Reintegration Programming, Mattie Windholz Apr 2022

Reintegration Programming, Mattie Windholz

SACAD: Scholarly Activities

Among the goals of the US correctional system, rehabilitation remains important The correctional system strives to successfully reintegrate formerly incarcerated individuals into their communities where they refrain from committing further crime While there was a body of research in prior decades suggesting rehabilitation and reintegration efforts were ineffective (“nothing works”), more recent research has discredited this idea by demonstrating that many programs can be effective in correctional settings (“what works”)

Student Ghettos: Fear Of Crime And Perceptions Of Police Legitimacy Explain Undergraduate Perceptions Of Victimization And Wellness, April Terry Apr 2022

Student Ghettos: Fear Of Crime And Perceptions Of Police Legitimacy Explain Undergraduate Perceptions Of Victimization And Wellness, April Terry

SACAD: Scholarly Activities

Criminological research has examined the role of neighborhood order in explaining perceptions of crime and official crime statistics for decades. When citizens perceive their neighborhood to be socially and/or physically disordered, community and interpersonal relationships diminish, mistrust increases – including perceptions of police legitimacy – and overall individual wellness decreases. While this literature is wellestablished, little is known about these interactions within a college population—these neighborhoods referred to as “studentification” and described as “student ghettos.” Student ghettos are known for visibly delinquent and socially frowned upon behaviors, heightened concern for sexual assaults and rape, and lack of respect and perceived …

Title Ix: Institutional Betrayal And Survivors Of Sexual Assault, Abigail Hayes

SACAD: Scholarly Activities

In 2011, the U.S. Department of Education’s (USDE) Office for Civil Rights “Dear Colleague Letter” specified how schools should respond to reports of sexual assault to be in compliance with Title IX. In 2017, these guidelines were rescinded, leaving some criticizing the new regulations. In 2021, President Biden signed an Executive Order, directing the USDE to review Title IX regulations and to provide new guidance. While national bodies are reviewing the Title IX practices, some survivors and activists have identified Title IX failures. As a result, lawsuits have emerged against colleges and universities. This review outlines university betrayal of sexual …

Adultification: Addressing The Injustice Faced By Young Girl Of Color In The School System, M. Siobhan Drown Apr 2022

Adultification: Addressing The Injustice Faced By Young Girl Of Color In The School System, M. Siobhan Drown

SACAD: Scholarly Activities

Adultification is a form of racial prejudice involving children of a racialized minority being treated as more mature than their biological age and reasonable social standards of development. It “reduces or removes the consideration of childhood as a mediating factor in Black youths’ behavior” (Epstein et al., 2017, p. 2). Adultification leads to a higher prevalence of sexualization, more frequent punishment, and increased alienation of young Black girls within the public school system. This is a systemic issue which requires systematic solutions. The most effective solution would be to diversify the workforce.

Recovering Feminist Lessons From The Past For A Less Carceral Future, Aziza Ahmed Apr 2022

Recovering Feminist Lessons From The Past For A Less Carceral Future, Aziza Ahmed

Faculty Scholarship

In a moment when mass incarceration, police reform, and abolition are dominating national headlines, Aya Gruber’s book, The Feminist War on Crime: The Unexpected Role of Women’s Liberation in Mass Incarceration, takes on one of the most complicated questions of the politics of policing and incarceration: gender violence. Her book provides a history of the uncomfortable relationship between the carceral state and feminist organizing to end violence against women. And, it offers a path forward that begins to address mistakes of the past by reigniting those modes of feminism focused on poverty, welfare, and race that were sidelined with …

America’S Public Defender System: A Day Late And A Dollar Short, Christopher Grondin Apr 2022

America’S Public Defender System: A Day Late And A Dollar Short, Christopher Grondin

MAD-RUSH Undergraduate Research Conference

The right to appointed legal counsel for those accused of felony crimes in America is well known, but the evolution of this right, and contemporary issues in public defense are less well understood. An analysis of case law reveals that the Supreme Court of the United States had certain intentions for an appointed counsel system in the U.S. that have historically not been met. Through analysis of the evolution of case law on this topic, as well as an examination of the systems workings today, informed by multiple public attorneys, specific issues affecting the lives of the accused on a …

Crime And Punishment: Adam Smith's Theory Of Sentimental Law And Economics, Maria Pia Paganelli, F. Simon Apr 2022

Crime And Punishment: Adam Smith's Theory Of Sentimental Law And Economics, Maria Pia Paganelli, F. Simon

Economics Faculty Research

For Adam Smith, a crime is not the result of a rational calculation of loss and gain but the consequence of envy and a vain desire to parade wealth to attract the approbation of others, combined with a natural systematic bias in overestimating the probability of success. Similarly, Smith does not conceive of legal sanctions as a rational deterrent but as deriving from the feeling of resentment. While the prevailing approach of the eighteenth century is a rational explanation of crime and a utilitarian use of punishment, Adam Smith instead builds his theory of criminal behavior and legal prosecution consistently …

Youth Empowerment: Case Study And Learning Strategy, Andrew Blum, Nohelia Ramos

Kroc IPJ Research and Resources

The U.S. Department of Justice’s Project Safe Neighborhoods (PSN) is invested in preventing violence and reducing recidivism. To achieve these objectives, PSN has committed to supporting lived experience mentoring, often called credible messenger mentoring, through grants made to community organizations in San Diego and Imperial Counties.

This document consists of two separate research products that align with these two objectives. The first is a case study of Youth Empowerment. The case study has several goals: first, to document the work of Youth Empowerment and allow others to learn in a detailed way about lived experience programming; second, to place the …

Determinants Of Police Department Change: An Institutional Theory Approach, Colby Dolly Apr 2022

Determinants Of Police Department Change: An Institutional Theory Approach, Colby Dolly

Dissertations

This research examines the change in police practices after the death of Michael Brown in Ferguson, Missouri, in 2014. Immediately after his death and throughout the following years, police departments in St. Louis County faced immense pressure to change. The pressure originated from numerous fronts, including the media, local community groups, and politicians. This research evaluates the change in policing using institutional theory with data from surveys and interviews of police chiefs. The findings indicate changes in policies after 2014. The most significant change occurred in departments strongly influenced by the mimetic dimension of institutional theory. The research adds to …

Measuring Ethnic Diversity, Liza G. Steele, Amie Bostic, Scott M. Lynch, Lamis Abdelaaty Apr 2022

Measuring Ethnic Diversity, Liza G. Steele, Amie Bostic, Scott M. Lynch, Lamis Abdelaaty

Sociology Faculty Publications

Researchers have investigated the effects of ethnic heterogeneity on a range of socioeconomic and political outcomes. However, approaches to measuring ethnic diversity vary not only across fields of study but even within subfields. In this review, we systematically dissect the computational approaches of prominent measures of diversity, including polarization, and discuss where and how differences emerge in their relationships with outcomes of interest to sociologists (social capital and trust, economic growth and redistribution, conflict, and crime). There are substantial similarities across computations, which are often generalizations or specializations of one another. Differences in how racial and ethnic groupings are constructed …

The 1994 Federal Crime Bill: An Evaluation Of The Past, Present, And Future Of Its Impact On The Criminal Justice System, Jade R. Philpot

Honors College Theses

The 1994 Violent Crime Control and Law Enforcement Act was signed into law in response to the crack cocaine and crime epidemic of the 1980s. In this thesis I address the major elements of this bill, the racial, financial, and ethical conflicts that arose thereafter, and the reforms that should be implemented today to correct said conflicts.

An Examination Of The Relationship Between Childhood Punishment And Adult Ipv, Anna G. Griffith Apr 2022

An Examination Of The Relationship Between Childhood Punishment And Adult Ipv, Anna G. Griffith

Honors College Theses

The goal of this project is to examine the relationship between childhood punishment and experiencing intimate partner violence (IPV) as an adult. Using an anonymous, self-report survey, students from Georgia Southern University were asked about their experiences with IPV, as well as their experiences of childhood punishment administered by both mother and father. The results show that children who receive corporal, verbal, and emotional punishment from their mother are more likely to experience all forms of IPV later in life. When analyzing the same relationships with fathers, corporal punishment is not associated with IPV while verbal and emotional punishment is.

Susceptibility To Phishing And Victims’ Views Of Love, Romance And Red Flags: Economic And Psychological Coercion In Virtual Space, Anna Hart Apr 2022

Susceptibility To Phishing And Victims’ Views Of Love, Romance And Red Flags: Economic And Psychological Coercion In Virtual Space, Anna Hart

Undergraduate Research and Engagement Symposium

Romance scams have increased 50% since 2019 and have cost victims about $304 million dollars in the last year (Federal Trade Commission, 2/10/2021). Romance scams also cause emotional distress (Buchanan & Whitty, 2014; Cross, Dragiewicz & Richards, 2018), with distress increasing for lonely victims and those who also were deceived into giving money. There is very little research on how an individual’s definitions of love and knowledge about potential ‘red flags’ in relationships contribute to becoming a victim of romance scams and monetary loss due to these scams. This study addresses this gap.

Content Analysis Of Cook County Correctional System News Coverage By The Chicago Sun-Times, Gwen Madden Apr 2022

Content Analysis Of Cook County Correctional System News Coverage By The Chicago Sun-Times, Gwen Madden

Undergraduate Research and Engagement Symposium

After the globalization of the Black Lives Matter movement in 2020, large-scale discourse on criminal justice system operations and mobilization for criminal justice reform has become increasingly prevalent in online spaces. The average online news consumer is more likely to form an opinion purely based on an article’s headline rather than the article’s content as well. This study’s content analysis aims to document and categorize the headline representation of Cook County Correctional System operations by popular local news source The Chicago Sun-Times. Cook County Corrections hosts one of the world's largest singular jail sites in Cook County Jail, and Chicago …

Parental Incarceration As A Predictor Of Legal Cynicism, Mackenzie Joy Heim Apr 2022

Parental Incarceration As A Predictor Of Legal Cynicism, Mackenzie Joy Heim

Theses and Dissertations

Researchers have established that legal cynicism is linked to violence, deviant behavior, and crime. In response to the potentially dangerous implications of a legally cynical society, research in recent years has attempted to identify experiences and conditions that play a role in the development of legal attitudes. Given that youths' familial and social conditions appear to be influential predictors, this study tests the relationship between parental incarceration and legal cynicism. Data from the Fragile Families and Child Wellbeing Study were used for this analysis. Results from three OLS regression models indicate that parental incarceration is not a significant predictor of …

Reason And Rhetoric In Edwards V. Vannoy, Richard M. Re Apr 2022

Reason And Rhetoric In Edwards V. Vannoy, Richard M. Re

Duke Journal of Constitutional Law & Public Policy

Judicial reasoning and rhetoric should be mutually reinforcing, but often they end up at odds. Edwards v. Vannoy offers an unusually rich opportunity to explore this tension. First, the watershed exception, though declared "moribund," may actually have survived. Second, Justice Gorsuch’s ostensibly strict judgment-based approach arguably called for providing relief in Edwards. Third, majority coalitions have a counterintuitive incentive, rooted in rhetoric, to overrule relatively insignificant precedents. Fourth, Edwards featured charges of personal inconsistency that both reflect and facilitate the erosion of conventional legal argument. Finally, the legal system may benefit from the superficial and even fallacious reasoning often …

Getting It Right: Whether To Overturn Qualified Immunity, David D. Coyle Apr 2022

Getting It Right: Whether To Overturn Qualified Immunity, David D. Coyle

Duke Journal of Constitutional Law & Public Policy

Qualified immunity, the defense available to police officers and other government officials facing civil rights lawsuits, has increasingly come under attack. In recent opinions, Justice Clarence Thomas has noted his growing concern that the Court's current qualified immunity jurisprudence, which deals with whether a right is "clearly established", strays from Congress's intent in enacting the Civil Rights Act of 1871 (the statute giving rise to civil rights claims). Other jurists and legal scholars similarly criticize the doctrine, with many calling for the Court to revisit its qualified immunity jurisprudence and abolish or significantly alter the doctrine.

Given that the Court's …
