The Horseshoe Theory Of Mental Illness And Incarceration, Alicia Y. Liu
The Horseshoe Theory Of Mental Illness And Incarceration, Alicia Y. Liu
Swarthmore Undergraduate History Journal
This paper focuses on the relationship between historical mental illness treatment and modern incarceration, reimagining it as a horseshoe, with mental illness on one end and prison on the other. There are three reasons why the two parallel each other, these being: formulated sequestration, chronicity, and histories of failed high-minded reform. The paper then writes about the intersection of the two in a mental health ward in a prison. The last aspect discussed is the gap between the ends of the horseshoe, which is due to the role of volition.

In the 1943 Alfred Hitchcock film, Shadow of a Doubt, a handsome, young Uncle Charlie visits his sister’s family, including a teenage niece, in the suburbs. Soon after Uncle Charlie’s arrival, the niece notices an unusual quirk: more than camera shy, Uncle Charlie refuses to be caught on film at all. Uncle Charlie steps out of frame whenever a photographer appears, and when a stranger tries to snap his photo on the sidewalk, Charlie grabs the camera and exposes the film. Spoiler alert: Uncle Charlie is a criminal on the run. Not long ago, with a little effort, it was …

August 9, 2014 is not a date most remember as being significant, but the events that day transformed standard police practices. Michael Brown and a friend were walking down the middle of a street in Ferguson, Missouri when a police officer told them to use the sidewalk. Words were traded and a clash ensued that led to the police officer shooting Michael Brown, an unarmed African-American teen. Individuals dispute how the events unfolded. However, two things are clear: the officer was not wearing a body camera, and the policy account differed from eyewitness testimony. The incident caused protests to erupt …

Cited At Nuremberg: The American Eugenics Movement, Its Influence Abroad, The Buck V. Bell Decision, And The Subsequent Bioethical Implications Of The Holocaust, Bessie Blackburn
Bound Away: The Liberty Journal of History
Eugenics was a bioethical movement that captivated many Americans at the turn of the nineteenth century and even into the Progressive era. No event in American history better encapsulates the American eugenics movement than the trial of Carrie Buck and her later forced sterilization. This trial is monumental not only to understanding American eugenic policy, but also international reactions and Nazi Germany’s chilling use of this pseudoscience in the Holocaust. In order to best understand the trial of Carrie Buck, one must look first look at the origins of eugenics, second, the context of the eugenics movement in America and …

Do Mandatory Minimums Increase Racial Disparities In Federal Criminal Sentencing?, Caroline Gillette
Do Mandatory Minimums Increase Racial Disparities In Federal Criminal Sentencing?, Caroline Gillette
Undergraduate Economic Review
Black males received sentences about twenty percent longer than similarly situated white males from 2012 to 2016. Some of this inequality may be introduced by mandatory minimum sentences. Charges carrying a mandatory minimum sentence are brought against Black defendants at higher rates than white defendants. It has been argued that these sentences introduce bias in two ways: legislatively (the types of crimes that carry a mandatory minimum) and in the way these sentences are put into practice (increasing prosecutorial discretion). This brief explores whether mandatory minimum sentences increase racial inequality in criminal sentencing.

From the vantage point of Summer 2020, 2019 seems almost a mirage. The conditions created across Canada by government and individual responses to COVID-19 were all but unimaginable when 2019 drew to a close, and the legal issues that preoccupy those interested in constitutional and public law now revolve around rapidly evolving rules and policies designed to protect public goods like health and health care. Questions of profound significance to constitutional lawyers, such as the location of limits on state powers, the appropriate roles and relative competencies of courts and governments, the place of state law in creating the good …

BACKGROUND: Despite a growing body of empirical support for the effectiveness of extended-release naltrexone (XR-NTX) to reduce opioid relapse among people with opioid use disorder (OUD) transitioning from a correctional facility to the community, continuity of care following release remains challenging. This paper describes a research-based adaptation of a state's standard of care XR-NTX protocol using the ADAPT-ITT framework for delivery in a non-traditional, non-treatment, community criminal justice setting (P&P office), as well as the expansion of services by a local Federally Qualified Health Center (FQHC) provider who would, for the first time, be going to the jail and P&P …

Revoking Supervised Release In The Age Of Legal Cannabis, Zachary J. Weiner
Revoking Supervised Release In The Age Of Legal Cannabis, Zachary J. Weiner
St. John's Law Review
(Excerpt)
Supervised release—part of the original sentence following a guilty verdict—is a system by which federal probation officers monitor prisoners released from federal prison. In imposing supervised release, sentencing judges set conditions that each supervisee must comply with, or risk reincarceration at the discretion of the sentencing judge. Certain conditions of supervised release are prescribed by statute and others are crafted by judges.
If a defendant violates the terms of supervised release by possessing cannabis products, the statutory regime provides the sentencing judge with two options: revoke the defendant’s supervised release and reincarcerate her or, alternatively, release the defendant from …

“Boehner snubs [White House], invites Netanyahu to address Congress.” These words, or words remarkably similar, headlined newspapers all around the United States on January 21, 2015. Without consulting President Obama, House Speaker John Boehner invited Israeli Prime Minister Benyamin Netanyahu to address a joint session of Congress in opposition to the White House’s overtures to Iran with respect to its nuclear program. Speaker Boehner extended the invitation in apparent response to President Obama’s State of the Union Address, in which he informed Congress that any further economic sanctions bill against Iran at that time would be detrimental to ongoing …

The Influence Of Adverse Childhood Experiences On Internalizing And Externalizing Problems In Early Adulthood: Evidence Of A Gene × Environment × Sex Interaction, Emily M. Wright, Joseph A. Schwartz
Criminology and Criminal Justice Faculty Publications
Background
Although adverse childhood experiences (ACEs) have negative effects on subsequent wellbeing, questions remain regarding how and why they do so. Sex, environmental effects, and genetic influences may play a role in both one’s exposure to ACEs as well as one’s reactions to ACEs.
Objective
To understand the combined genetic and environmental influences on males’ and females’ exposure and reactions to ACEs, and to determine whether sex differences in offending and depressive symptoms were partially impacted by genetic influences.
Methods
We employed a sample of monozygotic twins (n = 217 pairs), same-sex dizygotic twins (n = 185 …

The Status Of Women In Utah Politics: A 2021 Update, Hannah Payne, Marin Christensen, Susan R. Madsen
Marketing and Strategy Faculty Publications
The Utah Women & Leadership Project (UWLP) began reporting on the status of women in Utah politics in 2014, with updates in 2017 and now 2021. The first series of reports in 2014 were initially prompted by the Center for American Progress report titled “The State of Women in America: A 50-State Analysis of How Women Are Faring Across the Nation” that ranked Utah last in terms of women being in positions of decision making and leadership. Soon after, a series of other national reports also ranked Utah poorly, and most used the following four criteria: 1) gender wage gap, …
