Hospital Performance And Market Share: Implications For Patient Choice, Value-Based Care, And Health Equity, David August Oddleifson
Hospital Performance And Market Share: Implications For Patient Choice, Value-Based Care, And Health Equity, David August Oddleifson
Yale Medicine Thesis Digital Library
There is substantial hospital-level variation in the quality of healthcare delivered in the United States. Although patients now have greater access to public reporting of hospital quality than ever before, many individual, geographic, and structural factors limit patient choice. The degree to which hospital quality aligns with hospital market share is largely unknown.
Using public performance measure score and volume data from CMS’s Hospital Care Compare, we assessed the association between publicly reported hospital performance scores and hospital market share for elective, semi-elective, and non-elective procedures.
Using logistic regression, we found a significant association between hospitals’ risk-adjusted complication rate and …

To Be Continued: How Comic Book Copyright Inequity Inspired Industry Innovation And Instilled Instrumentalities For Independence, Richard P. Metzroth
Connecticut Law Review
Before Superman first made the world believe a man can fly or Captain America greeted Hitler with a punch to the face, comic book publishers sought to exercise command over all the characters and stories that writers and artists put to paper. Until recently, this one-sided industry culture regarding ownership—reinforced by decades of court rulings in publishers’ favor—left creators with few avenues by which to retain control of their art. The legal norms that enforced creators’ subservient position in the comic book copyright ecosystem drove these authors to seek out and construct alternative systemsfrom which they could realize the benefits …

A New Feudalism: Selfish Genes, Great Wealth, And The Rise Of The Dynastic Family Trust (Dft), Eric Kades
Connecticut Law Review
Today’s record levels of economic inequality are infecting our future as the top 0.01% bequeath vast wealth to their descendants. With the death of the Rule Against Perpetuities (RAP), this inequality has the potential to harden social class lines—not just for a generation or two, but forever. Although it may sound implausible, interviews with estate lawyers serving very high-net-worth clients reveal that some members of the wealthiest tier of testators are already exploiting the RAP’s elimination, along with a tax loophole, to establish dynasty trusts that will financially empower their bloodline as long as it continues. Recent work in evolutionary …
Mindful Debiasing: Meditation As A Tool To Address Disability Discrimination, Elizabeth F. Emens
Mindful Debiasing: Meditation As A Tool To Address Disability Discrimination, Elizabeth F. Emens
Connecticut Law Review
Antidiscrimination law is at a critical juncture. The law prohibits formal and explicit systems of exclusion, but much bias nonetheless persists. New tools are needed. This Article argues that mindfulness meditation may be a powerful strategy in the battle against disability discrimination. This Article sets out eight reasons that disability bias is particularly intractable. The Article then draws on empirical, philosophical, and scholarly sources to identify mechanisms through which mindfulness meditation can address these dynamics. The Article concludes by presenting concrete doctrinal implications of bringing mindfulness to bear on disability discrimination. This Article thus contributes to the established fields of …

New Records Of Digenetic Trematodes Infecting Melanoides Tuberculata (O.F. Müller, 1774) In Florida, Usa, Lori R. Tolley-Jordan, Michael A. Chadwick, Jimmy K. Triplett
Research, Publications & Creative Work
Melanoides tuberculata is a well-known invasive, freshwater snail and intermediate host for many species of parasitic trematodes. Despite being well established in Florida’s freshwater systems, little work has been conducted to document the associated trematodes of the snails. Live snails were collected from 11 sites from 25 locations sampled across the state of Florida, USA of which individuals from six sites were found to be infected with trematodes. Gross morphological characters and phylogenetic analysis using 18S rRNA and ITS2 gene regions, were used to identify these trematode taxa. Snails infected with the gill flukes, Centrocestus formosanus and Haplorchis pumilio (Heterophyidae) …

Limiting The Boundaries Of Assisted Reproductive Technology And Physiological Autonomy, George P. Smith Ii
Limiting The Boundaries Of Assisted Reproductive Technology And Physiological Autonomy, George P. Smith Ii
Scholarly Articles
This essay examines, critically, the wide successes of assisted reproductive technology (ART). With these successes have come concerns regarding its potential advancement of the boundaries of fecundity and of new levels of physiological freedom. One particular advancement involves efforts to utilize a phenomenon of nature termed parthenogenesis, or asexual reproduction. The potential for adapting this occurrence as a form of assisted reproduction is of particular interest for members of the LGBTQ community, holding great promise for embryo research and regenerative medicine. Parthenogenetic embryos could be derived from unfertilized human eggs and, thus, blunt--if not resolve--ethical concerns over experimentation on human …

On the cover: Education is defined as a process in which an individual receives instruction, acquires wisdom, gains knowledge or develops a skill. Its definition cannot be confined to a time-lapse of four years at an institution of higher education, nor can it be disguised as a time-tested package that carries a lifelong guarantee against knowledge stagnation. At MSU, the Division of Continuing Studies offers you an opportunity to return to the classroom and learn just for the enjoyment of learning, realizing that education is an infinite process and must be continued.

Assessing The Strategic Situation Underlying International Antitrust Cooperation, Weimin Shen
Emory International Law Review
This Article disputes the widely held view that the strategic situations underlying antitrust cooperation among developed antitrust regimes and developing antitrust regimes are similar, particularly the conclusion that the current set of policy options to address private and hybrid public-private restraints of trade is feasible in all situations. This Article utilizes an empirical inquiry into trade flows that affect the general level of antitrust regulations in open economies (here, Japan and China). Based on this empirical foundation, the current set of policy options are explored, including the extraterritoriality of U.S. antitrust law, Section 301’s competition-related clause, the World Trade Organization …

"Reeling In" Juvenile Sportfish Through Coastal Habitat Restoration: Population, Community, And Trophic Responses In The Indian River Lagoon, Florida, Jennifer Loch
Electronic Theses and Dissertations, 2020-2023
Coastal habitats provide crucial nursery habitat for predatory fishes, but they are in decline worldwide, impacting economically important fisheries. Habitat restoration can simultaneously mitigate the effects of habitat loss and benefit predators (e.g., sportfish), although this relationship is understudied. Here, the response of juvenile sportfish to oyster reef and living shoreline restoration is compared to controls in the Indian River Lagoon, Florida prior to and following restoration for up to three years through examination of community (diversity, assemblage), population (abundance), biometric (size, body condition), ontogenetic, and trophic (gut contents, stable isotopes) dynamics. Stable isotopes were used to quantify dietary history, …
