The Relationship Between Community Policing, Police Profiling And Brutality, And How It Relates To Minority Communities’ Perceptions Of Police, Tamela Ali Sep 2022

The Relationship Between Community Policing, Police Profiling And Brutality, And How It Relates To Minority Communities’ Perceptions Of Police, Tamela Ali

Dissertations

Ethnic communities in the United States are at a greater risk of police-related mortality and experiencing racial profiling by the police and are more likely to report negative perceptions of the police than White Americans. Community policing has been proposed as a viable solution to this problem. Residents’ perceptions of the police seem to be predicted by race, where they live, and other factors. Studies also show that the intensity of racial profiling and brutality by the police differs in urban and suburban areas. Therefore, it is difficult to generalize the perceptions of the police across all communities. This study …

But I Ain’T A Judge: The Therapeutic Jurisprudence Implications Of The Use Of Nonjudicial Officers In Criminal Justice Cases, Michael L. Perlin Sep 2022

But I Ain’T A Judge: The Therapeutic Jurisprudence Implications Of The Use Of Nonjudicial Officers In Criminal Justice Cases, Michael L. Perlin

Articles & Chapters

The role of nonjudicial officers occupies a hidden space in the U.S. judicial system. Statutorily sanctioned in many jurisdictions, such officers have a wide range of duties and responsibilities, including hearing certain pretrial motions in criminal cases and making decisions as to conditions of probation for sex offenders. These latter officers are frequently not lawyers, and there is significant evidence that many of the basic rudiments of the criminal trial process are often not honored. There has been virtually no consideration of this phenomenon in the scholarly literature, and absolutely no consideration from the perspective of therapeutic jurisprudence (TJ). An …

Rise Up Industries And The Challenge Of Reentry For Formerly Incarcerated Individuals, Andrew Blum Sep 2022

Rise Up Industries And The Challenge Of Reentry For Formerly Incarcerated Individuals, Andrew Blum

Kroc IPJ Research and Resources

Rise Up Industries provides reentry services and support to formerly incarcerated individuals who were previously in gangs through an intensive job training program, offered alongside a holistic set of support services. Kroc Institute for Peace and Justice Executive Director, Andrew Blum, provides a deeper understanding of this approach and the results it has produced to date, while situating it in the context of other initiatives focused on reentry and reducing recidivism.

This case study concludes that RUI’s reentry program is a promising approach and likely makes a small-scale contribution to solving a very hard problem – successfully fostering the reentry …

Educating Counselors About Offenders With Mental Illness: An Exploratory Study, Frances I. Ellmo, Leigh F. Holman, Richard James, Lacy Kemker Aug 2022

Educating Counselors About Offenders With Mental Illness: An Exploratory Study, Frances I. Ellmo, Leigh F. Holman, Richard James, Lacy Kemker

Journal of Counselor Preparation and Supervision

Racially and economically disenfranchised offenders with mental illness (OMI) are incarcerated at disproportionately high rates but experience less access to and utilization of mental healthcare. There is a need for trained counselors to work in forensic environments who are competent to provide multiculturally sensitive social justice-oriented interventions. However, there is little research exploring the extent counseling students are offered didactic or experiential training for working with OMI. Utilizing concurrent embedded mixed methods to explore relationships between opportunities and obstacles to counseling programs offering this training, this study finds interest in training exists but potential concerns about bias, safety, and other …

An Evaluation Of Findings From A Sbirt Training Program In Counselor Education, Tiffany Lee, Andrew Clay, Karis Callaway, Stephen E. Craig, Georgiana Fisher

Journal of Counselor Preparation and Supervision

The effective implementation of empirically supported interventions is critical for the mitigation of problematic substance use. Screening, Brief Intervention, and Referral to Treatment (SBIRT) has been identified as an efficacious approach for initial response to individuals who have, or are at risk of developing, a substance use disorder. For SBIRT to be delivered appropriately, helping professionals must be adequately trained in its implementation. As a part of a three-year grant project, counselor educators at a large Midwestern university provided intensive training on SBIRT to students in a counselor education program. The outcomes of this training, specifically related to satisfaction, opinion, …

The Exclusionary Rule And Judicial Integrity: An Empirical Study Of Public Perceptions Of The Exclusionary Rule, Matthew D. Kim Aug 2022

The Exclusionary Rule And Judicial Integrity: An Empirical Study Of Public Perceptions Of The Exclusionary Rule, Matthew D. Kim

Missouri Law Review

Fourth Amendment violations call upon courts to resolve the difficult question of who will benefit from past misconduct—the factually guilty defendant or the overreaching government. Either way, courts are forced to punish the misdeed of one actor and allow the other to profit from its misconduct, potentially undermining the public’s trust in the courts. The Supreme Court opined that suppressing unlawfully obtained evidence through the exclusionary rule deters police misconduct and better preserves judicial integrity. However, with the recent discrediting of the police deterrence rationale and the growing belief that the suppression of probative evidence instead undermines judicial integrity, the …

Case Study: Exploring College Students’ Transformative Learning Experience Through Co-Creation Of A Pilot Compassionate Parenting Module In A Humanities Class, Maria Silvia Casabianca

Theses and Dissertations

A case study was conducted with 14 students who took a 16-week college humanities course at a regional university in the state of Florida. The core subjects of the course were kindness, compassion, and empathy. The instructor’s approach to teaching included methods akin to those of transformational learning. Data were collected from 14 weeks of reflective journals, semi-structured interviews, and compassionate parenting modules written by the participants as final assignments. Findings indicated that transformative learning practices supported participants’ reflection and identification of acquired beliefs and new learning about kindness, empathy, and compassion. Participants also described perceived benefits of kindness for …

The purpose of this study is to follow the role that vendors of academic, instructional, educational, and communications technologies play in exchanges with their purchasing partners to promote the sale of educational technologies for medical academics. This study used a qualitative methodology through an Interpretative phenomenological (IP) approach. An IP approach explores vendor knowledge, background, and experiences related to the commercial exchanges of telehealth and telemedicine technology sellers in the United States. Interviews were conducted with sixteen vendors involved in telemedicine\telehealth sales throughout the United States. Data obtained from interviews provided the findings for this study.

The Paradox Of Salvation: Police-Perpetrated Sexual Violence Against Sex Workers In The United States, Aydan Murphy-Stanley Aug 2022

The Paradox Of Salvation: Police-Perpetrated Sexual Violence Against Sex Workers In The United States, Aydan Murphy-Stanley

Student Theses

This study explores how sex workers in the United States are sexually victimized and potentially traumatized by sexual violence perpetrated by police officers, as well as the paradoxical implications of this violence. A qualitative meta-synthesis was conducted to examine and integrate qualitative literature pertaining to this phenomenon. 10 databases were used to execute the systematic literature search. Only studies that utilized qualitative methodologies, are published in peer-reviewed academic journals, and examined police-sex worker interactions were included. Data from relevant studies was analyzed according to the meta-synthesis method. Police-perpetrated sexual violence against sex workers was identified as a form of sexual …

The Non-Applications Of Good Faith, Trust, And Confidentiality In Arbitration: A Study Of The Annulment Cases In Indonesia, Anangga W. Roosdiono, Muhamad Dzadit Taqwa, Mayta Ciara Salsabila Aug 2022

The Non-Applications Of Good Faith, Trust, And Confidentiality In Arbitration: A Study Of The Annulment Cases In Indonesia, Anangga W. Roosdiono, Muhamad Dzadit Taqwa, Mayta Ciara Salsabila

Indonesia Law Review

Arbitration is a dispute resolution method that is chosen by the parties for, mainly, avoiding weaknesses of resolving disputes through the general court. It has three principles, that strongly connect to one another, to hold: good faith, trust, and confidentiality. These principles determine whether a dispute resolution through arbitration will be successful. However, in many - if not all - cases, many disputing parties still do not maintain these principles. This reality can be observed in annulment cases. Although the annulment mechanism renders a protection to the parties from the errors made by intention, this mechanism opens an opportunity for …

Ai, Can You Hear Me? Promoting Procedural Due Process In Government Use Of Artificial Intelligence Technologies, Chris Chambers Goodman Aug 2022

Ai, Can You Hear Me? Promoting Procedural Due Process In Government Use Of Artificial Intelligence Technologies, Chris Chambers Goodman

Richmond Journal of Law & Technology

This Article explores the constitutional implications of algorithms, machine learning, and Artificial Intelligence (AI) in legal processes and decision-making, particularly under the Due Process Clause. Regarding Judge Henry J. Friendly’s procedural due process principles of the U.S. Constitution, decisions produced using AI appear to violate all but one or two of them. For instance, AI systems may provide the right to present evidence and notice of the proposed action, but do not provide any opportunity for meaningful cross-examination, knowledge of opposing evidence, or the true reasoning behind a decision. Notice can also be inadequate or even incomprehensible. This Article analyzes …

Why Not Both Nature And Nurture: Using Behavioral Genetic Markers As Sentencing Factors, Seely Kaufmann Aug 2022

Why Not Both Nature And Nurture: Using Behavioral Genetic Markers As Sentencing Factors, Seely Kaufmann

Richmond Journal of Law & Technology

On the evening of July 1, 2013, Amos Wells was upset that his pregnant girlfriend, Chanice Reed, would not answer his calls. He then drove to where she, her mother Annette, and ten-year-old brother Eddie, lived. After arguing with Chanice and yelling at the top of his voice in a “bone-chilling scream,” Wells retrieved a handgun from his Chevrolet Tahoe parked in front of the house, and shot Chanice in the front yard as she screamed, “No, no, no.” Her mother then tried to bat the gun away before he shot her too. Further shots were heard before Wells finally …

How Biden Could Keep Filling The Federal Circuit Court Vacancies, Carl Tobias Aug 2022

How Biden Could Keep Filling The Federal Circuit Court Vacancies, Carl Tobias

Washington and Lee Law Review Online

In October 2020, Democratic presidential nominee Joe Biden speculated that the fifty-four talented, extremely conservative, and exceptionally young, appellate court judges whom then-President Donald Trump and two relatively similar Grand Old Party (GOP) Senate majorities appointed had left the federal appeals courts “out of whack.” Problematic were the many deleterious ways in which Trump and both of the upper chamber majorities in the 115th and 116th Senate undermined the courts of appeals, which are the courts of last resort for practically all lawsuits, because the United States Supreme Court hears so few appeals. The nomination and confirmation processes which Trump …

Debt Governance, Wealth Management, And The Uneven Burdens Of Child Support, Allison Tait Aug 2022

Debt Governance, Wealth Management, And The Uneven Burdens Of Child Support, Allison Tait

Northwestern University Law Review

Child support is a ubiquitous kind of debt, common to all income and wealth levels, with data showing that approximately 30% of the U.S. adult population has either been subject to paying child support or has received it. Across this field of child support debt, however, unpaid obligations look different for everyone, and in particular the experiences around child support debt diverge radically for low-income populations and high-wealth ones. On the low-income end of the spectrum, child support debt is a sophisticated and adaptive governance technology that disciplines and penalizes those living in or near poverty. Being in child support …

Communities Moving Past The Daddy Daughter Dance: Adapting Gender-Exclusive Events For The 21st Century, Ezra Temko, Emily Love, Destiny Baxter, Heidi Masching, Adam Loesch Aug 2022

Communities Moving Past The Daddy Daughter Dance: Adapting Gender-Exclusive Events For The 21st Century, Ezra Temko, Emily Love, Destiny Baxter, Heidi Masching, Adam Loesch

SIUE Faculty Research, Scholarship, and Creative Activity

Executive Summary

Parent-child community events like father-daughter dances are a celebrated tradition in many communities. However, when these events specify the gender of who can participate, they exclude many families. They also tend to reinforce gender stereotypes (e.g., a dance for girls and a sports event for boys), and are legally questionable for public school and associated P.T.A./P.T.O. sponsors that may be violating federal Title IX requirements and for local governments that may be violating the 14th Amendment to the U.S. Constitution’s Equal Protection Clause.

Contemporary U.S. society is made up of families that come in diverse forms and …

Implementing The Mindfulness-Based Kindness Curriculum In An Inclusive Setting: Effects On Prosocial Behavior, Emily Cary Aug 2022

Implementing The Mindfulness-Based Kindness Curriculum In An Inclusive Setting: Effects On Prosocial Behavior, Emily Cary

Dissertations - ALL

Low rates of prosocial behavior are associated with poor academic, emotional, and behavioral outcomes, including physical aggression, externalizing problems, criminal justice convictions, lower academic achievement, and more peer rejection. Using a cluster randomized control trial, this study examined the effects of the mindfulness-based Kindness Curriculum (N = 26), compared to a matched control condition consisting of a social and emotional learning (SEL) curriculum, Merrell’s Strong Start (N = 20). Outcome measures included the Strengths and Difficulties Questionnaire and the Head Shoulders Knees and Toes task, which are measures of prosocial behavior including self-regulatory skills. These assessments were administered to 5 …

Biophilic Architecture Used To Improve Patient Outcomes And Recovery In Behavioral Health Centers, Heidy M. Valdez Aug 2022

Biophilic Architecture Used To Improve Patient Outcomes And Recovery In Behavioral Health Centers, Heidy M. Valdez

Theses

Humans naturally seek adventure and the outdoors. Currently, US institutions that care for people with chronic illnesses, severe injuries, and mental health conditions often exist in neutral spaces with little to no natural elements. Because this does not promote patient happiness, patient recovery time tends to be longer. These institutions are usually not pleasant for patients or their relatives and are seen as negative spaces by the public, which should not be the case. Typical design elements include windows with thick daylight-blocking mullions to ensure no patient tries to hurt themselves, small and dark rooms, white walls, and no private …

Exploring The K-12 School Experiences That Contribute To Resilience In Adulthood As Described By Resilient Adults With Adverse Childhood Experiences: A Phenomenology, Susannah Wyndi Bradley Aug 2022

Exploring The K-12 School Experiences That Contribute To Resilience In Adulthood As Described By Resilient Adults With Adverse Childhood Experiences: A Phenomenology, Susannah Wyndi Bradley

Doctoral Dissertations and Projects

The purpose of this transcendental phenomenological study is to describe the K-12 school experiences that contributed to resilience in adulthood for individuals with adverse childhood experiences (ACEs). The theory guiding this study is Abraham Maslow’s hierarchy of needs as it explains how students’ achievement and engagement in learning, as well as their barriers to the same are related to students’ unmet basic needs, the pursuit of safety, and feelings of fear and mistrust. The research questions will explore how resilient adults with ACEs describe the K-12 classroom experiences that contributed to their resilience in adulthood, the classrooms where they were …

Using Direct Pcr For Disaster Victim Identification Reference Samples, Mary Habib Aug 2022

Using Direct Pcr For Disaster Victim Identification Reference Samples, Mary Habib

Student Theses

Forensic genetic testing is an important tool for the identification of victims after a mass fatality event but degradation of remains, presence of PCR inhibitors, and limited amounts of sample can make testing difficult. Standard protocols typically include extraction of genetic material from recovered post-mortem samples, and from ante-mortem reference samples or families of a missing person. This is a time-consuming and laborious process and may result in the loss of trace amounts of DNA available for amplification. Incorporating workflows that bypass the extraction step and directly amplify recovered DNA for short tandem repeat (STR) profile generation has the potential …

The Voices Of The Divorced: Reasons For Early Divorce Among Emiratis In Abu Dhabi, Fakir Al Gharaibeh, Muneera Majed Al Ali

Journal of International Women's Studies

There has been a growing interest, especially among Emirati organizations concerned with family development, in the rising rates of early divorce in the United Arab Emirates (UAE). The purpose of this research is to identify the reasons for early divorce among Emiratis. The authors selected 2,162 Emirati early divorcees who were registered with the Family Development Foundation (FDF) in Abu Dhabi and who received services from the (FDF) between 2012 and 2018. Among those, 200 divorcees agreed to participate in this study. Quantitative data were analyzed using SPSS. Results found that the most common reasons for early divorce were the …
