The Failed Attempt To Overthrow The American Government: Crime And Insurrection, Frances P. Bernat

Journal of Criminal Justice and Law

President Trump, refusing to concede the 2020 Presidential election, claimed that there was election fraud. On January 6, 2021, the date set to finalize the election results by Congress, President Trump implored hundreds of thousands of his followers to march to the Capitol and “Stop the Steal.” Inside and outside the Capitol building, the police were overpowered by a mob of Trump supporters who did not want to have Joe Biden be formally declared the next U.S. President. The siege on the Capitol, in a failed attempted overthrow of the national government, was thwarted later that night. In the early …

Assisted living (AL) has existed in the United States for decades, evolving in response to older adults' need for supportive care and distaste for nursing homes and older models of congregate care. AL is state-regulated, provides at least 2 meals a day, around-the-clock supervision, and help with personal care, but is not licensed as a nursing home. The key constructs of AL as originally conceived were to provide person-centered care and promote quality of life through supportive and responsive services to meet scheduled and unscheduled needs for assistance, an operating philosophy emphasizing resident choice, and a residential environment with homelike …

Property And Local Knowledge, Malcolm Lavoie Dec 2021

Property And Local Knowledge, Malcolm Lavoie

Catholic University Law Review

Property rights play an important but largely under-appreciated role in channeling local knowledge into decisions about physical resources. Property devolves decision-making authority to a dispersed pool of owners, who are likely to be aware of local conditions relevant to their resources. As a result, property owners are often in a position to make better-informed decisions about the use of the resource than other parties. The homeowner who preemptively repairs an old roof, the retailer who offers a new product for sale, and the farmer who decides to switch crops are all decision-makers who are empowered through property rights to act …

But We Didn’T Agree To That!: Why Class Proceedings Should Not Be Implied From Silent Or Ambiguous Arbitration Clauses After Lamps Plus, Inc. V. Varela, Andrea Demelo Laprade

Catholic University Law Review

The application of class arbitrability when a contract is silent on the matter remains a mystery. The Supreme Court has not clarified its stance on class arbitrability and preemptive effects of the Federal Arbitration Act on state law when applied to determine if class arbitrability is available. The purpose of this Paper is to address how the Lamps Plus v. Varela decision created more confusion about the question of class arbitrability. It argues that the failure to address the particulars of the availability of class arbitration will perpetuate litigation on this issue. This Paper suggests that the FAA’s purpose supports …

American Surrogacy: Babies For Sale?, Madison Edwards Dec 2021

American Surrogacy: Babies For Sale?, Madison Edwards

Honors Projects

More surrogacy contracts are fulfilled in the United States than in any other country (Bromfield, 2016, p. 193). In 2014, there were approximately 2,000 surrogacy arrangements in the U.S., yet the market is totally unregulated (Shellnutt and Grizzle, 2018, p. 31). Given that 1 in 6 American couples face infertility, there will continue to be a demand for alternative and assisted reproductive options (Shellnutt and Grizzle, 2018, p. 34). This paper seeks to explore several areas of surrogacy, including contract enforcement, potential problems parties in surrogacy agreements face, current legislation, the role of religion in surrogacy, and specific case studies. …

Archaeology Of Disease And Medicinal Practices In 18th-Century Boston, Massachusetts, Kaitlyn N. Ball

Graduate Masters Theses

This research explores the knowledge of medical techniques during the early 18th century in Boston, Massachusetts, a period of modernization and changing attitudes toward disease. By analyzing archaeoparasitological samples, written accounts, and artifacts associated with medicinal practices, I shed light on attempts to treat parasitic diseases encountered by those living in urban Boston. The collections I have selected to analyze are samples of urban Boston life and provide ideal contexts for parasite preservation. I analyze samples from the Parker-Emery household privy (c. 1720-1750) in the North End and compare them to samples from the early 18th-century Town Dock landfill in …

Meaning-Making Dynamics Of Job Interview Performances, Jacquelyn K. Bertman Dec 2021

Meaning-Making Dynamics Of Job Interview Performances, Jacquelyn K. Bertman

Graduate Masters Theses

Behavioral interviewing has become a popular technique used across fields to assess the fitness of job seekers (Roulin & Bangerter, 2012; Powers, 2000). This particular style of interviewing calls on the interviewee to narrate their prior experiences in the workforce, with the idea that past behavior on the job is prelude to future job performance. The answers (stories) follow a specific format in order to be considered successful, one that adheres to the style and organization of the dominant Discourse (Gee, 1989). However, storytelling is a culturally situated practice and candidates from diverse backgrounds may construct their narratives outside of …

Health Policy & Community Health: Faculty Publications

Previous studies on the use of social media (SM) during the COVID-19 pandemic have focused on the use in sustaining academic communication. This study aimed to assess the association between SM and the ease of transitioning to online classes during the COVID-19 pandemic using survey data from 872 undergraduate students. The findings showed that Snapchat and Instagram were the most preferred social media sites among participants. Compared to students who use SM for <2 hours a day, use for > 5 hours (AOR= 2.44; 95% CI, 1.13 – 5.25) or 3 to 5 hours a day (AOR = 2.01, 95% CI 1.06-3.81) increased the odds of easily …

A Numerical Solution Of Water Flow In Unsaturated Soil With Evapotraspiration, Andrei Ludu, Harihar Khanal, Ramesh Chandra Timsina, Kedar Nath Uprety

Publications

Flow movement in unsaturated soil can be expressed by Richards equation. This equation can be obtained by applying the mass conversation law and the Darcy law. In this work, we solve one-dimensional Kirchhoff transformed Richards equation with loss of water due to the evaporation of unsaturated porous media (soils) and transpiration of plants numerically using Crank-Nicolson method. The result has compared with evapotranspiration function and without it in the governing equation. It has found that an additional work in time and flow movement is needs to reach the given boundary condition for the model without evapotranspiration.

This study focuses on the issue of the prohibition to work for refugees and asylum seekers by reviewing the law and regulation concerning refugee protection, rights to work for foreigners, and fundamental human rights. In addition, a review of international norms and conventions on human rights, as well …

Legal Introspection Towards The Development Of Right To Privacy As Fundamental Right In India, Payal Thaorey

Indonesia Law Review

Privacy of the individual is an essential aspect of dignity. The ability of the individual to protect a zone of privacy enables the realization of the full value of life and liberty. Liberty has a broader meaning of which privacy is a subset. All liberties may not be exercised in privacy. Yet others can be fulfilled only within a private space. Privacy enables the individual to retain the autonomy of the body and mind. The autonomy of the individual is the ability to make decisions on vital matters of concern to life. The journey of right to privacy has been …

Regulating Data Exclusivity Of Ride-Hailing Service In Indonesian Competition Law, Annisa Rahma Diasti

Indonesia Law Review

The digital ride-hailing service platforms have advanced significantly due to technological development. It resulted in lower consumer costs and better-quality service. Thus, consumers opted for such platforms more than the conventional transportation, resulting in their exponential growth over the years such as Gojek and Grab in Indonesia. Their strong market position was achieved quickly, facilitated by innovation advantages such as indirect network effects and algorithm-based analysis of users’ past data. Ultimately, data has become a barrier for potential competitors to entering the market. Simultaneously, the incumbents or the dominant market holders likely to use a technology-based strategy by keeping access …
