The Implementation Of The Rights To Self-Determination Of Aymara And Quechua Indigenous Peoples: An International Normative Response To The Spanish Conquest Of Tawantinsuyu, Yuri G. Mantilla

Emory International Law Review

Contrary to ethnocentric views of law, this Article proposes an inter-civilizational perspective of international law. This perspective provides an analytical tool to understand the importance of preserving and empowering diverse cultures and peoples. In a globalized world, there is an increasing recognition of the contributions of diverse cultures and nations, including indigenous, to the economic development and the cultural heritage of humankind. The Article focuses on the importance of the resolution of a historical and ongoing ethnic conflict between the people of Tawantinsuyu, especially the Quechua and Aymara, and the descendants of Spanish conquistadores who continue to pursue policies to …

Private Equity And Venture Capital In Germany: How Europe’S Heartland Is Poised To Become The Next Bay Area, Jake Besanceney Jan 2022

Private Equity And Venture Capital In Germany: How Europe’S Heartland Is Poised To Become The Next Bay Area, Jake Besanceney

Northwestern Journal of International Law & Business

Abstract

This note examines the current state of private equity and venture capital activity and investment in Germany, and specifically in Berlin, in relation to the state of such activity and investment that existed in the San Francisco Bay Area prior to and following its tech explosion in the late twentieth century. Numerous factors such as political and ethnic diversity, a comparatively lower cost of living, and proximity to higher education institutes are propelling Berlin’s startup and tech scenes, and are eerily reminiscent of similar factors that fueled the Bay Area’s growth and attracted private equity and venture capital activity …

The Disaster Chain: Counter-Mapping Global Value Chains, Peer Zumbansen Jan 2022

The Disaster Chain: Counter-Mapping Global Value Chains, Peer Zumbansen

Northwestern Journal of International Law & Business

Abstract: Prevailing accounts by consultancies and logistics scholars present global value chains [GVCs] as an expression of contemporary international economic integration and connectivity. As such, they are considered crucial to the pursuit of economic growth and prosperity. At the same time, GVCs are deemed susceptible to “disruptions” through natural catastrophes, restrictive trade policies or pandemics. Left out of the standard narratives, even in light of the experience of the global Coronavirus pandemic, is the actual, as such disruptive impact of global value chain capitalism on human and natural lives. Dominant depictions of global value chain governance treat labor, environment and …

Locked Up And Locked Down In The Land Of Free: A Look At The United States' Prisons And Covid-19'S Disproportionate Effect On Black Americans' Right To Health, Zachary Parrish Jan 2022

Locked Up And Locked Down In The Land Of Free: A Look At The United States' Prisons And Covid-19'S Disproportionate Effect On Black Americans' Right To Health, Zachary Parrish

American University International Law Review

The United States is infamous for having a large percentage of its population in prison. Each year since 2002, the United States has reported a higher incarceration rate than any other country in the world. Another unfortunate but widely prevalent issue that the United States has is systemic racism. The combination of the United States’ struggles with systemic racism and mass incarceration makes for a disproportionately devastating impact on Black Americans. As a result, Black Americans make up a disproportionate amount of the prisoners that fill American prisons.

Struggling For Security: The Complexity Of Nato Burden-Sharing, Tad Schnaufer Ii Jan 2022

Struggling For Security: The Complexity Of Nato Burden-Sharing, Tad Schnaufer Ii

Electronic Theses and Dissertations, 2020-2023

Since the founding of the North Atlantic Treaty Organization (NATO), US administrations have criticized their European allies for not meeting security burden-sharing goals. This study aims to gain insight into what factors motivate alliance members to contribute to the burden-sharing objectives they have agreed to achieve. From a US perspective, the need for its European allies to reach these goals will allow the United States to shift resources to more pressing strategic challenges like the rise of China. Informed by Mancur Olson's theory of collective action and Glenn Snyder's concept of the security dilemma in alliances, this project tests the …

Persecution And Labor Migrations Due To Corporate “Environmental” Exploitation: Waiting For The Unhrc’S Binding Treaty On Transnational Business Activities?, Riccardo Vecellio Segate Jan 2022

Persecution And Labor Migrations Due To Corporate “Environmental” Exploitation: Waiting For The Unhrc’S Binding Treaty On Transnational Business Activities?, Riccardo Vecellio Segate

Loyola University Chicago International Law Review

Policy debates on the rights and international status of climate refugees, environmental migrants, or environmentally displaced persons have unleashed detailed scholarly commentaries over the last decade, and virtually all standpoints have been scrutinized in literature already. Nevertheless, one aspect of this debate has gone somewhat off the radar in recent years: the (co-)responsibilities of incorporated subsidiaries of transnational corporations in triggering or exacerbating pseudo-environmentally motivated mass-movements of workers and related strata of the populations domiciled where these corporations operate. Despite such neglect, mentioned exploitative occurrences only increased in recent years, and the trend speaks for their further expansion …

Outside Literary Studies: Black Criticism And The University, Andy Hines Jan 2022

Outside Literary Studies: Black Criticism And The University, Andy Hines

Staff Scholarship

This striking contribution to Black literary studies examines the practices of Black writers in the mid-twentieth century to revise our understanding of the institutionalization of literary studies in America. Andy Hines uncovers a vibrant history of interpretive resistance to university-based New Criticism by Black writers of the American left. These include well-known figures such as Langston Hughes and Lorraine Hansberry as well as still underappreciated writers like Melvin B. Tolson and Doxey Wilkerson. In their critical practice, these and other Black writers levied their critique from “outside” venues: behind the closed doors of the Senate Permanent Subcommittee on Investigations, in …

Listening To The Unheard: Perceptions, Goals, And Challenges Of Latinx Small Business Owners In Suburban Cook County, Kendra Shaw

Capstone Projects – Politics and Government

This applied research project examines the perceptions, goals, and challenges Latinx small business owners face when participating in daily business activities and attempting to access resources. Through nine in-depth interviews with business owners in Berwyn, Illinois, and personal observations and professional discussions, this capstone identifies critical barriers, such as: language, “missing links” to resources, exclusionary marketing practices, and weak connections to financial institutions and governmental entities. In response, this study offers recommendations to economic development organizations, chambers of commerce, city governments, and business communities. Specifically, entities need to embrace inclusive marketing practices, design financial programs through a more equitable lens, …

Armed Conflicts, Hiv Testing, Hiv Prevalence, And High-Risk Sexual Behaviors: An Epidemiologic Analysis, Aissatou Thilo Ba Jan 2022

Armed Conflicts, Hiv Testing, Hiv Prevalence, And High-Risk Sexual Behaviors: An Epidemiologic Analysis, Aissatou Thilo Ba

MUSC Theses and Dissertations

Armed conflicts have a wide array of consequences on health and behavior possibly serving a role in the spread of HIV, yet there is limited research on the quantitative association between armed conflicts and HIV. To address this gap in the literature, we evaluated the effect of armed conflicts on HIV testing, HIV prevalence, and high-risk sexual behaviors, using Demographic and Health Surveys data from 11 countries in Sub-Saharan Africa (years 2010 to 2018) and the Armed Conflict Location & Event Data. We hypothesized that armed conflicts, measured using number of conflict days, fatalities, or distance to nearest conflict, would …

Successful Ethical Reporting Strategies In The Technology Industry, Frances Aida Billingsley Jan 2022

Successful Ethical Reporting Strategies In The Technology Industry, Frances Aida Billingsley

Walden Dissertations and Doctoral Studies

AbstractTechnology employees can feel restricted if there is an inability to report unethical behaviors safely, resulting in disengagement and reduced work performance. Technology managers need effective, ethical reporting strategies to improve work performance. Grounded in stakeholder theory, the purpose of this multiple case study was to explore the ethical reporting strategies that three technology managers used to improve work performance in New Jersey. The data sources were semistructured interviews and company documents from the companies’ websites, annual reports, professional association biographies, and the LinkedIn profiles of participants. The three primary themes that emerged using thematic analysis were documenting incidents immediately, …

Comparative Effectiveness Study Of Acute Ischemic Stroke Care Between Stroke Belt And Non-Stroke Belt Hospitals Using The Get With The Guidelines-Stroke Program, Michael Earl Brown Jr Jan 2022

Comparative Effectiveness Study Of Acute Ischemic Stroke Care Between Stroke Belt And Non-Stroke Belt Hospitals Using The Get With The Guidelines-Stroke Program, Michael Earl Brown Jr

Walden Dissertations and Doctoral Studies

Stroke is a leading cause of mortality in the United States, particularly in a cluster of states termed the stroke belt. This study examined the efficacy of the Get With The Guidelines (GWTG)-Stroke program in stroke belt hospitals (SBHs) compared to non-stroke belt hospitals (NSBHs) regarding disparities related to mortality and acute ischemic stroke (AIS) treatment (i.e., recombinant tissue-type plasminogen activator [r-tPA] rates, Door-to-Needle [DTN], Door-to-Imaging [DTI]). Use of the GWTG-Stroke program was assessed to determine if SBHs and NSBHs were quantitatively equivalent in terms of specific core stroke measures. This quantitative employed an equivalence study design with over 2.9 …

A Refugee Resource Guide 2022, Kerri Ullucci

Education Faculty Publications

Rhode Island has long hosted refugees from around the world. Schools in RI, particularly those in Providence, currently enroll hundreds of refugee youth. After spending a semester conducting research and teaching in a school that serves refugee youth, it became clear that explicit teacher training about this population rarely occurs. This guide seeks to provide resources in which to address this need.

At Roger Williams University, I teach courses in our Education programs about race, class, and culture. My professional research centers on the same topics. While on sabbatical, I created several documents for the principal I worked with, to …

Symposium: Can Intellectual History Be Done Otherwise?, Mohamed Arafa, Shahzad Bashir, Nader El-Bizri, Nauman Faizi, Lena H. Salaymeh

Faculty & Staff Publications

Using Shahzad Bashir’s open-access publication A New Vision for Islamic Pasts and Futures as a baseline, this symposium debates whether and how intellectual history can be done otherwise. Mohamed ‘Arafa follows Bashir’s invitation to explore the potential of open-ended historiographies when he thinks about the viability of a flexible method to interpret Sharī͑a. Nader El-Bizri interrogates whether the assemblage of personal experiential accounts offered by Bashir can be framed within the discourse of intellectual history at all. Nauman Faizi reads Bashir’s approach as a radical attempt to open up hermeneutical possibilities. Lena Salaymeh suggests that modern aesthetics can contribute to …

Distributional Consequences And Regulatory Analysis, Richard L. Revesz, Samantha P. Yi Jan 2022

Distributional Consequences And Regulatory Analysis, Richard L. Revesz, Samantha P. Yi

Faculty Articles

Distributional analysis has been a formal part of the regulatory state since 1993, when President Clinton directed agencies to consider the distributional consequences of significant regulations alongside the cost-benefit analysis of these regulations. President Obama reaffirmed and somewhat expanded this commitment. And both Presidents Clinton and Obama expressed particular concerns with distributional consequences in the environmental area, underscoring their respective commitments to environmental justice. Despite the undoubtedly good intentions embodied in these pronouncements, the analysis of the distributional consequences of regulations has never gotten off the ground. Unlike cost-benefit analysis, it has not become a meaningful part of the analysis …

Water Disconnection And Billing Policy In Central Illinois, Melissa Heil, Rebekah Bollin, Luke Gallagher Jan 2022

Water Disconnection And Billing Policy In Central Illinois, Melissa Heil, Rebekah Bollin, Luke Gallagher

Faculty Publications - Geography, Geology, and the Environment

Over ten percent of American households face unaffordable water bills. When households have overdue bills, they are usually subjected to service disconnection by the water utility. Water disconnection policy is set at the local level, which can result in spatial variation with respect to how lenient or strict disconnection policies are. Examining the case of the central Illinois region, this paper introduces a methodology for 1) chronicling this variation and 2) analyzing which populations are most affected by strict billing and disconnection policies.

Men Who Conquered & The Women Who Mov'd Them, Nikita Chinamanthur Jan 2022

Men Who Conquered & The Women Who Mov'd Them, Nikita Chinamanthur

Scripps Senior Theses

Considering John Dryden’s Aureng-Zebe and Christopher Marlowe’s Tamburlaine the Great, this thesis examines how drama shaped popular ideas of the Indian subcontinent in Renaissance England. This thesis engages in a comparative analysis of formal choices such as doubling, tripling, and etymology to assess the efficacy of two incomplete portrayals of South Asia configured as women.
