The Persistent Objector Doctrine: Identifying Contradictions, Shelly Aviv Yeini
The Persistent Objector Doctrine: Identifying Contradictions, Shelly Aviv Yeini
Chicago Journal of International Law
The persistent objector doctrine (POD) in international law provides that a rule of customary international law (CIL) will not oblige a state that has persistently objected to the development of the rule. The doctrine requires that the objection be “persistent” and “consistent” and that it not be contradictory. Yet, while in this context the meaning of persistency and consistency, in this context, has been discussed in the legal literature, the term “contradiction” has not. Therefore, it is not clear what type of behavior would represent a contradiction that would disqualify a state from persistent objector (PO) status. In practice, this …

What Is Research Development? A Nord Invited Opinion Piece, Kimberly Eck, Joshua Roney
What Is Research Development? A Nord Invited Opinion Piece, Kimberly Eck, Joshua Roney
Research Development Repository
Multiple definitions of Research Development (RD) have been offered in peer-reviewed literature, gray literature, an in public settings by RD researchers and thought leaders. Definitions often identify specific activities performed by RD professionals also referred to as RDers, whereas the authors of this work offer the following definition of Research Development for the purpose of communicating with a broad audience: Research Development is a function that seeks to grow research or increase the research reputation of an institution. The authors find this description sufficiently broad to capture the majority of activities RDers perform, reasonably succinct and devoid of jargon, and …

Whose Policy Is It Anyway? Public Support For Clean Energy Policy Depends On The Message And The Messenger, Emily Diamond, Jack Zhou
Whose Policy Is It Anyway? Public Support For Clean Energy Policy Depends On The Message And The Messenger, Emily Diamond, Jack Zhou
Communication Studies Faculty Publications
Environmental policy advocates are increasingly proposing ‘bundled’ clean energy policies to combat climate change while also creating jobs and transforming the economy. While such strategies may broaden the appeal of climate policies, these broad constituencies create challenges for policy communicators – how do messages about different aspects of the policy, coming from different messenger groups, influence public support for clean energy policies? This study uses a modified conjoint survey experiment (n = 2145) to test how the interaction between message frames (addressing climate change vs. creating jobs) and sources (business, environmental, or labor groups) influenced policy support for clean energy …
Building A Global Community: An Intercultural Communication Perspective, Guo-Ming Chen
Building A Global Community: An Intercultural Communication Perspective, Guo-Ming Chen
Communication Studies Faculty Publications
Built on the author's previous work, this paper lays down a theoretical framework for building a global community from an intercultural communication perspective. The rapid development of new media in recent decades has accelerated globalization and transformed human society into a highly interconnected place through changing the way people think and interact. This indicates that a global society is gradually emerging due to the convergence of new media and globalization trend in the 21st century. However, the emergence of a global society does not necessarily mean that a new sense of community will follow. This paper calls for using "community" …

Could Joseph Smith Have Drawn On Ancient Manuscripts When He Translated The Story Of Enoch?: Recent Updates On A Persistent Question, Jeffrey M. Bradshaw, Ryan Dahle
Could Joseph Smith Have Drawn On Ancient Manuscripts When He Translated The Story Of Enoch?: Recent Updates On A Persistent Question, Jeffrey M. Bradshaw, Ryan Dahle
Interpreter: A Journal of Latter-day Saint Faith and Scholarship
In this article, we offer a general critique of scholarship that has argued for Joseph Smith’s reliance on 1 Enoch or other ancient pseudepigrapha for the Enoch chapters in the Book of Moses. Our findings highlight the continued difficulties of scholars to sustain such arguments credibly. Following this general critique, we describe the current state of research relating to what Salvatore Cirillo took to be the strongest similarity between Joseph Smith’s chapters on Enoch and the Qumran Book of Giants — namely the resemblance between the name Mahawai in the Book of Giants and Mahujah/Mahijah in Joseph Smith’s Enoch account. …

A Brown Buffalo’S Observations On Color(Blindness), Legal History, And Racial Justice In The Rocky Mountain West, Tom I. Romero
Sturm College of Law: Faculty Scholarship
This essay is a series of three observations about interrogating and complicating the meaning of color for all of us who call the Rocky Mountain West home. Published as part of the University of Utah Law Review’s annual symposium asking legal academics and law practitioners to 'tell our stories', this essay is designed to highlight the importance of racial consciousness in the legal geography of the Rocky Mountain West. These observations are divided into three reflections. In the first, I explore what has long been the defining feature of race relations in the Rocky Mountain West—the persistent tension between the …
The Color Of Local Government: Observations Of A Brown Buffalo On Racial Impact Statements In The Movement For Water Justice, Tom I. Romero
The Color Of Local Government: Observations Of A Brown Buffalo On Racial Impact Statements In The Movement For Water Justice, Tom I. Romero
Sturm College of Law: Faculty Scholarship
This article is rooted larger racial justice conversations that became amplified in 2020 as the United States, and indeed the world, was literally and figuratively on fire as the interconnected pandemics of COVID-19, racial violence, and climate change-induced wildfires raged. These interconnected disasters helped reveal the ways that racial and ethnic minoritized communities disproportionately bore the brunt of economic dislocation, deadly health outcomes, and physical dislocation. For many local and state government entities, particularly those in the water sector, it also catalyzed a response to be more diverse, equitable, inclusive, and indeed color-conscious in service of racial and social equity …

State of the Region Reports: Hampton Roads
Hampton Roads is known for its relationship with water. For some, it is too much water in the wrong place at the wrong time. For others, it is how water can transform lives. Hampton Roads is home to several premier swimming organizations, and Hampton is opening a state-of-the-art aquatics facility. We explore how swimming is intertwined with the history of the region and the economic impact of the sport on the economy and lives of the region’s resident
The Criminal Justice System And The Lgbtq Community: An Anti-Queer Regime, Steven Peck
The Criminal Justice System And The Lgbtq Community: An Anti-Queer Regime, Steven Peck
Themis: Research Journal of Justice Studies and Forensic Science
The LGBTQ community in the US, while experiencing great strides in social equality, continues to suffer disproportionately in the criminal justice system. Historical precedents of criminalizing the LGBTQ community are rife within the criminal justice system; the establishment of anti-sodomy laws, belief of inherent criminality, and a heteronormative perspective have all fostered a greater anti-queer regime. The criminalization and incarceration of the LGBTQ community remain steadfastly in place, with little to no reprieve. Establishing a new narrative in the criminalization and imprisonment of the LGBTQ community may assist in efforts to achieve real change within the criminal justice system. Moving …

In Search For A Truer Sense Of Experience: Two Approaches In Roberto Bolaño’S Storytelling, Sofia Jimenez
Theses & ETDs
This thesis builds its arguments on a short reading of the translated short-story collection, Last Evenings on Earth, by Roberto Bolaño. In my first chapter, I examine aspects of the author’s life as presented through non-fictional works to make clear the ideologies that are reflected in his narrative material. The second chapter elucidates on exile as an aesthetic concept and historical condition of the self, I understand this as a framework to interpret the set of short stories by Roberto Bolaño. I describe the visual components of the narration, the narrative structure, and the links they tend with the author’s …

Newly Assertive Authoritarian Regimes And Personalist Bias: Examining Investment As A Foreign Policy Choice By Major Authoritarians, 2000-2019, Dmitriy Passioura
Theses & ETDs
The stereotypical view of how authoritarian regimes operate has changed in the last few decades since the end of the 20th century. Personalist regimes have become much more common; however, not as much information exists on how they operate compared to other authoritarian regime types. Personalist regimes have seemingly gotten a biased level of investment from major authoritarian powers in the past few decades, despite arguably more significant threats of instability. This research project intends to understand whether major authoritarian powers, in this case China and Russia, have a bias for personalist regimes in allocating their foreign direct investment. A …
Indigenous Aesthetics And Post-Revolutionary Nationalism: Defining Mexicanidad Through The Popular Arts And The Best-Maugard Method, Katie Margerison
Indigenous Aesthetics And Post-Revolutionary Nationalism: Defining Mexicanidad Through The Popular Arts And The Best-Maugard Method, Katie Margerison
Theses & ETDs
After the Mexican Revolution ended in 1920, President Álvaro Obregón (1920-1924) enacted a national reconstruction plan that aimed to establish a unified national identity through visual culture. The plan foregrounded efforts toward the cultural inclusion and integration of Mexico’s substantial yet marginalized indigenous population. Through a variety of government-sponsored events, initiatives, and educational programs related to the visual arts, Obregón sought to unify the nation by promoting indigenous culture as integral to Mexican identity. In this thesis, I examine the key ways in which Obregón’s administration was involved in popularizing indigenous aesthetics and integrating them into modern Mexican culture, while …
The Contention About Protection: Legal Status Of Protracted Refugees In Jordan, Bangladesh, India, And Kenya, Sierra Lamb
The Contention About Protection: Legal Status Of Protracted Refugees In Jordan, Bangladesh, India, And Kenya, Sierra Lamb
Theses & ETDs
The trend of international refugee crises lasting longer and longer leads to additional concerns and strains for host countries. Not only that, but long-term refugeehood creates continued dependence on the host nation and bars access to most durable solutions. One way to move from dependency to self-sufficiency for these refugees is to obtain a legal status that allows them to engage with their host society in a meaningful way. This study posits that the status of protracted refugees in a host state is to some degree dependent on the origins of the crisis (ethnic cleansing versus civil war) and on …
Teaching Statistics Through Mobile Applications, James Zinn
Teaching Statistics Through Mobile Applications, James Zinn
Theses & ETDs
This thesis presents the processes and results of a student’s research and the introductory statistics educational videos that were produced as a result. The goal of this thesis was to better understand the usage of third-party media in different classrooms teaching styles, and to create functional videos to assist entry-level students in learning new statistics concepts. Research was done prior to recording, and shed light on the reality that while unnecessary in the classroom, alternative apps or media provide a novelty to the class, enhancing the learning experience for all levels of students. With a background in video production, the …
The Case For Reproducibility: A Series Of Political Behavior Replications, Sarah Mcnitt
The Case For Reproducibility: A Series Of Political Behavior Replications, Sarah Mcnitt
Theses & ETDs
The scientific method has always included a step for retesting hypotheses, but it is often overlooked. Reproducibility in research of any field is increasingly more important as data and analyses become more complex. With replication, scientists can find more support for their theories, or come to new conclusions as time passes and contexts change. I replicate three political behavior studies to demonstrate the importance of reproducibility, using various datasets and statistical methods. I find that some political behavior conclusions still hold true while others have changed in tandem with the political landscape.
Empirical And Epistemic Justifications:A Comparative Assessment Of Mapping Validation Techniques For Evaluating Seagrass Abundance, Maria Guardado
Empirical And Epistemic Justifications:A Comparative Assessment Of Mapping Validation Techniques For Evaluating Seagrass Abundance, Maria Guardado
Theses & ETDs
Empirically, I perform three different mapping validation procedures (by eye, photo-quadrat, and point count) in order to compare their functionality as ground truth data. I calculate the benthic substrate coverage in a subset of the Sarasota Bay in Florida by using high resolution aerial images and perform accuracy assessments using the three validation procedures. Philosophically, I assess how the methodology of mapping validation procedures assumes a framework of scientific realism for practicing scientists, implying an absolutism about the truth in scientific claims. I then assess the procedures I used in the comparative study of mapping validation procedures through the epistemic …
Paving Over Democracy: The Relationship Between Highways And Voter Turnout In Florida, Carlos Gonzalez
Paving Over Democracy: The Relationship Between Highways And Voter Turnout In Florida, Carlos Gonzalez
Theses & ETDs
Highways are ubiquitous in the context of the United States, shaping much of American environmental, economic, and social geography. While urban planners have long heralded highways as the lifelines of American society, research has shown that highways have also enabled the segregation and displacement of resources from cities. Additionally, recent scholarship has connected such highway-induced processes to the polarization of American political geography. In this paper, I expand this connection by arguing that highways negatively impact voter turnout. Highways segregate, displace, and divide existing neighborhoods, producing contexts less conducive to the development of social capital. With less social capital, individuals …

Simulated Dataset Of Corn Response To Nitrogen Over Thousands Of Fields And Multiple Years In Illinois, German Mandrini, Sotirios V. Archontoulis, Cameron M. Pittelkow, Taro Mieno, Nicolas F. Martin
Department of Agricultural Economics: Faculty Publications
Nitrogen (N) fertilizer recommendations for corn (Zea mays L.) in the US Midwest have been a puzzle for several decades, without agreement among stakeholders for which methodology is the best to balance environmental and economic outcomes. Part of the reason is the lack of long-term data of crop responses to N over multiple fields since trial data is often limited in the number of soils and years it can explore. To overcome this limitation, we designed an analytical platform based on crop simulations run over millions of farming scenarios over extensive geographies. The database was calibrated and validated using data …
The Emergence Of Spirit In Extended Reality And The Speculative Synagogue, Ian Gonsher
The Emergence Of Spirit In Extended Reality And The Speculative Synagogue, Ian Gonsher
Scholarly Research
This essay outlines topics for further design research by posing questions about the way emerging technologies, particularly social media and extended reality, might provide new affordances for deeper spiritual consciousness. Drawing on Hegel’s concept of Spirit, as well as the Jewish mystical tradition, this essay explores how discourse, manifested through community and culture, can be imagined as the mind of God. From this foundation, we explore speculative design scenarios for the development of sacred spaces in augmented and extended reality, in particular synagogues, as we consider the prototype of the synagogue, which was once situated on the temple mount in …
Increase Funding And Staffing For State Resilience Office To Decrease West Virginia Communities' Vulnerability To Flooding, Jamie Shinn
Bridge Initiative for Science and Technology Policy, Leadership, and Communications
West Virginia has a long history of flooding, but the frequency and intensity of flood events is expected to continue to increase in coming years. Despite a recognized need for building community resilience to floods, the State Resilience Office has been under-resourced and has no plan in place for long-term flood response and recovery. Without such preparations, future flooding in West Virginia will have long-term impacts for communities and individuals, ranging from economic loss, to decreased quality of life, to preventable deaths. West Virginia policy makers should ensure the State Resiliency Office (SRO) is fully resourced and clearly mandated to …

Evaluating Usage, Acceptance, Integration, And Safety Impacts Of Demand Responsive Transportation (Drt) Services, Muhammad Arif Khan
Planning Dissertations - Archive
Transportation systems are vital in providing accessibility and mobility to city residents. Auto-oriented transportation systems have faced several challenges, including traffic congestion, crashes, and environmental pollution. Proponents of mass transit systems present them as a sustainable alternative to private automobiles. Although mass transit offers several benefits, these benefits are not very significant in rural, midsized, and low-density cities due to low public transit ridership. New modes of public transit, such as demand-responsive transport (DRT), also called on-demand public transport, have recently gained popularity across the United States. DRT systems are used in several mid-sized cities, either as an alternative to …
