The Effect Of The #Freebritney Movement On Bipartisanship Legislation: How A Pop Star’S Battle For Freedom Exposed Corruption In The American Conservatorship System, Deja Kemp-Salliey
Honors College Theses
Pop singer Britney Spears was at the peak of her career when she was forcibly placed under a conservatorship arrangement by her father, Jamie Spears. Conservatorships, also referred to as guardianships in some states, are a legal arrangement in which a judge appoints a person or an organization to care for another adult who is unable to manage themselves or their finances. Conservators are responsible for managing the personal matters and/or estate of a conservatee, and the system is designed to act in the best interest of incapacitated individuals. For decades, conservatorships have been criticized by legal scholars and activists …
Trauma On Top Of Trauma: How Child Welfare Failures Affect Trafficked Children, Christie J.W. Ra
Trauma On Top Of Trauma: How Child Welfare Failures Affect Trafficked Children, Christie J.W. Ra
UNLV Theses, Dissertations, Professional Papers, and Capstones
The commercial sexual exploitation of children is a phenomenon that greatly impacts the victimization of children. The sexual victimization of children is harmful to children and prior research has found various risk factors related to exploitation. The main risk factors observed in the current paper include prior sexual abuse and/or assault, adverse childhood experiences, foster care failures, race/ethnicity, and running away. The current study used secondary data that collected data from non-foster and foster-involved exploited children to observe how foster care involvement and race/ethnicity affect victimization within the juvenile justice system. Findings confirmed that race/ethnicity and foster care involvement greatly …
What Happens In Vegas: The Influence Of Las Vegas On High-Risk Attitudes And Behaviors, Marissa Tiemann
What Happens In Vegas: The Influence Of Las Vegas On High-Risk Attitudes And Behaviors, Marissa Tiemann
UNLV Theses, Dissertations, Professional Papers, and Capstones
The probability of victimization is affected by various factors, such as child abuse, a history of victimization, sexual assault, substance abuse, and risky behaviors. Previous research has attributed differences in victimization risk to differences in lifestyle. Overtly sexual cultures like Las Vegas, Nevada, could impact the adoption of risky behaviors (e.g., binge drinking, casual sex, and substance abuse) that could increase victimization risks. This study seeks to understand the impact of the city of Las Vegas on adopting high risk sexual attitudes and behaviors by examining the length of time an individual has spent in Las Vegas. This study used …

A Correlational Investigation Of Black Females’ Education And Their Reproductive Health, Angela Marie Holliday
Graduate Student Dissertations, Theses, Capstones, and Portfolios
Research supports that people who dropout of high school do substantially worse than those who graduate (Anderson & Pörtner, 2014) based upon research on the consequences of dropping out of high school. High school dropouts “earn less, report lower levels of happiness, commit more crimes, and suffer from poorer health” (Anderson & Pörtner, 2014, p. 113). Dropout rates have a massive impact on employment rates, individual earnings, and crime rates (thinkimpact.com, 2020, para. 7). Students who dropout of high school “face social stigma, fewer job opportunities, lower salaries, and higher probability of involvement with the criminal justice system” (Mass. Dept. …

Gangs No Longer: Reassessing Transnational Armed Groups In The Western Hemisphere, Douglas Farah, Marianne Richardson
INSS Strategic Perspectives
MS-13 (Mara Salvatrucha) in the Northern Triangle of Central America and the Primeiro Comando da Capital (PCC; First Command of the Capital), based in S.o Paulo, Brazil, are both tier-one criminal/political/military threats to the stability of the Western Hemisphere.1 These groups—no longer gangs but community-embedded transnational armed groups (CETAGs) in the pantheon of nonstate armed actors—are becoming more deeply enmeshed in the global drug trade, the body politic, and armed conflicts in the hemisphere. These CETAGs, rooted and enduring in their communities of origin, are likely to expand across the hemisphere and are driving multiple types of corruption that President …
Anger In The Overlooked: A Gendered Analysis Of The January 6, 2021 Capitol Hill Breach, Elizabeth Bender
Anger In The Overlooked: A Gendered Analysis Of The January 6, 2021 Capitol Hill Breach, Elizabeth Bender
Theses/Capstones/Creative Projects
The violence seen at the U.S. Capitol Building on January 6, 2021 has sparked concern at the threat of domestic violent extremism (DVE) within the United States. Over 700 individuals have been federally charged in connection with the events of January 6 including almost 100 women. Women’s involvement in DVE is underestimated and understudied. This project utilized a corpus of over 1,000 court documents to content code variables relating to violence and DVE affiliation for the individuals who have been federally charged in relation to January 6th. The results of the coding process were then used to compare the rates …
Medical Ethics: From The Perspective Of Undergraduate Pre-Health Students, Hannah Im
Medical Ethics: From The Perspective Of Undergraduate Pre-Health Students, Hannah Im
Theses/Capstones/Creative Projects
The burden of ethical decision-making is a significant contributor to compassion fatigue in healthcare professionals. Due to the impact of moral conflicts, it may be beneficial to reassess the effectiveness of current ethics education and training. While previous studies have surveyed a range of medical professionals and students, it remains unclear if exposure to ethics topics during undergraduate education could better prepare future healthcare workers. Thus, there is a need to identify the necessity of introducing ethics courses into the required pre-health curriculum. The following study took the first step to gauge this by surveying undergraduate pre-health students on their …

Eco: A Sustainability Education Chatbot, Joey Gruber
Theses/Capstones/Creative Projects
There is a lack of access to information about sustainability from what the climate crisis is to how to recycle properly. For both sustainability-informed and uninformed individuals, learning new information about sustainability and reducing their waste in a way that compliments their lifestyle is time-consuming, requires strategic skills, and can cost them money. ECO is an audio and text-based chatbot that teaches users to be more environmentally conscious through waste reduction.
Playing Hot Pot-Ato: Does Biden’S Presidency Signal The End Of Federal Marijuana Prohibition?, Sara Snowden
Playing Hot Pot-Ato: Does Biden’S Presidency Signal The End Of Federal Marijuana Prohibition?, Sara Snowden
Mercer Law Review
“Hot Potato is a very different game when the people playing are starving.” In the context of federal marijuana legalization, various branches and agencies within the government have long engaged in a game of political hot potato—tossing responsibility for legalization off into the hands of someone (anyone) else. These evasive maneuvers are not victimless. As an overwhelming majority of states have taken actions to legalize or decriminalize marijuana, unsuspecting citizens have been caught in the crosshairs between conflicting state and federal laws.
Take for example David Doe, a resident of Colorado, who suffered many afflictions. Three years ago, he was …
So Help Me, God, Decide This Case: The Eleventh Circuit’S New Standard For Dismissing Religious Jurors During Deliberations, Amanda Claxton
So Help Me, God, Decide This Case: The Eleventh Circuit’S New Standard For Dismissing Religious Jurors During Deliberations, Amanda Claxton
Mercer Law Review
You are on trial for a crime. Maybe you did precisely what the government claims, though perhaps not. However, a judge will not decide your fate because you exercised your constitutional right to a jury trial. During deliberations, you hear that a juror practices a religion condemning those who commit the crime you are accused of. You feel the juror would unfairly prejudice your chances of walking away freely. To your dismay, the judge refuses to dismiss the juror. You ask whether allowing this prejudicial juror to determine your fate is legal. After United States v. Brown, it is. …

Terrorism: A Case Study Of The Global Security Threat Of Boko Haram And The Isis Alliance In Nigeria, Emmanuel Ben-Edet
Terrorism: A Case Study Of The Global Security Threat Of Boko Haram And The Isis Alliance In Nigeria, Emmanuel Ben-Edet
Dissertations (2016-Present)
The literature on terrorism indicates that religion, cultures of origin, and environmental factors play globally critical roles in the emergence of terrorist groups worldwide. Terrorists use violence and threats to strike fear and intimidate people and governments into pursuing their religious, political, and ideological goals. One of the deadliest jihadist groups, Boko Haram, emerged in the early 2000s with a jihadist agenda mainly focused on Nigeria’s Islamization. In 2009, it launched violent attacks in Nigeria, which is Africa’s largest economy, and currently controls a large swathe of territory in its northeastern part. In its desire to create a caliphate, Boko …

SHAYLIN DALEY (Psychology) Combating Recidivism Sponsor: Lisa Holley (Political Science) Many people believe that criminals cannot be helped. It is evident that at least some of society shuns people who break laws and have negative views about the amount of money spent on detaining inmates. Thousands of individuals are released from United States prisons a day. Many of these individuals have no plan in place for their return home and are sent into the streets with nothing except for a jail ID. Most of these people will end up returning to prison. A good sum of these people face problems …

Performing From Under Penal Gaze: Examining What Incarcerated People Post To Tiktok, Lily B. Truppi
Senior Honors Projects
The prison walls previously keeping the lives of inmates private from the general population had been largely successful. In recent years, the creation of the internet and the accessibility of social media has transformed the way we can view and interact with the incarcerated population. Since the introduction of the social media app known as TikTok, the experience and lives of inmates have been posted and consumed by a larger portion of the population outside of academia. Within these videos inmates can express themselves through performance of culturally popular trends, their lives within prison, and establish identity in a place …
Evaluating The Effectiveness Of Restorative Justice Rehabilitative Services Available In Northeast Tennessee For Mothers Diagnosed With Substance Use Disorder, Claire Roberson
Undergraduate Honors Theses
Substance Use Disorder (SUD) has plagued families of rural Appalachia for many years, perpetuating involvement in the criminal justice system as well as generational trauma for people diagnosed with SUD and their children. This points to the necessity of a trauma-informed, restorative-justice based framework for rehabilitative services to most effectively heal families, address trauma, and re-integrate people diagnosed with SUD into society. A restorative justice-based program would provide health care services for addiction and any comorbid mental health disorders as well as teach parents how to properly provide for themselves and their families, manage finances, obtain employment, and further education. …
The Death Penalty: Recent Trends In Exonerations And Recommendations For Further Improvements, Brittany Wakefield
The Death Penalty: Recent Trends In Exonerations And Recommendations For Further Improvements, Brittany Wakefield
Undergraduate Honors Theses
The death penalty has had many regulations placed since its first use in America to make the process more equitable, but people are still being wrongfully sentenced to die. Using a data set of 139 exonerations over a period from 1980 to 2021, the current study examined some prominent factors in wrongful death penalty convictions and how these factors have changed or endured over time. The major findings revealed that racial disparity still exists in the legal process, but it is declining. Exonerees are more likely to have three or more contributing factors (perjury or false accusation, official misconduct, false …
The Dangers Of The Social Drinker: An Analysis Of Adolescent Drinking Habits At Social Gatherings, Mason Seitz
The Dangers Of The Social Drinker: An Analysis Of Adolescent Drinking Habits At Social Gatherings, Mason Seitz
Undergraduate Honors Theses
Adolescent alcohol consumption is a topic that has been well-researched to date due to the dangers it can pose. A variety of factors may work to contribute to the habits these adolescents develop. One factor that has not been extensively studied is the impact of locations on drinking decisions. Location provides a perspective on how various social factors can intersect to dictate where and when young people will choose to consume alcohol. Most previous literature has focused on the alcohol usage found at parties or bars, but the current research wishes to expand this idea to other locations, such as …
College Students’ Perception Of Law Enforcement, Joseph Lyon
College Students’ Perception Of Law Enforcement, Joseph Lyon
Undergraduate Honors Theses
There are many ways that people can form an opinion about law enforcement even if they have had a personal interaction with someone who works in the field. This idea has always been interesting as there needs to be some type of understanding when it comes to this certain viewpoint. There can be many factors that result in having a certain perspective on law enforcement in general like their background growing up, hearsay from close relatives, friends, and whatever they have seen up close in person. This study is going to aim at a specific area of how people view …

A New Approach To Felony Murder In Illinois, Jason M. Cieslik
A New Approach To Felony Murder In Illinois, Jason M. Cieslik
Northern Illinois University Law Review
In August of 2019, six teenagers drove to a rural area of Lake County, Illinois, in a stolen vehicle with the intention of burglarizing vehicles. Startled, the homeowner retrieved his gun, went out on the porch, and observed one of the teens approaching him, with what the homeowner determined to be a weapon. The homeowner fired his gun and killed one of the teens. The remaining five teens were charged with felony murder. At the time of this incident, Illinois applied the “proximate-cause theory” to felony murder. In response, the General Assembly amended the felony-murder rule with the intent to …
Fundamental First Amendment Principles, David L. Hudson Jr., Jacob David Glenn
Fundamental First Amendment Principles, David L. Hudson Jr., Jacob David Glenn
Northern Illinois University Law Review
First Amendment law is highly complex, even labyrinthine. But, there are fundamental principles in First Amendment law that provide a baseline for a core understanding. These ten fundamental principles are: (1) the First Amendment protects the right to criticize the government; (2) the First Amendment abhors viewpoint discrimination and often content, or subject-matter discrimination; (3) the First Amendment protects a great deal of symbolic speech or expressive conduct; (4) the First Amendment protects a great deal of offensive and even repugnant speech; (5) the First Amendment does not protect all forms of speech; (6) the First Amendment often depends upon …
The Character Of Jury Exclusion, Anna Offit
The Character Of Jury Exclusion, Anna Offit
Minnesota Law Review Vols. 106:2 onward (2021-present)
Encounters with the legal system are unevenly distributed throughout the American population, with Black and poor citizens targeted as disparate subjects of surveillance, arrest, and criminal conviction. At the same time, these encounters, as well as a stated belief in the unfairness of the legal system, are commonly viewed as legitimate grounds for excusal from jury service. This follows from an understanding of juror bias that assumes that people with negative experiences with legal actors—police and prosecutors, for example—will be less likely to trust and more likely to discount the contributions of those actors within the context of the jury …
Public Undersight, Christina Koningisor
Public Undersight, Christina Koningisor
Minnesota Law Review Vols. 106:2 onward (2021-present)
The laws governing transparency and accountability in government are deeply flawed and plagued by steep financial costs, high barriers to access, and widespread corporate capture. While legal scholars have suggested a wide variety of fixes, they have focused almost exclusively on legal solutions. They have largely overlooked a growing set of grassroots efforts that seek to reconstruct government information extralegally, rather than work through existing legal structures or remedy breakdowns in the formal transparency law regime. An array of bottom-up movements to circumvent the formal transparency law and challenge the government’s monopoly on information have sprung up around the country …
A Prisoner’S Dilemma: Why Covid-19 Must Serve As A Catalyst To Address Compassionate Release Limitations In Federal Prison, Mary M. Haasl
A Prisoner’S Dilemma: Why Covid-19 Must Serve As A Catalyst To Address Compassionate Release Limitations In Federal Prison, Mary M. Haasl
Minnesota Law Review Vols. 106:2 onward (2021-present)
COVID-19 significantly impacted the U.S. prison population. Given concerns surrounding its rapid spread through prisons, many federal inmates petitioned for compassionate release during the pandemic’s initial months. This significant increase in compassionate release petitions has yielded an impactful case study regarding the significant limitations posed by the compassionate release statute as written—particularly related to its exhaustion of administrative remedy requirement. Under the First Step Act of 2018, inmates must exhaust their administrative remedies before petitioning the district court for compassionate release. With concerns surrounding COVID-19 spread, some federal district courts allowed the waiver of the exhaustion requirement, while other did …
Challenging Some Baseline Assumptions About The Evolution Of International Commissions Of Inquiry, Michael A. Becker
Challenging Some Baseline Assumptions About The Evolution Of International Commissions Of Inquiry, Michael A. Becker
Vanderbilt Journal of Transnational Law
Conventional accounts of the historical development of international commissions of inquiry reflect a progress narrative consisting of three propositions: (1) that recourse to inquiry bodies has increased dramatically in the post-Cold War era, (2) that inquiry bodies have evolved from mechanisms for "pure" fact- finding into quasi-judicial bodies that engage with international law, and (3) that the function of inquiry bodies has shifted from diplomatic dispute settlement to norm enforcement and accountability. Part I explains how this narrative simplifies and distorts the rich history of inquiry bodies in international affairs. Part II shows how the idea of a post-Cold War …

#Blacklivesmatter: Critical Political Implications Of Twitter Discourse In The Wake Of George Floyd, Jillian C. Waterhouse
Honors Theses
As we move forward into a digitalized age of communication, social media becomes increasingly powerful with each passing day. Digital forms of interaction foster an active political discourse and influence the behavior of both the public and government officials. The freedom to deliver public statements at will has been effectively utilized by individuals, local activists, and representatives of the legislative branch to interact in discourse concerning current events, therefore furthering the mobilization of social media to shape the American public policy stage as a whole. As a result of the accessibility of the internet, social media has become the most …
Art, Race, And The Carceral System: Perceptions Of Criminality In Artful Expression, Abiodun Akinseye
Art, Race, And The Carceral System: Perceptions Of Criminality In Artful Expression, Abiodun Akinseye
Undergraduate Honors Thesis Collection
Prior research suggests that rap music is viewed as more “criminal” than other musical genres. Furthermore, juries are likely to attribute criminal stereotypes to rappers, in part due to assumptions of guilt and innocence based on race (Smiley, 2017; Smiley & Fakunle, 2016). Recently courts have used rap lyrics as a form of confessionary evidence against rappers in the courtroom (e.g., McKinley Phipps v. Tim Wilkinson, 2001), but this practice does not extend to other art forms, such as stand-up comedy. This interdisciplinary paper utilizes a mixed-methods approach to research, using both content analysis and experimental methods to develop an …
The American Prosecutor And The Carceral State: An Analysis To Address Prosecutorial Power And Discretion In An Effort To Reduce Overincarceration In The United States, Olivia Jordan
Honors Theses
There is perhaps no other actor within our legal system that shares more power and control over the carceral state than the American prosecutor. This thesis examines the powers of the prosecutor at every stage of criminal procedure, how these powers contribute to the carceral state, and how prioritizing prosecutorial policy reform can effectively reduce persistent mass incarceration in the United States. This thesis uses three criteria- effectiveness at reducing overincarceration, feasibility of implementation, and ethical impact- to critically evaluate several proposals for addressing prosecutorial power and discretion. Ultimately, the thesis recommends a combination of three proposals for a more …
Amlo And Huachicoleo: The Effects And Implications Of The Fuel Theft Crackdown In Mexico, Samuel Starr
Amlo And Huachicoleo: The Effects And Implications Of The Fuel Theft Crackdown In Mexico, Samuel Starr
Honors Theses
On December 20th, 2018—less than three weeks into new president Andrés Manuel López Obrador’s term—the Mexican federal government initiated a crackdown on fuel theft, or huachicoleo. The crackdown was intensive and nationwide. Its implementation was costly: gas stations throughout the country shut down as fuel pipelines were closed, the newly established National Guard was deployed to protect fuel infrastructure, and cartels threatened acts of terror against the government. The crackdown ended in April of 2019, with the López Obrador administration calling it a success. The overarching goal of this study is to test that assertion empirically by investigating the crackdown’s …
