The Center for Homeland Defense and Security identified an increase of active threat events, such as mass shootings, annually since 1999. Literature suggests that 90% of shootings were over before law enforcement arrived at the scene and the first responder response was limited to “surround and contain” until Special Weapons and Tactics Teams (SWAT) arrived on the scene. Using Unmanned Aircraft Systems (UAS) to detect which individual was the threat and type of weapon used can provide useful information to increase the speed of the response for first-on-scene rather than waiting for SWAT if the type of weapon was known. …

Existence And Enforcement Of A Right To Be Forgotten In China, Yue Zhen
Existence And Enforcement Of A Right To Be Forgotten In China, Yue Zhen
Chulalongkorn University Theses and Dissertations (Chula ETD)
This research examines establishment and enforcement of the right to be forgotten under the Chinese legal system, including the origin and characteristics of the "right to be forgotten", as well as the regulations on "erasure" in China. It finds that protection challenges stem from the fact that personal data can be publicly accessible online. In addition, different countries, which are electronically connected through the internet, may have different legal protection measures for a right to be forgotten. In China, a legislative protection on a right to be forgotten is relatively weak. Firstly, compared with the General Data Protection Regulation (GDPR), …

The commercial success of cellular phone systems during the late 1980s and early 1990 years heralded the wireless revolution that became apparent at the turn of the 21st century and has led the modern society to a highly interconnected world where ubiquitous connectivity and mobility are enabled by powerful wireless terminals. Software defined radio (SDR) technology has played a major role in accelerating the pace at which wireless capabilities have advanced, in particular over the past 15 years, and SDRs are now at the core of modern wireless communication systems. In this paper we give an overview of SDRs that …
Public Carry And Criminal Law After Bruen, Eric Ruben
Public Carry And Criminal Law After Bruen, Eric Ruben
Faculty Journal Articles and Book Chapters
Gun rights supporters appear to be on the cusp of achieving a decades-long goal: defanging licensing laws for carrying handguns in public nationwide. More than 20 states have removed all licensing requirements for concealed carry, and most of the others now require little more than a background check. At oral argument in New York State Rifle & Pistol Ass’n v. Bruen, meanwhile, the Supreme Court seemed poised to strike down policies in the remaining states that limit licenses to those who can show a heightened need, or “good cause,” to carry a gun. If that happens, what comes next?

Creating a more sustainable world will require a coordinated effort to address the rise of social, economic, and environmental concerns resulting from the continuous growth of cities. Supporting planners with tools to address them is pivotal, and sustainability is one of the main objectives. Modeling and simulation augmenting digital twins can play an important role to implement these tools. Although various green best practices have been utilized over time and there are related attempts at measuring green success, works in the published literature tend to focus on addressing a single problem (e.g., energy efficiency), and a comprehensive approach that takes …
The Deficiencies Of Oregon Ballot Measure 110, Jacob Towles
The Deficiencies Of Oregon Ballot Measure 110, Jacob Towles
SMU Science and Technology Law Review
In 1970, the Federal Government enacted the Controlled Substance Act (CSA), which made certain drugs and substances illegal absent a medical prescription. The control of drugs through the CSA exists to prevent harm to the public. Nonetheless, some cities and states have enacted laws that allow for the benefit of selling or pleasure of using illegal drugs to outweigh the legal ramifications.
In November 2020, The Drug Addiction Treatment and Recovery Act, also known as Oregon Ballot Measure 110 (Measure 110), made Oregon the first state in the country to decriminalize all drugs. Measure 110 was enacted with the overarching …

Post-Conviction Release And Defacto Double Jeopardy: Making The Case For Felons As A Quasi-Suspect Class Due To The Collateral Consequences Of A Felony Conviction
Florida A & M University Law Review
Felons are a prime example of a sub-class of individuals that, once convicted in a court of law, are classified, punished, stigmatized, stripped of their rights as American citizens, and discriminated against. Could this be a form of De Facto double jeopardy? While felons are not literally subjected to a second trial within the judicial system for the same offense, felons face a pseudo trial with society, as its jury, upon re-entry into society, based on the continual discrimination for crimes they have already served time for. The enactment of discriminatory laws against felons dehumanizes the individual by discarding their …
Defunding The Police: True Police Reform Or Just Political Smoke And Mirrors? A Look At The City Of Camden, New Jersey And Its Approach To Police Reform, Anitra Austin
MPA/MPP/MPFM Capstone Projects
The summer of 2020 brought police brutality to the forefront of society. The deaths of Breonna Taylor and George Floyd at the hands of police officers ignited a firestorm of social justice movements. Black Lives Matter and other social justice organizations were calling for cities around the country to defund their police departments as a strategy for police reform. This strategy was largely unprecedented, and highly controversial. There was a lack of understanding of what defunding the police actually meant, as it seemed to mean different things to different people. The subtle suggestions of defunding the police quickly turned to …

Sunset Provisions In The Local Tax Code: Best Practices, Sara Deuster
MPA/MPP/MPFM Capstone Projects
The primary objective of this research project is to identify the main uses of the sunset provision as it relates to the local tax code. This research project utilizes a case study approach to collect and analyze sunset tax legislation from five municipalities. Capital project funding is found to be the primary use of taxes with a sunset provision. Other uses associated with sunset taxation include transportation infrastructure, capital funding, bond financing, and public safety. Through the analysis process for this research project, five best practices were developed to guide municipalities who engage in sunset taxation with respect to their …

Merged Government: Is This An Option For Bowling Green And Warren County, Ky Governments?, Alice Williams
MPA/MPP/MPFM Capstone Projects
In recent history, the most common attempt at reorganization of government in a metropolitan area is the city-county consolidation model. With limited government resources, elected officials along with community members look to this model to make the best use of those resources. “Applied to local government, the term ‘‘consolidation’’ is generally understood to mean the structural merging of two or more governments into one. When a city and county consolidate, a new and different form of local government is created that has elements of both city and county government but is neither.” (Martin, 2011) There are both benefits and problems …

Cloud computing underlies many of the most powerful and controversial technologies of our day - from large-scale data processing to face recognition systems - yet the human rights impacts of cloud computing have received little scrutiny. This article explains what cloud computing is, how it works, and what some of its most significant human rights impacts are through three case studies. It offers some initial thoughts on the human rights responsibilities of cloud computing providers under the United Nations Guiding Principles on Business and Human Rights and concludes by suggesting directions for future research.

Abstract: A critical challenge during volcanic emergencies is responding to rapid changes in eruptive behaviour. Actionable advice, essential in times of rising uncertainty, demands the rapid synthesis and communication of multiple datasets with prognoses. The 2020–2021 eruption of La Soufrière volcano exemplifies these challenges: a series of explosions from 9–22 April 2021 was preceded by three months of effusive activity, which commenced with a remarkably low level of detected unrest. Here we show how the development of an evolving conceptual model, and the expression of uncertainties via both elicitation and scenarios associated with this model, were key to anticipating this …

Individuals who wish to access a website or qualify for a loan are expected to expose personally identifying information, undermining their privacy and security. Firms share proprietary information in dealmaking negotiations which, if the deal fails, may be used by the negotiating partner for a competitive advantage. Regulators are expected to disclose their algorithmic tools to comply with public transparency and oversight requirements, a practice that risks rendering these tools circumventable and ineffective. Litigants might have to reveal trade secrets in court proceedings to prove a claim or defense. Such “verification dilemmas” — costly choices between opportunities that require the …
Expanding The Capabilities Of Firearm Investigations: Novel Sampling And Analytical Methods For Gunshot Residue Evidence, Courtney Helen Vander Pyl
Expanding The Capabilities Of Firearm Investigations: Novel Sampling And Analytical Methods For Gunshot Residue Evidence, Courtney Helen Vander Pyl
Graduate Theses, Dissertations, and Problem Reports (ETD)
During firearm-related incidents, the accurate collection and detection of gunshot residues (GSR) are crucial for reconstructing events and providing investigative leads. Regardless of the strong scientific foundations in the discipline, the standard practice for GSR can benefit from increased confidence in the results and the adoption of reference standard materials and screening tools that can lead to faster turnaround times and improved efficiency. Moreover, the implementation of comprehensive interpretation approaches requires strengthening the current body of knowledge on the transfer and persistence of inorganic and organic GSR compounds (IGSR, OGSR). As a result, the overall objective of this project was …

Correlates Of Risky Sexual Behaviors Among African American Females In Juvenile Detention Centers, Eghosa E. Asemota
College of Graduate Studies: Theses & Dissertations
Introduction: In comparison to other demographics, research shows that African American female adolescents are over-represented in the United States Juvenile Justice System. Studies in this vulnerable population demonstrate higher rates of engagement in unsafe sex, and its attendant negative consequences of HIV infections, sexually transmitted diseases, and mistimed pregnancies. There is a paucity of studies that have specifically examined risky sexual behaviors amongst African American females in Juvenile Detention Centers. Objective: The aim of this study is to assess the relationship between the individual, family, peer, and societal factors, and engagement in risky sex among Black female detainees in Juvenile …
A Proportionality-Based Framework For Government Regulation Of Digital Tracing Apps In Times Of Emergency, Sharon Bassan
A Proportionality-Based Framework For Government Regulation Of Digital Tracing Apps In Times Of Emergency, Sharon Bassan
Dickinson Law Review (2017-Present)
Times of emergency present an inherent conflict between the public interest and the preservation of individual rights. Such times require granting emergency powers to the government on behalf of the public interest and relaxing safeguards against government actions that infringe rights. The lack of theoretical framework to assess governmental decisions in times of emergency leads to a polarized and politicized discourse about potential policies, and often, to public distrust and lack of compliance.
Such a discourse was evident regarding Digital Tracing Apps (“DTAs”), which are apps installed on cellular phones to alert users that they were exposed to people who …
