The Global Rise Of International Commercial Courts: Typology And Power Dynamics, Weixia Gu, Jacky Tam
The Global Rise Of International Commercial Courts: Typology And Power Dynamics, Weixia Gu, Jacky Tam
Chicago Journal of International Law
Over the past decade, there has been a proliferation of International Commercial Courts (ICCs) across the globe. ICCs are specialized tribunals within the domestic court hierarchy tailored for the adjudication of complicated cross-border commercial disputes. Most ICCs share similar features, such as a set of flexible procedural rules comparable to those in international arbitration, multilingual court proceedings, and the recruitment of overseas judges or foreign legal experts.
The global phenomenon calls for a systematic comparative study of the different generations of ICCs and their power dynamics. This Article will offer a unique typological framework to study the evolution of ICCs. …

Helping Asylum Seekers And New Asylees Find Their Way In The United States, Kristin Briner
Children's Legal Rights Journal
People seek asylum in the United States (U.S.) when their home country is no longer safe due to persecution or other forms of violence. However, obtaining asylum is a notoriously complicated process due to the numerous government agencies involved, the immigration courts' backlogs, and the possibility of detention while awaiting a hearing. The current U.S. immigration system is itself a large barrier to individuals seeking asylum, and information regarding legal rights and protections are often inaccessible to asylum seekers. In this way, the U.S. immigration officials cause massive injustices against asylum seekers and those who have been granted asylum ("asylees"). …

Professional Speech At Scale, Cassandra Burke Robertson, Sharona Hoffman
Professional Speech At Scale, Cassandra Burke Robertson, Sharona Hoffman
Faculty Publications
Regulatory actions affecting professional speech are facing new challenges from all sides. On one side, the Supreme Court has grown increasingly protective of professionals’ free speech rights, and it has subjected regulations affecting that speech to heightened levels of scrutiny that call into question traditional regulatory practices in both law and medicine. On the other side, technological developments, including the growth of massive digital platforms and the introduction of artificial intelligence programs, have created brand new problems of regulatory scale. Professional speech is now able to reach a wide audience faster than ever before, creating risks that misinformation will cause …
Follow The Trails: A Path To Systematically Designing Corporate Alumni Programs, Alison Dachner, Erin Makarius
Follow The Trails: A Path To Systematically Designing Corporate Alumni Programs, Alison Dachner, Erin Makarius
2022 Faculty Bibliography
Organizations today are facing increasing amounts of turnover and evolving labor markets. When employees leave they become corporate alumni, which initial research suggests are an important and valuable part of an organization’s network. Corporate alumni can provide value as brand ambassadors, a source of employee referral, as a return employee (i.e. boomerang), or through knowledge sharing. One way to establish a strong network of alumni and achieve some of these benefits is to establish a corporate alumni program (CAP). Although CAPs are increasingly being recognized as beneficial for organizations, little is known about how to systematically design and implement these …

Mapping Meaningful Symptoms And Impacts Of Early Parkinson's Disease To Digital Outcome Measures, Jennifer R. Mammen, Et Al.
Mapping Meaningful Symptoms And Impacts Of Early Parkinson's Disease To Digital Outcome Measures, Jennifer R. Mammen, Et Al.
College of Nursing Faculty Publications
Background: Digital health technologies have the potential to capture fine variations in symptoms across a range of diseases. However, it is not clear whether these measures are meaningful to patients, which is critical to guiding the selection of digital endpoints.
Objective: This manuscript describes novel methodology for mapping meaningful symptoms and impacts of disease and assessing personal relevance of digital measures from the patient perspective. Methods: Participants with early Parkinson’s from the WATCH-PD study [NCT03681015] completed online surveys (N=65), with a subset recruited for 1:1 online video-interviews (N=40) to explore symptoms, impacts and perceived relevance of selected digital …
Immigration Public Defenders: A Model For Going Beyond Adequate Representation, Matthew Chang
Immigration Public Defenders: A Model For Going Beyond Adequate Representation, Matthew Chang
JCLC Online
What does adequate legal representation for noncitizen criminal defendants look like? After the Supreme Court decided the landmark case of Padilla v. Kentucky, criminal defense attorneys became responsible for advising clients if and when there might be immigration consequences that accompany acceptance of a guilty plea deal, such as a potential risk of deportation. Currently, the criminal and immigration representation are completely divided. This Comment argues that the Padilla mandate alone, while important, fails to adequately provide noncitizen criminal defendants their Fifth Amendment Due Process Right and Sixth Amendment Right to Counsel. Using the Supreme Court’s legal analysis in …

Traffickers’ Use Of Substances To Recruit And Control Victims Of Domestic Trafficking For Sexual Exploitation In The American Midwest, Erica Koegler, Claire Wood, Lilly Bahlinger, Sharon Johnston
Traffickers’ Use Of Substances To Recruit And Control Victims Of Domestic Trafficking For Sexual Exploitation In The American Midwest, Erica Koegler, Claire Wood, Lilly Bahlinger, Sharon Johnston
Social Work Faculty Works
This paper describes how traffickers use substances to recruit and control victims of domestic trafficking for sexual exploitation, as reported by service providers working with trafficking survivors in the American Midwest. This data was derived from interviews with 15 service providers in a major metropolitan area. Findings revealed consistencies with previous literature and new insights into the trafficker- substance use dynamic. Traffickers’ use of substances with victims was pervasive when trafficking was for the purpose of sex but not other labour. There were several examples of how traffickers use substances for victim exploitation and recruitment. These include using substances to …

Part 4: Virginia's Lawyers Confront Tougher Times, Dragas Center For Economic Analysis And Policy, Old Dominion University
State of the Commonwealth Reports
While movies and television shows portray lawyers as members of high society, with expensive cars and tastes, the reality is grittier. In 2021, more than 90% of law students took out a loan to enable them to pay their costs, and the typical law school graduate owed $165,000 in loans. The crucial point of this report, however, is that significant proportions of law school graduates are destined to be disappointed if they pursue a career in law believing they will earn lots of money. In this chapter, we explore the supply of lawyers in Virginia and whether we are producing …

State of the Region Reports: Hampton Roads
While movies and television shows portray lawyers as members of high society, with expensive cars and tastes, the reality in Hampton Roads is grittier. Between 2005 and 2021, lawyers’ real income in the region declined by more than 25%. In this chapter, we explore the supply of lawyers in Hampton Roads and whether we are producing too many lawyers for economic conditions in the region. We ask what the future may hold for the legal profession in Hampton Roads, Virginia, and the nation.
Applying Dialectical Behavior Therapy To Latinx Youth Experiencing Deportation Stress: A Critical Literature Review And Culturally Congruent Application, Desiree Curcio
Selected Full Text Dissertations, 2011-
Deportation policies from Immigration and Customs Enforcement (ICE) have harmful effects on the mental health of immigrant families in the US. These effects can be experienced at multiple points such as living in fear of deportation, undergoing ICE raids, becoming detained, or being deported. The children that witness these experiences of deportation within their families are impacted substantially. Some of the psychological effects of having a parent deported or detained can include internalizing and externalizing problems, attention difficulties, emotional and behavioral changes, interpersonal conflict, and feeling like a burden. While the impacts of deportation on youth are highlighted in the …

Integration Of Sexual Assault Nurse Examiners (Sane’S) Care Program, Erin B. Mehta
Integration Of Sexual Assault Nurse Examiners (Sane’S) Care Program, Erin B. Mehta
Theses and Graduate Projects
Sexual assault is a public health issue, especially for individuals experiencing homelessness, violence, and victimization. Barriers to post-sexual assault health care must be addressed to ensure individuals experiencing homelessness receive effective and adequate care. Traditionally found in Emergency Departments, Sexual Assault Nurse Examiners (SANEs) offer patient-centered, comprehensive health care to sexual assault survivors. To reduce barriers for individuals experiencing homelessness, SANEs must be accessible where health care services are utilized. Guided by Jean Watson’s Theory of Human Caring and trauma-informed principles, this project aims to embed a SANE program into a homeless-specific Midwest Health Care Center. The SANE program will …

Accomplishing Equity Under Amateurism: The Name, Image, And Likeness Stipend, Dylan Bobbitt
Campbell Law Review
There are approximately 160,000 student-athletes participating in NCAA-sanctioned sports. In order to preserve their status as amateurs, the NCAA has historically prohibited student-athletes from earning certain forms of compensation during college. Demand for college sports has grown exponentially over the last fifty years, and it has become a billion-dollar industry. Despite large revenues, student-athletes still face industry-wide limits on compensation. Considering recent precedent and the NCAA’s Interim Name, Image, and Likeness Policy of 2021, this Comment proposes a rule change permitting a college to provide student-athletes a stipend for its use of their name, image, and likeness in sports broadcasts. …
The American Security Drone Act: America's Paper Tiger Vs. China's Trojan Horse, Susan E. Upward
The American Security Drone Act: America's Paper Tiger Vs. China's Trojan Horse, Susan E. Upward
American University National Security Law Brief
The skies above America have been increasingly inundated with small unmanned aircraft systems (sUAS) operated by both government agencies and civilians alike. The majority of these drones are manufactured by Da-Jiang Innovations (DJI), a Chinese company that continues to emerge as a national security threat. The risk posed by these drones stems not only from physical access to American airspace, but also from the surreptitious transmittal of information back behind the “Great Firewall of China” via DJI mobile device applications. However, current pending legislation is inadequate to effectively counter this threat. Instead, the United States should take a more comprehensive …
