Oversight Riders, Kevin M. Stack, Michael P. Vandenbergh

Notre Dame Law Review

Congress has a constitutionally critical duty to gather information about how the executive branch implements the powers Congress has granted it and the funds Congress has appropriated. Yet in recent years the executive branch has systematically thwarted Congress’s powers and duties of oversight. Congressional subpoenas for testimony and documents have met with blanket refusals to comply, frequently backed by advice from the Department of Justice that executive privilege justifies withholding the information. Even when Congress holds an official in contempt for failure to comply with a congressional subpoena, the Department of Justice often does not initiate criminal sanctions. As a …

Predicting Lifespan Of Drosophila Melanogaster: A Novel Application Of Convolutional Neural Networks And Zero-Inflated Autoregressive Conditional Poisson Model, Yi Zhang, V. A. Samaranayake, Gayla R. Olbricht, Matthew S. Thimgan Dec 2021

Predicting Lifespan Of Drosophila Melanogaster: A Novel Application Of Convolutional Neural Networks And Zero-Inflated Autoregressive Conditional Poisson Model, Yi Zhang, V. A. Samaranayake, Gayla R. Olbricht, Matthew S. Thimgan

Mathematics and Statistics Faculty Research & Creative Works

A model to classify the lifespan of Drosophila, the fruit fly, into short- and long-lived categories based on a sleep characteristic, extracted from activity data, is developed using a two-stage process. Stage 1 models the per-minute activity counts of each fly using a zero-inflated autoregressive conditional Poisson model. These probabilities are allowed to vary hourly, reflecting the circadian and other cycles present in a fly's sleep architecture. A 5-day moving window is used to model data allowing the model parameters to vary over the course of the fly's life. The resulting probabilities capture information about changes in sleep patterns with …

Post-Czu Lightning Complex Regeneration In The Año Nuevo Monterey Pine Stand, Allison Trutna

Master of Science in Environmental Sciences and Management Projects

Climate induced increases in fire frequency and severity along with years of fire suppression and drought are predicted for California. The recent CZU Lightning Complex, a high severity wildfire, burned in the Santa Cruz Mountains on California’s central coast and affected an assortment of vegetation, including the survival and recovery of the native Año Nuevo Monterey pine (Pinus radiata (D. Don)) stand. This stand is partially located in Cal Poly’s Swanton Pacific Ranch and has been monitored for over 20 years for the presence of pitch canker (Fusarium circinatum) fungal disease. This study characterized the survival and initial recovery of …

“Transport Batteryfication” Analysis Of Pre-Recycling Phases Of End-Of-Life Electric Vehicle Lithium-Ion Batteries From An Irish Perspective, Matt Mcguinness Dec 2021

“Transport Batteryfication” Analysis Of Pre-Recycling Phases Of End-Of-Life Electric Vehicle Lithium-Ion Batteries From An Irish Perspective, Matt Mcguinness

Masters

Transport plays a key role in maintaining the economic prosperity of our society. However, transport has remained reliant on fossil fuels, a main contributor to climate change. New EU and Government policies aim to decarbonise the transport sector through batteryfication by shifting to electric vehicles. The lithium-ion battery will underpin this strategy.

Lithium-ion batteries have a limited lifespan for automotive applications, this will bring new and unprecedented challenges for end-of-life waste management. The recent growth of electric vehicles is expected to continue exponentially which raises important questions on how to process this new waste stream.

This study investigates the recycling …

The Opioid Crisis: Evaluating Current Practices And Outcomes For Neonatal Abstinence Syndrome, Deborah A. Mendoza Dec 2021

The Opioid Crisis: Evaluating Current Practices And Outcomes For Neonatal Abstinence Syndrome, Deborah A. Mendoza

Nursing | Senior Theses

Neonatal Abstinence Syndrome (NAS) in the infant are severe symptoms from opioid exposure in utero. These symptoms include: “central nervous system irritability, autonomic over-reactivity, and gastrointestinal tract dysfunction” (Ko et al., 2016). The treatment for NAS can be a combination of drug therapy and non-pharmacological interventions, but a standardized treatment is lacking. A review of this literature aims to evaluate the available interventions that lead to decreased symptom severity, reduction of length of hospital stay, and a reduction in the use of drug therapy. As a result of the literature review, the nurse researcher supports the standardization of treatment and …

As nurses, working towards the best health outcomes for our patients is critical to our care. A large aspect of this care includes being knowledgeable of risk factors and precautions to take to avoid conditions and illnesses. Colorectal cancer remains to be a highly preventable disease, yet it is one of the top five leading causes of cancer deaths in the nation. Preventing colorectal cancer requires the efficient use of screening and education, while also addressing barriers of inconvenience and affordability. This senior thesis delves deeper into colorectal cancer prevention by asking the research question: For young and middle-aged adults, …

Perceived Family And Partner Support And The Work-Family Interface: A Meta-Analytic Review, Heather H. Kelley, Ashley Lebaron-Black, E. Jeffrey Hill, Diana Meter

Human Development and Family Studies Faculty Publications

This study employed meta-analytic techniques to elucidate the role of perceived partner and family support in four measures of the work-family interface. We extracted 183 effect sizes from 82 samples and a total of N = 36,226 individuals. We found perceived familial (partner and family) support was negatively associated with work-to-family conflict (r = -.099) and family-to-work conflict (r = -.178). It was positively associated with work-to-family enrichment (r = .173) and family-to-work enrichment (r = .378). Various sample-level moderators were investigated through meta regression and subgroup analyses, including whether the support measure was family or …

Amanece.

Investigating Corruption Amongst Uniformed Police Officers In Local Police Departments, Keara Dixon

Honor’s College Freeman Research Journal

Police corruption within the United States has been around since the formation of the first police department in Boston, Massachusetts. Furthermore, the pervasiveness of police corruption threaten the lives and safety of civilians residing in the U.S. Past reform movements failed to eradicate the issue and bring about change. This has inspired the question how can police departments and uniformed officers be reformed to eradicate police corruption. A case study of uniformed police officers in popular police departments would demonstrate the pervasiveness, adaptability, and factors of police corruption. A historical analysis of the New York Police Department, Miami Police Department, …

Methods Utilized For Music Education And Their Effectiveness, Camryn Roberts

Honor’s College Freeman Research Journal

The purpose of this paper is to educate, inform, and analyze how music is taught within the education system today. Music is a very essential part of the education system and is oftentimes overlooked. The State of Texas has a system that is different from most states when it comes to education and meeting academic standards on all grade levels(Matthew 2006).This alone has placed fear in some educators for teaching within the State of Texas because they just want to be successful overall and give their students the opportunity to do the same. The most frustrating thing to me, is …

A Multiwell Plate-Based System For Toxicity Screening Under Multiple Static Or Cycling Oxygen Environments, Ming Yao, Glenn Walker, Michael P. Gamcsik

Faculty and Student Publications

Tumor tissue contains a continuous distribution of static and dynamically changing oxygen environments with levels ranging from physiologically normal oxygen down to anoxia. However, in vitro studies are often performed under oxygen levels that are far higher than those found in vivo. A number of devices are available to alter the oxygen environment in cell culture, including designs from our laboratory. However, in our devices and most other designs, changing the media in order to feed or dose cells remains a disruptive factor in maintaining a consistent hypoxic environment. This report presents a novel 96-well plate design that recirculates the …

Copyright And The Creative Process, Mark Bartholomew Dec 2021

Copyright And The Creative Process, Mark Bartholomew

Notre Dame Law Review

Copyright is typically described as a mechanism for encouraging the production of creative works. On this view, copyright protection should be granted to genuinely creative works but denied to non-creative ones. Yet that is not how the law works. Instead, almost anything—from test answer sheets to instruction manuals to replicas of items in the public domain—is deemed creative and therefore eligible for copyright protection. This is the consequence of a century of copyright doctrine assuming that artistic creativity is incapable of measurement, unaffected by personal motivation, and incomprehensible to novices and experts alike. Recent neuroscientific research contradicts these assumptions. It …
