Value Vectors Of The World Local Orthodox Churches Position Regarding Russia's War Against Ukraine, Oleksandr Brodetskyi, Iryna Horokholinska, Mykola Lahodych
Occasional Papers on Religion in Eastern Europe
The article deals with the religious contexts of the modern civilizational crisis caused by Russia’s war of aggression against Ukraine. Among the multitude of thematic lines of this set of problems, the article’s authors focus their attention precisely on the position of the world Orthodox Churches regarding this war. The concentration of such attention is objectively determined by the fact that the majority of Ukrainian citizens position themselves as Orthodox by faith, and therefore, are particularly sensitive to the opinion of the leaders of the Orthodox Churches of the world. The article examines the value aspects of the problem of …

Clergy Social Activity During War Conditions: The Case Of Western Regions Of Ukraine, Ihor Lutsan, Iryna Horokholinska
Occasional Papers on Religion in Eastern Europe
In this article, the authors analyze the impact of Russia-Ukraine war on church-religious life and the state of public consciousness in Ukraine and identify the main trends and contradictions in public reactions to threats to their lives and spirituality. The research focuses on religious communities of the western regions of Ukraine and their socially significant activities. The primary empirical source of the article was the study (by questionnaire survey) of the opinions of the clergy of this religious organization on the characteristics of parish life and the role of the pastor in the conditions of war. Three defining vectors that …

Distributed Partial Differential Equation Solving With Julia Fast Fourier Transform Library, Christopher E. Mottola
Distributed Partial Differential Equation Solving With Julia Fast Fourier Transform Library, Christopher E. Mottola
Honors Theses and Capstones
Scientific computing relies on advanced computational and mathematical techniques to solve complex problems in scientific domains. For the numerical rendering of spectral, nonlinear, and dynamic phenomena, there is a growing need for greater availability of a broad class of Fourier-based algorithms to perform large scale operations on multidimensional data in distributed and optimized ways. To this effect, the Julia programming language is new and has significant advantages compared to other common languages used in scientific computing. The research presented here formulates a basis for further development in high-performance scientific computing of periodic partial differential equations through the application of distributed …

Tinkering With Tinker: Why The Supreme Court Must Protect Student Speech Through Social Media, Alexis Roach
Honors Theses and Capstones
The goal of this paper is to address the failing of the Supreme Court in their decision of the case Mahanoy Area School District v. B.L.[1]. While the Court defended students’ rights to free speech under the First Amendment in Tinker v. Des Moines (1969)[2], they have since restricted that right through a number of cases. While the Court’s decision in Mahanoy Area School District v. B.L. protected student speech, the Court failed to provide a standard for application in cases regarding social media in schools. This paper argues that while the Court was correct in …
Investigating Signs Of Orbital Decay In The Tres-1 Exoplanetary System, Amanda F. Wester
Investigating Signs Of Orbital Decay In The Tres-1 Exoplanetary System, Amanda F. Wester
Honors Theses and Capstones
Transit observations of exoplanetary systems can be used to investigate orbital decay. TrES-1b is an exoplanet hypothesized to be experiencing orbital decay due to observed transit timing variations (TTVs) [12]. Numerous transits must be observed to establish a long term pattern to conclusively determine if the planet’s orbit is decaying. Measurements were made using the UNH Observatory where 2 transits were observed of the TrES-1b transiting system on February 27, 2022 and March 5, 2022. A CCD camera was used to image the transit and capture calibration images. The software AstroImageJ (AIJ) was used to calibrate the images and perform …

John Copeland Nagle: A Man For All Seasons, Patricia A. O'Hara
Journal Articles
Many fine law schools have faculty members who are outstanding teachers, preeminent scholars, and generous colleagues. Few law schools are as blessed as we were at Notre Dame to have someone as singular as John Copeland Nagle—a person who was all those things professionally, but who was also a man without self-serving ego or guile; a man possessed of a moral compass that made him "true north" to so many of us; a person who consistently acted out of charity in an effort to do the right thing in all things.
John was genuine, authentic, self-giving, and humble with every …
Coming Full Circle On Human Rights In The Global Economy: International Economic Law Tools To Realize The Right To Development, Diane A. Desierto
Coming Full Circle On Human Rights In The Global Economy: International Economic Law Tools To Realize The Right To Development, Diane A. Desierto
Journal Articles
From the Article
This article argues that the discipline and profession of international economic law has undergone a significant architectural change to focus on human rights law as both the premise and promise of the international economic system. Contrary to prevailing currents that focus on the irrelevance of the global economic system to realize human rights, this article argues that international economic law tools have already been converging within the last decade to authentically realize the Right to Development of individuals, groups, and populations. The Draft Convention on the Right to Development defines the right as the enjoyment, participation, and …

History Faculty Publications
This study focuses on the Indian mission of IBVM nuns, and the role played by them in the spread of female education in India. While acknowledging that missionaries were part of the imperial process, this study analyzes the work of Catholic nuns in India, their convents, and curriculum to show how their work advanced women’s educational opportunities in India. In the process the study examines how Catholic nuns resisted the dominating attitude of the Catholic Church in India. The last section of the article examines how Christian influence under missionaries not only prepared good mothers and wives but also trained …

Harnessing The Power Of Interdisciplinary Research With Psychology-Informed Cyberbullying Detection Models, Deborah Hall, Yasin N. Silva, Brittany Wheeler, Lu Cheng, Katie Baumel
Computer Science: Faculty Publications and Other Works
Cyberbullying has become increasingly prevalent, particularly on social media. There has also been a steady rise in cyberbullying research across a range of disciplines. Much of the empirical work from computer science has focused on developing machine learning models for cyberbullying detection. Whereas machine learning cyberbullying detection models can be improved by drawing on psychological theories and perspectives, there is also tremendous potential for machine learning models to contribute to a better understanding of psychological aspects of cyberbullying. In this paper, we discuss how machine learning models can yield novel insights about the nature and defining characteristics of cyberbullying and …

We have shown that membrane-associated guanylate kinase with inverted domain structure-1 (MAGI1), a scaffold protein with six PSD95/DiscLarge/ZO-1 (PDZ) domains, is involved in the regulation of endothelial cell (EC) activation and atherogenesis in mice. In addition to causing acute respiratory disease, influenza A virus (IAV) infection plays an important role in atherogenesis and triggers acute coronary syndromes and fatal myocardial infarction. Therefore, the aim of this study is to investigate the function and regulation of MAGI1 in IAV-induced EC activation. Whereas, EC infection by IAV increases MAGI1 expression, MAGI1 depletion suppresses IAV infection, suggesting that the induction of MAGI1 may …

PURPOSE: We investigated the feasibility of biology-guided radiotherapy (BgRT), a technique that utilizes real-time positron emission imaging to minimize tumor motion uncertainties, to spare nearby organs at risk.
METHODS: Volumetric modulated arc therapy (VMAT), intensity-modulated proton (IMPT) therapy, and BgRT plans were created for a paratracheal node recurrence (case 1; 60 Gy in 10 fractions) and a primary peripheral left upper lobe adenocarcinoma (case 2; 50 Gy in four fractions).
RESULTS: For case 1, BgRT produced lower bronchus V40 values compared to VMAT and IMPT. For case 2, total lung V20 was lower in the BgRT case compared to VMAT …
Leveling Up To A Reasonable Woman's Expectation Of Privacy, Victoria Schwartz
Leveling Up To A Reasonable Woman's Expectation Of Privacy, Victoria Schwartz
University of Colorado Law Review
Various privacy law doctrines involve a reasonable expectation of privacy or similar analyses that take into account social privacy norms. For the most part, however, neither courts nor scholars have explicitly grappled with whether courts descriptively do or normatively should consider gender in deciding what constitutes a reasonable expectation of privacy. This is despite the fact that, in various scenarios, a reasonable woman’s expectation of privacy might vary from a man’s in light of different lived experiences, biological differences, and existing societal gendered privacy norms.
This Article addresses how courts do and should take into account a reasonable woman’s expectation …

Undocuamerica Monologues, Motus Theater, Alejandro Fuentes Mena, Armando Peniche, Christian Solano-Córdova, Kirsten Wilson
University of Colorado Law Review
The following work contains three monologues from Motus Theater's UndocuAmerica Project, which aims to interrupt dehumanizing portrayals of immigrants by encouraging thoughtful engagement on the challenges faced by undocumented communities and the assets immigrants bring to our country. The monologues were created in a collaboration between leaders with DACA status and Motus Theater Artistic Director Kirsten Wilson during a seventeen-week autobiographical- monologue workshop. All three pieces were presented in a virtual performance on April 8, 2021, as an introduction to the 29th Annual Rothgerber Conference.
The Failures Of Good Moral Character Determinations For Naturalization, Zachary New
The Failures Of Good Moral Character Determinations For Naturalization, Zachary New
University of Colorado Law Review
This Article examines the effects of the good-moral-character requirement in naturalization proceedings. Specifically, it looks to such character requirements as a method by which a citizen polity screens out undesirable noncitizens from those who are deserving of inclusion in the "in"g roup of citizenship. The Article discusses historical methods of good-moral-character adjudication, and especially how such methods carried an undercurrent of forgiveness and redemption-an undercurrent lacking in the current method of statutory bars to showings of good moral character. By looking at specific examples of statutory bars to showings of good moral character, this Article argues that the overinclusive nature …
Synchronizing Copyright And Technology: A New Paradigm For Sync Rights, Michael P. Goodyear
Synchronizing Copyright And Technology: A New Paradigm For Sync Rights, Michael P. Goodyear
Missouri Law Review
Embedded in a copyright owner’s musical work or sound recording is the synchronization, or sync right, the exclusive right to use music in sync, or in timed-relation, with audiovisual works. Considerations about sync rights, one of the least discussed aspects of music copyright, have come to the fore as the world has increasingly moved from the real world to the virtual. The COVID-19 pandemic has spurred thousands of activities and events to go online. With many of these involving music, the shift to the virtual world has raised new questions about the extent of sync rights.
The Most Dangerous Branch Of Science? Reining In Rogue Research And Reckless Experimentation In Social Services, James G. Dwyer
The Most Dangerous Branch Of Science? Reining In Rogue Research And Reckless Experimentation In Social Services, James G. Dwyer
Missouri Law Review
Most people are unaware how much public policy is either lacking in any empirical-research support or driven by bad research. Political actors motivated by ideology or donor/constituent demands propose new government practices—in areas ranging from policing to funding of treatments for gender dysphoria in youth to welfare-qualification rules—that will greatly impact people’s lives, and if anyone asks what basis they have for thinking the impact will be good, they can readily find some study to support their case. Especially when powerless populations are put at risk, neither the legislative process nor peer review in the publication process provides a real …
Risky Business: Breakfast Sandwiches, Course Of Employment, And Revisiting Missouri Workers’ Compensation Law, Trent H. Hamoud
Risky Business: Breakfast Sandwiches, Course Of Employment, And Revisiting Missouri Workers’ Compensation Law, Trent H. Hamoud
Missouri Law Review
Since its inception, the Missouri Workers’ Compensation scheme has presented interesting and complex problems regarding workplace risk allocation. To avoid workplace injuries, employees and employers engage in significant preventative behaviors. One such action by employers is employee monitoring. Clearly, however, constant workplace monitoring is not feasible. This inherent limitation leads to this Note’s initial inquiry: at what point do the actions of employees taken out of sight of their employers create compensable claims under the existing Missouri Workers’ Compensation system, and what inefficiencies may result from requiring that employers provide compensation for the injuries that arise from such actions? Boothe …
Creating An Impossible Burden: State Ex Rel. Becker V. Wood And Prosecutorial Vindictiveness, Rachael Moore
Creating An Impossible Burden: State Ex Rel. Becker V. Wood And Prosecutorial Vindictiveness, Rachael Moore
Missouri Law Review
In the American criminal justice system, prosecutors have an enormous amount of discretion and power. With dockets growing more cramped, prosecutors often use threats of harsher charges and sentences to deter defendants from exercising their right to a jury trial or an appeal. Prosecutors can also wield this power for purely vindictive or retaliatory purposes, as one prosecutor noted when reflecting on his career: Sometimes a public defender or a defense lawyer will just try and bust your ass all the time. Frankly, you end up busting theirs back. You get irritated, but you try not to take it out …
Blown Whistle Falls On Deaf Ears: The Eighth Circuit Interprets Map-21’S Whistleblower Provision, Sarah (Walters) Porter
Blown Whistle Falls On Deaf Ears: The Eighth Circuit Interprets Map-21’S Whistleblower Provision, Sarah (Walters) Porter
Missouri Law Review
In recent years, whistleblowers have been praised as heroes by onlookers and in the media for bravely unveiling wrongdoing by their employers, but whistleblowers have not always enjoyed this white-hat status. These private employees expose themselves to serious risks of backlash and retaliation from their employers, historically without any guaranteed protection from Congress or their respective state legislatures. Decades-old social norms and corporate culture prioritized loyalty from employees. They allowed employers to fire employees who spoke out against the company and even blackball them from their respective industries. With blind loyalty or termination being the only options for employees witnessing …
The Destruction Gap: A Study Of The Unprotected Societal Interest In Privately Held Artworks, Jessica Schmitz
The Destruction Gap: A Study Of The Unprotected Societal Interest In Privately Held Artworks, Jessica Schmitz
Missouri Law Review
Imagine putting a Warhol through a washing machine, a Rembrandt in a recycling bin, or a Seurat in a shredder. If you are the lucky owner of a masterpiece by one of these artists you may take any of these actions and face no legal repercussions, thereby destroying the artwork and removing it from the cultural landscape. Our understanding of world history would be neither as beautiful, illuminated, nor as informed if artworks of cultural significance like these were destroyed. For example, little would be known of the ideologies of pre-historic civilizations but for the sculptures, wall paintings, and other …

Background. For men with intermediate-risk prostate cancer (IRPC), adding short-term androgen deprivation therapy (ADT) to external beam radiation therapy (EBRT) has shown efficacy, but men are often reluctant to accept it because of its impact on quality of life. Methods. We conducted time tradeoffs (score of 1 = perfect health and 0 = death) and probability tradeoffs with patients aged 51 to 78 y who had received EBRT for IRPC within the past 2 y. Of 40 patients, 20 had received 6 mo of ADT and 20 had declined. Utility assessments explored 4 ADT-related side effects: hot flashes, fatigue, loss …

Over the last two years, the COVID-19 pandemic has required teacher educators to teach their classes online. Teacher educators now need to reflect on the learning opportunities that the COVID-19 induced shift to online learning has provided. This study shares two teacher educators’ experiences of teaching and supporting preservice teachers (PSTs) as they taught engineering online to elementary students. The two teacher educators noticed (a) positive changes in PSTs’ attitudes and beliefs about technology integration, (b) PSTs’ tendency to select and use of educational technologies, (c) PSTs’ recognition of the importance of online interaction and feedback from K-12 students, (d) …
How The Media Frames Mental Health And Social Media: A Case Study Of The Facebook Whistleblower, Megan Switzgable
How The Media Frames Mental Health And Social Media: A Case Study Of The Facebook Whistleblower, Megan Switzgable
Honors Theses and Capstones
In September 2021, Frances Haugen, a former Facebook employee, leaked confidential documents surrounding internal research performed at the company, revealing that Facebook knew the negative impact Instagram had on the mental health of teenagers. In this paper, I study how the media frames the relationship between mental health, teenagers, and social media when discussing the leaked documents. In order to do this, I perform a critical discourse analysis of thirty print media articles written about the Facebook Whistleblower, focusing on how the
articles present gender, mental health, and the positive and negative uses of social media. I also look at …

The Liberatory Potential Of Fashion, David Billie Suoth
Honors Theses and Capstones
Fashion has the potential to be liberatory and this can be seen in the ways fashion has been targeted by systems of oppression. Fashion is the use of clothes as a vessel to create a greater social meaning. According to Edward Sapir, the meaning of fashion “while it is primarily applied to dress and the exhibition of the human body is not essentially concerned with the fact of dress or ornament, but with its symbolism” (Barnard, 2007, p. 65). Fashion with the symbolism behind it is able to show the sentiments and attitudes of civilization at different points in history …
