Without Accommodation, Jennifer B. Shinall Jul 2022

Without Accommodation, Jennifer B. Shinall

Vanderbilt Law School Faculty Publications

Under the Americans with Disabilities Act (ADA), workers with disabilities have the legal right to reasonable workplace accommodations provided by employers. Because this legal right is unique to disabled workers, these workers could, in theory, enjoy greater access to the types of accommodations that are desirable to all workers including the ability to work from home, to work flexible hours, and to take leave. This Article compares access to these accommodations, which have become increasingly desirable during the COVID-19 pandemic, between disabled workers and nondisabled workers. Using 2017-2018 data from the American Time Use Survey's Leave and Job Flexibilities Module, …

Image-Based Crack Detection By Extracting Depth Of The Crack Using Machine Learning, Nishat Tabassum Jul 2022

Image-Based Crack Detection By Extracting Depth Of The Crack Using Machine Learning, Nishat Tabassum

Theses and Dissertations

Concrete structures have been a major aspect of social infrastructure since the ancient Roman times, so they have been used for many centuries. Concrete is used for the durability and support it provides to buildings and bridges. Assessing the state of these structures is important in preserving the longevity of structures and the safety of the public. Detecting cracks in their early stage allows repairs to be made without the need to replace the whole structure, so it reduces the cost. Traditional methods are slowly falling behind as technology advances and an increase in demand for a practical method of …

Municipal Sign Ordinances In The Post-Reed World: How Can Municipalities Continue To Regulate Signs Without Violating The First Amendment?, James V. Ferolo, J. Allen Wall, Jonathan M. Priest

Southern Illinois University Law Journal

In the aftermath of Reed, municipal officials face the question of how to regulate signs to promote legitimate governmental purposes without violating the First Amendment.

This article first seeks to provide answers to this important question by providing a historical context for the Reed v. Town of Gilbert decision by examining several earlier Supreme Court decisions that considered the constitutionality of sign regulations and the principles it used to determine when these laws violated the Free Speech Clause.

Secondly, the article examines several Federal Circuit Court of Appeals and Federal District Court, post-Reed, decisions that have interpreted and applied the …

Dismantling New Democracies: The Case Of Tunisia, Hannah M. Ridge

Political Science Faculty Articles and Research

After a decade as the stand-out democracy of the Middle East, Tunisia took an anti-democratic turn in July 2021 with President Kaïs Saïed’s self-coup. Using a survey fielded in the weeks after these reforms, this article documents the substantial support for liberal institutions and civil rights in Tunisia. Democracy itself, on the other hand, is not so strongly supported. The study thus identifies potential for democratic backsliding in Tunisia through the strategic implementation liberal but anti-democratic actions. Other would-be authoritarians could follow Saïed’s model of strategic regression to autocratize their regimes.

Defunding Police Agencies, Rick Su, Anthony O'Rourke, Guyora Binder Jun 2022

Defunding Police Agencies, Rick Su, Anthony O'Rourke, Guyora Binder

Journal Articles

This Article contextualizes the police defunding movement and the backlash it has generated. The defunding movement emerged from the work of Black-led activists to reassert democratic control over policing and shift resources to social service agencies and other institutions serving community needs. In reaction, states have enacted anti-defunding bills checking local government reduction of law enforcement budgets. These anti-defunding measures continue a long tradition of state and federal control over local police spending, subverting local democratic control over police agencies. These limits include direct legal constraints on local police spending and indirect constraints through grants and authorization to collect fines, …

Nebraska Law Review

The year 2022 will be the fiftieth anniversary of the Supreme Court’s 1972 landmark prisoners’ rights case, Morrissey v. Brewer.1 Morrissey was a Fourteenth Amendment due process challenge involving an Iowan whose parole was revoked without a hearing.2 But long before Mr. Morrissey was in prison, a legislative internship at the University of Nebraska College of Law (Nebraska Law) in 1968 got me involved in researching and drafting the Nebraska Treatment and Corrections Act of 1969, including state parole law. The one area of parole law not reformed by the new legislation was parole revocation, a shortcoming that was the …

U.S. Micromobility Law (Major Road Work Ahead), Peter W. Martin Jun 2022

U.S. Micromobility Law (Major Road Work Ahead), Peter W. Martin

Cornell Law Faculty Working Papers

Over the past decade electrically powered bicycles, stand-up scooters, skateboards, and more have burst onto the nation’s streets and sidewalks. While some have been owned by their riders, a combination of embedded technology and smartphone apps allowed well-funded start-ups to distribute these novel e-vehicles across urban public spaces, making them available for on-demand, short-term rental. This blossoming of “micromobility” has taken place within physical and legal infrastructures ill-prepared for the change. Indisputably, most of the new types of individual motorized mobility fell outside established vehicle categories. The literal terms of existing law banned their use on all public rights of …

Oklahoma established that much of the eastern part of the state of Oklahoma is Indigenous land and therefore falls under either tribal jurisdiction or Federal jurisdiction. In 2015 Victor Manuel Castro-Huerta was charged and convicted of child neglect by …
