Shortly after turning 17, Robert Webster was arrested for firebombing a drug witness’s home in Jamaica, Queens at the height of the crack epidemic in 1987. Convicted as a juvenile, he was sentenced 50-to-life for causing minor burns and property damage after the arson was linked, in the public eye, to the subsequent assassination of a young police officer.
Having maintained his innocence since the day of his arrest, Webster is now seeking clemency.

The purpose of this project is to evaluate the effectiveness of the Adolescent Intervention Program (AIP), a faith-based drug and alcohol recovery program for teens. This is an alternative to jail program. Nearly 1 in 10 Americans, 12 years or older (20.1 million people), have a substance use disorder (SUD), involving alcohol or illicit drugs (National Center for Drug Abuse Statistics, 2019). The average age of first-time alcohol or substance use is 13 years old and nine out of ten addictions start in the adolescent years (National Center for Drug Abuse Statistics, 2019). Abstract The goal of the Elk Grove Village Cares program is to decrease the deaths and overdoses of those who abuse opioids through harm reduction strategies and provide access to treatment. The article is a program evaluation of the Elk Grove Village Cares program. Surveys, interviews and the synthesis of program data is used to evaluate the efficacy of program activities. Results: The rate of death from opioid use has decreased an average of 1.7 deaths since program implementation in 2018. Law enforcement officers (LEO) and the community responded similarly to many survey questions regarding attitudes surrounding addiction. Within the …

This Article analyzes Derrick Bell's interest-convergence theory and its utility for lawyers when litigating for the rights of nondominant groups. The first part of this Article studies four different cases in which plaintiffs or amicus curiae chose arguments that highlighted the ways their interests converged with potential allies. The Article uses these cases as examples of four different ways that a lawyer can engage in interest-convergence litigation. The strategies examined in this Article rest on two axes: dominant/nondominant narrative convergence and natural/unnatural ally convergence. An analysis of the effects of each of these techniques makes it clear that dominant narrative …

The goal of the dissertation is to undertake an analysis of substance use disorders that focuses on a public health ethics perspective. The ethical argument focuses upon justifying the use of harm reduction and is primarily concerned with the current opioid crisis. While substance abuse/misuse over the course of history has been identified as a public health concern, this dissertation presents substance use disorders over the course of the lifespan, examining various contexts in which it can affect daily living and health outcomes. During the 1980s, the HIV epidemic grew worse each year. The virus is easily spread through shared injection needles. In 1985, activists in New York learned of a solution utilized in Amsterdam, where the municipal health system established a needle exchange program that distributed more than 100,000 needles.

Eighth Amendment jurisprudence has resulted in limited scrutiny of solitary confinement despite the known harms associated with the practice. The two-part test established by the federal courts to evaluate Eighth Amendment claims and limitations on challenging prison conditions under the Prison Litigation Reform Act can make it difficult to establish that solitary confinement is cruel and unusual punishment.
State constitutional challenges to solitary confinement are underexplored. Nearly all state constitutions contain an equivalent provision to the Eighth Amendment’s prohibition on cruel and unusual punishment. State courts need not be bound by federal jurisprudence in interpreting the scope of the state …

The opposite of poverty is not wealth. It is justice. Beginning in the 1980s, a "trail of tax cuts" led to budget shortfalls and revenue gaps throughout the United States. These budgetary problems resulted in many cities and towns shifting their burden of funding courts and the justice system at large "to the 'users' of the courts, including those least equipped to pay." Although "jailing an indigent person for a fine-only, low-level offense is unconstitutional," it is still an ongoing practice in many states, including Arkansas. In 1995, Arkansas passed new legislation to govern its circuit courts' collection and enforcement …

Current literature indicates a strong association between asthma and the early onset of comorbid generalized anxiety disorder (GAD) in minors and their primary caregivers. Studies show that asthma prevalence increases with certain demographic factors, such as ethnicity, socioeconomic status, and housing quality. Evidence also suggests that GAD influences decision-making, especially when deciding to utilize emergency room (ER) services for asthma-related concerns. This study analyzed the effect of comorbid GAD on minors with asthma and ER utilization. A doctor botches a vasectomy. Or says it’d be dangerous to keep a healthy pregnancy. Or misses a risk of passing along disease. Our laws do little to deter such reproductive negligence or compensate its victims. Some of this misconduct leaves people without the baby they desperately want. Other times, it foists on parents a child they’d set out to avoid. Or one with meaningfully different traits than what they were led to believe.
I call these three harms procreation deprived, procreation imposed, and procreation confounded.

Sex offender treatment is often court ordered and part of conditional release for individuals who have been convicted of harmful sexual acts. Counselors working with this population have an important role in terms of supporting and addressing the needs of their clients, but also in terms of public safety. A cursory exploration of this treatment includes an overview of the role that risk/protective factors documented through assessments have on outcomes, the impact of restrictions regarding conditional release, and how the counselors are both impacted by and integral to this field. The long-term use of opioids to manage chronic pain in those with an opiate use disorder (OUD) is dangerous and poses a considerable risk of death. Pain management providers must have protocols and tools in place for OUD screening and referral. If OUD is not managed correctly, such as through provider education, screening, and referral, morbidity and mortality rates will severely affect society (Centers for Disease Control and Prevention, 2020). Recent studies have shown that eyewitness confidence is positively associated with high identification (ID) accuracy, but some eyewitness researchers have expressed concerns regarding the reliability of this confidence-accuracy relationship in applied settings (e.g., are there circumstances or moderator variables that make this relationship less reliable?). For the present study, we considered two types of moderator variables: material difficulty (i.e., the difficulty level associated with different sets of eyewitness stimuli) and individual difference factors such as face recognition ability. Volume 7 of The Year in C-SPAN Archives Research series focuses on the relationship between democracy and the media. Using the extensive collection of the C-SPAN Video Library, chapters cover Trump political rallies, congressional references of late-night comedy, responses of African American congresswomen to COVID-19 bills, and congressional attacks on the media through floor speeches in the House of Representatives and Senate.

If a rape victim becomes pregnant following the attack, she has three options: abort the pregnancy, place the child for adoption, or keep and raise the child. However, by requiring proof of conviction of rape to terminate the parental rights of the man who fathered that child through his rape, the Commonwealth of Virginia imposes a substantial burden on a victim weighing those options. To obtain a conviction under the current scheme, a victim, through her local prosecutor, has to prove to a jury that the accused committed the rape beyond a reasonable doubt.
