Loyola University Chicago Law Journal
The COVID-19 pandemic has caused millions of deaths and disastrous consequences around the world, with lasting repercussions for every field of law, including privacy and technology. The unique characteristics of this pandemic have precipitated an increase in use of new technologies, including remote communications platforms, healthcare robots, and medical AI. Public and private actors alike are using new technologies, like heat sensing, and technologically influenced programs, like contact tracing, leading to a rise in government and corporate surveillance in sectors like healthcare, employment, education, and commerce. Advocates have raised the alarm for privacy and civil liberties violations, but the emergency …

Sexual Harassment In A University Setting: Searching For Justice And Compassion In An Unjust And Indifferent World, Marie Failinger
Sexual Harassment In A University Setting: Searching For Justice And Compassion In An Unjust And Indifferent World, Marie Failinger
Faculty Scholarship
The article deals with the question concerning legal responses to sexual harassment – whether those responses should be relentless in punishing and stigmatizing perpetrators and banishing them from positions where they can offend further, or whether there should be room for rehabilitating or even forgiving at least those offenders whose abusive behavior is not violent or serial. On the one hand, the importance of achieving justice and equality for women is critical. On the other hand, one may recognize the possibility of repentance and restoration of both victim and offender to society. The modern restorative justice movement, informed by Christian …

Meaningless Guarantees: Comment On Mitchell E. Mccloy's “Blind Justice: Virginia's Jury Sentencing Scheme And Impermissible Burdens On A Defendant's Right To A Jury Trial", Alexandra L. Klein
Faculty Articles
Despite the important role that jurors play in the American criminal justice system, jurors are often deprived of critical information that might help them make sense of the law their oaths require them to follow. Such information with regard to sentencing might include the unavailability of parole, geriatric release, sentencing guidelines, or other information that is relevant to determining a defendant's penalty. Withholding information from juries, particularly in sentencing, risks unjust and inequitable sentences. Keeping jurors in the dark perpetuates injustices and undermines public confidence and trust in the justice system.
Mitch McCloy's excellent Note provides a compelling illustration of …

This study explores the educators’ perspectives on their experiences providing academic services and supports to incarcerated youth placed in short-term juvenile detention centers and how they perceive success and challenges in this environment. The study used an explanatory sequential mixed-methods research design while incorporating tools such as a questionnaire, interviews, and reflective journal activities to get a deeper understanding of the experiences educators encounter in this role. The questionnaire consisted of 38 questions designed to address the demographics of the teachers participating in the study, their teaching experience with incarcerated youth, professional development received, and the challenges and successes they …
False Confession In Wrongful Convictions And The Effect Of Recording Custodial Interrogations Through Exoneration, Nana F. Owusu
False Confession In Wrongful Convictions And The Effect Of Recording Custodial Interrogations Through Exoneration, Nana F. Owusu
West Chester University Doctoral Projects
To reduce false confessions and guilty pleas, twenty-seven states have passed a law to have all custodial interrogations electronically recorded. According to the Innocence Project briefing book (2017) on the electronic recording of interrogations, electronic recording is audio and audiovisual (Innocent Project, 2017). This study explores the factors that lead to false confessions and guilty pleas in wrongful convictions. The literature explains how deprivation, coercion, violence, and evidence fabrication can lead to false confessions and guilty pleas. Using the comparative/experimental research approach to study two groups (27 states with recording laws and 27 states (including territories) with no recording laws), …
Policies & Services Mitigating Gender-Based Violence (Gbv): Perceptions Of African Immigrant Women In The Northeastern, U.S., & Empowering Their Human Rights., Chinenye Nwoke
West Chester University Doctoral Projects
African immigrant women’s harrowing experiences of gender based violence (GBV) is a violation of human rights and requires a systematic policy attention (USAID, 2012). The theoretical groundwork for this study is macro-oriented, utilizing the socio-cultural theories associating cultural acceptance and gender roles to incidents of violence against women. The connection between African immigrant women and socio-cultural theories is embedded in African social and cultural conditions typically encouraging the likelihood of domestic violence against the women. Governments are required to pursue policies towards appropriate domestic legal framework against GBV. This study investigated perceptions of African immigrant women in the northeastern, U.S. …

“Born Under My Heart”: Adoptive Parents’ Use Of Metaphors To Make Sense Of Their Past, Present, And Future, Lucas Hackenburg, Toni Morgan, Eve Brank
“Born Under My Heart”: Adoptive Parents’ Use Of Metaphors To Make Sense Of Their Past, Present, And Future, Lucas Hackenburg, Toni Morgan, Eve Brank
Center on Children, Families, and the Law: Faculty Publications
Metaphors provide the opportunity to make sense of our experiences and share them with others. The current research qualitatively examined interviews with adoptive parents who had adopted through intercountry or private adoptions. Throughout their interviews, each participant used at least one metaphor in describing their experiences of adopting and raising their child. Overarchingly, the metaphor of “Adoption is a journey” encapsulated parents’ experiences. To demonstrate the journey, parents used metaphors to describe the past, present, and future. Metaphors of the past focused on their child’s trauma and the origin of how the child came to join their family. Metaphors used …

“Good morning, Your Honor, AA, here on behalf of the United States government.”1 AA recounted her proudest moment: appearing in federal district court as an attorney for the Department of Justice (DOJ) in a religious accommodation case under Title VII of the Civil Rights Act of 1964.2 There she stood, an Ivy League graduate and the granddaughter of sharecroppers. She appeared before the court as an African-American Muslim woman in hijab representing the government to uphold the constitutional rights of another Muslim woman.3 The complainant, Safoorah Khan, was employed as a teacher in a small Illinois school district and had …

Removing Police From Schools Using State Law Heightened Scrutiny, Christina Payne-Tsoupros
Journal Articles
This Article argues that school police, often called school resource officers, interfere with the state law right to education and proposes using the constitutional right to education under state law as a mechanism to remove police from schools. Disparities in school discipline for Black and brown children are well-known. After discussing the legal structures of school policing, this Article uses the Disability Critical Race Theory (DisCrit) theoretical framework developed by Subini Annamma, David Connor, and Beth Ferri to explain why police are unacceptable in schools. Operating under the premise that school police are unacceptable, this Article then analyzes mechanisms to …

Asylum Attorney Burnout And Secondary Trauma, Lindsay M. Harris, Hillary Mellinger
Journal Articles
We are in the midst of a crisis of mental health for attorneys across all practice areas. Illustrating this broader phenomenon, this interdisciplinary Article shares the results of the 2020 National Asylum Attorney Burnout and Secondary Traumatic Stress Survey (“Survey”). Using well-established tools, such as the Copenhagen Burnout Inventory and the Secondary Stress Trauma Survey, the Survey assessed the well-being of over 700 immigration attorneys navigating the tumultuous asylum space. As the largest such study of United States attorneys to date, it is particularly timely. Between 2017 and 2021, the Trump administration’s extreme policies, sweeping regulatory changes, and Attorney General …

The Potential Role Of Trauma-Informed Positive Education In The Secondary Mathematics Classroom In Disrupting The Preschool-To-Prison Pipeline, Jessica Michele Doering
Theses and Dissertations--Education Sciences
This mixed-methods study considered the potential for trauma-informed mathematics education to disrupt the preschool-to-prison (or school-to-prison) pipeline. Phenomenological qualitative interviews were conducted in conjunction with the use of the Attitudes Related to Trauma-Informed Care (ARTIC; Baker et al., 2016) scale to determine teacher perceptions of trauma-informed care practices, their thoughts regarding challenging classroom behaviors and the connection of these behaviors with trauma and the pipeline, and their ideas about how much of an impact teachers can have on students who present with challenging behaviors that might be symptoms of trauma or that might be an indicator of future incarceration. This …
