The purpose of this case study is to determine the effect of diaphragmatic breathing and endurance exercise in hospital-acquired pneumonia (HAP) cases. HAP is a nosocomial pneumonia that occurs 48 hours or more after the patient is admitted to the hospital, without any signs of pulmonary infection at the time of initial treatment. The existence of clinical manifestations that appear, patients with HAP tend to avoid physical activity which can decrease the functional capacity of the respiratory system and have an impact on decreasing endurance. Diaphragmatic breathing exercise is thought to be able to help reduce shortness of breath, reduce …

Don't Tread On My Ip Rights: A Law And Economics Analysis Of "March-In Rights" Under The Bayh-Dole Act, Caitlin Grow
Cleveland State Law Review
The Bayh-Dole Act has been imperative to the development of the United States’ dynamic pharma-biotech sector. However, the use of march-in rights under the Bayh- Dole Act has remained controversial. On the one hand, there is the idea of market equilibrium with a need to secure health care for the public. Many believe march-in rights should be used to create this balance by regulating the pricing of drugs that were developed using federally funded research. On the other hand, some advocates recognize that the current relationship between public-sector institutions and business as the developers of basic research, and private-sector biotechnology …
Defining Genetic Information Under Gina, Shane Padilla
Defining Genetic Information Under Gina, Shane Padilla
Cleveland State Law Review
The Genetic Information Nondiscrimination Act (GINA) was enacted to prevent discrimination based on an employee’s genetic information. Although GINA undoubtedly provides employees protection from unjust genetic discrimination by employers, varying interpretations of what constitutes “genetic information” has raised legal uncertainties in how GINA is applied. Consequently, the genetic information of an employee’s family may be unduly placed at risk as a result of misinterpreting the statutory language and legislative intent of GINA. It is of the utmost importance that the definition of “genetic information” be construed with respect to the Act’s legislative history, which supports a broad interpretation and application …
Increasing Competition In Live Music: The Case For Better Enforcement Of The Live Nation Entertainment Consent Decree, Tj Hunt
Cleveland State Law Review
In 2009, Live Nation and Ticketmaster Entertainment expressed their intent to merge to become Live Nation Entertainment. Before the merger, Ticketmaster Entertainment was the leading live music ticketing and marketing company. Live Nation was the leading producer of live music events. Live Nation also entered the primary ticket sales market and led merchandising at its entertainment venues. Antitrust concerns arose that this newly formed entity would be a near-monopoly in live music. Despite general antitrust concerns and lawsuits from consumers, smaller promoters, seventeen state attorneys general, and the Department of Justice (“DOJ"), Live Nation Entertainment agreed to a consent decree …

With the development of technology which is rapidly making the community easier in communicating and searching for information such as social media. Social media itself has different characteristics and types and has advantages and disadvantages. The use of social media does not look at a person's status such as age, gender, religion, or profession. At this time many judges use social media to communicate and search for information and interact with the community. Judges in carrying out their obligations as bearers of the legal profession are framed by an institutional institution that is formulated into a code of ethics for …

Overdispersion Models For Clustered Toxicological Data In A Bioassay Of Entomopathogenic Fungus, Silvia Maria De Freitas, Lida Fallah, Clarice G.B. Demétrio, John P. Hinde
Research Outputs: 2025-Present
We consider discrete mortality data for groups of individuals observed over time. The fitting of cumulative mortality curves as a function of time involves the longitudinal modelling of the multinomial response. Typically such data exhibit overdispersion, that is greater variation than predicted by the multinomial dis-tribution. To model the extra-multinomial variation (overdispersion) we consider a Dirichlet-multinomial model, a random intercept model and a random intercept and slope model. We construct asymptotic and robust covariance matrix estimators for the regression parameter standard errors. Applying this model to a specific insect bioassay of the fungus Beauveria bassiana, we note some simple relationships …

Injuries And Abnormalities Of The Southwestern Pond Turtle (Actinemys Pallida) In The Mojave River Of California, Kristy L. Cummings, Jeffrey E. Lovich, Shellie R. Puffer, Sarah Greely, Christopher D. Otahal, James Gannon
Western North American Naturalist
The southwestern pond turtle (Actinemys pallida) is a semiaquatic turtle that occasionally spends time on land to bask, oviposit, make intermittent overland movements, and overwinter in terrestrial locations. Use of both aquatic and terrestrial environments exposes semiaquatic turtles to increased risk of injury or mortality from floods, predation attempts, and other environmental hazards (e.g., human activities such as vehicle strikes, etc.). We collected injury and morphological abnormality data from adult turtles at 3 study sites along the length of the Mojave River in San Bernardino County, California: 1 site on the upper half of the Mojave River (hereafter …

Applying Data Science And Machine Learning To Understand Health Care Transition For Adolescents And Emerging Adults With Special Health Care Needs, Lisamarie Turk
Nursing ETDs
A problem of classification places adolescents and emerging adults with special health care needs among the most at risk for poor or life-threatening health outcomes. This preliminary proof-of-concept study was conducted to determine if phenotypes of health care transition (HCT) for this vulnerable population could be established. Such phenotypes could support development of future studies that require data classifications as input. Mining of electronic health record data and cluster analysis were implemented to identify phenotypes. Subsequently, a machine learning concept model was developed for predicting acute care and medical condition severity. Three clusters were identified and described (Cluster 1, n …
Validating Financial Statement Comparability Assessment In Non-Profit Firms, Daniel Friesner, Andrew Brajcich
Validating Financial Statement Comparability Assessment In Non-Profit Firms, Daniel Friesner, Andrew Brajcich
The North American Accounting Studies
In a recent manuscript, Brajcich and Friesner (2022) proposed a new methodology to assess financial comparability in not-for-profit organizations. Their approach utilizes entropy-based information theory, and thus requires few prior assumptions about the formation and implications of financial statement comparability. This manuscript assesses the practical utility of the Brajcich and Friesner (2022) methodology by comparing its results to those generated by nonhierarchical cluster analysis. The analysis was conducted using balance sheets drawn from Washington State critical access hospitals in 2019, using a similar set of hospitals and an identical set of variables outlined in Brajcich and Friesner (2022). We find …
The Global Mindset Of Accounting Educators - A National Study, Jill Christopher, Danielle Foster, Chao Wen, Perry Haan
The Global Mindset Of Accounting Educators - A National Study, Jill Christopher, Danielle Foster, Chao Wen, Perry Haan
The North American Accounting Studies
There is a mandate for business educators to cultivate Global Mindset in their students. In the accounting discipline, employers explicitly state that they seek job candidates who demonstrate a Global Mindset. To many educators in the U.S., developing Global Mindset in their students is a bewildering challenge because their own Global Mindset may be weak in some aspects, and widely used accounting textbooks fall short in presenting ideological, socio-political, and cultural perspectives alternative to that of Anglo-American capitalism. This study surveyed accounting educators from U.S. institutions to evaluate their Global Mindset, identify common weaknesses in their Global Mindset, and provide …

Pelaksanaan Sistem Pengawasan Hakim Konstitusi Di Indonesia, Al Amin Syayidin Ali Mustopa
Jurnal Konstitusi & Demokrasi
The supervision system for constitutional judges in Indonesia based on the 1945 Constitution and Law 24/2003 explicitly involves two forms of supervision, namely internal supervision by the Honorary Council and external supervision by the Judicial Commission. The supervisory system finally changed after the Constitutional Court Decision Number 005 / PUU-IV / 2006. After this decision, the supervision system for constitutional judges in Indonesia underwent a substantial change in the form of supervision that eliminated external supervision. The existing internal supervision system often changes in accordance with the current statutory regime and implementing regulations. Changes related to the existing internal supervision …

Sustainable development is a colossal narrative of state elites to institutionalize the right to development which, instead of being oriented towards harmonization of development efforts with efforts to protect the environment, is actually based on human interests. The inherent causality of this effort has an impact on systemic environmental damage in various countries. When the environment is no longer able to recover itself according to the timeline of meeting the needs of human civilization, an ambitious approach such as ecocentrism needs to be used as a counter-narrative to the anthropocentrism approach which tends to be relative: it looks useful, but …

OBJECTIVES: Cancer patients have worse outcomes from the COVID-19 infection and greater need for ventilator support and elevated mortality rates than the general population. However, previous artificial intelligence (AI) studies focused on patients without cancer to develop diagnosis and severity prediction models. Little is known about how the AI models perform in cancer patients. In this study, we aim to develop a computational framework for COVID-19 diagnosis and severity prediction particularly in a cancer population and further compare it head-to-head to a general population.
METHODS: We have enrolled multi-center international cohorts with 531 CT scans from 502 general patients and …

Student Perception On Acceptability And Usefulness Of Sit-Stand Desks In College Classrooms, Abiola Kuilan
Theses
Sedentariness has been proved to be a major cause of various health concerns. Given that a full-time college student in the US spends more than 15 hours per week sitting in a college classroom, it may be an ideal setting for implementation of Sit-Stand Desk (SSD) to reduce college students’ sedentary time. Graduate and undergraduate students (N = 178) of NJIT were randomly recruited to complete a need based online assessment survey. Participants' mean (SD) age was 22.4(4.7) years old, 63% identified as male, 33% identified as female while 4% were of the other gender class. Among the participants, 44.3% …
A Neural Analysis-Synthesis Approach To Learning Procedural Audio Models, Danzel Serrano
A Neural Analysis-Synthesis Approach To Learning Procedural Audio Models, Danzel Serrano
Theses
The effective sound design of environmental sounds is crucial to demonstrating an immersive experience. Classical Procedural Audio (PA) models have been developed to give the sound designer a fast way to synthesize a specific class of environmental sounds in a physically accurate and computationally efficient manner. These models are controllable due to the choice of parameters from analyzing a class of sound. However, the resulting synthesis lacks the fidelity for the preferred immersive experience; thus, the sound designer would rather search through an extensive database for real recordings of a target sound class. This thesis proposes the Procedural audio Variational …
