Trademarking Recreational Marijuana And Potential Threats To The United States' Treaty Obligations, Charles Wells Jan 2021

Trademarking Recreational Marijuana And Potential Threats To The United States' Treaty Obligations, Charles Wells

Journal of Intellectual Property Law

The conflict between state and federal laws regarding the cultivation and sale of recreational marijuana results in inconsistent application of trademark protections between state and federal governments that could cause conflict with the United States’ treaty obligations under the TRIPS agreement. Whereas the federal government categorically denies trademark protections for marijuana-based products state governments protect trademarks belonging to recreational marijuana businesses through state and common law trademark protections. The United States is also obligated to ensure that foreign nationals and United States receive the same treatment regarding trademark protections under The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). …

Encirclement, Deprivation, And Humanity: Revising The San Remo Manual Provisions On Blockade, Tom Dannenbaum Jan 2021

Encirclement, Deprivation, And Humanity: Revising The San Remo Manual Provisions On Blockade, Tom Dannenbaum

International Law Studies

Among the most pernicious trends in contemporary armed conflict is the return of mass starvation in war, in some cases as its primary source of human suffering. This has prompted a renewed focus on the relevant rules of international humanitarian law (IHL). On some issues, there is relative consensus. On the issue of deprivation by encirclement, however, there is confusion.

Some have questioned whether the prohibition on the starvation of civilians as a method of warfare applies to encirclements at all, particularly in the naval context. Others have interpreted the prohibition vanishingly narrowly. In contrast to the more extreme of …

Controlling Schools: How School Resource Officers’ Roles Map Onto Schools’ Behavior Management Strategies, Ivan Benitez, Benjamin W. Fisher, Taylor Tolles, Emily M. Wright Jan 2021

Controlling Schools: How School Resource Officers’ Roles Map Onto Schools’ Behavior Management Strategies, Ivan Benitez, Benjamin W. Fisher, Taylor Tolles, Emily M. Wright

Criminology and Criminal Justice Faculty Publications

School resource officer (SRO) behavior varies across schools, but little is known about what shapes their behavior. Social ecological theories state that features of communities shapes individual behavior, including police officers. This may similarly apply to SROs. This study uses the 2015 to 2016 School Survey on Crime and Safety to test the extent to which three aspects of a school’s context related to behavior management (i.e., security measures, disciplinary environment, and restorative practices) shape SROs’ involvement in three roles: law enforcement, teacher, and mentor. Using a generalized structural equation model to examine the relationships between school context and SRO …

Teaching Challenging Texts And Encouraging Inquiry Remotely, Aisha Ratanapool

UNLV Best Teaching Practices Expo

Creating a culture of inquiry in non-research based courses helps students enhance their skills in critical thinking, reading, writing, collaboration, and argumentation. In English 101, some students feel like not having all of the answers about a text after a first read is unacceptable. This practice is designed to help college students understand and confidently discuss complex texts in a remote course.

Transformational Leadership, Conflict Management Style, And Job Satisfaction In Law Enforcement, Giuseppe Alise Jan 2021

Transformational Leadership, Conflict Management Style, And Job Satisfaction In Law Enforcement, Giuseppe Alise

Seton Hall University Dissertations and Theses (ETDs)

Abstract

Effective leaders are essential for any organization, including law enforcement. Police work is not free from the challenges of leadership, confronted with its own unique challenges, including developing ways to adapt to rapid change and continually having to adjust to various political and environmental factors.

This research is an in-depth examination of how transformational leadership and conflict management style drive job satisfaction in law enforcement. The goal is to determine whether employee satisfaction achieved through transformational leadership is, in fact, largely the result of how leadership handles conflict. The idea is to disentangle the relationship between transformational leadership and …

Examining Adverse Childhood Experiences Among Native American Persons In A Nationally Representative Sample: Differences Among Racial/Ethnic Groups And Race/Ethnicity-Sex Dyads, Tara Richards, Joseph A. Schwartz, Emily M. Wright

Criminology and Criminal Justice Faculty Publications

Background

Existing research using nationally representative samples has provided valuable information regarding the prevalence and context of childhood adversity, but Native American persons have largely been absent from these studies.

Objective

We examined adverse childhood experiences (ACEs) among persons identifying as White, Black, Asian, Hispanic, and Native American in the NESARC, a longitudinal study (Wave 1: 2001–2002; Wave 2: 2004–2005) using a nationally representative sample from the United States.

Methods

Means tests and negative binomial regression were used to examine the prevalence and variety of ACEs across racial/ethnic groups and race/ethnicity-sex dyads.

Results

Native American persons reported the greatest average …

State Secrecy: A Literature Review, Stephane Lefebvre Jan 2021

State Secrecy: A Literature Review, Stephane Lefebvre

Secrecy and Society

What is secrecy? What is a state secret? Which state secrets deserve protection from disclosures? How are state secrets protected from disclosure? In this review, I use these questions as an organizing framework to review the richness of a very disparate, largely US-centric, but also multidisciplinary literature. In doing so, I highlight the social nature of secrecy - that it is a social construct with social effects and consequences - and the need for further research to unveil those rationalities that specific discourses on state secrecy put forward to legitimize the nondisclosure of state secrets.

The Rhetorical Devices Of The Keepers Of State Secrets, Stephane Lefebvre Jan 2021

The Rhetorical Devices Of The Keepers Of State Secrets, Stephane Lefebvre

Secrecy and Society

This article examines a set of rhetorical devices forming a linguistic practice that are used repeatedly by secret keepers in the United States and the United Kingdom when legally and popularly arguing against the disclosure of state secrets. Each of these devices (using lists, using the future conditional, arguing from ignorance and authority, arguing from consequences, and arguing by analogy) play a role in shaping our social understanding of state secrecy. More importantly, these devices provide secret keepers a means by which to assert their knowledge and expertise, and to legitimize, if judges agree with them, the nondisclosure of state …

Independent And Cumulative Impacts Of Adverse Childhood Experiences On Adolescent Subgroups Of Anxiety And Depression, Isak Kim, Angélica Galván, Nayoung Kim

Counseling Faculty Publications

The purpose of this study is to investigate the independent and cumulative impacts of Adverse Childhood Experiences (ACEs) on the subgroups of anxiety and depression among 12–17 aged adolescents in the U.S. A sample of 21,496 cases was derived from the 2017–2018 National Survey of Children’s Health (NSCH). Four adolescent subgroups were identified depending on their mental health condition: Anxiety-only (7.2%), Depression-only (1.5%), Anxiety-Depression (6.3%), and None (85.0%). All sociodemographic characteristics such as sex, age, race/ethnicity, and family structure had significant associations with the subgroups. Two multinomial logistic regression analyses were conducted to examine the independent and cumulative effects of …
