Taxation Of The Digital Economy: Adapting A Twentieth-Century Tax System To A Twenty-First-Century Economy, Assaf Harpaz
Taxation Of The Digital Economy: Adapting A Twentieth-Century Tax System To A Twenty-First-Century Economy, Assaf Harpaz
Scholarly Works
This Article analyzes the tax challenges of digitalization and the potential solutions to address them. This Article argues in favor of a multilateral approach and proposes applying a new tax nexus based on market thresholds subject to a global de minimis amount. As more companies conduct business online, current international tax law and its principles have failed to adapt to global commercial practices. Digital-tech giants such as Facebook, Google and Amazon have been able to exploit the international tax framework by avoiding a physical presence in the jurisdiction of their consumers. As a result, profits of highly digitalized enterprises can …
Debt’S Emotional Encumbrances, Pamela Foohey
Debt’S Emotional Encumbrances, Pamela Foohey
Scholarly Works
This chapter focuses on the role of emotions in the theory and practice of commercial and consumer credit laws, including bankruptcy, in the United States. It assesses knowledge about people’s emotions regarding personal and business financial problems, and evaluates how “money law” systems account for these emotions. This assessment finds that emotions surrounding taking on and being able to pay back debt differ between business leaders and people who shoulder household debt. These differences are traceable in large part to historical understandings of the respectability of incurring debt. This history has shaped the development of bankruptcy, commercial, and consumer credit …
Fintech's Role In Exacerbating Or Reducing The Wealth Gap, Pamela Foohey, Nathalie Martin
Fintech's Role In Exacerbating Or Reducing The Wealth Gap, Pamela Foohey, Nathalie Martin
Scholarly Works
Research shows that Black, Latinx, and other minorities pay more for credit and banking services, and that wealth accumulation differs starkly between their households and white households. The link between debt inequality and the wealth gap, however, remains less thoroughly explored, particularly in light of new credit products and debt-like banking services, such as early wage access and other fintech innovations. These innovations both hold the promise of reducing racial and ethnic disparities in lending and bring concerns that they may be exploited in ways that perpetuate inequality. They also come at a time when policy makers are considering how …
The Disparate Treatment Of Rights In Trade, Desiree Leclercq
The Disparate Treatment Of Rights In Trade, Desiree Leclercq
Scholarly Works
Rights advocates are increasingly urging U.S. trade negotiators to include new binding and sanctionable provisions that would protect human rights, women’s rights, and gender equality. Their efforts are understandable. Trade agreements have significant advantages as a process for advancing global rights. Even though Congress and the Executive incorporate global environmental standards and labor rights in U.S. trade agreements, they have refused to incorporate gender rights and broader human rights. The rationale behind the United States’ disparate treatment of rights in trade has received almost no scholarly attention. That is a mistake.
Using labor rights as a case study, this Article …
Sensorless Direct Torque Control Of An Induction Motor Using Fuzzy Controller., A. Khalil
Sensorless Direct Torque Control Of An Induction Motor Using Fuzzy Controller., A. Khalil
Mansoura Engineering Journal
In this paper direct torque control DTC of an induction motor is developed. A new technique for DTC based ou fuzzy logic concept is proposed, where fast torque response with low ripple in the stator lux and torque of induction motor can be achieved. In comparison with the conventional DTC şimulation results clearly demonstrate a better dynamic and steady state performance with the fuzzy logic DTC. The two approaches are explained in clear details, which are designed using SIMULINK under Matlab Ver.6 software package. Also, MATLAB/FUZZY toolbox is used to implement the fuzzy logic controller. Both systems are simulated under …

Hydraulic Characteristics Of Submerged Flow In Non-Prismatic Stilling Basins., A. Negm, G. Abdel-Aal, M. Elfiky, Y. Mohamed
Mansoura Engineering Journal
Recently, the non-prismatic stilling basins attracted many researchers due to their effective dissipation of excess energy. Radial stilling basins are characterizing with symmetric flow patterns that in turn minimize the expected damages of the erodible bed downstream the stilling basins. In this research, the submerged flow in radial stilling basin was provided with negative step and an end sill was analyzed both theoretically and experimentally. The effects of various parameters such as submergence, relative height of sill, relative height of step and inlet Froude number were presented and discussed. The experimental study is conducted on 30 cm wide, 45 cm …

Characteristics Of Seepage Underneath A Heading-Up Structure And A Subsidiary One., Adel El-Masry, Mohamed Abd-Alla
Mansoura Engineering Journal
Sometimes, it is necessary to build a subsidiary weir downstream the heading-up structures to relief the acting head. In the present study. Water prevented between the main and subsidiary structures was considered. The boundary element technique using linear elements was used to analyze the uplift pressure underneath a simple flat floor of the heading-up structure and the subsidiary weir. Seepage flow and the exit gradients were also considered. Seven cases of the distance between the heading-up structure and the subsidiary one had been considered with five thickness of the permeable layer under the structure. Obtained results were illustrated and discussed.

Mansoura Engineering Journal
The main objective of this study is to investigate the feasibility of using shredded waste tires as a reinforcing material in road construction. Triaxial and CBR tests were conducted on mixtures of base layer material (sand) and shredded waste tires. Sand-tire mixtures were prepared with different shred contents by weight and different shred sizes. These mixtures were subjected to identical laboratory tests to observe the influence of shreddca waste tires on physical and engineering properties of sand-Lire mixtures. The following parameters were studied to evaluate their influence on shear strength and resistance to penetration: confining pressure, shred content, shred size …

A Comparative Study For The Variables Affecting Municipal Water Demand., Falah Almouiri, Falah Wegian
Mansoura Engineering Journal
In this study a real case is used in order to evaluate the effect of the factors controlling the residential water demand in one of the suburb of the state of Kuwait. The important of this study comes from the fact that our case study has at the same time two kinds of residential areas in which one the them contains complete and modern water and sewage networks, while the other is lacking this surface. Therefore an evaluation of the effect of the availability of water and sewage networks on residential water demand is made by making a comparison studies …

Measuring Individual And Group Flow In Collaborative Improvisational Dance, Klara Łucznik, Jon May
Measuring Individual And Group Flow In Collaborative Improvisational Dance, Klara Łucznik, Jon May
School of Psychology
This study investigated flow experience during group collaborations of creative dance improvisation, where group flow was defined as periods when most members of a group reported a flow experience. Sixteen dancers took part in the experimental sessions, performing improvisational tasks in groups of four. We chose two different types of dance task, hypothesising that dancers’ external focus upon the group's shared surroundings and awareness of others might facilitate group flow experience; while an internal focus upon one's own mental imagery might inhibit it. A novel, video-stimulated recall method to assess flow experience was used to track time patterns and shared …

Santa Clara Pueblo V. Martinez In The Evolution Of Federal Law, Richard B. Collins
Tribal Law Journal
Few Indian law decisions have evoked as much scholarly attention as Santa Clara Pueblo.1 Shepard's pulls up over 1000 law review references, and Google reports almost 3,000,000 hits.2 It is a major case in all Indian law treatises and casebooks and is important in several other books.3 Most analyze the decision as an event and focus on its principal holding, denying a federal cause of action for civil enforcement of the Indian Civil Rights Act.4 Policy discussions parse tribal sovereignty and discrimination against women.

Tribal Justice: Honoring Indigenous Dispute Resolution (Symposium Keynote Address), Deb Haaland
Tribal Law Journal
Tribal Law Journal 20th Anniversary Symposium Keynote Address. I am working to weave our Native voice into a system that is not traditionally our own to make sure these legal fictions do not persist into another detrimental federal policy era. This symposium is highly valuable because it shows our community how important it is to incorporate indigenous traditional values into our legal system—but this is also important to highlight in our political systems and my effort to encourage more Native Americans to run for office and will continue. Native American people need to redefine all aspects of our governance systems …

Native American Oral Evidence: Finding A New Hearsay Exception, Max Virupaksha Katner
Tribal Law Journal
The Federal Rules of Evidence hearsay rules unjustifiably exclude legitimate and trustworthy evidence that support many Native American legal claims. Native American communities traditionally were not literate and rarely recorded the treaties, contracts, and other legal instruments they drew up or honored in any kind of written format, oftentimes recording their histories and diplomatic events in other ways; take for example wampum belts used by the Haudenosaunee Confederacy, among others. While the U.S. legal system presupposes that evidence in written statements provides a greater assurance of accuracy and truth than oral statements, this is not always the case. Writing is …

New Ecological Equilibrium: A Perspective For Our Long Conversion Journey, P. Wiryono Priyotamtama Sj
Asia Pacific Mission Studies
Through the encyclical letter Laudato Si’, Pope Francis launched integral ecology as a new paradigm to solve the global ecological crises. The most fundamental challenge identified was that the awareness of the fact that everything is connected should be chosen by those who are trusted to design pastoral leadership formation within the Church to implement the above new paradigm. In line with the spirit of Laudato Si’, awareness should be understood as the opening of mind, heart, and will that will enable the development of new convictions, attitudes, and forms of life toward creating a new equilibrium. In this paper, …

Preventive Measures Against The Sexual Abuse Of Minors And Vulnerable Adults In Pastoral Ministry Today, Nchumbonga George Lekelefac
Asia Pacific Mission Studies
The current context regarding the efficient protection of minors and the attentiveness to ensure their human and spiritual development, in line with the dignity of the human person, are indispensable parts of the Gospel message. The Church and all her members are called to it. The need for an awareness of preventive measures against the sexual abuse of minors and of the vulnerable in pastoral ministry is of absolute importance. This article seeks to raise such an awareness of this crucial topic among the clergy, religious, and lay faithful who are directly or indirectly involved in pastoral ministry in the …

Building Pastoral Capacity In The Post-Pandemic Era Alongside Of “Human Fraternity”, Greg Soetomo Sj
Asia Pacific Mission Studies
A great number of people have expressed their admiration for the document on “Human Fraternity for World Peace and Living Together” (HF). One of the comments that is commonly heard is, “We will use this document as a guide to build and strengthen good and vibrant interfaith and intercultural relations.” This desire for better relations is validated by a statement in the paper itself: “It is a document that invites all persons who have faith in God and faith in human fraternity to unite and work together so that it may serve as a guide for future generations to advance …

Signs Of Pandemic, Symbols Of Hope: A Sketch Of Pastoral Work In Liturgy, Antonius Firmansyah Sj
Asia Pacific Mission Studies
Bearing in mind that the faithful have already experienced the different impacts of COVID-19 in their daily life, pastoral workers need to find new ways of respecting the liturgical norms while also inviting and sustaining the spiritual motivation of the faithful to personally participate in liturgy. One possibility is through juxtaposing the signs of the pandemic encountered in our daily life with the symbols of liturgical celebration. To this end, pastoral workers need to facilitate an appropriate symbolic engagement process during liturgy.

Spiritual Life Of The Christian Immigrant And Non-Immigrant Family, Moses Mary Apreku
Spiritual Life Of The Christian Immigrant And Non-Immigrant Family, Moses Mary Apreku
Asia Pacific Mission Studies
The Asia-Pacific Christian immigrants and non-immigrants have a huge impact on Western Christianity. Therefore, special pastoral care, faith, and spiritual formation should be given to immigrant families so that they can become efficient lay missionaries. Unfortunately, proper faith formation of the lay faithful is lacking in the Church, while by virtue of their baptism, they are also called to witness Christ in the world. The formation and training of Christians in the faith is essential so that as Christ’s disciples, they may become his efficient witnesses in the world. For this reason, Jesus took three years in training and forming …

Exploring Mission With Saint Paul Ten Pastoral-Theological Principles, James H. Kroeger Mm
Asia Pacific Mission Studies
Saint Paul, apostle par excellence, tirelessly labored to spread the Gospel, particularly in the Gentile world. His missionary travels and encounter with diverse peoples, cultures, and religions form the matrix or context of his missionary methods. A comprehensive examination of Paul's writings yields much mission wisdom and insight shaped by his apostolic experience and dynamic faith. This presentation suggests ten “mission principles”—derived from Paul's direct mission experience coupled with his profound faith reflection and then “applied” to missionary engagement today.

Rebuilding From Covid-19: Pastoral Leadership Towards A New World, Christina Kheng
Asia Pacific Mission Studies
The COVID-19 pandemic calls for pastoral leadership that is spiritually-rooted, discerning, synodal, humble, and committed to rebuilding a better world. This article outlines a suggested process by which pastoral workers can reflect on the “pandemic year” together with their communities and exercise pastoral leadership in a collaborative way. In doing do, they might model a way of proceeding that brings new vitality to the Church’s life and mission in these challenging times.
Relationship Is At The Heart Of Dialogue: A Reflection On Engaging With Muslims In Delhi, Joseph Victor Edwin Sj
Relationship Is At The Heart Of Dialogue: A Reflection On Engaging With Muslims In Delhi, Joseph Victor Edwin Sj
Asia Pacific Mission Studies
This essay proposes that 'relationship' is at the heart of Christian-Muslim Relations. I present two simple experiences that I had with a Muslim teacher and young Muslim students during my years of formation towards priesthood. Those experiences taught me the importance of taking roots among Muslims so that we can discover in one another a brother or a sister. An attitude nurtured by Nostra Aetate will flourish in an ambience of open ended conversation between Christians and Muslims that neither compromises one's faith convictions nor disregards the faith convictions of Muslim brothers and sisters.

Finding Christ In Photographs Of Suffering, Harry Setianto Sunaryo
Asia Pacific Mission Studies
Photojournalists employ images in order to tell a news story, honestly and impartially while telling the story in strictly journalistic terms. Theologians, specialists in theology, reflect on faith as a personal response to God's self-communication. This article is an innovative attempt to bring them together, photojournalism and theology. Indeed, both make use of verbal and non-verbal language as well as a person's imagination. The author shows that both shall not exclude an urgent social concern for the common good. Here the author presents his reflection from a context of a country, the Philippines, in the middle of drug-war with its …

To Change A Culture: Reflections On One Attempt To Help Theology Students Reconsider Assumptions, Christine E. Burke Ibvm
Asia Pacific Mission Studies
In a time described by Pope Francis as “not an era of change but a change of era,” assisting students to examine assumptions which are embedded in their culture is critical. Manila has many institutions dedicated to theological and pastoral formation. In a post Vatican II church, where baptism is recognized as empowering all to use their gifts as 'priests, prophets and kings'(spiritual leadership, commitment to justice, and governance), how can we help students to participate in a church challenged by the equality of women and men? Feminist theology offers rich resources to enable students to recognize and support the …
