Contracting For Process, David Snyder Jan 2022

Contracting For Process, David Snyder

Scholarly Articles in Law Reviews & Journals

This article introduces the concept of contracting for process and considers when it is likely to be the best contract design. Contracting for process is in widespread use, but it often goes unnoticed. Some characteristics of contracting for process suit it particularly well to situations of uncertainty, including the radical uncertainty that results from fundamental disruptions such as COVID-19. Parties can employ this design for both contracts made or renegotiated during a crisis and for contracts made in ordinary times. The concept articulated here, however, is not confined to contexts of uncertainty or complexity; it can be used to achieve …

Africana Legal Studies: A New Theoretical Approach To Law & Protocol, Angi Porter Jan 2022

Africana Legal Studies: A New Theoretical Approach To Law & Protocol, Angi Porter

Scholarly Articles in Law Reviews & Journals

INTRODUCTION: In 1743, a group of enslaved Africans from various estates in French colonial New Orleans gathered, held a musical ceremony sung in their native language, and discussed the actions and fate of a slaveholder named Corbin. Earlier, Corbin had threatened to shoot one of the enslaved Africans in this group, and Corbin’s brother then actually shot that person with a gun loaded with salt. Now, as the group of Africans gathered, they determined that Corbin had to die. Two months later, Corbin disappeared and was never found.

If we use a traditional (Western) legal framework to describe this …

Persistent Surveillance, Andrew Guthrie Ferguson Jan 2022

Persistent Surveillance, Andrew Guthrie Ferguson

Scholarly Articles in Law Reviews & Journals

Persistent surveillance technologies grant police vast new investigative capabilities. The technologies both monitor targeted areas and generate databases of searchable information about people, places, and patterns that can be connected and accessed for criminal prosecutions.

In the face of this growing police surveillance, courts have struggled to make sense of a fragmented Fourth Amendment doctrine. The Supreme Court has offered some clues that “digital may be different” when it comes to surveillance, but lower courts have been left struggling to apply old law to new technologies. Warrantless use of persistent surveillance technologies raises hard questions about when a “search” occurs …

Electronic Word Of Mouth, Online Advertisement Value And Attitude Toward Egyptian Websites As Antecedents Of Online Purchase Intention: An Extended Technology Acceptance Model, Mayada Aref

Faculty Journal Articles

The understanding of the antecedent of online purchase intentions is imperative for the growth of electronic commerce. This paper extended the technology acceptance model by three factors electronic word of mouth, online advertisement value, and attitude toward Egyptian websites, and empirically examined the proposed model among Egyptian Internet users. Furthermore, based on online purchase intention, market segmentation was conducted. A structured online questionnaire was used to collect 479 responses. Explanatory factor analysis and cluster analysis were performed using SPSS software; the structural equation modeling and hypotheses testing were examined using Amos IBM. The paper contributed by identifying the main factors …

Reinforcement Learning Applied To The Shoals Marine Laboratory Smart Grid, Daniel C. Mattson Jan 2022

Reinforcement Learning Applied To The Shoals Marine Laboratory Smart Grid, Daniel C. Mattson

Honors Theses and Capstones

Reinforcement learning (RL) techniques have been applied to smart grids with a variety of applications. The most common objective is to optimize profit for one actor in the system. The goal of this work is to apply different RL models to the smart grid at the Shoals Marine Laboratory (SML) located on Appledore Island, Maine in an effort to reduce costs and minimize the amount of nonrenewable energy consumed on the island. The RL models implemented resulted in more sustainable practices in simulations, with a linear spline model outperforming the naive policy the SML currently uses. Future work includes extending …

Sensory Scouting: An Analysis Of Supports For Sensory Needs Of Children In Local Businesses, Alison Whitman Jan 2022

Sensory Scouting: An Analysis Of Supports For Sensory Needs Of Children In Local Businesses, Alison Whitman

Honors Theses and Capstones

Families with children with challenging sensory needs may experience a decline in community participation, leading to decreased quality of life, personal feelings of well-being, and identity as a member of the community (Little et al., 2015 & Silverman & Tyszka, 2017). The purpose of this study was to examine and report the sensory experiences such as the sights, sounds, and physical movement opportunities within local businesses in the Seacoast New Hampshire area. To accomplish this, nine family-focused businesses were evaluated using the Sensory Scout Business Assessment-4th Edition (SSBA). Many businesses were found to have potentially overwhelming movement, auditory and …

Attempts To Measure Nanosecond Resolved Electronic Dynamics Of Charge Density Wave Phase Transition In 1t-Tas2, Ben Campbell Jan 2022

Attempts To Measure Nanosecond Resolved Electronic Dynamics Of Charge Density Wave Phase Transition In 1t-Tas2, Ben Campbell

Honors Theses and Capstones

Scanning tunneling microscopes allow for atomic spatial resolution but the resulting images are necessarily time-averaged and fast dynamics are lost. Pump-probe spectroscopy is a common optical technique used to measure ultrafast electronic dynamics but the integration of optical pump-probe spectroscopy into an STM requires specialized knowledge and equipment. Alternatively, an all-electronic pump-probe spectroscopy technique has recently been developed for use with an STM that replaces the laser pulses of optical pump-probe with voltage pulses. In this paper, I implemented an all-electronic pump-probe scheme into an existing scanning tunneling microscope using an arbitrary waveform generator and a lock-in amplifier. I developed …

Word Embeddings For Fake Malware Generation, Quang Duy Tran, Fabio Di Troia Jan 2022

Word Embeddings For Fake Malware Generation, Quang Duy Tran, Fabio Di Troia

Faculty Research, Scholarly, and Creative Activity

Signature and anomaly-based techniques are the fundamental methods to detect malware. However, in recent years this type of threat has advanced to become more complex and sophisticated, making these techniques less effective. For this reason, researchers have resorted to state-of-the-art machine learning techniques to combat the threat of information security. Nevertheless, despite the integration of the machine learning models, there is still a shortage of data in training that prevents these models from performing at their peak. In the past, generative models have been found to be highly effective at generating image-like data that are similar to the actual data …

Robustness Of Image-Based Malware Analysis, Katrina Tran, Fabio Di Troia, Mark Stamp Jan 2022

Robustness Of Image-Based Malware Analysis, Katrina Tran, Fabio Di Troia, Mark Stamp

Faculty Research, Scholarly, and Creative Activity

In previous work, “gist descriptor” features extracted from images have been used in malware classification problems and have shown promising results. In this research, we determine whether gist descriptors are robust with respect to malware obfuscation techniques, as compared to Convolutional Neural Networks (CNN) trained directly on malware images. Using the Python Image Library (PIL), we create images from malware executables and from malware that we obfuscate. We conduct experiments to compare classifying these images with a CNN as opposed to extracting the gist descriptor features from these images to use in classification. For the gist descriptors, we consider a …

Fake Malware Generation Using Hmm And Gan, Harshit Trehan, Fabio Di Troia Jan 2022

Fake Malware Generation Using Hmm And Gan, Harshit Trehan, Fabio Di Troia

Faculty Research, Scholarly, and Creative Activity

In the past decade, the number of malware attacks have grown considerably and, more importantly, evolved. Many researchers have successfully integrated state-of-the-art machine learning techniques to combat this ever present and rising threat to information security. However, the lack of enough data to appropriately train these machine learning models is one big challenge that is still present. Generative modelling has proven to be very efficient at generating image-like synthesized data that can match the actual data distribution. In this paper, we aim to generate malware samples as opcode sequences and attempt to differentiate them from the real ones with the …

In The Age Of Imperialism: A Study Of Hankow Based On The Maritime Customs Decennial Report (1892-1901), Sze Pui Yin Daisy Jan 2022

In The Age Of Imperialism: A Study Of Hankow Based On The Maritime Customs Decennial Report (1892-1901), Sze Pui Yin Daisy

Armstrong Undergraduate Journal of History

This research is based mainly on the Maritime Customs Decennial Report (1892-1901) to scrutinize the circumstances and development of Hankow, a typical Chinese port, in the Age of Imperialism. This essay argues that the western powers did not merely exploit the Chinese resources in the Age of Imperialism, but came hand in hand with capital, goods, and scientific knowledge, which facilitated trades and introduced technologies to China. This transformed Hankow into a global emporium with not only new constructions but also metropolitan characteristics. To this end, imperialism and modernization co-existed.

Nations can build and rebuild degraded soils to help address climate change and potentially improve the nutritional content of food if we change policies that allow the addition of safe mineral and organic wastes to soil. We present a framework that facilitates the transition from intensive conventional to more regenerative farming practices by considering soil’s natural cycle. Our paper is presented in three parts. Firstly, we consider that ’soil is living’; just like humans, the soil biome needs a balanced diet of macro and micronutrients as well as a nurturing environment. We simplify the soil science and take a systems …

Population Assignment Of Entrained Migratory Westslope Cutthroat Trout In North Idaho, Craig D. Wells

EWU Masters Thesis Collection

The Clark Fork-Pend Oreille River basin of northeastern Washington and the Idaho Panhandle historically supported a robust metapopulation of Westslope Cutthroat Trout (WCT) Oncorhynchus clarkii lewisi, a western native salmonid of high cultural and economic value. The construction of impassible hydroelectric dams and smaller in-stream barriers has prevented the return of migratory WCT to spawning tributaries, likely leading to the fragmentation of this metapopulation over the last 100 years. One such impassible barrier is Albeni Falls Dam near Newport, Washington. Completed without fish passage capabilities in 1955, Albeni Falls Dam has been of interest as a site for restoring fish …

Understanding The Mode Of Action Of Essential Oil Nanoemulsions To Inhibit Fusarium Growth And Mycotoxin Production In Cereal, Haiyang Jiang Jan 2022

Understanding The Mode Of Action Of Essential Oil Nanoemulsions To Inhibit Fusarium Growth And Mycotoxin Production In Cereal, Haiyang Jiang

Plant Sciences

Deoxynivalenol (DON) is a commonly occurred mycotoxin in cereal-based food, which is mainly produced by Fusarium spp. in the field. It is unfeasible to entirely avoid DON contamination in cereal grains with good agricultural practices. Therefore, it is of great importance to have a strategy for preventing DON contamination in our final food products. In recent years, utilization of plant extracts such as essential oils (EOs) as antifungal and mycotoxin inhibitory agents in foods have gained popularity. Depending on the EO type and chemical composition of EOs, the antifungal and mycotoxin inhibitory efficacies of different EOs might be varied. In …

Metasoftware: Building Blocks For Legal Technology, Houman Shadab

Articles & Chapters

This Article develops a novel concept in information technology called metasoftware. It then applies the concept of metasoftware to developing legal technology.

Metasoftware enables users to create the software of their choosing and stands in sharp contrast to traditional, functional software that is intended for a particular purpose or a defined range of tasks. Functional software is the default type of software that is currently produced and includes word processing, email, social networking, enterprise resource management, online marketplaces, and video game software. Metasoftware, by contrast, is not functional. Metasoftware presents the user with a blank slate upon which to build …

Lawyers And The Lies They Tell, Bruce Green, Rebecca Roiphe Jan 2022

Lawyers And The Lies They Tell, Bruce Green, Rebecca Roiphe

Articles & Chapters

Noting that the First Amendment protects lies about the government made in the public square, this article explores whether lawyers’ free speech rights ought to be different from that of other speakers. The law holds lawyers to a more demanding standard of conduct than others when it comes to aspects of lawyers’ fiduciary relationships with courts and clients. But how much more demanding can the law be when it comes to lawyers’ speech — in this case, false political speech? Applying the current First Amendment framework, we question the bar’s assumption that lawyers’ speech outside of these contexts can be …

Trauma-Informed Forensic Mental Health Assessment: Practical Implications, Ethical Tensions, And Alignment With Therapeutic Jurisprudence Principles, Julie Goldenson, Stanley Brodsky, Michael L. Perlin

Articles & Chapters

The need for trauma-informed practice is well recognized across mental health and legal settings; however, relatively little has been written about its application in forensic mental health assessment. This paper focuses on trauma-informed assessment of criminal justice involved individuals, given the high rates of trauma exposure and related sequelae in this population. A trauma-informed lens allows forensic mental health examiners to assess examinees in the context of their developmental histories and lived experience. Such a lens also has implications for the entire assessment process in terms of interviewing, psychological testing, diagnostic conclusions, feedback, and the provision of testimony and educating …

Culture And Fair Use, Michael Goodyear Jan 2022

Culture And Fair Use, Michael Goodyear

Articles & Chapters

The intersections of race and copyright have been underexamined in legal scholarship, despite repeated calls for further scrutiny. The scholarship has so far focused primarily on identifying where copyright has fallen short in protecting the creative works of artists of color. This Article, instead, hopes to offer one viable solution for creating more inclusivity of different cultures in copyright: the approval of cultural adaptations under fair use.
Cultural adaptations—the transforming of preexisting works to reflect the cultural and social mores and norms of a different group—would appear on first glance to be prohibited as derivative works, which, under the Copyright …

Returning To The Start? Federal Bipa Claims After Transunion V. Ramirez, Michael Goodyear

Articles & Chapters

The Illinois Biometric Information Privacy Act, more commonly known as “BIPA,” was the first statute to protect biometric privacy in the United States when it was passed in 2008. Although Texas and Washington have since passed their own biometric privacy laws, and other states have protected biometric information as part of more general data privacy legislation, BIPA remains the most powerful such law in the country due to being the only biometric privacy law to contain a private right of action. BIPA has also proven to be an important precedent for other states, such as New York, that are currently …
