"A Novel And Controversial Technology." Artificial Face Recognition, Privacy Protection, And Algorithm Bias In Europe, Andrea Pin

William & Mary Bill of Rights Journal

R (Bridges) v. Chief Constable of South Wales Police's Court of Appeals ruling... showcases the variety and the thickness of the legal, ethical, and political considerations that lie underneath the deployment of [Artificial Face Recognition]-based police tools and its ramification within Europe and beyond. More broadly, the topic of "[f]acial recognition technologies provide[s] a useful case study of the complex and unpredictable ways that norms of procedural fairness, equality, and privacy interact when the state deploys machine-learning tools to draw inferences from otherwise unilluminating data." This Article uses Bridges as a proxy to sketch out the main legal issues …

If You Think Ai Won't Eclipse Humanity, You're Probably Just A Human, Gary D. Brown Dec 2021

If You Think Ai Won't Eclipse Humanity, You're Probably Just A Human, Gary D. Brown

William & Mary Bill of Rights Journal

Building machines that can replicate human thinking and behavior has fascinated people for hundreds of years. Stories about robots date from ancient history through da Vinci to the present. Whether designed to save labor or lives, to provide companionship or protection, loyal, capable, productive machines are a dream of humanity.

The modern manifestation of this interest in using human-like technology to advance social interests is artificial intelligence (AI). This is a paper about what that interest in AI means and how it might develop in the world of national security.

Ridden With Controversy: Applying The Public Forum Doctrine To Public Transit Advertising, Remy T. B. Oliver Dec 2021

Ridden With Controversy: Applying The Public Forum Doctrine To Public Transit Advertising, Remy T. B. Oliver

William & Mary Bill of Rights Journal

This Note tackles the application of the First Amendment to public transit advertising. Under the current judicial framework, the First Amendment is filtered through the "public forum doctrine" when discussing the rights of citizens to utilize government property for expressive purposes. The Note will argue that public transit advertising constitutes a "designated public forum" in most (if not all) cases. That characterization would force any content-based restrictions to be narrowly tailored to serve a compelling government interest. The natural result is a significant expansion of access to public transit advertising by interested parties. If the U.S. Supreme Court were to …

Docket Selection And Judicial Responsiveness: The Use Of Ai In The Colombian Constitutional Court, Pablo Rueda Saiz Dec 2021

Docket Selection And Judicial Responsiveness: The Use Of Ai In The Colombian Constitutional Court, Pablo Rueda Saiz

William & Mary Bill of Rights Journal

This Article addresses some of the limitations of AI as a tool to preselect a long or shortlist of cases for a court at the apex of the judicial system to review. It focuses on the Colombian Constitutional Court, as an example of a court at the apex of the judicial system that has been historically responsive to claims for fundamental rights. Docket selection is an example of a classification problem using supervised learning, in which a machine groups data according to preestablished characteristics.

This Article draws from two different bodies of literature to analyze the consequences of using AI …

Ballots In An Unfamiliar Language And Other Things That Make No Sense: Interpreting How The Voting Rights Act Undermines Constitutional Rights For Voters With Limited English Proficiency, Abigail Hylton Dec 2021

Ballots In An Unfamiliar Language And Other Things That Make No Sense: Interpreting How The Voting Rights Act Undermines Constitutional Rights For Voters With Limited English Proficiency, Abigail Hylton

William & Mary Bill of Rights Journal

This Note will argue that the current federal scheme for determining the baseline resources that a state must provide to voters with limited English proficiency is unconstitutional. Specifically, the Voting Rights Act neglects to require adequate translation and interpretation services for many voters with limited English proficiency. Such failure to adequately support this group of citizens throughout the election process effectively excludes them from the democratic process and deprives them of their constitutional right to vote. Whether this group of voters has access to translated materials currently hinges on the language they speak, their nationality, and their geographic location; the …

Geofence Warrants: Geolocating The Fourth Amendment, A. Reed Mcleod Dec 2021

Geofence Warrants: Geolocating The Fourth Amendment, A. Reed Mcleod

William & Mary Bill of Rights Journal

This Note begins by focusing on the technology and procedure of geofence warrants in Part I. Because an understanding of both the technology and procedure is ultimately required to make any headway in later legal analysis, this step is necessary. The heart of the legal analysis is undertaken in Parts II and III.

In Part II, this Note argues that law enforcement requests for location data require a warrant: either because of the expectation of privacy in location data proposed by cases such as Carpenter v. United States or because some courts have found that Carpenter's holding must mean …

Unusual Catchment Runoff In A High Alpine Karst Environment Influenced By A Complex Geological Setting (Northern Calcareous Alps, Tyrol, Austria), Karl Krainer, Gerfried Winkler, Sabine Pernreiter, Thomas Wagner

KIP Articles

Garber Schlag (Q-GS) is one of the major springs of the Karwendel Mountains, Tyrol, Austria. This spring has a unique runoff pattern that is mainly controlled by the tectonic setting. The main aquifer is a moderately karstified and jointed limestone of the Wetterstein Formation that is underlain by nonkarstified limestone of the Reifling Formation, which acts as an aquitard. The aquifer and aquitard of the catchment of spring Q-GS form a large anticline that is bound by a major fault (aquitard) to the north. Discharge of this spring shows strong seasonal variations with three recharge origins, based on δ 18 …

Crisis Of Hegemony: China’S Rise To Power And The South China Sea, Vanessa Gonzalez

Undergraduate Research Projects

“Let China sleep. For when she wakes, the world will tremble.” This quote attributed to Napoleon Bonaparte has foreshadowed the international political climate of the twenty-first century. Throughout history, great empires and nations that were sure of their power could not fathom their eventual decline until it came knocking at their door. In many ways, the U.S is facing one of these wake-up calls. Its likely successor? The People’s Republic of China. From trade and technology wars all the way to what many consider the “New Cold War” in the South China Sea: the U.S has met its economic match. …

Nhtsa Up In The Clouds: The Formal Recall Process & Over-The-Air Software Updates, Emma Himes Dec 2021

Nhtsa Up In The Clouds: The Formal Recall Process & Over-The-Air Software Updates, Emma Himes

Michigan Technology Law Review

Software updates are pushed to vehicles “over-the-air” (OTA) with increasing frequency as they reduce costs of visiting dealerships and auto shops to receive maintenance. These updates, pushed from the cloud, have been used to remedy safety defects in vehicles and improve software controlling all aspects of vehicles from steering to rearview mirrors. Remedies of vehicle safety defects are overseen by the National Highway Traffic Safety Administration (NHTSA); however, because many OTA software updates do not remedy issues officially deemed safety defects, they are pushed straight from the manufacturer to drivers with little government oversight or transparency. NHTSA’s recall process was …

An Empirical Study: Willful Infringement & Enhanced Damages In Patent Law After Halo, Karen E. Sandrik Dec 2021

An Empirical Study: Willful Infringement & Enhanced Damages In Patent Law After Halo, Karen E. Sandrik

Michigan Technology Law Review

For decades, companies and attorneys have instructed teams of engineers, researchers, and computer scientists to ignore patents. The reasoning for this advice: if there is no pre-suit knowledge of a patent, then it is nearly impossible for a patent holder to prove that enhanced damages are warranted. Pre-suit knowledge is a prerequisite for a finding of willful infringement, which is itself a prerequisite for awarding enhanced damages. The median patent damages award is around ten million dollars, and large companies like Intel, Teva Pharmaceuticals, Microsoft, and Abbott Laboratories have all recently faced billion-dollar patent infringement judgments. In this landscape, a …

Impact Of Metropolization On The Crime Structure (Case Study Of Provincial Capitals In Poland), Natalia Sypion-Dutkowska, Michael Leitner, Marek Dutkowski Dec 2021

Impact Of Metropolization On The Crime Structure (Case Study Of Provincial Capitals In Poland), Natalia Sypion-Dutkowska, Michael Leitner, Marek Dutkowski

Faculty Publications

The aim of this study is to verify the hypothesis that the rapid metropolization process that has been taking place in large Polish cities since the beginning of the second phase of post-communist transition in 2000 leads to their socio-economic diversity, which is manifested, among others, in the differentiation of the level and structure of crime. Introduced into the discourse of this paper are subsequent stages of metropolization, which are called potential, initiating, advanced, and mature and which the examined cities have achieved so far. These stages have led to various economic and social effects, which resulted in changes in …

Examining An Intersection Of Environmental Justice And Covid-19 Risk Assessment: A Review, Ashley Ellis Dec 2021

Examining An Intersection Of Environmental Justice And Covid-19 Risk Assessment: A Review, Ashley Ellis

Honors Theses

This study views the risks associated with the novel coronavirus (COVID-19) as an environmental injustice issue due to the connection between existing environmental disparities and the disproportional negative impacts brought upon by the virus. The social and health determinants attributed to those environmental disparities have traditionally been evaluated as individual risk factors, an approach that fails to gauge the complexity of an environmental injustice issue. This study employs the emerging theory of intersectionality, a belief that phenomena cannot be linked to one principal cause but instead an interconnected web of influences, in order to synthesize the multitude of factors believed …

The Role Of A-Layer In Polyunsaturated Fatty Acid (Pufa)-Mediated Effects On Aeromonas Salmonicida Subsp. Salmonicida, Allen Lin

Honors Theses

Aeromonas salmonicida subsp. salmonicida is a Gram-negative bacterium that infects salmonids and non-salmonids worldwide leading to an infection known as furunculosis, which is characterized by skin lesions and hemorrhages of the fish epidermis. This infection is carried out by a A+ (virulent strain) of A. salmonicida containing an important virulent factor known as the A-layer, which is a 2D paracrystalline structure that binds to the basement membrane and functions to promote adherence to host membranes and resistance to host defense. The purpose of this study was to examine the ability of the A+ A. salmonicida to incorporate exogenous fatty acids …

Gut Permeability And Osteoarthritis, Towards A Mechanistic Understanding Of The Pathogenesis: A Systematic Review, Giorgio Guido, Guido Ausenda, Veronica Iascone, Emanuele Chisari Dec 2021

Gut Permeability And Osteoarthritis, Towards A Mechanistic Understanding Of The Pathogenesis: A Systematic Review, Giorgio Guido, Guido Ausenda, Veronica Iascone, Emanuele Chisari

Rothman Institute Papers

Osteoarthritis (OA) is the most common condition affecting human joints. Along with mechanical and genetic factors, low-grade inflammation is increasingly supported as a causal factor in the development of OA. Gut microbiota and intestinal permeability, via the disruption of tight junction competency, are proposed to explain a gut-joint axis through the interaction with the host immune system. Since previous studies and methods have underestimated the role of the gut-joint axis in OA and have only focussed on the characterisation of microbiota phenotypes, this systematic review aims to appraise the current evidence concerning the influence of gut permeability in the pathogenesis …

A Survey Of The Epistolary Dimension In Peninsular Contemporary Women Poets [Panorama De Lo Epistolar En La Poesía Española Peninsular Contemporánea Escrita Por Mujeres], Elena Vega-Sampayo

Literatures and Cultural Studies Faculty Publications

This paper seeks to interpret the choice by some Peninsular women poets of what would initially seem to be mere traces, sheer remnants of the epistolary genre. To this end, a score of 20th and early 21st century works of Contemporary Peninsular Spanish women poets will be analyzed, bearing witness to a singular poetic reality, inasmuch they share an approach to the epistolary genre, and scrutinizing their connections with the literary tradition. By resorting to J. Culler's analysis of the apostrophe as a framework of reference, as well as to a specific analysis of the literary techniques and rhetorical figures …
