Promoting Privacy, Fairness And The Open Court Principle In Immigration And Refugee Proceedings, Jon Khan, Sean Rehaag Nov 2021

Promoting Privacy, Fairness And The Open Court Principle In Immigration And Refugee Proceedings, Jon Khan, Sean Rehaag

All Papers

Court decisions and court documents are becoming easier to access online than ever before. This access provides many possible benefits, including increased fairness. But court decisions and documents often contain intensely personal information. Public exposure of that private information may even lead to significant harm. The Federal Court of Canada has demonstrated leadership among Canadian courts in attempting to proactively grapple with these issues, including by consulting stakeholders about increased electronic access to court records.

We—researchers connected with the Refugee Law Lab based out of York University’s Centre for Refugee Studies and Osgoode Hall Law School—write this paper to participate …

Bridging The Gap Between Clients And Public Defenders: Introducing A Structured Shadow Method To Examine Attorney Communication, Christopher M. Campbell, Kelsey S. Henderson Nov 2021

Bridging The Gap Between Clients And Public Defenders: Introducing A Structured Shadow Method To Examine Attorney Communication, Christopher M. Campbell, Kelsey S. Henderson

Criminology and Criminal Justice Faculty Publications and Presentations

A growing body of scholarship argues that representing clients in an effective and quality manner should be a critical goal for public defenders, emphasizing the need to be client-centered. Beyond this call, recent research emphasizes that client-centered approaches hinge on good communication as it can contribute to a more effective attorney–client relationship. However, to identify and improve communication and client-centered relationships, major obstacles must be overcome which involve conceptualizing and operationalizing quality representation and communication. In this article, we introduce a two-phase, structured shadowing method as a way to overcome these obstacles. Phase I consists of a survey of public …

Intra-Participant And Inter-Analyst Cacophony: Working The Hyphen Between Modalities Using Provocative Reflexivity, David A. Caicedo, Andrea Nikté Juarez Mendoza, Miguel Pinedo

Publications and Research

Multimodal psychological research highlights the benefit of using complementary approaches to the phenomenological study of lived experience. Rather than focus on any individual method, this study attempts to concentrate on the transition, or hyphen, between them, as a place for reflexivity, ethics, and theory. Participants were 14 adults, recruited from ‘New York Community College’ and ‘New Jersey Community College’ in the U.S., who engaged in focus groups where they completed two activities: drawing a map of their personal journey to the college or of their self-identity, and their definitions for the immigration-related terms illegal and undocumented. Results demonstrated that …

Copycat Mass Killings: How Personality Might Moderate Identification With Antisocial Characters, Emily R. Mazzurco Nov 2021

Copycat Mass Killings: How Personality Might Moderate Identification With Antisocial Characters, Emily R. Mazzurco

Kean Quest

Research indicates that certain personality traits are prevalent within mass killers. Aggression, social rejection, narcissism, fame-seeking, low self-esteem, and depression are commonalities with mass killers, specifically mass shooters. Identification or idolizing antisocial fictional characters is also a common behavior within these types of offenders. These types of killers often draw inspiration for their own crimes from past criminals or from film and TV, thus committing what is known as a copycat crime. The purpose of the current study will be to examine the effects of social rejection and instigation on the likelihood of identifying with an antisocial character in young …

Trauma, André Douglas Pond Cummings Nov 2021

Trauma, André Douglas Pond Cummings

Law Faculty Scholarship

Meek Mill’s life and career have been punctuated by trauma. From childhood through his current adulthood, Mill has experienced excruciating trauma even as a well-known hip hop artist. In 2018’s track of that name Trauma, Mill describes in illuminating prose just how these traumatic experiences harmed and impacted him personally describing the very same harms that impact so many similarly situated young black people in the United States. Meek Mill, as a child, witnessed violent death and experienced poverty while as a young man he was arrested and incarcerated (wrongly). Despite his star turn as a true hip hop icon, …

Rap Lyrics And Evidence Of Guilt: The Racial Impact Of The Weaponization Of Evidence Rules, Brooke Hodgins Nov 2021

Rap Lyrics And Evidence Of Guilt: The Racial Impact Of The Weaponization Of Evidence Rules, Brooke Hodgins

Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog

Many who study the Unites States criminal justice system are quick to note that racial discrimination in the specific contexts of policing and incarceration leads to disproportionate outcomes for Black and Hispanic Americans. As these aspects of our justice system are riddled with racially disproportionate impacts, their prominence in the advocacy for criminal justice reform and legislative attention is undeniably warranted. However, there is also an area less prominent in the public conversation that has shown to play a substantial role in contributing to the racial disparity we see within our system today: state and federal rules of evidence. Specifically, …

A Female Scribe In The Twenty Sixth Dynasty [Iretrau], Heba Maher Nov 2021

A Female Scribe In The Twenty Sixth Dynasty [Iretrau], Heba Maher

Journal of the General Union of Arab Archaeologists

(En)

This research studies Iretrau’s ‘sS-sHm.t’, which was mentioned several times in her tomb. This is a clear reference to literacy. It is notable that Iretrau and her position as a scribe is one of the most complicated issues, due to the lack of texts written by her as a male scribe, as well as the absence of writing tools in her tomb. However, there are many other reasons for looking at Iretrau as a literate woman who held a scribal position with actual duties according to previous indications. The fact that Iretrau used the very plain …

Analysis And Strategy Of Ai Ethical Problems, Zhaoxiang Zhang, Jiyu Zhang, Tieniu Tan Nov 2021

Analysis And Strategy Of Ai Ethical Problems, Zhaoxiang Zhang, Jiyu Zhang, Tieniu Tan

Bulletin of Chinese Academy of Sciences (Chinese Version)

Artificial intelligence (AI) is the core of the fourth industrial revolution, and it has brought challenges to ethics and social governance. On the basis of explaining the current ethical risks of artificial intelligence, the study furtherly analyzes the current consensus on ethics, governance principles, and governance approaches of artificial intelligence. Moreover, the study also proposes to take "co-construction, co-governance and sharing" as the guiding theory to gradually build a multi-dimensional ethical governance system, including education reform, ethical norms, technical supports, legal regulations, and international cooperation.

Legislatures, Judges, And Parole Boards: The Allocations Of Discretion Under Determinate Sentencing, Dhammika Dharmapala, Nuno Garoupa, Joanna M. Shepherd Nov 2021

Legislatures, Judges, And Parole Boards: The Allocations Of Discretion Under Determinate Sentencing, Dhammika Dharmapala, Nuno Garoupa, Joanna M. Shepherd

Florida Law Review

The most significant development in criminal sentencing in recent decades has been the shift from indeterminate to determinate sentencing. Yet no study has systematically explored the factors leading to this shift. In this Article, we provide the first analysis to explain why state legislatures enact reforms that significantly reduce both judges’ and parole boards’ discretion over criminal sentencing. First, we develop a political economy model that explains why legislatures acting in their own self-interest may be motivated to enact these laws. Our model predicts that legislatures are more likely to enact determinate sentencing reforms when there is tension among the …

Civil Rights Violations = Broken Windows: De Minimis Curet Lex, Anita Bernstein Nov 2021

Civil Rights Violations = Broken Windows: De Minimis Curet Lex, Anita Bernstein

Florida Law Review

Civil rights violations that appear relatively slight may warrant judicial redress despite their small size; some of them point up important principles. Leaving these violations unremedied may contribute to an ambient lawlessness that can foster bigger harms. A small infringement in this respect resembles the criminological construct of “broken windows,” which in its prescriptive form urges governments to view de minimis violations as harbingers of more disorder to come.

Using broken windows to understand privately initiated civil rights claims honors a statutory mandate and helps to achieve progressive ends. This application is potentially better than the one that police impose …

Second-Order Proof Rules, Michael S. Pardo Nov 2021

Second-Order Proof Rules, Michael S. Pardo

Florida Law Review

Proof rules in law dictate when facts have been proven. They do so by specifying a level of proof such as by a preponderance of the evidence, by clear and convincing evidence, or beyond a reasonable doubt. The goals of the rules are to minimize errors (accuracy) and to allocate the risk of error fairly. I argue that the current rules fail to serve these two goals. Rather than suggesting we abandon these well-entrenched rules, I propose and argue for “second order” proof rules that will better align decision-making with its goals by providing criteria for applying the current rules. …

Still Waiting For A Cure, Uchenna Emenaha Nov 2021

Still Waiting For A Cure, Uchenna Emenaha

Journal of Multicultural Affairs

Poetry elicits emotions and imagery, which can capture the sentiments of the collective experiences that educators and our society are experiencing during this moment in history. This poem calls to attention the way in which the COVID-19 pandemic has affected our country through social distancing precautions put into place to curb the spread of the virus. The verses in the poem speak to the loss of community and celebrations that occurred during this time. The poem concludes by addressing the racial awakening that has also taken place during these unprecedented times. The pandemic reduced many of life’s distractions allowing a …
