Under the current wording of the federal removal statute, 28 U.S.C. § 1441, defendants in some jurisdictions may remove a state action to federal court before an in-state defendant is served. These defendants are taking advantage of the forum defendant rule in 28 U.S.C. § 1441(b)(2). This phenomenon has been coined “snap removals.” Three federal courts of appeals allow such removals, whereas many federal district courts say it is improper. Until recently, the State Department had a policy deeming children born abroad to married same-sex couples to be children born out of wedlock. Then, applying the statute for children born out of wedlock with more rigorous requirements, the State Department only allowed citizenship to pass through a biological relationship between the biological parent and the child.
Although the State Department updated this policy in May 2021 to allow for birthright citizenship of children born abroad to married same-sex couples, the new policy does not go far enough. This Note argues that Congress should amend the Immigration and Nationality Act to …

The movement to abolish slavery relied heavily on the exercise and protection of enslaved and formerly enslaved people’s freedom of speech against robust efforts to suppress their messaging. The same is true in the context of the movement to abolish immigration detention. For decades, people in immigration detention, formerly detained people, and their allies have exercised their First Amendment rights to expose the conditions of their confinement and demand their freedom. In response to their protests and other forms of individual and collective expression, detained and formerly detained immigrants have faced suppression and retaliation, threatening not only their right to …

The City of Philadelphia has addressed the need to utilize vacant lots in the city’s comprehensive planning document, Philadelphia2035 (PCPC, 2010). The document encourages designers to use sustainable practices to reincorporate these abandoned lots back into the fabric of the city. Through partnerships with local organizations in Philadelphia, guidelines and suggestions were created to guide Philadelphians while they revive abandoned lot spaces. In the neighborhood of Nicetown-Tioga, Philadelphia, there is a large amount of vacant lots leaving the area blighted and without resilience. Purpose: The purpose of this study was to investigate the impact of two educational environments (jigsaw learning activity and standardized patient encounters) on speech-language pathology students’ professional communication when assessing and treating a voice disorder case study. Jigsaw activities are cooperative learning experiences that provide students opportunities to learn from one another. Studies have shown that students have improvements in learning new material, self-confidence, and communication skills (Wong & Driscoll, 2008; Asif et al., 2021). Escherichia coli, a fecal coliform, is an essential component of water quality monitoring, entering waterways through sewage deposits, agricultural land and livestock, and wildlife. Various fast and user-friendly methods for quantifying E. coli make it the principal indicator bacteria for fecal contamination. The most common methods for E. coli quantification are culture-based and involve cultivating samples onto nutrient agar and counting the visible colonies. However, E. coli can enter a viable but non-culturable (VBNC) state in stressful environments. Bacteria in a VBNC state are still alive but reduce key metabolic activities that typically encourage growth and division, allowing them …

Purpose: Speech-language pathologists (SLPs) play an integral role in identification and treatment of developmental language disorders (DLD). Best practices include the use of language sample analysis (LSA) as part of a comprehensive evaluation. However, LSA requires a specific set of foundational morphological and syntactic knowledge. Previous studies have shown a knowledge gap for both SLPs and SLP graduate students for other areas of morphosyntax and phonology. The process of child disclosure of sexual abuse can be complex. Children often disclose abuse consistently across settings (continuous disclosure), though there is research to support that children may deny abuse or recant their allegations despite the abuse having truly occurred (London et al., 2008; Bradley & Wood, 1996; Malloy, Lyon, & Quas, 2007). In this study, data was collected from voluntary MTurk users (N = 688). This dissertation examines how perceived perspective taking relates to trust repair, specifically in the context of a benevolence-based violation. I draw on perspective taking theory, attribution theory, and the integrative model of organizational trust to explore a model of interpersonal trust repair. The extant literature on trust repair primarily focuses on violations of ability and integrity, leaving the third dimension of trustworthiness, benevolence, largely unexplored. Yet, research suggests as many as 96% of workplace employees have been victims of benevolence-based offenses, such as disrespect, condescension, or degradation. Diabetes is a chronic health condition that affects millions of Americans. It can have significant, lasting effects on an individual’s mental and physical wellbeing, especially when it goes unmanaged or untreated. Diabetes has been a growing problem in West Virginia (WV), which has the highest adult rate of diabetes at 15.7% in the US. Furthermore, WV has the highest mortality rate associated with diabetes at 36.2%. An effective method of management is through diabetes self-management education and support (DSMES). The recent Eighth Circuit ruling in Arkansas Times, LP v. Waldrip, a lawsuit revolving around an Arkansas state anti-discrimination bill, has been widely misreported and generally misunderstood. While the decision was actually very narrow, case-specific, and ripe for review, the misleading information presented to the public has led to speculation and fear that similar anti-discrimination legislation in dozens of other states might somehow be constitutionally deficient. Whereas previous literature reviews have concluded that people of color are underrepresented in psychological literature, the fields of counseling and counseling psychology have taken a clear affirmative stance with respect to human diversity. This study sought to evaluate the representation of people of color in four key journals across the 2000-2019 timespan: The Counseling Psychologist, Journal of Counseling Psychology, Journal of Counseling & Development, and Counselling Psychology Quarterly. Journal articles were coded for several variables, including focus on racial/ethnic minority (REM) groups and article content topics. Aim: To identify differential methylation related to prescribed opioid use. Methods: This study examined whether blood DNA methylation, measured using Illumina arrays, differs by recent opioid medication use in four population-based cohorts. We meta-analyzed results (282 users; 10,560 nonusers) using inverse-variance weighting. Results: Differential methylation (false discovery rate <0.05) was observed at six CpGs annotated to the following genes: KIAA0226, CPLX2, TDRP, RNF38, TTC23 and GPR179. Integrative epigenomic analyses linked implicated loci to regulatory elements in blood and/or brain. Additionally, 74 CpGs were differentially methylated in males or females. Purpose: The heterogeneous nature of measures, methods, and analyses reported in the aphasia spoken discourse literature precludes comparison of outcomes across studies (e.g., meta-analyses) and inhibits replication. Furthermore, funding and time constraints significantly hinder collecting test-retest data on spoken discourse outcomes. This research note describes the development and structure of a working group, designed to address major gaps in the spoken discourse aphasia literature, including a lack of standardization in methodology, analysis, and reporting, as well as nominal data regarding the psychometric properties of spoken discourse outcomes. As Yellowstone National Park celebrates its 150th anniversary as the first such park in the world, it is fascinating to rediscover the records of mountain men and and that the same features that enthrall modern visitors captivated them as well. “Sonder” is the realization that other people with whom we share the mortal coil have lived lives just as complex and wonderous as our own. Americans can no better appreciate this than when they stand in Yellowstone National Park today and marvel at the same grandeur mountain men witnessed two hundred years ago.

This article addresses the current state of gender-responsive human rights due diligence (GR-HRDD) standards and advocates for greater attention to be paid to women’s human rights in the due diligence process. The 2011 United Nations Guiding Principles on Business and Human Rights (UNGPs) created a global framework for recognizing, preventing, and addressing the risk of adverse impacts of human rights violations linked to business activities. The responsibility of businesses to respect human rights under the UNGPs includes implementing a human rights due diligence process. Disinvestment and associated property abandonment are defining features of many post-industrial legacy cities. While the reasons are varied and complex, racist law and policy are at the root. Though abandoned properties negatively affect an entire city, their effects usually disproportionately fall on neighborhoods of color. Law and policy have been major drivers of how such neighborhoods look and feel today. Because law and policy have been part of the problem, they are also a necessary part of the solution.

State medical boards (SMBs) protect the public by ensuring that physicians uphold appropriate standards of care and ethical practice. Despite this clear purpose, egregious types of wrongdoing by physicians are alarmingly frequent, harmful, and under-reported. Even when egregious wrongdoing is reported to SMBs, it is unclear why SMBs sometimes fail to promptly remove seriously offending physicians from practice. Legal and policy tools that are targeted, well-informed, and actionable are urgently needed to help SMBs more effectively protect patients from egregious wrongdoing by physicians.

Many combat-occupation veterans experience difficulty translating their military occupation to a civilian occupation after they leave the military. Veterans may struggle with military culture, self-leadership, health concerns, stereotypes, and employment barriers such as disability and underemployment. In this qualitative descriptive research study, the researcher analyzed the transition barriers U.S. combat-occupation veterans experienced when entering the civilian sector and workforce. The researcher interviewed six participants via Zoom using semistructured interview questions. Trust is an integral part of the healthcare experience. Patient trust is associated with treatment adherence, patient satisfaction, patients engaging in follow-up care, shared decision-making, and positive health-related outcomes (e.g., Gupta et al., 2014; Mohseni & Lindstrom, 2007; Musa et al., 2009; Tam, 2012; Thom, et al., 2004; Trachtenberg et al., 2005). There are several levels of trust discussed in the literature, including interpersonal trust and institutional trust.
