When Beneficiaries Predecease: An Empirical Analysis, Adam J. Hirsch

Under current law, bequests to beneficiaries who predecease the testator “lapse” to the beneficiary of the residuary, unless they are preserved for the descendants of predeceased beneficiaries under an “antilapse” statute. The beneficiaries covered by antilapse statutes vary from state to state, but in most states today the statutes apply only to blood relatives of the testator as distant as first cousins. This Article examines the public policy of antilapse statutes, assessing them by undertaking the first-ever survey of popular preferences concerning the matter. Harvesting evidence for five types of beneficiaries, the study finds that the prevailing structure of antilapse …

By the beginning of the twentieth century, the development of better contraceptives and changing cultural attitudes led to an increased interest in contraceptive research. Although major political, legal, social, religious, and cultural obstacles remained, birth control advocates began to perform clinical trials to identify effective contraceptives and to disseminate contraceptive information. These trials began in the United States, but birth control advocates quickly introduced them into other areas. This Article examines the evolution of copyright law pertaining to collaborative authorship and finds that much of the core legal doctrine in this area arose from disputes involving dramatic works. This fresh look at theatrical collaborations reveals a rich history that calls into question the modem judicial presumption that dramatic writing is the product of individual genius. Examining the history of Anglo- American law's response to collaboration in dramatic works offers valuable insight into the development of multiple concepts related to authorship-in particular, the rules governing derivative works, works made for hire, and joint works. This thesis explores the role of independent film distributor NEON as a leading tastemaker in the American indie sector. Founded in 2017, NEON has distinguished itself from competing studios and streaming services by maintaining a commitment to the theatrical experience and to genres that Hollywood has been historically hesitant to embrace. Using Pierre Bourdieu’s concept of the ‘cultural intermediary,’ I analyze how NEON has demonstrated its viability within the indie sector through its promotional strategies, chosen avenues of distribution, and specific film products. Inner Martyrdom: Deconstructing The Sacrificial Female Subject In Post-Soviet Georgia, Gvantsa Gasviani

This article analyzes the 2017 film, My Happy Family, and how it depicts the archetypical Georgian woman and the sacrifices she is required to make for the family and, by extension, the nation. In doing so, I explore the socio-historical construction of the ideal woman and the ways women resist gendered demands, often through unseen means. Scholars have explored the cultural politics of “postsocialism,” analyzing the “New Woman” archetype in relation to class, sexuality, and labor. Finding that many neglect issues of women’s own socio-psychic negotiation of the postsocialist terrain, I argue that we must investigate more closely the production …

Ambient fungal spores within the atmosphere can contribute to a range of negative human, animal and plant health conditions and diseases. However, trends in fungal spore seasonality, species prevalence, and geographical origin have been significantly understudied in Ireland. Previously unpublished data from the late 1970s have recently been collected and analysed to establish historical fungal spore trends/characteristics for Dublin. Historical spore concentrations were largely dominated by Alternaria, Ascospores, Basidiospores, Botrytis, Cladosporium, Erysiphe and Rusts. The main fungal spore season for Dublin commenced in April with the fructification of Scopulariopsis and Ganoderma. However, the vast majority of other spore types did …

Many impoverished women struggled to raise their children without support in Fremantle, Western Australia, in the late nineteenth and early twentieth century. This thesis investigates how these women managed to provide for their children, and keep their families together, at a time when society expected women to be supported by men. The appalling living conditions in the slum areas of Fremantle, which often led to serious health issues that further impacted on women’s struggle for survival, are explored as well as how the denial of legal rights, and harsh community attitudes towards these women, exacerbated already difficult situations. As the primary ingredient in gunpowder, saltpeter was an extraordinarily important commodity in the early modern world. Historians of science and technology have long studied its military applications but have rarely focused on its uses outside of warfare. Due to its potential effectiveness as a fertilizer, saltpeter was also an integral component of experimental agricultural reform movements in the early modern period and particularly in seventeenth-century England. This became possible for several reasons: the creation of a thriving domestic saltpeter production industry in the second half of the sixteenth century; the development of vitalist alchemical theories that sought a unified …

The Katyn Forest Massacre is one example of an event where the recorded history and collective memory do not align. At times when events are misrepresented through media and intentional deception, those who remember what actually took place pass on the knowledge collectively, allowing a collective understanding that spites the historical record. These intersections are defining moments for national identity, where the image a state presents to the world conflicts with how their actions are actually perceived. This is true for Katyn. The Atlantic horseshoe crab, Limulus polyphemus, is a commercially, ecologically, and economically important species. Current management practices of this species may not be well informed enough to avoid jeopardizing the future health of these animals. This thesis argues that population differences, as defined by morphometrics, behavior, and genomics, may be visible over smaller geographic scales than current fisheries management observes. Specifically, this work focuses on three states in southern New England: Rhode Island, Massachusetts, and Connecticut. In this study, we investigate the spatial and temporal distribution of stable isotopes of oxygen and hydrogen in water across two mountainous catchments in west-central Montana to trace the input of snow to local soil, bedrock aquifers, and streams. Snowpack and snowmelt samples were collected throughout the winter season at ten sites selected to encompass a range of elevation, aspect, slope angle and hillslope position. Soil and bedrock wells at five of the ten sites were sampled after the initial snowmelt pulse and stream samples were collected weekly at the outlets of both catchments to trace the timing and partitioning …

Scholars are still unsure why American cities passed cross-dressing bans over the closing decades of the nineteenth century. By the 1960s, cities in every region of the United States had cross-dressing regulations, from major metropolitan centers to small cities and towns. They were used to criminalize gender non-conformity in many forms – for feminists, countercultural hippies, cross-dressers (or “transvestites”), and people we would now consider transgender. Starting in the late 1960s, however, criminal defendants began to topple cross-dressing bans.

This dissertation works to integrate the growth of regional tourism into the existing historiography of economic development in Appalachia and the postwar American South. Regional leaders introduced an economic transition throughout western North Carolina that emphasized the growth of regional tourism. By centering this study on the growth of regional tourism, this research also analyzes regional boosters’ efforts to manufacture and commodify a racialized and classed folk culture within the region for tourist consumption. Machine Infelicity In A Poignant Visitor Setting: Comparing Human And Ai’S Ability To Analyze Discourse, Martin Maccarthy, Hairong Shan

This study compares the efficacy of computer and human analytics in a commemorative setting. Both deductive and inductive reasoning are compared using the same data across both methods. The data comprises 2490 non-repeated, non-dialogical social media comments from the popular touristic site Tripadvisor. Included in the analysis is participant observation at two Anzac commemorative sites, one in Western Australia and one in Northern France. The data is then processed using both Leximancer V4.51 and Dialectic Thematic Analysis. The findings demonstrate artificial intelligence (AI) was incapable of insight beyond metric-driven content analysis. While fully deduced by human analysis the metamodel was …

About 300 m north of the Mar-Elias Monastery, near an ancient water reservoir, “Bir Kadismo” on the British survey map, three salvage excavations were conducted on behalf of the Israel Antiquities Authority in 1992, 1997 and 2000; another excavation was undertaken in 1999, in collaboration with the University of Athens and representatives of the Greek Orthodox Patriarchate of Jerusalem. Remains of a church with a unique octagonal plan were discovered, as well as buildings identified as the monastery to which the church belonged. A minimal, reasonably uncontroversial, demand of a legal system is that it should stabilize a polity against the chance hazards of ordinary violence and soften the blows of extraordinary, destabilizing misfortune. Law in the contemporary United States, however, has not abated the lethal toll of violent crime, the serial mass shootings of children, the endless flow of racialized police violence, or even the toll of insurrectionary violence that shadows democratic politics. Occupational stressors in police work are abundant, and high rates of attrition make the recruiting and maintaining of a qualified force challenging. The increased risks that overnight officers face with regard to their mental and/or physical health warrant further research to ensure that burnout does not interfere with officers’ well-being or performance. The purpose of this quantitative nonexperimental study was to examine whether sleep quality for police officers involved in shift work leads to burnout or the intention to leave law enforcement. This study explores the queer history of the University of North Dakota from 1980 to present day and demonstrates how LGBTQ+ student activism lead to the development of LGBTQ+ programs and services at the University. Situated in a socially and politically conservative state, the University of North Dakota provides an understanding of how LGBTQ+ students organized in the 1980s out of necessity to combat social opposition and discriminatory state legislation. The problem with the Westminster model is the model’s lack of governance, oversight and colonial mindset which has led to a crisis that includes severe government corruption, deepening poverty, upticks in crime, debt and decreasing trade opportunities. Elijah is among the most popular prophets in the Judeo-Christian tradition. In Judaism, the hope for his return has evolved into a plethora of legends in which he functions as a helper to the righteous in the present and avenger to the wicked in the future eschaton. In Christianity, the expectation involving his return has also a multitemporal dimension, but its fulfilment is typologically oriented. More often, scholars study the fulfilment of the Elijah typology from the NT perspective in a backward movement.
