How U.S. Gdp Affects Prison Population: Discrediting Conceptions Of Recessions, Michael Mcpherson
How U.S. Gdp Affects Prison Population: Discrediting Conceptions Of Recessions, Michael Mcpherson
Student Research Symposium (SRS)
This research was designed to discover correlative effects of US GDP with prison population. This arose out of the lack of studies conducted on economic effects of prison laborers within the U.S. economic framework. A rudimentary statistical regression was executed to determine the effects of real GDP based in the year 2012 with the U.S. prison population. Qualitative and theoretical sources supplemented the analysis to provide context to the trends that were discovered. Change in U.S. GDP was found to have ambiguous effects on the prison population which debunks the notion that recessions cause escalations in serious criminal activity.

New Federalism And Civil Rights Enforcement, Alexander Reinert, Joanna C. Schwartz, James E. Pfander
Northwestern University Law Review
Calls for change to the infrastructure of civil rights enforcement have grown more insistent in the past several years, attracting support from a wide range of advocates, scholars, and federal, state, and local officials. Much of the attention has focused on federal-level reforms, including proposals to overrule Supreme Court doctrines that stop many civil rights lawsuits in their tracks. But state and local officials share responsibility for the enforcement of civil rights and have underappreciated powers to adopt reforms of their own. This Article evaluates a range of state and local interventions, including the adoption of state law causes of …

Sex And The Streets: The Open Secret Of Sexual Abuse Among Pakistan's Two Million Street Children, Amir Humza Sohail, Muhammad Hassaan Arif Maan, Sachal Sohail
Medical College Documents
Background: About two million children live on the streets in Pakistan. Their complicated past and dire living conditions make them susceptible to many psychological and physical problems, including sexual abuse.
Main body: With little research on the topic, the prevalence of sexual intercourse among street children is reported to be as high as 88% in Pakistan. With commercial sex a common practice among the street children, public places such as bus terminals and parks have become foci of prostitution and sexual exploitation. A growing concern is the spread of HIV/AIDS among the affected children due to a general lack of …

Prison Librarianship And Lis Schools: Is There A Career-Path?, Patrick J. Raftery Jr
Urban Library Journal
Library Information Science research has inquired and advocated for prison librarianship since as far back as the 1930s. While most of the articles published focus on the problems facing these institutional libraries, (budgets, censorship, best practices, and standards), very few focus on the preparations LIS schools take to prepare and promote prison librarianship. For many years’ civilians, not professional librarians, operated prison libraries. Although the rise in professional librarians in prison libraries has grown, has the preparation and quality of professionally trained institutional/prison librarians changed? Previous research states LIS schools often overlook or ignore institutional/prison librarianship. This article explores past …

Sweet And Sour: The Representations Of Chinese Americans In American Popular Culture, 2010-2020, Yu Dong
Student Theses and Dissertations
ABSTRACT Yu Dong SWEET AND SOUR: THE REPRESENTATIONS OF CHINESE AMERICANS IN AMERICAN POPULAR CULTURE, 2010-2020 The history of Chinese Americans can be traced back to the 1850s. From “filthy foreigner” to “model minority” to “virus spreader,” White Americans’ attitudes and perceptions toward Chinese Americans have been vague and ambivalent and constantly shifting back and forth in different time periods. However, one thing has never changed – Chinese Americans are perpetual foreigners. The purpose of this dissertation is to investigate the representations of Chinese Americans in American popular culture (2010-2020) by comparing these images in Americans’ minds with Chinese American …

Walking The Line: Understanding The History And Development Of The Nhtsa Standardized Field Sobriety Tests, Jon D. Gurney
USF Tampa Graduate Theses and Dissertations
In the early 1980’s within the United States, state legislatures criminalized the practice of driving under the influence of alcohol due to the efforts of moral entrepreneurs such as Mothers Against Drunk Driving that served to vilify the drunk-driver. During the political culture of the early 1980’s, the National Highway Traffic Safety Administration sought to develop field sobriety tests that would assist law enforcement in the detection and arrest of drunk drivers.
This study provided a brief historical account of the development of the NHTSA Standardized Field Sobriety Test battery, which consisted of the Horizontal Gaze Nystagmus test, the Walk …

Juridical-Normative Review Of The Designation Of Armed Criminal Groups (Kkb) In Papua As Terrorist Groups, Marthen Napang, Syaiful Rohman
Juridical-Normative Review Of The Designation Of Armed Criminal Groups (Kkb) In Papua As Terrorist Groups, Marthen Napang, Syaiful Rohman
Journal of Terrorism Studies
There are differences of opinion among various groups after the stipulation of the Armed Criminal Group (KKB) in Papua as a terrorist group/organization. KKB has been identified with the West Papua National Liberation Army (TPNPB-OPM), which is one of the armed separatist movements in Papua. The determination based on armed violence carried out by the KKB has political, ideological, and security motives which are elements in the crime of terrorism. In the context of criminal law reform, the drafters of the Criminal Code separate criminal acts of terrorism and treason in different forms and concepts. Separately, they are categorized as …

The Portrayal Of Trial By Jury In American Entertainment, Kimberly Satterfield
The Portrayal Of Trial By Jury In American Entertainment, Kimberly Satterfield
Undergraduate Honors Thesis Projects
Numerous American films have portrayed jurors who make difficult decisions together in order to fairly and justly decide a case. Serving on a jury is the main role that an average American plays in the legal system, which helps explain why movies about court cases, and specifically about juries, are popular in America. In this thesis, I will use the film theory of spectatorship, which studies how a spectator comes to view themselves in relation to a film, to look more closely at the portrayal of trial by jury in American cinema. I will also be using the idea of …

Staying Afloat: Experiences Of Previously Incarcerated Students, Jodi Burshia, Jodi Burshia
Teacher Education, Educational Leadership & Policy ETDs
The experiences of Previously Incarcerated Indigenous Students (PIIS) need to be understood so that educators and administrators can include the experiences, perspectives, and realities of Indigenous students who have been previously incarcerated in Adult Basic Education (ABE) and collegiate programs at Tribal Community Colleges and Universities (TCUs). To date, considering and providing targeted support for this population has not been part of the focus of TCUs even when all tribal colleges work to strengthen the cultural heritage of their respective tribes (Bad Wound, 1990) and some students at TCUs are PIIS. This qualitative study offers a respectful critique of higher …

Criminal Justice Citizenship, Daniel S. Mcconkie, Jr.
Criminal Justice Citizenship, Daniel S. Mcconkie, Jr.
Florida Law Review
The American criminal justice system is fundamentally democratic and should reflect an ideal of citizenship that is equal, participatory, and deliberative. Unfortunately, the outcomes of criminal cases are now almost always determined by professionals (prosecutors, defense attorneys, and judges) instead of by juries. This overly bureaucratized system of adjudication silences the voice of the people. A better system would strengthen “criminal justice citizenship,” which refers to the right of the citizenry to participate, directly and indirectly, in the criminal justice system and to deliberate in its workings. The three key principles of criminal justice citizenship are membership, participation, and deliberation. …

Are Good Deeds Being Punished?: Independent Charity Patient Assistance Programs And The Anti-Kickback Statute, John C. Hood
Florida Law Review
Largely funded by the pharmaceutical industry, Independent Charity Patient Assistance Programs (PAPs) dispense billions of dollars of aid annually to help financially vulnerable patients afford their prescription drugs. Recently, these charitable entities and their drug company donors have faced mounting legal scrutiny for allegedly funneling illegal kickbacks to Medicare beneficiaries. This Note examines Independent Charity PAPs and the issues they raise under the Anti-Kickback Statute (AKS). It explores the uncertain legal environment in which Independent Charity PAPs operate and concludes that a new AKS regulatory safe harbor may be necessary to preserve the viability of the safety net assistance that …
Technological Triage Of Immigration Cases, Fatma Marouf, Luz Herrera
Technological Triage Of Immigration Cases, Fatma Marouf, Luz Herrera
Florida Law Review
In the medical profession, triage refers to sorting medical resources in emergency situations based on the greatest need for immediate attention. Similarly, legal service providers talk about “triaging” cases to prioritize individuals with the most serious problems. But in the immigration field, the concept of triage is turned on its head. Noncitizens with the riskiest cases—those facing deportation—have the least access to legal assistance, especially if they are detained.
Technology has the potential to help with triage but is not yet being used effectively to assist with deportation defense. This Article argues that utilizing technology to facilitate access to representation …
