Toward A Feminism Without Scaffoldings: Mapping A Research Project, A Narrative From The Field, And A Draft Bill, Debarun Sarkar

Journal of International Women's Studies

The paper maps the site of a funded research project to understand how three knowledge articulations—harassment-knowledge, LGBTQ-knowledge, and intersectionality-knowledge—intersect in and around a research project and are produced, circulated, interrogated, and codified to note how intersectionality-knowledge effaces other possible articulations. The paper begins with an auto-ethnographic account of a Ford Foundation funded research project in India, led by key power-brokers of the LGBTQ+ movement, focusing on concerns of discrimination of non-normative genders and sexualities in India. The paper juxtaposes a Ford Foundation funded research project, a narrative from the fieldwork conducted for the project, and a draft of the Equality …

Tempering Our Expectations: Drinking, Smoking, And The Economy Of A Western Massachusetts Farmstead-Tavern, Laura E. Masur, Aaron F. Miller Feb 2022

Tempering Our Expectations: Drinking, Smoking, And The Economy Of A Western Massachusetts Farmstead-Tavern, Laura E. Masur, Aaron F. Miller

Northeast Historical Archaeology

Between 1800 and 1830, William Sanford and his family operated a tavern in Hawley, a hilltown in western Massachusetts. The establishment was located on the town’s common, adjacent to the community’s Congregational meetinghouse and several other taverns. At the initiative of the local historical preservation group the Sons and Daughters of Hawley, archaeologists, students, teachers, and community members excavated the tavern site between 2011 and 2014. Historical and archaeological research indicates that William Sanford’s homestead functioned not only as a tavern, but also as a farm, store, smithy, and occasionally a court of law. Material evidence of alcohol and tobacco …

These Kids Need Lawyers: Why And How The United States Must Provide The Right To Appointed Counsel For Detained Unaccompanied Children, Adrielli Ferrer

San Diego International Law Journal

Children throughout the world are fleeing home situations of violence and seeking safety in the United States. Some children begin their migration with their families, only to find that some family members do not survive the journey, while others are separated by the United States government upon arrival. Some children are so driven by fear and desperation that they flee without family at all. Alone in the United States, unaccompanied children are a hyper vulnerable population. Exacerbating matters, upon encountering law enforcement, they are locked and contained within “secure facilities,” or detention centers. What can be done to aid detained …

Nonlawyers In The Legal Profession: Lessons From The Sunsetting Of Washington's Lllt Program, Lacy Ashworth Feb 2022

Nonlawyers In The Legal Profession: Lessons From The Sunsetting Of Washington's Lllt Program, Lacy Ashworth

Arkansas Law Review

Today, the number of attorneys in the world fails to serve the number of people in need of legal assistance. Approximately sixty percent of law firm partners are baby boomers, meaning those in their mid fifties to early seventies, and twenty-five percent of all lawyers are sixty-five or older. These individuals will predictably retire. Meanwhile, law school costs more than ever. The average law student graduates $160,000 in debt only to enter into the legal profession with an average starting salary of $56,900 in the public sector and $91,200 in the private sector. It is no surprise law schools have …

State Leadership Vs. Lawyers' Entrepreneurship: The Globalization Trajectories Of Chinese Legal Professionals Under The Belt & Road Initiative, Jing Li Feb 2022

State Leadership Vs. Lawyers' Entrepreneurship: The Globalization Trajectories Of Chinese Legal Professionals Under The Belt & Road Initiative, Jing Li

Indiana Journal of Global Legal Studies

Based on the analysis of the online profiles of 205 BRI Talent Bank lawyers as accredited by China's national bar association, this article generates important empirical knowledge about the approaches and processes that a nation-state may use in directing the internationalization of legal professionals. In addition to designing the general roadmap and offering broad incentives, the state has demonstrated a much more handson approach. By collecting the so-called "state-adjacent" lawyers and commissioning them to take some concrete first steps stipulated in the roadmap, the Chinese state effectively envisions them as role models for other lawyers to follow to ensure that …

Battle Over Bus Ads: Rethinking Lehman And Speech Restrictions On Public Transportation, Scott Gutierrez Feb 2022

Battle Over Bus Ads: Rethinking Lehman And Speech Restrictions On Public Transportation, Scott Gutierrez

Washington Journal of Law, Technology & Arts

Public transportation systems carry millions of daily commuters and provide a valuable platform for display advertising. However, transit authorities that open their rolling billboards to speech may be hesitant to carry ads that offend riders and create conflicts with their mission of providing a safe and comfortable commuting experience. Advocacy groups have sued to overturn bans on controversial transit ads, prompting inconsistent rulings about whether such bans violate the First Amendment. These rulings rely on Lehman v. City of Shaker Heights, a divided Supreme Court decision from 1974 that held that the First Amendment did not require the Shaker …

Asia Marketing Journal

The aim of this paper is to expand upon previous research into the country of origin effect through the use of empirical data by formulating an analysis method which allows the measurement of the extent of country of origin effect by the proxy of K-pop musicians associated with country of origin image and to propose an alternative framework which provides an explanation as to the discrepancies between empirical data and prior research. Our analysis results reveal that the impact of country of origin associated with ‘PSY’ and ‘BTS’ on the automobile sales of ‘Hyundai Sonata’ was significant in the U.S. …
