Taking Stock: Open Questions And Unfinished Business Under The Vawa Amendments To The Indian Civil Rights Act, Jordan Gross
Taking Stock: Open Questions And Unfinished Business Under The Vawa Amendments To The Indian Civil Rights Act, Jordan Gross
UC Law Journal
The primary statutory tool for federal regulation of Tribal court criminal procedure is the Indian Civil Rights Act of 1968 (ICRA). ICRA replicated most of the procedural protections in the Bill of Rights applicable to the States, as then interpreted by the Supreme Court. ICRA also sets out procedures Tribes must extend to criminal defendants in their courts, caps their sentencing authority, and defines their criminal jurisdiction.
Some parts of Indian country are the most dangerous places in the United States today, particularly for indigenous women and girls. They are exposed to a higher level of personal violence than any …

This qualitative study examines LGBTQIA+ people’s experiences of navigating risk and safety, interacting with law enforcement, and utilizing support services. LGBTQIA+ people experience stigma, social marginalization, and resource access disparities, particularly individuals who visibly transgress gendered norms about appearance and behavior, or whose identities as LGBTQIA+ intersect with other marginalized social categories based in characteristics such as race and socioeconomic status. LGBTQIA+ people also report negative experiences with law enforcement and obstacles to accessing care. These experiences are consistent with the notion that police and other institutional actors maintain social control through the surveillance and targeting of populations seen as …

Disinformation On Trial: Fighting Foreign Disinformation By Empowering The Victims, Ari B. Rubin
Disinformation On Trial: Fighting Foreign Disinformation By Empowering The Victims, Ari B. Rubin
Cardozo Law Review
Foreign disinformation catapulted into the national spotlight with the 2016 presidential election, but its impact is not confined to the electoral map or season. This Article addresses the threat of foreign disinformation by proposing a new statute: a private right of action, enabling harmed persons to directly sue state or private actors, foreign or domestic, who knowingly or recklessly spread disinformation from abroad. Scholars and policymakers have proposed other, far-flung solutions ranging from greater online security to outright censorship. Each of those ideas stumbles on common challenges and lacks a valuable ingredient: an interested party, directly harmed by the foreign …

Nicknames such as Boo Bear, Snookums, Sweet Precious Baby, or Cutie Patootie fondly show how owners might typically interact with their pets. With Americans spending approximately $95.7 billion on pets in 2019, the Uniform Trust Code expressly allowing trusts to care for deceased owners’ pets, and the COVID-19 pandemic bringing a sharp increase in dog adoptions, pets are becoming an ever more significant part of the American family. When a pet escapes or goes missing, most owners desperately want them to return home safely; microchipping is one proactive, reliable option for owners to help ensure they do.

The Relationship Between Utilization Of The Elsevier Online Remediation Tool And The Hesi Exit Exam For Student Nurses Preparing For The Nclex-Rn, Judith A. Egan
Dissertations
Nursing schools are operating at full capacity in order to address an impending shortage of registered nurses that may exceed 500,000 by the year 2025. This pressure on scarce resources elevates the importance of NCLEX-RN preparedness for nursing faculty, nursing students, and the public at large. Additionally, the ability to successfully prepare students to sit for the NCLEX-RN exam can affect the reputation of nursing programs throughout the United States. Nursing schools frequently utilize commercially prepared standardized exams to assess student readiness and identify students in need of remediation. The HESI E2 Exit Exam distributed by Elsevier is one such …

This is a consensual multi-dyadic exploration of the diverse perspectives of seven community subgroups’ perceptions of events before, during, and after the 2014 police-involved shooting death of Michael Brown, Jr. in Ferguson, Missouri. Recognizing an enacted environment in the complex history that preceded the uprising, findings were contextualized and framed through the cosmology episode trauma model. A multicultural and visibly diverse research team conducted 34 interviews with involved citizens (protesters), law enforcement, clergy, politicians, business owners, media personnel, and educators. A culturally diverse cross-analysis team triangulated social perspective through consensus coding and audit. Consensual multi-dyadic method preserved the unique characteristics …

Place-Based Consequences Of Person-Based Transfers: Evidence From Recessions, Brad J. Hershbein, Bryan A. Stuart
Place-Based Consequences Of Person-Based Transfers: Evidence From Recessions, Brad J. Hershbein, Bryan A. Stuart
Upjohn Institute Working Papers
This paper studies how government transfers respond to changes in local economic activity that emerge during recessions. Local labor markets that experience greater employment losses during recessions face persistent relative decreases in earnings per capita. However, these areas also experience persistent increases in transfers per capita, which offset 16 percent of the earnings loss on average. The increase in transfers is driven by unemployment insurance in the short run, and medical, retirement, and disability transfers in the long run. Our results show that nominally place-neutral transfer programs redistribute considerable sums of money to places with depressed economic conditions.

Objectives: When the COVID-19 pandemic was declared, Governments responded with lockdown and isolation measures to combat viral spread, including the closure of many schools. More than a year later, widespread screening for SARS-CoV-2 is critical to allow schools and other institutions to remain open. Here, we describe the acceptability of a minimally invasive COVID-19 screening protocol trialled by the Western Australian Government to mitigate the risks of and boost public confidence in schools remaining open. To minimise discomfort, and optimise recruitment and tolerability in unaccompanied children, a combined throat and nasal (OP/Na) swab was chosen over the nasopharyngeal swab commonly …

The Opioid Crisis: The Battle For Overdose Prevention Sites In Illinois, Haley Arnieri
The Opioid Crisis: The Battle For Overdose Prevention Sites In Illinois, Haley Arnieri
DePaul Journal of Health Care Law
Opioid overdose deaths have been steadily increasing over the past thirty years. Since 1999, more than 841,000 people have died in the United States from a drug overdose. In 2018, two out of three drug overdose deaths were from opioids. Like the rest of the country, Illinois was not able to escape this public health crisis. Opioid overdoses are the leading cause of injury-related death in the United States, but these deaths are preventable with the right resources. Some jurisdictions have started to look at new solutions to this public health crisis such as supervised injection site.

Interest Groups, Local Politics, And Police Unions, Daniel Disalvo

Police unions raise issues of great importance for political scientists. Yet, the field has neglected them. This essay argues that political scientists should see police unions as important interest groups, empowered by state collective bargaining laws, that are important players in local politics and shapers of the criminal justice system in America. The organizational properties that make police unions important interest groups are described. The important political questions that arise once we consider police union as interest groups are examined. The existing research on police unions—especially their impact on government costs and police behavior—is detailed. Ultimately, the study of collective …
