The Productivity And Future Growth Potential Of Indonesia, Mohamad Ikhsan, Sri Mulyani Indrawati, I Gede Sthitaprajna Virananda, Zihaul Abdi Mar 2022

The Productivity And Future Growth Potential Of Indonesia, Mohamad Ikhsan, Sri Mulyani Indrawati, I Gede Sthitaprajna Virananda, Zihaul Abdi

Economics and Finance in Indonesia

The output per worker of Indonesia has been on a downtrend since 2010, with total factor productivity (TFP) and capital stock largely stagnant if not declining. This paper discusses stylized facts that may explain recent trends in the productivity and growth potential of Indonesia. The decomposition of output per worker reveals the declining contribution of human capital, which is also most negative among peer countries. The growth in labor productivity has been concentrated within sectors, implying room for gains from labor reallocations. A substantial share of employment and credit in Indonesia has shifted to the relatively unproductive service sectors, particularly …

Immigration E-Carceration: A Faustian Bargain, Mary Holper Mar 2022

Immigration E-Carceration: A Faustian Bargain, Mary Holper

San Diego Law Review

A new wave of federal court litigation has required immigration judges to consider alternatives to immigration detention in bond hearings. Although alternatives to detention can take many forms, the most common is electronic monitoring. Immigration detainees and their advocates now find themselves asking to trade the physical walls of jail for virtual walls, begging for a different type of punishment and control. Electronic monitoring imposes pain, shame, arbitrary rules, and limitation of freedom on persons, causing many to experience it as punitive. Its use also facilitates replacing a regime of over-detention with one of over-supervision and becomes the means by …

Multiservice Business And Social Mobility: Reform To Lift Community Leaders, Jared C. Nicholson Mar 2022

Multiservice Business And Social Mobility: Reform To Lift Community Leaders, Jared C. Nicholson

Denver Law Review

In 2020, Senator Elizabeth Warren launched her presidential campaign in Lawrence, Massachusetts—an economically struggling former mill city. F&M Multiservices was across the street from her press conference. Multiservice businesses pervade urban communities with large immigrant populations, providing a mix of multilingual services like tax preparation, travel, and translation. Multiservice businesses have long been viewed skeptically in legal literature as they are typically analyzed through the lens of immigration law and scrutinized due to legitimate concerns about fraud. This Article analyzes the value of multiservice businesses from the perspective of urban law and poverty law and argues that multiservice businesses like …

Reforming State Electoral College Laws To Depolarize American Politics, M. Akram Faizer Mar 2022

Reforming State Electoral College Laws To Depolarize American Politics, M. Akram Faizer

Cleveland State Law Review

Brnovich v. Democratic National Committee involved the Supreme Court gutting the remaining vestiges of the Voting Rights Act (VRA), such that jurisdictions will have free rein to impose partisan burdens on franchise rights that have a disproportionate negative effect on racial minority voters who, based on racial political polarization, prefer Democratic Party candidates over their Republican opponents. Brnovich follows the highly divisive 2020 presidential election that Joe Biden won against former President Trump based on very narrow margins in highly contested swing states, notwithstanding a nationwide popular margin of more than 8 million votes. This blurring of the lines between …

Addressing Labor Trafficking: The Next Step In The Anti-Trafficking Movement, Cassie Gardner-Wong Mar 2022

Addressing Labor Trafficking: The Next Step In The Anti-Trafficking Movement, Cassie Gardner-Wong

Denver Law Review

Modern human trafficking law is a new and emerging legal field in our country and across the world, and , and in Colorado, human trafficking law is less than ten years old. While the Colorado legislature takes its role in the anti-trafficking movement seriously and has reformed the law when it sees a need, the law is not perfect. The purpose of Colorado’s human trafficking statute—to protect victims and survivors of human trafficking—is not yet fully effectuated. Key reforms will elevate the ability of the anti-trafficking community to end this terrible crime. This Comment endeavors to define and contextualize human …

Online tools are needed to provide visibility to the status of projects and the accountability necessary to ensure that tasks are completed on time and on budget. Digital transformation of organizational data is now the target of AI projects to provide enterprise transparency and predictive insights into the process of work. In …

Digital Curb Cuts: Towards An Inclusive Open Forms Ecosystem, Quinten Steenhuis, David Colarusso Mar 2022

Digital Curb Cuts: Towards An Inclusive Open Forms Ecosystem, Quinten Steenhuis, David Colarusso

Akron Law Review

In this paper, we focus on digital curb cuts created during the pandemic: improvements designed to increase accessibility that benefit people beyond the population that they are intended to help. As much as 86% of civil legal needs are unmet, according to a 2017 study by the Legal Services Corporation. Courts and third parties designed many innovations to meet the emergency needs of the pandemic: we argue that these innovations should be extended and enhanced to address this ongoing access to justice crisis. Specifically, we use the Suffolk University Law School's Document Assembly Line as a case study. The Document …

Tele-Lawyering And The Virtual Learning Experience: Finding The Silver Lining For Remote Hybrid Externships & Law Clinics After The Pandemic, Lucy Johnston-Walsh, Alison Lintal Mar 2022

Tele-Lawyering And The Virtual Learning Experience: Finding The Silver Lining For Remote Hybrid Externships & Law Clinics After The Pandemic, Lucy Johnston-Walsh, Alison Lintal

Akron Law Review

The COVID-19 pandemic has rocked the world in innumerable ways. This article argues that the COVID-19 pandemic has a silver lining for law students in experiential learning programs. The pandemic has forced law schools across the country to fully utilize remote learning technology. The pandemic similarly forced courts to accept virtual tools in an environment that had previously relied primarily on in-person appearances. The lessons that law faculty and judges have learned from the pandemic will be permanent and may change the methods of operation going forward. Law schools that embrace the lessons they learned can help their law students …

Expanding Immigrant Justice By Training Professionals, Michele R. Pistone Mar 2022

Expanding Immigrant Justice By Training Professionals, Michele R. Pistone

Faculty Publications

As a law professor at Villanova University, I headed a clinic that helps hundreds of asylum seekers gain protection in the United States. On good days, I would remember the Talmudic saying, “whoever saves one life saves the world entire,” and take great pride in what my students and I were able to accomplish. On bad days, however, the fruits of our work could seem but a drop in the bucket, for every visit to immigration court demonstrated anew that our clients were the exception. Most immigrants face the immigration system without legal representation of any sort. This unfortunate and …
