Is Investment Arbitration An Effective Alternative To Court Litigation? Towards A Smart Mix Of Litigation And Arbitration In Resolving Investment Disputes, Wanli Ma, Michael Faure

This article analyzes litigation and arbitration as commonly used methods for dispute resolution, more particularly between foreign investors and host states. It compares investor-state dispute settlement (ISDS) via investor-state arbitration with dispute resolution via domestic courts in the host state. The article adopts a goal-based approach for assessing the effectiveness of international adjudication and analyzes the extent to which the current ISDS system is aligned with its predetermined goals. The article starts by identifying four goals of ISDS: 1) fair and efficient dispute resolution, 2) norm compliance, 3) facilitating the objectives of the investment law regime, and 4) legitimizing the …

E-waste, short for electronic waste, is a term used to describe end-of-life electronic products. In recent years there has been a sharp rise in the demand for electronic products, and production has ramped up to meet the demand. A landslide of e-waste is being generated in tandem, exacerbated by increased global access to electronic devices, quickening innovation rates, and device obsolescence. On November 24, 2016, Colombia ended a half-century civil war with the Revolutionary Armed Forces of Colombia (FARC) with the signing of the Peace Accord. While there was hope that there would be a new era of peace and reconciliation, Colombia is consistently ranked as the most dangerous country in the world for human rights defenders. Since the late nineteenth century, debate has unfolded over the use of euthanasia and physician-assisted death to alleviate the suffering of individuals with medical illnesses. The controversy surrounding the issue persists and its implications are significant. While most countries prohibit Aid in Dying (AID), legalization of the practice has expanded globally in recent years. Canada and the United States (US) are two such jurisdictions that have expanded access to AID. For the past two decades, discourse on terrorism (both global and domestic) has been commonplace throughout the international sphere. Following the attacks on September 11, 2001, many nations have followed suit in launching counterterrorism operations to identify and prevent attacks by both radical groups and lone actors. While the common narrative has focused on “why” terrorist actors commit heinous acts and “how” to best prevent future incidents from emerging, it is important to analyze the legal nuances between prosecuting domestic versus international terrorists. Although the rate of childhood obesity seems to have plateaued in recent years, the prevalence of obesity among children and adolescents remains high. Childhood obesity is a major public health concern as overweight and obese youth suffer from many co-morbid conditions once considered exclusive to adults. It is now well demonstrated that abdominal obesity as measured by waist circumference (WC) is an independent risk factor for cardiovascular disease and metabolic dysfunction in youth. Cardiomyopathy is commonly observed in patients with autosomal dominant polycystic kidney disease (ADPKD), even when they have normal renal function and arterial pressure. The role of cardiomyocyte polycystin-1 (PC1) in cardiovascular pathophysiology remains unknown. PC1 is a potential regulator of BIN1 that maintains T-tubule structure, and alterations in BIN1 expression induce cardiac pathologies. We used a cardiomyocyte-specific PC1-silenced (PC1-KO) mouse model to explore the relevance of cardiomyocyte PC1 in the development of heart failure (HF), considering reduced BIN1 expression induced T-tubule remodeling as a potential mechanism. Asymptomatic bacteriuria (ASB) is the presence of bacteria in apparently healthy individuals. Although, the prevalence varies widely with age, gender, and the presence or absence of genitourinary abnormalities, the detection of pathogenic bacteria in urine constitutes firm evidence of infection. The objectives of this study were to isolate members of the family Enterobacteriaceae from urine samples of research participants, and to determine the antibacterial susceptibility and plasmid profiles of the isolates. Pekerja dapat mengalami stres, termasuk Tenaga Bantuan di Kantor Kesehatan Pelabuhan (KKP). Selama Pandemi COVID- 19, tenaga bantuan KKP melakukan pengawasan terhadap COVID-19. Ruminant production systems are major contributors to greenhouse gases emissions, with animal feeding practices being the main cause for methane and nitrous oxide’s release. Although feeding animals forages has been proven to be more sustainable, traditional ryegrass monocultures still require a lot of input (e.g., fertilisers and pesticides). Multi-species swards, consisting of different swards, such as grasses, forage legumes and herbs, need less management and fertiliser, produce more dry matter, and also add a variety of phytochemicals into the animal diet. Many countries around the world are beset by the democratic recession, and Southeast Asia is no exception to that. Series of events show that Southeast Asian electoral democracies are receding back to full authoritarianism, and such a phenomenon requires academic attention to investigate its pattern. This paper explores the impact of Chinese patronage on Southeast Asian democracy and argues that its economic and normative support of autocrats enable the continuation of an authoritarian turn in Southeast Asia. Excessive sugar-sweetened beverages (SSB) consumption and abdominal obesity have been independently linked to numerous disorders, including diabetes and elevated C-reactive protein (CRP). This study aimed to explore the association between SSB intake, abdominal obesity, and inflammation in normal and prediabetic adults. Sugar intake from SSBs was calculated from 24-h dietary recalls and further classified into non-, medium-, and high-intake. The status of non- and prediabetes was identified based on hemoglobin A1c level. Telemedicine has been proven to improve access to care. However, it is still not sure how a payment system can accommodate high-quality telemedicine services. This paper aims to study the available payment system to accommodate telemedicine with a focus on health services quality. We conducted a scoping review of the telemedicine payment system and telemedicine quality through the PubMed and CINAHL databases including primary research, literature reviews, and expert opinion, aside from policy documents. Spinal manipulation is recommended by clinical guidelines to treat low back pain. However, our understanding of how spinal manipulation alleviates pain and knowledge of the role that viscoelastic tissue properties play in the dampening of applied spinal manipulation forces in vivo is limited. Superficial and deep intramuscular pressures and applied forces were measured using miniature pressure catheters and a force transducer during low back spinal manipulation using a clinically available spinal manipulation device (Activator V) or a feedback motor in a deeply anesthetized animal model. Di Indonesia, masalah stunting masih menjadi fokus utama terkait isu di bidang kesehatan bagi pemerintah Indonesia. Dalam beberapa tahun terakhir, prevalensi stunting di Indonesia mengalami penurunan. Data dari Riset Kesehatan Dasar Tahun 2018 menunjukan terjadi penurunan kasus stunting dari 37,2% pada tahun 2013 menjadi 30,8% pada tahun 2018. Berdasarkan laporan dari The Global Cancer Observatory (GLOBOCAN) 2020, kasus terbaru kanker serviks di Indonesia sebanyak 36.633 jiwa (17,2%) menempati posisi kedua setelah kanker payudara dan menempati posisi ketiga penyebab kematian akibat kanker. Secara nasional hanya sebanyak 8,3% perempuan usia 30-50 tahun yang melakukan pemeriksaan dini kanker serviks melalui metode Inspeksi Visual Asam Asetat (IVA test) dan kanker payudara dengan Periksa Payudara Sendiri (SADARI). COVID-19 merupakan jenis penyakit menular baru yang sampai saat ini masih ditetapkan sebagai pandemi. Berbagai studi menyebutkan risiko kematian COVID-19 lebih tinggi pada kelompok lanjut usia terutama dengan riwayat penyakit penyerta. Ketersediaan rumah sakit dan laboratorium pemeriksa COVID- 19 yang tidak adekuat juga dapat memberikan pengaruh terhadap tingginya angka kematian COVID-19. Menurut Riset Kesehatan Dasar (Riskesdas) 2013, prevalensi stroke pada penduduk usia >15 tahun di Indonesia sebesar 7 permil dan mengalami kenaikan dari tahun 2007 yang sebesar 6 permil. Provinsi Daerah Istimewa Yogyakarta (DIY) menjadi provinsi dengan prevalensi stroke tertinggi kedua di Indonesia dan prevalensinya melebihi angka nasional yakni sebesar 10,3 permil pada tahun 2013. Ventilator Associate Pneumonia yang sering disingkat VAP adalah terjadinya pneumonia pada pasien yang telah terpasang ventilasi mekanik dengan menggunakan endotrakhea tube (ETT) dengan durasi penggunaan minimal 48 jam. Pneumonia terjadi karena infeksi nosocomial yang umumnya didapatkan dari penggunaan ventilator di rumah sakit. Seseorang yang mengalami stunting saat balita cenderung memiliki tubuh yang lebih pendek dan memiliki risiko efek jangka panjang, yaitu menderita penyakit kronis yang berkaitan dengan gizi, rentan terhadap penumpukkan lemak tubuh, serta berisiko menderita diabetes melitus karena resistensi insulin dan beberapa penyakit tidak menular seperti hipertensi dan stroke.
