Persecution And Labor Migrations Due To Corporate “Environmental” Exploitation: Waiting For The Unhrc’S Binding Treaty On Transnational Business Activities?, Riccardo Vecellio Segate
Loyola University Chicago International Law Review
Policy debates on the rights and international status of climate refugees, environmental migrants, or environmentally displaced persons have unleashed detailed scholarly commentaries over the last decade, and virtually all standpoints have been scrutinized in literature already. Nevertheless, one aspect of this debate has gone somewhat off the radar in recent years: the (co-)responsibilities of incorporated subsidiaries of transnational corporations in triggering or exacerbating pseudo-environmentally motivated mass-movements of workers and related strata of the populations domiciled where these corporations operate. Despite such neglect, mentioned exploitative occurrences only increased in recent years, and the trend speaks for their further expansion …
Air Pollution And Environmental Justice, Richard L. Revesz
Air Pollution And Environmental Justice, Richard L. Revesz
Faculty Articles
Particulate matter emissions give rise to the environmental problem with the worst public health consequences. Despite a half century of regulatory efforts, they still lead to 85,000 to 200,000 additional deaths each year and produce more than 100,000 heart attacks and almost nine million cases of exacerbated asthma. These enormously serious adverse health consequences are borne disproportionately by communities of color and individuals of low socioeconomic status. Nonetheless, attacking the root cause of the problem— excessive air pollution from a myriad of sources that mixes in the air and often has its most serious health impacts hundreds of miles from …
Distributional Consequences And Regulatory Analysis, Richard L. Revesz, Samantha P. Yi
Distributional Consequences And Regulatory Analysis, Richard L. Revesz, Samantha P. Yi
Faculty Articles
Distributional analysis has been a formal part of the regulatory state since 1993, when President Clinton directed agencies to consider the distributional consequences of significant regulations alongside the cost-benefit analysis of these regulations. President Obama reaffirmed and somewhat expanded this commitment. And both Presidents Clinton and Obama expressed particular concerns with distributional consequences in the environmental area, underscoring their respective commitments to environmental justice. Despite the undoubtedly good intentions embodied in these pronouncements, the analysis of the distributional consequences of regulations has never gotten off the ground. Unlike cost-benefit analysis, it has not become a meaningful part of the analysis …

Supporting Environmental Justice: Transformative Leadership Dynamics Of Residents In Informal Subdivisions, Jose Perez Vela
Supporting Environmental Justice: Transformative Leadership Dynamics Of Residents In Informal Subdivisions, Jose Perez Vela
2022 Fall Honors Capstone Projects - Archive
Residents in low-income informal subdivisions are commonly abandoned by neoliberal municipalities that avoid the financial costs of providing access to essential services, exposing them to environmental and climate injustices. Community leadership is critical for communities of color living in low-income informal subdivisions to develop resiliency against environmental injustices that absent governments have intensified. Fieldwork in Floral Farms and a Freedmen Settlement in Southeast Dallas County were used to document the leadership of each community. Historical accuracy was strengthened through interviews with residents in tandem with participatory mapping techniques and historical archives collected from county data. Community relationships developed through the …

Nys Bar Association Annual Meeting Lecture Outline: The New Environmental Rights In Ny’S Constitutional Bill Of Rights, Nicholas A. Robinson
Elisabeth Haub School of Law Faculty Publications
It is too easy this winter to miss the signature Human Rights event in New York, the overwhelming vote last November 4th to recognizing the Human Right to the Environment. Competition for our attention is fierce: the Pandemic, political rivalries playing out in Washington, D.C., and angst about extreme weather events and other climate change impacts. So, I welcome this opportunity to illuminate the hope and promise of Article 1, Section 19 in New York’s Bill of Rights: “Each Person shall have a right to clean air and water, and a healthful environment.” Most New York lawyers have yet …
Equitable, Affordable And Climate-Cognizant Housing Construction, Shelby D. Green
Equitable, Affordable And Climate-Cognizant Housing Construction, Shelby D. Green
Elisabeth Haub School of Law Faculty Publications
The almost universal sentiment by a growing body of physical and social scientists is that climate change--with its floods, drought, heat, and cold-- portend losses of life, communities, property, and the rhythms of living. Some are more vulnerable to these impacts than others: individuals and the poor, who through official government policy and self-interest in the housing markets, have been relegated to live in poorly-constructed and poorly-placed structures--in the wake of ocean surges; in the path of strong winds; near hazardous and noxious facilities; stranded in urban heat islands. Failing to heed climate change omens will lead to a world …

Regulatory Theater: How Investor-Owned Utilities And Captured Oversight Agencies Perpetuate Environmental Racism, Ruhan Nagra, Jeanne Bergman, Jasmine Graham
City University of New York Law Review
It is well-documented that fossil fuel infrastructure—and its attendant health and safety effects—is disproportionately located in and near Black, Brown, and low-income communities. This Article explores the role of a key administrative proceeding—the utility “rate case”—in facilitating this inequitable distribution of environmental burdens. In theory, the utility rate case process enables regulatory oversight of proposed changes in gas and electric utility companies’ fees and investments. But in an energy system centered on investor-owned monopoly utilities, the rate case process is the mechanism by which these companies ensure their continued ability to secure profits at the expense of a captive market. …

Looking Out, Looking In: How India Can Respond To A Carbon Border Adjustment Mechanism On The Principles Of Justice And Equity In The Net-Zero Transition, Paridhi Srivastava
Looking Out, Looking In: How India Can Respond To A Carbon Border Adjustment Mechanism On The Principles Of Justice And Equity In The Net-Zero Transition, Paridhi Srivastava
LL.M. Essays & Theses
The net-zero transition is a curious term. It is multi-dimensional. It must be inclusive, equitable, and just—considering the different realities of various economies and various pathways to achieving net-zero. One of the merits of global climate action since the Paris Agreement in 2015 has been its attempt to balance climate change justice with inter-generational justice and environmental justice. But as evidenced from the international momentum brewing in a post-Paris world leading up to Glasgow, the problems of justice are not abated with a net-zero transition — they are indeed being rendered more poignant by it. While it is just to …
Procedural Environmental Justice, Jonathan Skinner-Thompson
Procedural Environmental Justice, Jonathan Skinner-Thompson

Achieving environmental justice—that is, the fair treatment and meaningful involvement of all people regardless of race, color, national origin, or income, with respect to the development, implementation, and enforcement of environmental laws, regulations, and policies—requires providing impacted communities not just the formal right, but the substantive ability, to participate as equal partners at every level of environmental decision-making. While established administrative policy purports to provide all people with so-called “meaningful involvement” in the regulatory process, the public participation process often excludes marginalized community members from exerting meaningful influence on decision-making. Especially in the environmental arena, regulatory decisions are often buried …

Dancing Across Difference: Arts And Community-Based Interventions As Intercultural Education, Theresa Catalano, Amanda R. Morales
Dancing Across Difference: Arts And Community-Based Interventions As Intercultural Education, Theresa Catalano, Amanda R. Morales
Department of Teaching, Learning, and Teacher Education: Faculty Publications
There is an ever-present need to foster and maintain intercultural competence in today’s teaching force. Although much research details how to do this, few studies document how to utilize arts and community-based (ACB) approaches to align with the goals of intercultural education. This qualitative study examines reflections from 61 teacher learners who participated in an ACB intervention with community partners while enrolled in an undergraduate or graduate course focused on serving students with immigrant/refugee backgrounds. The aim of this study was to find out what the characteristics of good intercultural education are, as well as how ACB approaches can provide …

Evaluating Project Need For Natural Gas Pipelines In An Age Of Climate Change, Alexandra B. Klass
Evaluating Project Need For Natural Gas Pipelines In An Age Of Climate Change, Alexandra B. Klass
Law & Economics Working Papers
As the Biden administration attempts to make climate change the focus of many aspects of its domestic and international agenda, an independent federal regulatory agency—the Federal Energy Regulatory Commission (FERC)—finds itself at the center of debates over the nation’s energy policies and greenhouse gas (GHG) emissions. Under Sections 4 and 5 of the Natural Gas Act of 1938, FERC has the authority and obligation to ensure that rates, charges, and rules relating to interstate natural gas sales and transportation are just, reasonable, and nondiscriminatory. Under Section 7 of the Natural Gas Act, FERC also has the authority to grant certificates …

Emerging Investigator Series: Moving Beyond Resilience By Considering Antifragility In Potable Water Systems, Joseph E. Goodwill, Patrick Ray, Destenie Nock, Christopher M. Miller
Civil & Environmental Engineering Faculty Publications
It is inherently difficult to plan water systems for a future that is non-predictive. This paper introduces a novel perspective for the design and operation of potable water systems under increasing water quality volatility (e.g., a relatively rapid and unpredicted deviation from baseline water quality). Increased water quality volatility and deep uncertainty stress water systems, confound design decisions, and increase the risk of decreased water system performance. Recent emphasis on resilience in drinking water treatment has partly addressed this issue, but still establishes an adversarial relationship with change. An antifragile system benefits from volatile change. By incorporating antifragility, …

This manuscript describes an empirically designed internship course that utilized the Ecological Social Justice School Counseling theory to teach internship students how to engage in antiracist practice to address social determinants of health in schools. The research reports on the eight school counseling internship students' experiences, through five themes and 12 subthemes, highlighting the ways they increased awareness of SDOH, antiracist practice, and related constructs at their schools and with students including their action toward addressing SDOH, advocacy, barriers, and growth. Implications for counselor educators and site supervisors conclude.

The Green Police In The Golden State: An Analysis Of The Criminal Enforcement Of Environmental Law In The State Of California, Joshua Ozymy, Melissa Jarrell Ozymy
UC Law Environmental Journal
The use of criminal enforcement tools is necessary for deterring and punishing environmental offenses involving significant harm or culpable conduct. Yet we have very limited empirical knowledge of how the criminal enforcement of environmental laws has functioned historically in the Golden State. Through content analysis of prosecution summaries for every federal criminal investigation undertaken by the U.S. Environmental Protection Agency (EPA) in the State of California that led to criminal prosecution, 1983-2019, we are able to provide a comprehensive account of what laws are violated, how prosecutors charge environmental criminals, and how these criminals are sentenced, illustrating broader themes in …
