยภาพระบบการเตรียมพร้อม (  = 4.15, S.D. = 0.54) รองลงมาคือ การเสริมสร้างความร่วมมือการเตรียมพร้อมรับมือ ( = 4.06, S.D. = 0.60) การบริหารจัดการแผนแบบบูรณาการ ( = 4.02, S.D. = 0.66) และการเสริมสร้างศักยภาพของทุกภาคส่วน ( = 3.89, S.D. = 0.43) ตามลำดับ 2) แนวทางการพัฒนาการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) ได้แก่ การเสริมสร้างศักยภาพของทุกภาคส่วน ประกอบด้วยการเสริมสร้างศักยภาพขององค์กรปกครองส่วนท้องถิ่น การเสริมสร้างศักยภาพของโรงพยาบาลส่งเสริมสุขภาพตำบล การเสริมสร้างศักยภาพของชุมชน การเสริมสร้างศักยภาพของอาสาสมัครสาธารณสุขประจำหมู่บ้าน (อสม.) และการเสริมสร้างศักยภาพของประชาชน

อินเดียกับการจัดการจลาจลในกรณีแคชเมียร์, สุรัตน์ โหราชัยกุล, สิริกร ธารีรัตนาวิบูลย์

นับตั้งแต่ได้รับเอกราชในปี ค.ศ. 1947 อินเดียก็เผชิญความท้าทายด้านความมั่นคงมาโดยตลอด ในบรรดาความท้าทายเหล่านั้น การก่อจลาจลในรูปแบบต่าง ๆ ที่เกี่ยวกับแคชเมียร์หรือในแคชเมียร์ ปัญจาบ ภูมิภาคตะวันออกเฉียงเหนือ และนักซาไลต์ เป็นภัยคุกคามที่บั่นทอนความมั่นคงแห่งชาติของอินเดียมากที่สุด บทความนี้มีวัตถุประสงค์เพียงข้อเดียวคือ เพื่อตอบคำถามวิจัยว่าอินเดียมีวิธีจัดการกับปัญหาจลาจลในแคชเมียร์อย่างไร ในขณะเดียวกันก็มีข้อโต้แย้งสำคัญสองประการ คือ (1) การก่อจลาจลในแคชเมียร์มีปัจจัยภายนอกมาเกี่ยวข้องอย่างสำคัญยิ่ง ทำให้รัฐบาลอินเดียแก้ปัญหาได้ยากลำบาก และ (2) การแก้ปัญหาแคชเมียร์ของอินเดียมีหลักคิดและวิธีตรงกับกรอบความมั่นคงแบบดั้งเดิมและกรอบความมั่นคงของมนุษย์ผสมผสานกัน ต่างจากโลกวิชาการที่มักจะมองกรอบทั้งสองแยกจากกันสิ้นเชิง บทความแบ่งออกเป็น 3 ส่วน ส่วนแรกบรรยายพัฒนาการประเด็นปัญหาการจลาจลในแคชเมียร์ ส่วนที่สองอธิบายการจัดการจลาจลแคชเมียร์ของอินเดีย และส่วนสุดท้ายสรุปเนื้อหาใจความของบทความพร้อมทิ้งท้ายด้วยข้อคิดบางประการ

เงื่อนไขไตรลักษณ์ของความรุนแรงที่กระทำโดยรัฐต่อมุสลิมชนกลุ่มน้อย : ศึกษาเทียบเคียงกรณีโรฮีนจาในรัฐยะไข่ของเมียนมากับกรณีมลายูมุสลิมในจังหวัดชายแดนใต้ของไทย, อันวาร์ กอมะ, เอกรินทร์ ต่วนศิริ

งานวิจัยชิ้นนี้ศึกษาความแตกต่างของความสัมพันธ์ระหว่างรัฐกับมุสลิมชนกลุ่มน้อยในประเทศเมียนมาและไทย โดยใช้กรณีของโรฮีนจาในรัฐยะไข่เทียบเคียงกับกรณีของมลายูมุสลิมในจังหวัดชายแดนใต้ แม้ว่าเมียนมาและไทยเป็นประเทศที่มีผู้นับถือศาสนาพุทธนิกายเถรวาทเป็นชนส่วนใหญ่ แต่ผลลัพธ์ของความสัมพันธ์ระหว่างรัฐและมุสลิมชนกลุ่มน้อยของทั้งสองประเทศก็มีความแตกต่างกันอย่างชัดเจน กล่าวคือ ในกรณีของโรฮีนจาปรากฏความรุนแรงสุดโต่ง ส่วนในกรณีของมลายูมุสลิมเกิดความรุนแรงต่ำที่กระทำโดยรัฐ นัยยะของการเทียบเคียงของทั้งสองกรณีคือการค้นหาปัจจัยที่ทำให้เกิดและไม่เกิดความรุนแรงที่กระทำโดยรัฐต่อชนกลุ่มน้อยมุสลิม ผลการศึกษาพบว่าปัจจัยสำคัญที่ทำให้ทั้งสองกรณีแตกต่างกันคือ ‘เงื่อนไขไตรลักษณ์’ ซึ่งประกอบด้วยมุมมองของรัฐต่อมุสลิมชนกลุ่มน้อย อิทธิพลของขบวนการพุทธชาตินิยม และความอ่อนแอของมุสลิมชนกลุ่มน้อย ฉะนั้น เมื่อรัฐมีมุมมองที่ปิดกั้นต่อชนกลุ่มน้อยประกอบกับขบวนการพุทธชาตินิยมมีอิทธิพลสูงและสถานะของมุสลิมชนกลุ่มน้อยมีความอ่อนแอแล้ว โอกาสที่จะเกิดการใช้ความรุนแรงสุดโต่งก็มีสูงตามไปด้วย ด้วยเหตุนี้ ผู้วิจัยเสนอว่าการปรากฏหรือไม่ปรากฏของเงื่อนไขไตรลักษณ์สามารถใช้เป็นเครื่องมือในการเฝ้าระวังการใช้ความรุนแรงสุดโต่งที่กระทำโดยรัฐต่อมลายูมุสลิมในประเทศไทย และต่อชนกลุ่มน้อยทางศาสนาและชาติพันธุ์ในเอเชียตะวันออกเฉียงใต้

วัฒนธรรมสร้างสรรค์ขององค์การสมองซีกขวาซึ่งเป็นองค์การที่มีศักยภาพในการทำหน้าที่ของสมองซีกขวาในการผลิตจินตนาการนั้น เป็นหัวใจสำคัญในการสร้างนวัตกรรมองค์การระดับโลก อาทิ มหาวิหาร ซากราดา ฟามิเลีย บทความนี้มีวัตถุประสงค์เพื่อศึกษาลักษณะการบริหารวัฒนธรรมองค์การ ของวัดร่องขุ่น จังหวัดเชียงราย ว่าได้อาศัยวัฒนธรรมสร้างสรรค์ขององค์การสมองซีกขวาหรือไม่ อย่างไร ในการสร้างนวัตกรรมองค์การ และศึกษามาตรการเพื่อส่งเสริมและประยุกต์ใช้กับองค์การภาครัฐ โดยอาศัยการบูรณาการข้ามศาสตร์ ด้วยวิธีวิจัยแบบผสม ทั้งเชิงปริมาณและคุณภาพ เครื่องมือในการวิจัย ได้แก่ แบบสอบถาม แบบสัมภาษณ์กึ่งโครงสร้าง และแบบสัมภาษณ์เชิงลึก กลุ่มตัวอย่าง ได้แก่ กลุ่มผู้ที่ปฎิบัติงานในวัดร่องขุ่น กลุ่มผู้เชี่ยวชาญสาขาต่าง ๆ และกลุ่มสาธารณชน ข้อค้นพบคือ (1) การบริหารวัฒนธรรมองค์การของวัดร่องขุ่น ได้อาศัยวัฒนธรรมสร้างสรรค์ขององค์การสมองซีกขวาทุกมิติ ข้อมูลจากแบบสอบถามแสดงว่ากลุ่มตัวอย่างมีการรับรู้วัฒนธรรมสร้างสรรค์ ลักษณะองค์การสมองซีกขวา และการสร้างนวัตกรรมของวัดร่องขุ่น อยู่ในระดับสูงที่สุด สอดคล้องกับผลการสัมภาษณ์และข้อเสนอทางทฤษฎี (2) มาตรการส่งเสริมและประยุกต์ใช้การบริหารด้วยแนวทางวัฒนธรรมสร้างสรรรค์ขององค์การสมองซีกขวา เพื่อสร้างนวัตกรรมขององค์การภาครัฐ ได้แก่ การส่งเสริมวัฒนธรรมเชิงรุกและวัฒนธรรมมืออาชีพ การขจัดวัฒนธรรมความกลัวและวัฒนธรรมการลอกเลียนแบบ

This autoethnographic qualitative study details the researcher’s interest in the world of Islamic terrorism, which stemmed from the 2007 disappearance of a colleague in Iran, while on a rogue CIA mission. Gun control measures, referred to as “risk protection orders” or “Red Flag” laws, are expanding with widespread public support. Currently, 19 states have similar legislation, varying in procedural approaches and enforcement to reduce firearm-related homicide, emphasizing mass homicide. However, little is known about whether the legislation is effective. High turnover in the role of school superintendent signaled functional disruption, decreased morale and impaired student achievement. The principal researcher sought to explain perceptions among professional Florida K-12 public school educators about key factors related to the role of school superintendent, necessary qualifications, important leadership skills, longevity and its impact on student achievement.

The principal researcher disseminated a 10-question online self-administered survey she developed for the study to a sample of 199 professional Florida K-12 public school educators. The barrage of over sixty failed lawsuits filed by lawyers representing former President Donald Trump and his allies seeking to overturn the 2020 presidential election brought forth numerous calls to sanction these lawyers. So far, Rule 11 and disciplinary sanctions have reached one of the most public of the pro-Trump lawyers, Rudolph Giuliani, as well as some of the lawyers who filed and put their names on the complaints initiating the frivolous cases. For decades, commentators have adopted a story of mass incarceration’s rise as caused by “punitive populism.” Growing prison populations, expanding criminal codes, and raced and classed disparities in enforcement result from “pathological politics”: voters and politicians act in a vicious feedback loop, driving more criminal law and punishment. The criminal system’s problems are political. But how should society solve these political problems? The primary statutory tool for federal regulation of Tribal court criminal procedure is the Indian Civil Rights Act of 1968 (ICRA). ICRA replicated most of the procedural protections in the Bill of Rights applicable to the States, as then interpreted by the Supreme Court. ICRA also sets out procedures Tribes must extend to criminal defendants in their courts, caps their sentencing authority, and defines their criminal jurisdiction.

From “Reefer Madness” to “This Is Your Brain on Drugs,” Americans have lived through decades of anti-cannabis propaganda. Legalization is poised to turn this information environment on its head, unleashing a torrent of corporate-funded, pro-cannabis misinformation that regulators cannot prevent or dispel. This appears to be a problem caused by the Supreme Court’s creation and expansion over the past fifty years of First Amendment protections for corporate and commercial speech. Although these doctrines contribute substantially to the problem, this Article shows how it originates in lax antitrust policy rather than expansive First Amendment jurisprudence.
