Traumatic Justice, Teri Dobbins Baxter Jan 2022

Traumatic Justice, Teri Dobbins Baxter

University of Richmond Law Review

In the recent past, allegations of police misconduct have periodically led to widespread community protests, but usually only when the incident is sufficiently high-profile and the harm is severe, such as when a police officer beats or kills an unarmed Black person. More often the spotlight and outrage have faded quickly, as victims were discredited and no charges were brought, or no convictions obtained. But citizens have increasingly harnessed the power of cell phone videos and social media to bring attention to acts of racial violence and hold accountable those who are responsible, particularly in cases of alleged police misconduct. …

Teaching Constitutional Law, Administrative Law, And Health Law As Presidential Administrations Change, Renée M. Landers Jan 2022

Teaching Constitutional Law, Administrative Law, And Health Law As Presidential Administrations Change, Renée M. Landers

Saint Louis University Law Journal

When elections bring about changes in the political party of the president, the shifts frequently involve a change in the philosophies that inform the approach to governing. In teaching constitutional law, administrative law, and health law, this author cautions students to consider the political content of agency actions underlying the judicial opinions studied. Examining the political and discretionary judgment government officials exercise may provide an explanation for the results or an analysis when the law does not seem to account for the agency action or court decision. This Article examines the opportunities available to an incoming administration to undo the …

Battleground Of The Opioid Crisis: The Eighth Amendment Right To Medication-Assisted Treatment In Prisons And Jails, And Upon Release, Claire E. Scavone Jan 2022

Battleground Of The Opioid Crisis: The Eighth Amendment Right To Medication-Assisted Treatment In Prisons And Jails, And Upon Release, Claire E. Scavone

Emory Law Journal

About eighty percent of all inmates in the United States need but will not receive treatment for their Opioid Use Disorder (OUD). Instead, they will leave prison with a 140 times greater chance of a fatal overdose than before their prison sentence. Although incarceration is conceivably an opportune time for the state to connect individuals with treatment, only about one percent of prisons and jails allow the use of Medication-Assisted Treatment (MAT). This failure has a myriad of causes. Notably, beliefs that OUD is a moral failure and that MAT either does not work or is dangerous are both among …

Law Enforcement Motivations For Establishing Real-Time Crime Centers: A Mixed Model Study, Frank Linton Jan 2022

Law Enforcement Motivations For Establishing Real-Time Crime Centers: A Mixed Model Study, Frank Linton

Electronic Theses and Dissertations, 2020-2023

Law enforcement agencies across the United States are establishing real-time crime centers (RTCCs) at a rapid rate, yet research exploring the decisions to establish them is lacking. This study therefore attempts to fill that void by using a mixed methods approach to examine whether adaptive organizational theories, consisting of contingency theory (Lawrence & Lorsch, 1967; Woodward, 1965), resource dependency theory (Pfeffer & Salancik, 1978), and institutional theory (DiMaggio & Powell 1991; Meyer & Rowan, 1977), can be used to explain a law enforcement agency's decision to set up an RTCC. This cross-sectional mixed methods design comprised two different studies (Study …

Managing The Police Emergency, Adam Davidson Jan 2022

Managing The Police Emergency, Adam Davidson

Public Law and Legal Theory Working Papers

There is a policing emergency in the United States. Police across the country cause massive, widespread, and unpredictable physical harm—killings, beatings; psychological harm—negative stress-related birth and educational outcomes, general worsened mental health; and sociological harm—advancing the racial, gender, and economic hierarchies that undermine our work towards an equal society. Even after the largest protest movement in U.S. history in summer 2020, the traditional political process has failed to make significant inroads against this emergency.

This Article begins to explore in depth the legal ramifications of recognizing the policing emergency. It suggests that among the most important ramifications is unlocking a …

The Mediating Role Of Parental Context And Social Support On The Relationship Between Polyvictimization And Juvenile Delinquency: A Longitudinal Study, Kristen Graham Jan 2022

The Mediating Role Of Parental Context And Social Support On The Relationship Between Polyvictimization And Juvenile Delinquency: A Longitudinal Study, Kristen Graham

Master's Theses and Capstones

Polyvictimization and non-victimization adversity in adolescence is a prevalent and evolving issue that poses many implications for families, teachers, policymakers, and others. This study sought to examine whether polyvictimization and adversity longitudinally predict later delinquency, and the possible mediating role of parental context and social support on this relationship. Data was collected as part of the THV survey and the NatSCEV II and yielded a final sample of 791 youths ages 10-20. Poisson regression analyses and structural equation modeling were conducted. Results demonstrated that over and above the impact of demographics, delinquency at Time 1, and community disorder, experiencing composite …

Institutional Choice For Software Safety Standards, Bryan H. Choi Jan 2022

Institutional Choice For Software Safety Standards, Bryan H. Choi

Publications

The pursuit of software safety standards has stalled. In response, commentators and policymakers have looked increasingly to federal agencies to deliver new hope. Some place their faith in existing agencies while others propose a new super agency to oversee software-specific issues. This turn reflects both optimism in the agency model as well as pessimism in other institutions such as the judiciary or private markets.

This Essay argues that the agency model is not a silver bullet. Applying a comparative institutional choice lens, this Essay explains that the characteristic strengths of the agency model—expertise, uniformity, and efficiency—offer less advantage than one …

Cannibalizing The Constitution: On Terrorism, The Second Amendment, And The Threat To Civil Liberties, Francesca Laguardia

Department of Justice Studies Faculty Scholarship and Creative Works

This article explores the links between internet radicalization, access to weapons, and the current threat from terrorists who have been radicalized online. The prevalence of domestic terrorism, domestic hate groups, and online incitement and radicalization have led to considerable focus on the tension between counterterror efforts and the First Amendment. Many scholars recommend rethinking the extent of First Amendment protection, as well as Fourth, Fifth, and Sixth Amendment protections, and some judges appear to be listening. Yet the Second Amendment has avoided this consideration, despite the fact that easy access to weapons is a necessary ingredient for the level of …
