International Business and Entrepreneurship Faculty Publications
This study highlights the impact of digital financial services as enhancing the capacity of development goals as well as social sustainability. The selected emerging markets are Ghanaian financial service providers (FSP)s and microenterprise customers (CME)s, where we examine how “Ubuntu”, an African philosophy of humanism, legitimizes spaces for a more democratic, egalitarian, and ethical engagement of human beings. This study adopts a grounded theory methodology for investigation of the phenomena with a sample size of 70 relationship managers. The findings further existing sustainability literature pertaining to social sustainability and consumer wellbeing. We contribute to theory by presenting a psychological perspective …
Why Do Competition Authorities Need Artificial Intelligence?, Isabella Lorenzoni
Why Do Competition Authorities Need Artificial Intelligence?, Isabella Lorenzoni
Yearbook of Antitrust and Regulatory Studies
Recent technological developments are transforming the way antitrust is enforced as well as the way market players are infringing competition law. As a result, enforcers are starting to equip themselves with sophisticated digital investigation tools. This paper explores this interest in building an Artificial Intelligence (AI) arsenal for the fight against algorithmic infringements. What are the key factors motivating regulators to develop their own technological tools to enforce competition law? Building on interviews with a number of competition authorities, this paper finds that changes in digital markets, the need for enforcers to reverseengineer companies’ algorithms in order to better understand …
Competition Law Enforcement In Ukraine: Challenges From On-Line Giants, Anzhelika Gerasymenko, Nataliia Mazaraki
Competition Law Enforcement In Ukraine: Challenges From On-Line Giants, Anzhelika Gerasymenko, Nataliia Mazaraki
Yearbook of Antitrust and Regulatory Studies
Competition law, economics and policy are facing a regulatory metamorphosis due to the rise of the digital economy. US, China and EU jurisdictions have announced and partially introduced systemic changes to their competition law frameworks to keep pace with technological developments. The Antimonopoly Committee of Ukraine is following the principle of ‘three monkeys’, it sees no on-line platforms, hears no on-line platforms, speaks of no on-line platforms, so nothing has been undertaken or even announced. The paper is twofold. Firstly, it analyses the economic background and features of the digital economy and shows why the available instruments of competition enforcement …

Section 19a Gwb As The German ‘Lex Gafa’ – Lighthouse Project Or Superfluous National Solo Run?, Tabea Bauermeister
Yearbook of Antitrust and Regulatory Studies
As the European Union kept on struggling with its Digital Markets Act, Germany forged ahead and implemented its own ‘Lex GAFA’ in early 2021. The paper will introduce this new Section 19a and explain its inner workings. Furthermore, Section 19a will be compared to classic Article 102 TFEU-procedure and contrasted with the DMA. Thereby, the paper will present the advantages and disadvantages of Section 19a in comparison to existing and future European law to assess whether Section 19a is in fact the lighthouse project it was presented to be – or rather a superfluous national solo run.
The Digital Markets Act Between The Eu Economic Constitutionalism And The Eu Competition Policy, Claudia Massa
The Digital Markets Act Between The Eu Economic Constitutionalism And The Eu Competition Policy, Claudia Massa
Yearbook of Antitrust and Regulatory Studies
Given that a lot has already been written by legal scholars on the practical implications that the entry into force of the Digital Markets Act will have, the present article intends to bring the discussion back to the theoretical level, trying to find out where the roots of this proposed regulation lie, with an analysis of the context in which it falls, the EU principles and values upon which it is based, the objectives it intends to pursue, and the legal-economic theories behind it.

Consensual Qualitative Research Of Compassion And Self-Compassion Definitions: A General Public Perspective, Júlia Halamová, Andrea Petrovajová, Tomáš Žilinský
The Qualitative Report
Even though compassion for others and for the self are important indicators of mental and physical health and well-being, scientists vary greatly in defining them. Therefore, we examined how the public defines compassion for others and self and explore what are the similarities or differences between researchers´ definitions and public´s definitions of compassions as well as between compassion and self-compassion themselves. 305 members of public defined compassion and self-compassion using their own words, of which we randomly selected 35 for the analysis. The definitions have been analysed using the modified Consensual Qualitative Research (CQR-M) method. The research team composed of …

The study was framed around four research questions: How do veterans describe the impact sports and exercise have on their D- PTSD?, When there are PTSD symptoms being experienced prior to engaging in a sport or exercise, how does the veteran feel after the sport or exercise is completed?, What do veterans describe as the primary catalyst that draws them to engage in combative sports?, What is the holistic connectedness with sports and exercise for veterans with D- PTSD …
James Monroe’S White House: The Genius Of Politics And Place, Susan Glen Amos
James Monroe’S White House: The Genius Of Politics And Place, Susan Glen Amos
Doctoral Dissertations and Projects
This research endeavor has discerned the origins of an enduring American nationalistic distinctiveness perpetuated by President James Monroe’s White House. A careful scholarly examination of Monroe’s White House as a cultural landscape enquires into the genesis of interdependence between place and politics. It also studies the depth of the American people’s ability to embrace, as their own, the symbolism and national vision fashioned in these spaces. The juxtaposition of James Monroe’s election as the first United States president after the War of 1812 with the resurrection of the White House manifested for him an exclusive opportunity, still fraught with perils, …

American Policy Discourses On China: Two Centuries Of National Imagination And Constructed Reality, Yan Chang Bennett
Doctoral Dissertations and Projects
In the 2022 U.S. National Security Strategy (NSS), the United States government has declared that the world is at an inflection point in which there are tremendous challenges that the American people face with regard to their collective continuing security and prosperity. One of those challenges that the Biden administration has identified is the government of the People’s Republic of China (PRC), which, according to the NSS, “harbors the intention and increasingly, the capacity to reshape the international order in favor of one that tilts the global field to its benefit.” As the administration believes, The PRC threatens the U.S.-led …

The Relationship Between Young Adult Attachment And Loneliness Factors With Their Childhood Social Media Usage Patterns, Kenneth Walter Mark
Doctoral Dissertations and Projects
Social media use has become an integral and often ignored part of children’s lives because it is rationalized not to be detrimental to their future development. However, childhood social media use was associated with insecure attachment styles and possible loneliness issues emerging in young adulthood. Past research examined social media use and secular attachment in the present only, without examining spiritual attachment or loneliness levels. This is the first research study to explore longitudinally the relationship between past childhood social media use and current young adult (aged 18-24) secular attachment, spiritual attachment, and loneliness levels. The population (N = 149) …

The study focused on the experiences of vicarious trauma (VT), secondary traumatic stress (STT), compassion …
Communicating The Gospel Authentically: Message Transmission Between The Christian Music Artist And The Audience, Lindsey Montez Graham
Communicating The Gospel Authentically: Message Transmission Between The Christian Music Artist And The Audience, Lindsey Montez Graham
Doctoral Dissertations and Projects
This study seeks to establish that congruence between the Christian artist and the piece directly affects the process of Message Transmission. Artist authenticity and perceived artist authenticity are central to this study. Authentic expression must be believed in the heart and then confessed with the mouth (Romans 10:9–10; Matthew 12:34; Matthew 15:18). In the secular space there is an expectation for the artist to embody or emulate the performance piece temporarily while performing the song, but to not “be” the piece in life. In the Christian setting, however, the artist is communicating the means by which people should live their …

This study seeks to examine the extent to which non-Christian college students in Japan perceive their engagement with the biblical God while participating in daily chapel services at Kyūshū Lutheran College. The research employs a mixed-methods approach, analyzing survey and focus group data to explore whether a relationship exists between students’ participation in chapel committee activities and their perceived spiritual engagement. Responses to Lynn Underwood’s Daily Spiritual Experience Survey, the Centrality of Religiosity Scale, and the Centrality of Buddhist Religiosity Scale are combined to create a general spiritual profile of respondents. Worship leaders and missionaries who are in positions of …
Teacher Retention Crisis After Natural Disaster Trauma And A Global Pandemic, Kimberly Marie Jarrard
Teacher Retention Crisis After Natural Disaster Trauma And A Global Pandemic, Kimberly Marie Jarrard
Doctoral Dissertations and Projects
Natural disasters affect the communities of over one million students and educators in the United States every year; however, school-based preparedness and prevention programs are nearly non-existent across disaster-prone areas. School-based trauma intervention programs are somewhat present in schools; however, it is more expensive and at a cost, and most public school systems do not have funds readily available to spend. However, the price is more significant on the adolescents' and educators' mental health and communities affected when they are only treated reactively rather than proactively. There are many studies on the results and after-effects of trauma on the mental …

This qualitative media content analysis researches gratifications derived from sports podcast consumption by analyzing fifteen podcasts in three different categories: high-ranking, medium-ranking, and low-ranking. Through the qualitative content analysis of over 54 hours of podcast content, the emergence of four structural content elements that seem to foster and facilitate audience gratifications were identified. The implications of the findings of this …
Digital Habit Evidence, Andrew Guthrie Ferguson
Digital Habit Evidence, Andrew Guthrie Ferguson
Duke Law Journal
This Article explores how “habit evidence” will become a catalyst for a new form of digital proof based on the explosive growth of smart homes, smart cars, smart devices, and the Internet of Things. Habit evidence is the rule that certain sorts of semiautomatic, regularized responses to particular stimuli are trustworthy and thus admissible under the Federal Rules of Evidence (“FRE”) 406 “Habit; Routine Practice” and state equivalents.
While well established since the common law, “habit” has made only an inconsistent appearance in reported cases and has been underutilized in trial practice. But intriguingly, once applied to the world of …
Not So Civil Commitment: A Proposal For Statutory Reform Grounded In Procedural Justice, Margaret J. Lederer
Not So Civil Commitment: A Proposal For Statutory Reform Grounded In Procedural Justice, Margaret J. Lederer
Duke Law Journal
Every year, millions of Americans struggle with serious mental illness. Of them, thousands experience civil, or involuntary, commitment—that is, hospitals invoke the coercive power of the state to force these individuals into psychiatric hospitals against their will. Whether someone requires hospitalization is a complex question of psychology, medicine, and substantive law.
But the process of civil commitment itself is troubling. Across the board, states fail to afford those facing civil commitment meaningful procedural protections. Current state laws subject individuals facing commitment to extended periods of confinement with little to no judicial intervention. Indeed, individuals facing commitment may wait weeks or …
Prescribing A Change To The Fda's Drug Labeling Rules After The 21st Century Cures Act, P. Sydney Engle
Prescribing A Change To The Fda's Drug Labeling Rules After The 21st Century Cures Act, P. Sydney Engle
Duke Law Journal
Signed into law in 2016, the 21st Century Cures Act offers new hope to patients by empowering the FDA to expedite review of innovative, potentially lifesaving drugs. But these expedited approvals raise the risk that pivotal drug safety and efficacy data will not arise until after the drug is already on the market. The Cures Act failed to respond to two key aspects of shifting the discovery of safety and efficacy data to the postmarket phase. First, the Cures Act did not correspondingly enhance the FDA’s authority to require manufacturers to generate and disclose postmarket information. Second, it did not …
