Epistemology In Heterodox Economics?, Bret N. Bogenschneider
Epistemology In Heterodox Economics?, Bret N. Bogenschneider
SMU Science and Technology Law Review
The epistemology of Heterodox Economics has been described as a type of methodological pluralism where its relativism is taken as consistent with new versions of science. However, methodological pluralism has severe drawbacks as a means of inquiry. Whereas Economics is often understood in positivist terms as a closed set, Heterodox Economics includes additional concepts and methods. As an open set of ideas, Heterodox Economics is a means to doubt or to not-know and comprises Einfühlung or the creative intuition for the introduction of new ideas into the epistemology of Economics.
Where Black Lives Matter Less: Understanding The Impact Of Black Victims On Sentencing Outcomes In Texas Capital Murder Cases From 1973 To 2018, Jelani Jefferson Exum, David Niven
Where Black Lives Matter Less: Understanding The Impact Of Black Victims On Sentencing Outcomes In Texas Capital Murder Cases From 1973 To 2018, Jelani Jefferson Exum, David Niven
Saint Louis University Law Journal
The systemic disregard for Black lives in America was on full display when footage of a police officer kneeling on the neck of George Floyd went viral. Mr. Floyd’s resultant death set off protests declaring that Black Lives Matter throughout the nation and across the world. While national attention rightfully turned to demanding police accountability for undue violence, the prevailing conversation also incorporated at least a declared concern for addressing institutionalized racism within the criminal justice system and other American institutions. The term of the day became “antiracism.” With regard to police killings, the lesson is that police officers disproportionately …
Legislative Push Towards Supersession In Missouri: Why The State Attorney General Should Not Be Statutorily Granted Concurrent Jurisdiction With Locally Elected Prosecutors, Josef Nilhas
Saint Louis University Law Journal
There is a current trend of electing progressive or “reform-minded” prosecutors over “tough-on-crime” prosecutors in local elections across the country. Traditionally, prosecutors have possessed wide discretion over which cases to prosecute or not, and the law presumes that “prosecutors make discretionary decisions disinterestedly, unaffected by their own self-interest or the interest of others.” However, recently in Missouri, state officials have pushed for providing the state attorney general with concurrent jurisdiction over certain cases. In particular, the Missouri Senate passed a provision through an amendment to House Bill 2 (“HB2”) that would allow the State Attorney General to take over homicide …
Resisting The Siren Song Of Gross Receipts Taxes: From The Middle Ages To Maryland’S Tax On Digital Advertising-Abstract, Richard Pomp
Resisting The Siren Song Of Gross Receipts Taxes: From The Middle Ages To Maryland’S Tax On Digital Advertising-Abstract, Richard Pomp
Faculty Articles and Papers
A turnover tax, more commonly known as a gross receipts tax, has a long and sordid history. The tax has ancient roots, first appearing when economies were primitive and underdeveloped, with few alternatives for raising revenue. A turnover tax makes no pretense of taxing profits, income, consumption, wealth, or other bases that have come to be accepted as legitimate around the world. Instead, it taxes business activity, and is fundamentally different in concept, and inferior to, either a well-designed retail sales tax or a value-added tax.
Economists throughout the ages have nearly universally condemned turnover taxes; some even blame the …

Hanford Nuclear Site Cultural Resource Gis Analysis: A Case Study Investigating Pre-Contact Travel Networks And Site And Artifact Locations, Luciana R. Chester
Hanford Nuclear Site Cultural Resource Gis Analysis: A Case Study Investigating Pre-Contact Travel Networks And Site And Artifact Locations, Luciana R. Chester
All Master's Theses
This thesis uses Global Information Systems (GIS) to investigate travel networks and site locations on the Hanford Nuclear Site. I construct a spatially referenced base map of historical travel routes, compare amounts of areas with and without archaeological survey, and analyze the location of archaeological sites. Government Land Office maps (GLO’s) mapped trails between1860’s and 1890’s. GIS analysis helps calculate relative frequencies and the densities of site and artifact types within 2 km buffers along the Columbia River corridor and trails. Collaboration between agencies and tribes facilitates consultation on all matters related to Hanford, and shared management of data covering …
Racial And Ethnic Disparities Within Maternal Health, Nyrie Abdur-Rahim
Racial And Ethnic Disparities Within Maternal Health, Nyrie Abdur-Rahim
Research Days Posters 2022
There is a serious lack of effective measures being taken to address the issue of maternal mortality and morbidity disparities within the United States. Multitude of factors aid in the disproportionate quality of care received by racial and ethnic minority women compared to white women. In maternal health, there exists a clear disparity regarding the rates at which ethnic and racial minorities experience both death and lasting health outcomes pre- and post- natal. I analyze quantitative data in the existing literature to explain why disparities in maternal health persist. I highlight these aspects to bring attention to the lack of …

Regulating Noncompetes Beyond The Common Law: The Uniform Restrictive Employment Agreement Act, Stewart J. Schwab
Regulating Noncompetes Beyond The Common Law: The Uniform Restrictive Employment Agreement Act, Stewart J. Schwab
Indiana Law Journal
The common law has never treated a post-employment noncompete agreement between employer and employee like an ordinary contract. Rather, a court will enforce a noncompete only if it is reasonably tailored in time, geography, and scope of business to further a legitimate employer interest. Suppressing competition is an understandable but not legitimate interest.
While the common-law approach works well enough for some occupations, it is problematic for both workers and employers in many cases. It is a challenge for workers who don’t know about the noncompete until after starting work, for lowwage workers who are unlikely to have trade secrets …
Fruits Of Our Labor: Exploring The Impacts Of A Nonprofit Seed Bank On Indigenous Communities In The Southwestern United States, Rachel Mary Davis
Fruits Of Our Labor: Exploring The Impacts Of A Nonprofit Seed Bank On Indigenous Communities In The Southwestern United States, Rachel Mary Davis
Graduate Research Theses & Dissertations
This thesis explores the ways that the nonprofit Native Seeds/SEARCH, of Tucson, Arizona interfaces with Indigenous communities and the local seed and food systems in the Southwest United States. The thesis argues that Native seed and food sovereignty have different meanings for different Indigenous people, and that nonprofits working with Indigenous communities need to consider input from them when deciding how to catalogue, regenerate and sustain healthy grow outs for the future, especially in the light of climate change and drought.
Growing Meat On Plants: Using Intermediate Cbd-Rgd Fusion Proteins To Improve Bovine Satellite Cell Attachment On Cellulose-Based Scaffolds, Julian Cohen
Pitzer Senior Theses
Cellular agriculture is an emerging technology aiming to replace existing methods for animal agriculture with tissue engineering and cell culture-based technologies. Cultured meat falls within this purview, using a biomimetic approach to recreate animal muscle tissue through tissue engineering. In the attempt to diminish the necessity of animal-derived materials within this process, plant-based scaffolds can be used as a substrate upon which stem cells are cultured. Due to the unfavorable environment of cellulose for mammalian cell-surface proteins, the approach was taken of coating cellulose nanofiber films with a fusion protein composed of a cellulose binding domain (CBD) protein and the …
The Heirloom As Evidence: Investigating The Colonial Trace Preserved Within My Family’S Sandalwood Box, Olivia Meehan
The Heirloom As Evidence: Investigating The Colonial Trace Preserved Within My Family’S Sandalwood Box, Olivia Meehan
Pitzer Senior Theses
This paper accompanies my senior art exhibition Picturing the Colonial Trace. Pulling from a wide range of interdisciplinary scholars, I theorize the practice of critical white auto-ethnography through visual interrogations of family heirlooms. The heirloom as evidence holds within its form a colonial trace. I investigate this trace through my creative practice, revealing the environmental, economic, and interpersonal histories of the British colonization of the Indian subcontinent. My art disrupts my family’s narrative of a benevolent British Empire and redirects attention to the silences of my family archive. This thesis proposes a potential model for white scholars of Environmental …

The Struggle For American Public Space, Emma Martin
The Struggle For American Public Space, Emma Martin
Schultz-Werth Award Papers
In this paper, I delve into America's relationship with public space. Through literature review, critical analysis, and case studies, I answer the research questions: what is public space in America, and does it need to be improved? According to literature and experts, public space does not have a concrete definition; instead, it is a concept that evolves as people change and time passes; public space in 1890 was very different from public space in 2020. And in 2020, there has been a consensus by experts that public space is endangered by increased privatization and a disregard for public space's importance. …
Terrible Revolution: Latter-Day Saints And The American Apocalypse By Christopher James Blythe, Tona Hangen
Terrible Revolution: Latter-Day Saints And The American Apocalypse By Christopher James Blythe, Tona Hangen
BYU Studies
When a costume-clad man wielded a Captain Moroni “title of liberty” flag at the Capitol insurrection of January 6, 2021, it was a notable reminder that revolutionary end-times ideology has a long and evocative presence in the culture of The Church of Jesus Christ of Latter-day Saints and adjacent religions. Christopher Blythe’s timely and wide-ranging book explores these themes across time, geography, and even denominational boundaries. He defines apocalypticism both as a distinct Jewish- Christian scriptural literary form found in Hebrew and Christian texts and malleable perfectionist ideology embracing “catastrophic millennialism,” to borrow Catherine Wessinger’s coinage. In brief, apocalyptic rhetoric …
Mormon Studies: A Critical History By Ronald Helfrich Jr., Roger Terry
Mormon Studies: A Critical History By Ronald Helfrich Jr., Roger Terry
BYU Studies
This short but dense critical history of Mormon studies is unique in several ways. First, author Ronald Helfrich Jr. is a self-described “Gentile” scholar who spent “probably far too many years,” including a year as a visiting professor in the Department of Sociology at Brigham Young University, researching and writing this history. Second, the book is surprisingly thorough. I have been the editorial director at BYU Studies for the past sixteen years and thought I had a fairly decent grasp of Mormon studies, past and present, but Helfrich repeatedly describes the work of historians and other scholars with whom I …

When Goods Become Gods: Fractured Identities And The Call For Safe Spaces In Sports, Cynthia A. White, Elizabeth Bounds
When Goods Become Gods: Fractured Identities And The Call For Safe Spaces In Sports, Cynthia A. White, Elizabeth Bounds
Movement and Being: The Journal of the Christian Society for Kinesiology, Leisure and Sports Studies
What is the relationship between identity, idolatry, wholeness, and community? What are the ways in which sports culture bolsters or misdirects God-given identity? How can leaders in sports cultivate authentic, loving community that provides athletes safe spaces to explore and discern messages from the world and truth from God? In this paper, we will explore existential questions such as these. First, we will describe how identity is inherently physiological, psychological, social, and spiritual, developing subconsciously through explicit and implicit messaging. Then, we will explore the ways in which sports – organized play, human creation, and a good gift from God …

Mapping The Civil Justice Gap In Federal Court, Roger Michalski, Andrew Hammond
Mapping The Civil Justice Gap In Federal Court, Roger Michalski, Andrew Hammond
UF Law Faculty Publications
Unrepresented litigants make up a sizable and normatively important chunk of civil litigation in the federal courts. Despite their importance, we still know little about who these pro se litigants are. Debates about pro se litigation take place without sufficient empirical information. To help fill some of the gaps in our understanding of pro se litigants, this Article takes a new approach by mapping where pro se litigants live.
Using a massive data set of 2.5 million federal dockets from a ten-year period, we obtained addresses of non-prisoner pro se litigants. We then geolocated these addresses and cross-referenced that information …
Patterning Ecological Restoration After Weeds, Stephen L. Young, Erik P. Hamerlynck
Patterning Ecological Restoration After Weeds, Stephen L. Young, Erik P. Hamerlynck
United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications
The United Nations Decade on Ecosystem Restoration aims to prevent, halt, and reverse the degradation of ecosystems on every continent. Disturbances stemming from anthropogenic or natural causes make plant community restoration challenging. The introduction of fast-growing weeds that generate high biomass and produce copious seed is most threatening to plant communities. A paradigm shift in ecosystem restoration is needed that emphasizes traits and affected ecological processes similar to weeds. The repeated introduction of seed from native plants with weedy characteristics follows the propagule pressure and evolution of invasiveness hypotheses. In targeting areas with heavy weed populations, native plants could establish …

Accurate nitrogen (N) diagnosis early in the growing season across diverse soil, weather, and management conditions is challenging. Strategies using multi-source data are hypothesized to perform significantly better than approaches using crop sensing information alone. The objective of this study was to evaluate, across diverse environments, the potential for integrating genetic (e.g., comparative relative maturity and growing degree units to key developmental growth stages), environmental (e.g., soil and weather), and management (e.g., seeding rate, irrigation, previous crop, and preplant N rate) information with active canopy sensor data for improved corn N nutrition index (NNI) prediction using machine learning methods. Thirteen …
Schooled To The Streets? Exploring The Relationship Between K-12 Educational Experiences And Early Careers In Activism, David Abraham Castro
Schooled To The Streets? Exploring The Relationship Between K-12 Educational Experiences And Early Careers In Activism, David Abraham Castro
Dissertations
Since the late eighteenth century, organizing and activism have been part of the urban landscape, from the labor organizing of Eugene Debs in the early twentieth century to the community organizing work of Saul Alinsky during the 1950s and 1960s. The development of community organizers is strongly tied to local institutions such as factories, houses of worship, and schools. For many youths in Chicago, schools often become the sites of political and social awakening and lead to activism beyond the schoolhouse. Within the current context of urban education scholars, practitioners, policymakers, and community organizers alike agree that the perspectives of …

The Unexpected Consequences Of Automation In Policing, Elizabeth E. Joh
The Unexpected Consequences Of Automation In Policing, Elizabeth E. Joh
SMU Law Review
This Article has two aims. First, it explains how automated decision-making can produce unexpected results. This is a problem long understood in the field of industrial organization, but identifying its effects in policing is no easy task. The police are a notoriously difficult institution to study. They are insular, dislike outsiders, and especially dislike critical outsiders. Fortunately, we have the benefit of a decade’s worth of experimentation in police use of automated decision-making and the resulting political backlash against some of these uses. As a result, some large urban police departments have undergone external investigations to see whether tools like …
