Could Private Legislation Be The First Key To Unlocking The Nation’S Information Resources In The Battle Against Misinformation?, Michelle M. Wu Jan 2021

Could Private Legislation Be The First Key To Unlocking The Nation’S Information Resources In The Battle Against Misinformation?, Michelle M. Wu

Georgetown Law Faculty Publications and Other Works

Unfiltered, unverified information flows freely on the web and is much more easily found and used than reliable sources. There are logical reasons for this, as quality, reliable information often costs both time and money to investigate, verify, and publish. However, that type of investment only justifies the charging for the information at the outset, not the cabining of it once it is available and has been purchased. Where public libraries have acquired content, they should be allowed to maximize its use in society within the bounds of copyright. Such use is within the spirit of copyright and its hope …

A Taxonomy Of Police Technology’S Racial Inequity Problems, Laura M. Moy Jan 2021

A Taxonomy Of Police Technology’S Racial Inequity Problems, Laura M. Moy

Georgetown Law Faculty Publications and Other Works

Over the past several years, increased awareness of racial inequity in policing, combined with increased scrutiny of police technologies, have sparked concerns that new technologies may aggravate inequity in policing. To help address these concerns, some advocates and scholars have proposed requiring police agencies to seek and obtain legislative approval before adopting a new technology, or requiring the completion of “algorithmic impact assessments” to evaluate new tools.

In order for policymakers, police agencies, or scholars to evaluate whether and how particular technologies may aggravate existing inequities, however, the problem must be more clearly defined. Some scholars have explored inequity in …

From Lex Informatica To The Control Revolution, Julie E. Cohen Jan 2021

From Lex Informatica To The Control Revolution, Julie E. Cohen

Georgetown Law Faculty Publications and Other Works

Legal scholarship on the encounter between networked digital technologies and law has focused principally on how legal and policy processes should respond to new technological developments and has spent much less time considering what that encounter might signify for the shape of legal institutions themselves. This essay focuses on the latter question. Within fields like technology studies, labor history, and economic sociology, there is a well-developed tradition of studying the ways that new information technologies and the “control revolution” they enabled—in brief, a quantum leap in the capacity for highly granular oversight and management—have elicited long-term, enduring changes in the …

Congressional Oversight Of Us Intelligence Activities, Mary B. Derosa Jan 2021

Congressional Oversight Of Us Intelligence Activities, Mary B. Derosa

Georgetown Law Faculty Publications and Other Works

This chapter examines the challenges, how they affect congressional oversight of intelligence, and Congress’s efforts to ensure accountability for United States (US) intelligence activities. The United States Government has engaged in intelligence collection and covert action since its earliest days. Congressional oversight of intelligence activities, however, has a relatively short history. It was not until the late 1940s, with the creation of the Central Intelligence Agency (CIA), that the US House of Representatives and Senate created entities – subcommittees of their Armed Services committees – with responsibility for intelligence oversight. The Church Committee revelations and other concerns that surfaced during …

French Military Masculinities And The Birth Of Cinéma Colonial: Triangulating Queer Desire In Jacques Feyder’S L’Atlantide (1921), Barry Nevin Jan 2021

French Military Masculinities And The Birth Of Cinéma Colonial: Triangulating Queer Desire In Jacques Feyder’S L’Atlantide (1921), Barry Nevin

Articles

Jacques Feyder’s L’Atlantide (1921) is widely considered not only cinéma colonial’s first major representative example but also one of the genre’s most emblematic narratives. However, ambiguities in the film’s portrayal of the mission civilisatrice have received comparatively little analysis. This article aims to expand on our understanding of L’Atlantide and the mirror it held up to interwar France in three main stages. First, it situates the film’s discourses of gender and colonialism within present post-colonial scholarship. Second, it analyses the aesthetic and political contexts of L’Atlantide, paying particular attention to how the film offered a remedy to France’s ailing postwar …

Biopolitics' New Iteration: Gay Men, Pre-Exposure Prophylaxis And The Pharmaco-Pornographic Imagination, Rory David Crath, J. Cristian Rangel, Adam Gaubinger Jan 2021

Biopolitics' New Iteration: Gay Men, Pre-Exposure Prophylaxis And The Pharmaco-Pornographic Imagination, Rory David Crath, J. Cristian Rangel, Adam Gaubinger

School for Social Work: Faculty Publications

This article builds upon Paul Preciado’s conceptualisation of pharmaco-pornographic power to understand the ongoing affects and effects of Pre-Exposure Prophylaxis (PrEP) on queer men’s sexual socialities and subjectivities. Drawing from a new-materialist epistemology, we analyze data from a sexual health pilot study in NYC to trace the techno-sexual health assemblages forming in queer life worlds. Our analysis suggests that these assemblages, entangling PrEP and other pharmacological substances, pornographic imaginaries together with mediatic technologies and public health rationalties, are creating paradoxical desires and practices of intimacy that are both normative and exceed rational health-actor logics and normative understandings of risk. These …

Ovarian cancer is the leading cause of gynecological malignancy-related deaths, due to its widespread intraperitoneal metastases and acquired chemoresistance. Mesothelial cells are an important cellular component of the ovarian cancer microenvironment that promote metastasis. However, their role in chemoresistance is unclear. Here, we investigated whether cancer-associated mesothelial cells promote ovarian cancer chemoresistance and stemness in vitro and in vivo. We found that osteopontin is a key secreted factor that drives mesothelial-mediated ovarian cancer chemoresistance and stemness. Osteopontin is a secreted glycoprotein that is clinically associated with poor prognosis and chemoresistance in ovarian cancer. Mechanistically, ovarian cancer cells induced osteopontin expression …

Adherence Of Internet-Based Cancer Risk Assessment Tools To Best Practices In Risk Communication: Content Analysis, Erika A Waters, Jeremy L Foust, Laura D Scherer, Amy Mcqueen, Jennifer M Taber

Open Access Publications

BACKGROUND: Internet-based risk assessment tools offer a potential avenue for people to learn about their cancer risk and adopt risk-reducing behaviors. However, little is known about whether internet-based risk assessment tools adhere to scientific evidence for what constitutes good risk communication strategies. Furthermore, their quality may vary from a user experience perspective.

OBJECTIVE: This study aims to understand the extent to which current best practices in risk communication have been applied to internet-based cancer risk assessment tools.

METHODS: We conducted a search on August 6, 2019, to identify websites that provided personalized assessments of cancer risk or the likelihood of …

Global Governance Of Environmental Mobility: Latin America & The Caribbean, Ama Francis Jan 2021

Global Governance Of Environmental Mobility: Latin America & The Caribbean, Ama Francis

Sabin Center for Climate Change Law

Environmental events – including droughts, floods, hurricanes, sea level rise and earthquakes play a role alongside socioeconomic and political factors in triggering displacement, migration and planned relocation in Latin America and the Caribbean (LAC). LAC countries experience the strongest relationship between environmental hazards and migration in the world. From 2008 to 2019, there were more than 23 million reported incidents of internal displacement in the context of disasters linked to sudden- and slow-onset hazards linked to disasters. LAC has developed a significant normative framework in response to environmental mobility, especially relative to other regions. In practice, LAC countries use regional …

The Law Of Enhanced Weathering For Carbon Dioxide Removal: Volume 2 – Legal Issues Associated With Materials Sourcing, Romany M. Webb Jan 2021

The Law Of Enhanced Weathering For Carbon Dioxide Removal: Volume 2 – Legal Issues Associated With Materials Sourcing, Romany M. Webb

Sabin Center for Climate Change Law

Achieving the Paris Agreement’s goal of limiting the increase in global average temperatures well below 2°C, and ideally to 1.5°C, above pre-industrial levels will likely require the removal of carbon dioxide from the atmosphere. This could be achieved in various ways, including by enhancing natural weathering processes in which carbon dioxide reacts with silicate-based rocks, eventually forming carbonate minerals (e.g., limestone). Research suggests that the amount of carbon dioxide sequestered through this natural process can be increased by grinding silicate-rich minerals (e.g., olivine) or rocks (e.g., dunite) to increase their surface area and then spreading the powder over land or …

Government Speech And First Amendment Capture, Caroline Mala Corbin Jan 2021

Government Speech And First Amendment Capture, Caroline Mala Corbin

Articles

Alarm regarding government speech is not new. In earlier decades, scholars worried that the government's speech might monopolize a marketplace and drown out opposing viewpoints. But today, using a move I term "First Amendment capture," the government need not be the loudest speaker because it can become the only speaker. First Amendment capture has been made possible by the Supreme Court's developing government speech doctrine, which holds that government speech is not subject to the Free Speech Clause. Consequently, once speech is declared governmental, the government may censor viewpoints it does not like. First Amendment capture categorizing contested speech as …

The Effects Of Adding Motivational Interviewing To A Behavioral Coaching Intervention To Increase Physical Activity, Ryley Acrea Jan 2021

The Effects Of Adding Motivational Interviewing To A Behavioral Coaching Intervention To Increase Physical Activity, Ryley Acrea

University of the Pacific Theses and Dissertations

Most people do not meet the physical activity guidelines set forth by the Center for Disease Control (CDC) and World Health Organization (WHO). Sufficient physical activity plays an important role in preventing chronic illnesses, such as Type 2 diabetes, which are a burden on the health care system. Health coaching (a client-centered approach to improve health outcomes) holds promise as a preventive strategy to change health behavior and limit office visits, thereby reducing the burden of illnesses caused by physical inactivity. One component of health coaching that warrants more research is motivational interviewing. The current study used a multiple baseline …

The Harmful Addiction To The War On Drugs, Walter E. Block, Alan G. Futerman Jan 2021

The Harmful Addiction To The War On Drugs, Walter E. Block, Alan G. Futerman

Touro Law Review

Most modern societies prohibit the use of addictive drugs such as cocaine and heroin. We contend this is a mistake. They should all be legalized, forthwith, since their usage constitutes a victimless crime. But more, we also maintain that these jurisdictions are actually addicted to these unjust and harmful laws since, no matter what the logic or the evidence about the perniciousness of this legislation, it still remains on the books

The Slippery Discourse Of Sexual Consent: Feminist Acumen And Feminist Excess, Dan Subotnik Jan 2021

The Slippery Discourse Of Sexual Consent: Feminist Acumen And Feminist Excess, Dan Subotnik

Touro Law Review

The Kavanaugh confirmation hearings, the Harvey Weinstein case, and the Jeffrey Epstein case have done us a valuable service. By focusing mass media attention and academic discourse on consent to sex and on assault, they have brought to a boil two issues that have been simmering for some time in feminist circles. The present essay invites readers to consider feminist writings over the last half-century that have influenced this discourse and continue to incite febrile talk today.

First to be examined is the American “heartbalm” regime, an early effort to protect women from the emotional harm resulting from seduction by …
