A Study Of The Punishment Of Crimes By Us Federal Legislators From 1798 To 2016, Kenneth J. Grossberger
A Study Of The Punishment Of Crimes By Us Federal Legislators From 1798 To 2016, Kenneth J. Grossberger
Dissertations, Theses, and Capstone Projects
Public distrust of government has increased because of the criminal behavior of federal legislators over time, due, at least in part, to the political effects on Congress (which causes confrontation and accusation), and therefore it is critical to study how Congress deals with the corruption of its members. This study examines the punishment of U.S. federal legislators for criminal corruption in the context of time. This was accomplished by collecting and analyzing original data by means of the multiple methods of binomial logistic regressions and content analysis. The results showed that several variables were predictive of the criminal justice and …

A History Of The Center For The Study Of Women And Society, 1975–2015, Clarisa Gonzalez
Dissertations, Theses, and Capstone Projects
In the early 1970s, New York City was experiencing an extreme fiscal crisis, with a reported debt of at least $600 million. In CUNY, students were protesting admissions policies that favored the white middle class and hikes in tuition. At the same time, the women’s movement was in the midst of the “second wave,” focusing on women in the workplace and in education. It’s in the midst of these tumultuous times that the first motions to create what was then called the Center for the Study of Women and Sex Roles began in 1975 by Graduate Center faculty Joan Kelly, …
Who Taught You To Hate Yourself: Disentangling My Black Identity From White Christian Doctrine, Patrice Lorna Lebron
Who Taught You To Hate Yourself: Disentangling My Black Identity From White Christian Doctrine, Patrice Lorna Lebron
Dissertations, Theses, and Capstone Projects
How does white Christian doctrine fragment Black existence? When African slaves bound in chains landed on the shores of the Americas, they brought their religious and cultural traditions into that oppressive environment. They were dehumanized and compelled to embrace white Christian doctrine enforced on them by white theologians and white enslavers. Slaves were branded as inhuman and inferior beings. Biblical scriptures became a vessel for their prayers, dreams and sacred ceremonies. They transformed their deities into biblical prophets. Their African identity, religious and cultural beliefs were demolished and shrouded with biblical mis-interpretations to promote white supremacy.

The Impact On Crime Rate During A Period Of Covid-19 Induced Jail Booking Restrictions, Nathan A. Jendrick
The Impact On Crime Rate During A Period Of Covid-19 Induced Jail Booking Restrictions, Nathan A. Jendrick
Doctoral Dissertations and Projects
COVID-19 has become a catalyst for profound changes not just in public health but in criminal justice as well. To reduce the close-quarters populations of correctional facilities in an effort to reduce the spread of the virus, law enforcement administrators in the Pacific Northwest have significantly limited the opportunity to make custodial arrests of criminal suspects. The effect on crime rate by not booking suspected criminals for misdemeanor and felony crimes alike remained largely unstudied. To assess this intervention, a paired samples t-test was used after acquiring call volume data for 13 crime types from the dispatch communications center of …

Our criminal justice system is broken. Problems of mass incarceration, racial disparities, and susceptibility to error are prevalent in all phases of the criminal process. Recently, two dominant trends that aspire to tackle these fundamental problems have emerged in the criminal justice system: progressive prosecution—a model of prosecution adopted by elected reform-minded prosecutors that advance systemic change in criminal justice—and algorithmic decision-making—characterized by the adoption of statistical modeling and computational methodology to predict outcomes in criminal contexts.
Taking Stock: Open Questions And Unfinished Business Under The Vawa Amendments To The Indian Civil Rights Act, Jordan Gross
Taking Stock: Open Questions And Unfinished Business Under The Vawa Amendments To The Indian Civil Rights Act, Jordan Gross
UC Law Journal
The primary statutory tool for federal regulation of Tribal court criminal procedure is the Indian Civil Rights Act of 1968 (ICRA). ICRA replicated most of the procedural protections in the Bill of Rights applicable to the States, as then interpreted by the Supreme Court. ICRA also sets out procedures Tribes must extend to criminal defendants in their courts, caps their sentencing authority, and defines their criminal jurisdiction.
Some parts of Indian country are the most dangerous places in the United States today, particularly for indigenous women and girls. They are exposed to a higher level of personal violence than any …

Interrogating The Nonincorporation Of The Grand Jury Clause, Roger Fairfax
Scholarly Articles in Law Reviews & Journals
With the Supreme Court's recent incorporation-in Ramos v. Louisiana of the Sixth Amendment's jury unanimity requirement to apply to the states, the project of "total incorporation" is all but complete in the criminal procedure context. Virtually every core criminal procedural protection in the Bill of Rights has been incorporated through the Due Process Clause of the Fourteenth Amendment to constrain not only the federal government but also the states with one exception. The Fifth Amendment's grand jury right now stands alone as the only federal criminal procedural right the Supreme Court has permitted states to ignore. In one of the …

Opportunity Zones, 1031 Exchanges, And Universal Housing Vouchers, Brandon Weiss
Scholarly Articles in Law Reviews & Journals
The Tax Cuts and Jobs Act of 2017 contained former President Trump's signature economic development initiative: the Opportunity Zone program. Allowing a deferral of capital gains tax for certain qualifying investments in low-income areas, the Opportunity Zone program aims to spur economic development by steering capital into economically distressed neighborhoods. The program is the latest iteration of an overly simplistic market-based approach to community development an approach that transcends political party-based on a flawed yet enduring notion that mere proximity of capital will solve deeply entrenched issues of poverty and racial inequality. In reality, the legacy of Opportunity Zones is …
Scientific Development Of An Integrated Workflow For Latent Print, Questioned Document, And Dna Processing Of Paper Evidence, Ashley Morgan
Scientific Development Of An Integrated Workflow For Latent Print, Questioned Document, And Dna Processing Of Paper Evidence, Ashley Morgan
Dissertations, Theses, and Capstone Projects
Touch paper evidence could be the source of probative human DNA but recovery is challenging and forensic laboratories instead prioritize processing by the Latent Print and Questioned Document disciplines. Recent advances in DNA collection methods and the increased sensitivity of STR typing kits have improved success rates for DNA testing of paper evidence; but prior to implementing DNA collection, laboratories have to decide in which order to examine paper for the different types of forensic evidence. This thesis developed and tested a multi-discipline workflow for processing paper evidence by DNA, Latent Prints and Questioned Documents experts. Preliminary sampling studies indicated …

Fatal And Non-Fatal Police Shootings In The United States, 2015: An Examination Of Open-Source Data, Yuchen Hou
Dissertations, Theses, and Capstone Projects
Purpose and Significance: Police shootings do not always result in death. This fact raises a question of what distinguishes fatal and non-fatal police shootings (FNFPS). However, no existing database is available to address how often and under what circumstances civilians have died from or survived police shootings in the United States. To fill the gaps, this dissertation research uses open sources to create a crowdsourced national database on FNFPS in the United States in 2015. The creation of this database provides researchers insights into the suitability and sustainability of open-source research applied for studying police shootings and offers practitioners …

IMPORTANCE: Self-injury mortality (SIM) combines suicides and the preponderance of drug misuse-related overdose fatalities. Identifying social and environmental factors associated with SIM and suicide may inform etiologic understanding and intervention design.
OBJECTIVE: To identify factors associated with interstate SIM and suicide rate variation and to assess potential for differential suicide misclassification.
DESIGN, SETTING, AND PARTICIPANTS: This cross-sectional study used a partial panel time series with underlying cause-of-death data from 50 US states and the District of Columbia for 1999-2000, 2007-2008, 2013-2014 and 2018-2019. Applying data from the Centers for Disease Control and Prevention, SIM includes all suicides and the preponderance …

Critical Legal Studies And The Police, Nirej Sekhon
Critical Legal Studies And The Police, Nirej Sekhon
Cardozo Law Review
Constitutional police regulation is a complex tangle of substantive rights, remedies, and procedural rules. Together, they appear to scaffold a cohesive system of police restraint. Legal scholars tend to focus criticism on specific rules, impelled by faith that the system can be made to serve its core purpose: protecting civilians against police overreach and abuse. Drawing on critical legal studies, this Article contends that constitutional police regulation is incapable of realizing its putative purpose. Constitutional police regulation frames policing as a series of isolated, individual police-civilian encounters. This is compounded by the unpredictable interpretive interplay between substantive, remedial, and procedural …

The Peculiar Double-Consciousness Of Twail, Mohsen Al Attar
The Peculiar Double-Consciousness Of Twail, Mohsen Al Attar
Indonesian Journal of International Law
Shunning the Eurocentrism that colours much mainstream scholarship, TWAIL has centred in international legal scholarship the views of peoples historically marginalised in the imperial-colonial process. In a single generation, its interventions have shifted perceptions of international law across the academy, forcing scholars to account for the partialities of our purportedly universal international legal regime. Yet, despite embracing iconoclasm and critique, TWAIL is also denoted by a formalist streak. Many of its scholars are committed to the regime, towing an orthodox line that appears counter-intuitive, even inconsistent. In this article, I use WEB Du Bois’ concept of double-consciousness to explain the …

Much research has found that implicit associations between Black male faces and aggression affect dispositional judgments and decision-making, but there have been few investigations into downstream effects on explicit episodic memory. The current experiment tested whether such implicit associations interact with explicit recognition memory using an associative memory paradigm in younger and older adults. Participants studied image pairs featuring faces (of Black or White males) alongside handheld objects (uncategorized, kitchenware, or weapons) and later were tested on their recognition memory for faces, objects, and face/object pairings. Younger adults were further divided into full and divided attention encoding groups. All participants …

Omar Effendi Vs. Union Fenosa: Corruption As A Transnational Public Policy Consideration, Ahmed Badr Eldin
Theses and Dissertations
At the beginning of 2011, Egypt witnessed radical political developments that led to the emergence of a pressing tendency to adjudicate the collapsed regime’s policies and practices. Shortly thereafter, the Egyptian State Council issued a number of judicial decisions that confirmed that the sale of the privatized governmental enterprises had been tainted by corruption. Crucially, the Court maintained that flagrant breach of law, regulations, and administrative orders that encompassed these transactions created serious suspicions about corruption committed by public officials and investors. It concluded that the existence of corruption, as a transnational public policy consideration, had deprived foreign investors of …

The Judicialization Of Mega-Politics In Egypt’S Administrative Courts: Insight Into The Rulings Of The Egyptian State Council (2000-2020), Ahmed Kamal Bastawisy
Theses and Dissertations
The interrelationship between law, courts and politics has always been complex and multidimensional. The role and political significance of courts are prominent dimensions of this interrelationship. Over the past decades, there has been global expansion of judicial power, in parallel with the proliferation of modern constitutionalism principles. One of the fundamental manifestations of this trend is the judicialization of politics- the reliance on courts for addressing pivotal social, economic, moral and political controversies and public policy questions. This phenomenon manifests profound transfer of power from representative institutions, mainly legislatures and executives, to judiciaries. Political importance of courts expanded, in scope, …

Lifting The Veil Of Mona Lisa: A Multifaceted Investigation Of The "Beyond A Reasonable Doubt" Standard, Zhuhao Wang, Eric Zhi
Georgia Journal of International & Comparative Law
For a long period of time, the golden standard in judicial fact-finding of criminal cases in the United States and many other countries has been the “Beyond a Reasonable Doubt” (BARD) standard – every person accused of a crime is presumed to be innocent unless, and until, his or her guilt is established beyond a reasonable doubt. The BARD standard’s undergirding principle is one of error distribution, where wrongful conviction of the innocent is a much greater wrong than failed conviction of the guilty. This concept was famously expressed by the English jurist William Blackstone in 1760s: “It is better …

A patchwork of policies exists across the United States. While citizens' policy preferences in domains such as the criminal legal system, gun regulations/rights, immigration, and welfare are informed by their political predispositions, they are also shaped by the extent to which policy targets are viewed as deserving. This article centres the idea that collective evaluations matter in policymaking, and it ascertains whether subnational levels of deservingness evaluations of several target groups differ across space to illuminate the link between these judgements and state policy design. We leverage original survey data and multilevel regression and poststratification to create state-level estimates of …

Depression in the United States (US) is increasing across all races and ethnicities and is attributed to multiple social determinants of health (SDOH). For members of historically marginalized races and ethnicities, depression is often underreported and undertreated, and can present as more severe. Limited research explores multiple SDOH and depression among African American adults in the US. Guided by Healthy People (HP) 2030, and using cross-disciplinary mental health terminology, we conducted a comprehensive search to capture studies specific to African American adults in the US published after 2016. We applied known scoping review methodology and followed Preferred Reporting Items for …
