Widening The Pathway To A Degree: The Impact Of Accepting Credit For Prior Learning At A Community College, Jessica Berek
Widening The Pathway To A Degree: The Impact Of Accepting Credit For Prior Learning At A Community College, Jessica Berek
Graduate Research Theses & Dissertations
Credit for prior learning is a way to recognize previous experiences and knowledge as an equivalent to college level learning. Determining effective ways to accept credit for prior learning experiences can have a positive impact on students, including community college students, as they work to reach academic goals. This qualitative study aimed to understand the experiences of community colleges students who have received credit for prior learning on their academic transcript. Through interviews with students, benefits and barriers of credit for prior learning were discussed. Barriers to credit for prior learning included a lack of overall knowledge on the types …
Justifying Force: Police Procedurals And The Normalization Of Violence, Emily Brenner
Justifying Force: Police Procedurals And The Normalization Of Violence, Emily Brenner
Faculty Curated Undergraduate Works
Much like the CSI effect in forensic crime dramas, portrayals of law enforcement in crime media can potentially skew a viewer’s perception of what the profession actually entails. Many studies address the depiction of law enforcement in the media, but few solely examine the use of force by television police officers, and the impact this may have on frequent viewers. In an era of calls for accountability over growing attention towards police brutality and misconduct, the media as an influencer has the potential to play a role in how real-world instances of brutality are perceived, and more importantly, how it …

Review Of Inmate Litigation Challenging The Constitutionality Of Solitary Confinement, Kaelyn Little
Review Of Inmate Litigation Challenging The Constitutionality Of Solitary Confinement, Kaelyn Little
All ETDs from UAB
Inmate litigation has evolved since the 1960s, and little is known about the state of inmate litigation since the enactment of the Prisoner Litigation Reform Act (PLRA) in 1996. Additionally, the current conditions of solitary confinement are largely unknown, and correctional facilities operate with little accountability. This study provides an analysis of Section 1983 lawsuits across six states and decided from 2015 to 2020. All cases included in the study involved inmates filing a Section 1983 lawsuit due to a constitutional violation experienced during their time spent in solitary confinement. The findings showed that most lawsuits were unsuccessful due to …
Understanding And Improving The Police Response To Suspected Cases Of Human Trafficking, Lekendra Kidd
Understanding And Improving The Police Response To Suspected Cases Of Human Trafficking, Lekendra Kidd
All ETDs from UAB
Human trafficking has been on the rise since slavery was abolished in the 19th century. As the prevalence of human trafficking continues to rise, the criminals involved continue to develop more sophisticated ways to hide their crimes from the police. Accordingly, countless victims remain unidentified. Research shows there is a critical need for local law enforcement officers to be trained in how to identify and investigate cases of human trafficking, as well as to interact compassionately with and effectively help its victims. The purpose of the current study was to qualitatively investigate the human trafficking training currently provided to local …

From Deviance To Disease: How Congress Frames Opioid Use, 1994-2019, Stephanie Kirkland
All ETDs from UAB
Over the past thirty years, the use of opioids like heroin, fentanyl, oxycodone, and hydrocodone led to tens of thousands of deaths from overdoses and caused a public health crisis. Researchers have noted the roles of various social organizations and groups in creating a public discourse around this topic and have studied the changing public views of opioid use in light of new scientific research. And yet, there remains a gap in research on the role of the members of Congress in this public discourse. These legislators pass policies that directly affect people who live with or who know someone …

Introduction – 2019 Constitutional Cases At The Supreme Court: Up Close And In Person, Sonia Lawrence
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
From the vantage point of Summer 2020, 2019 seems almost a mirage. The conditions created across Canada by government and individual responses to COVID-19 were all but unimaginable when 2019 drew to a close, and the legal issues that preoccupy those interested in constitutional and public law now revolve around rapidly evolving rules and policies designed to protect public goods like health and health care. Questions of profound significance to constitutional lawyers, such as the location of limits on state powers, the appropriate roles and relative competencies of courts and governments, the place of state law in creating the good …

Policing Arbitrariness: Fleming V. Ontario And The Ancillary Powers Doctrine, Terry Skolnik, Vanessa Macdonnell
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
In 2019, the Supreme Court of Canada released its decision in Fleming v. Ontario. The case is significant because it is one of the very few police powers cases in the past three decades in which the Supreme Court has declined to recognize a new power. Since the pivotal case of Dedman, police powers jurisprudence has been characterized by the recognition of increasingly more intrusive common law powers to detain, investigate and search. This trend seemed to reach its zenith in Saeed, in which a majority of the Court recognized a common law power to conduct a warrantless penile swab …

The Beginning Of The End: Abolishing Capital Punishment In Virginia, Alexandra L. Klein
The Beginning Of The End: Abolishing Capital Punishment In Virginia, Alexandra L. Klein
Faculty Articles
When thinking about the history of capital punishment in the United States, I suspect that the average person is likely to identify Texas as the state that has played the most significant role in the death penalty. The state of Texas has killed more than five hundred people in executions since the Supreme Court approved of states' modified capital punishment schemes in 1976. By contrast, Virginia has executed 113 people since 1976.
But Virginia has played a significant role in the history of capital punishment. After all, the first recorded execution in Colonial America took place in 1608 at Jamestown, …

Fake News & International Criminal Law, Sara L. Ochs
Fake News & International Criminal Law, Sara L. Ochs
Saint Louis University Law Journal
In a decade defined by fake news, nations have weaponized disinformation to attack political, legal, and social systems throughout the world. Specifically, in recent years, government leaders have spread fake news about the International Criminal Court (“ICC”) in efforts to turn public opinion against the ICC and deter its attempts to investigate and prosecute controversial cases. Given the ICC’s reliance on state party cooperation, not only does this use of fake news hamper the Court’s likelihood of successfully prosecuting crimes that are of most concern to the international community, but it also promotes a version of history that denies victims …

A Trend You Can't Ignore: Social Media As Government Records And Its Impact On The Interpretation Of The Law, Jessica De Perio Wittman
Faculty Articles and Papers
There has been a sharp increase in official communications from government agencies and elected officials that occur initially, primarily, and even solely, on social media. The Federal Records Act (FRA), Presidential Records Act (PRA) and the Freedom of Information Act (FOIA) govern the retention, access, preservation and disclosure of records produced by the federal government. Recent litigation has highlighted why courts, attorneys, and other legal researchers must consider social media as a primary source of government information, particularly when records may become inaccessible once a social media post is modified or deleted, or when technology becomes obsolete. Additionally, as social …

Now Is Not The Time For Another Law School Lecture: An Andragogical Approach To Virtual Learning For Legal Education, Charletta A. Fortson
Saint Louis University Law Journal
COVID-19 forced nearly every institution of higher learning, as well as others, to quickly pivot from a traditional face-to-face teaching model to an online teaching model. While some institutions had technology in place to quickly adapt, most institutions were not prepared. Even where the technology infrastructure was in place, the faculty were not readily prepared to adapt their teaching style to this online model. Given these challenges, many professors chose the path of least resistance and chose to conduct those lectures just as they always had but just in an online format. However, now was not the time for another …
The Trafficking Of Men And Boys In The United States And India: A Legal Analysis, Benjamin Portnoy
The Trafficking Of Men And Boys In The United States And India: A Legal Analysis, Benjamin Portnoy
Research Days Posters 2021
“Trafficking may answer a demand, but the cost is too steep for this ever shrinking world to bear” (Feingold, p. 32). Human trafficking exists as an intensely globalized issue that victimizes people from all walks of life. Unfortunately, most major international and federal anti-trafficking laws have only been implemented within the past twenty years. The trafficking of men and boys certainly constitutes a minority share of this issue, but receives a disproportionately low share of attention in the fight against trafficking. This becomes especially prevalent when analyzing our international legal systems. Traffickers within the United States and India continue to …

Predictive Policing: The Use Of Ai In The Justice System And The Future Of Law Enforcement, Eric Yen
Research Days Posters 2021
Defund the police. This simple mantra carried an immense weight as it rippled through the country last summer. It rallied millions together to protest the death of those victims of police brutality, such as George Flloyd and Breona Taylor. The turmoil and uncertainty opened up one glaring question: what does the future of policing look like? How will the police operate with less funding, while becoming more equitable? One answer seems to be predictive policing, which has already been implemented by the NYPD and LAPD. This method utilizes algorithms to predict when and where a crime will take place, and …
Victims On Trial: New York’S Response To Sex Trafficking, Jason Anglum
Victims On Trial: New York’S Response To Sex Trafficking, Jason Anglum
Research Days Posters 2021
In 2019, New York State had a reported 454 cases of labor and sex trafficking. It had the fourth most cases of any state in the U.S. behind California, Texas, and Florida, the three most populous states. Sadly, there are likely far more trafficking cases than were reported. In the 21st century, New York State has taken considerable action to combat human trafficking by passing legislation including the Human Trafficking Act (2007) and the Safe Harbor for Exploited Children Act (2008). But in 2013, the state began using the criminal justice system to combat sex trafficking. New York established the …
