Meaningless Guarantees: Comment On Mitchell E. Mccloy’S “Blind Justice: Virginia’S Jury Sentencing Scheme And Impermissible Burdens On A Defendant’S Right To A Jury Trial”, Alexandra L. Klein
Washington and Lee Law Review
Despite the important role that jurors play in the American criminal justice system, jurors are often deprived of critical information that might help them make sense of the law their oaths require them to follow. Such information with regard to sentencing might include the unavailability of parole, geriatric release, sentencing guidelines, or other information that is relevant to determining a defendant’s penalty. Withholding information from juries, particularly in sentencing, risks unjust and inequitable sentences. Keeping jurors in the dark perpetuates injustices and undermines public confidence and trust in the justice system.
Mitch McCloy’s excellent Note provides a compelling illustration of …
Prisoners, Power And Panopticon: Investigating Fremantle Gaol, 1831-1841, Emily Lanman
Prisoners, Power And Panopticon: Investigating Fremantle Gaol, 1831-1841, Emily Lanman
Theses
The history of crime and punishment is intertwined with Australia’s colonisation, including the foundation of the Swan River Colony in 1829. It can be demonstrated that Jeremy Bentham’s writings on criminal reform, specifically through his work on the panopticon model prison, influenced the development of punishment and prisons in the colony. This is evident in the construction of Fremantle Gaol (1831), which was built on the principles set forth by the panopticon and provides an interesting insight into what was deemed important in the penal system the colony continued to establish between 1831 and 1841. While Fremantle Gaol conformed to …

Structuring Techlaw, Rebecca Crootof, Bj Ard

Technological breakthroughs challenge core legal assumptions and generate regulatory debates. Practitioners and scholars usually tackle these questions by examining the impacts of a particular technology within conventional legal subjects — say, by considering how drones should be regulated under privacy law, property law, or the law of armed conflict. While individually useful, these siloed analyses mask the repetitive nature of the underlying questions and necessitate the regular reinvention of the regulatory wheel. An overarching framework — one which can be employed across technologies and across subjects — is needed.
The fundamental challenge of tech-law is not how to best regulate …
Three Observations About The Worst Of The Worst, Virginia-Style, Corinna Lain
Three Observations About The Worst Of The Worst, Virginia-Style, Corinna Lain

Much could be said about Virginia’s historic decision to repeal the death penalty, and Professor Klein’s essay provides a wonderful starting point for any number of important discussions. We could talk about how the decision came to be. Or why the move is so momentous. Or what considerations were particularly important in the decision‑making process. Or where we should go from here. But in this brief comment, I’ll be focusing not on the how, or the why, or the what, or the where, but rather on the who. Who are condemned inmates, both generally and Virginia‑style?
Plea Bargaining: A Test Of Dual Discounting Preferences For Non-Monetary Losses, Lauren E. Clatch
Plea Bargaining: A Test Of Dual Discounting Preferences For Non-Monetary Losses, Lauren E. Clatch
Law Faculty Publications
Judgment and decision-making research on discounting suggests that when humans are thinking about gains, they tend to prefer certain and immediate outcomes to uncertain and delayed outcomes. However, discounting has been studied primarily using monetary commodities and, until recently, by testing one feature of the binary forced-choice task at a time: delay, probability, or amount of money received/lost. The present research is the first test of a dual discounting task that combines probability and delay into a single, binary forced-choice task in a non-monetary loss context. The key findings, based on three studies, suggest that delay and probability discounting play …
