“Yes, Separation! No, Integration!” A Historical Analysis Of Black Nationalist Groups Across The Decades: From The Civil Rights Era To The Contemporary Era, John Mcgee

Undergraduate Research Conference

As tens of thousands of protesters have taken to the streets with the chants of “Black Lives Matter!” Or “hands up, don’t shoot” issues such as police brutality and institutional racism have once again been thrust into the national spotlight. The strength, longevity, and occasional violence associated with these protests have made Americans from all backgrounds aware of the demands of the protestors. Unsurprisingly, these recent protests, often concerned with issues of race and justice, have drawn comparisons to the powerful protests of the civil rights era. As a result of the success of the civil rights movement and leaders …

Towards A New Archimedean Point For Maternal Versus Fetal Rights?, Pnina Lifshitz-Aviram, Yehezkel Margalit Mar 2021

Towards A New Archimedean Point For Maternal Versus Fetal Rights?, Pnina Lifshitz-Aviram, Yehezkel Margalit

Louisiana Law Review

Some experts in the field have defined the year 2019 as “a critical time for abortion rights,” since during the first half of the year alone 19 American states enacted almost 60 abortion restrictions, including 26 abortion bans, and state legislators have introduced many more. This Article reevaluates whether these recent shifts may amount to a real legal tsunami that could yield a new Archimedean point for women’s and fetuses’ rights, or only a temporary and shallow wave, which will probably abate after the Trump presidency. After exploring in a nutshell the recent restrictive as well as liberal developments in …

Criminal Justice In Juvenile Delinquency, Rana Aloutor Mar 2021

Criminal Justice In Juvenile Delinquency, Rana Aloutor

UAEU Law Journal

Childhood is a very important period in human life; therefore certain principles exist to control its rights. Because of its status and importance, the Jordanian legislator, like the French one, treated it with special attention and care.

The existence of specific sustem regime in juvenile delinquency has three dimensions: The content, the procedural and the institutional. First, in the content, it doesn't seem adequate to apply at juvenile delinquency the same penalties as adults, measures of protection and education seem more adequate.

Then, in the procedural, the specifity of juvenile delinquency demands special courts, specialized in the issues related to …

What Can Be Taught In College In Prison? Reconciling Institutional Priorities In Clashes Over Incarcerated Students’ Access To Instructional Materials, Magic M. Wade Mar 2021

What Can Be Taught In College In Prison? Reconciling Institutional Priorities In Clashes Over Incarcerated Students’ Access To Instructional Materials, Magic M. Wade

Journal of Prison Education and Reentry (2014-2023)

This research was inspired by allegations of censorship of college curricula in an Illinois state penitentiary. This example highlights the confusion and controversy that may ensue when disagreements arise over what students in prison-based college programs are permitted to read and learn. Following this, my research considers these relevant questions: First, do many programs and prisons encounter disagreements over certain instructional materials? Next, to what extent are these rooted in clashing institutional values and priorities? And finally, what can be done to quell controversy, reduce confusion, and strengthen relationships between colleges and prisons? To shed light on these questions, I …

Censorship And The Satanic Verses: Policing Blasphemy In A Secular World, Alixa Brobbey Mar 2021

Censorship And The Satanic Verses: Policing Blasphemy In A Secular World, Alixa Brobbey

Undergraduate Honors Theses

Free speech is currently a hotly debated topic in the world of arts. This thesis traces the history and abolition of blasphemy law in England in light of its relationship with censorship in English literature. I examine the Rushdie Affair and its legacy, particularly in comparison to the Gay News trial. Building on previous scholarship, I examine the arguments that hate speech laws serve as a replacement for blasphemy law. I conclude with the suggestion that hate speech laws be amended to include a clause specifying that works of artistic merit cannot be prosecuted under such laws, mirroring the language …

ENG 101 Library Research Scholarship Recipients' Papers

2021 ENG 101 Library Research Scholarship Recipient

The main purpose of this literature review is to understand the social factors that impact the physical health of racial/ethnic groups in the United States. Studies investigating the health disparities among racial and ethnic groups show that these particular minority populations are disadvantaged in other aspects of life, such as social factors, which ultimately affect their ability to access and utilize healthcare in the United States.

The Dream Act And Daca: A History Of Immigrant Children, Sofia Paschero Mar 2021

The Dream Act And Daca: A History Of Immigrant Children, Sofia Paschero

USF Tampa Graduate Theses and Dissertations

This thesis writes the history of the Development, Relief, and Education for Alien Minors (DREAM ACT) and the Deferred Action for Childhood Arrivals (DACA). Chapter One gives a background history on immigration reforms in the 20th century. Chapter Two focuses on the history of the Development, Relief and Education for Alien Minors (DREAM Act). Chapter Three is the immigrant children story. This chapter is an oral history. My main argument is immigrants have always been and still are, easy targets. Politicians create immigrants as scapegoats in order to avoid the social, political, cultural, and economic issues that are affecting people …

The purpose of this exploratory study was to garner a better understanding of the following research question: What factors may contribute to women’s retention in aviation occupations in the United States? The Aviation Occupation Survey was developed drawing from the published literature in organizational retention and diversity in aviation to explore this research question. The survey consisted of 50 Likert-scale items on nine subjects related to career retention. A total of 188 participants (women = 70, men = 118) completed the survey. Results revealed similarities between women and men on perceptions about numerous aspects of their workplace, particularly job satisfaction, …

Symposium: Examining Black Citizenship From Reconstruction To Black Lives Matter: Rhetoric And Nostalgia In The Criminal Justice Reform Movement, Michael Gentithes Mar 2021

Symposium: Examining Black Citizenship From Reconstruction To Black Lives Matter: Rhetoric And Nostalgia In The Criminal Justice Reform Movement, Michael Gentithes

ConLawNOW

Today’s movement for criminal justice reform and its attendant "defund the police" slogan contain nuanced calls to redirect public funds in ways that will both control crime and support downtrodden neighborhoods. But the language in those calls can easily be misinterpreted. Such poor messaging misleads both the movement’s members and the public in two important ways. First, it repeats many of the mistakes made by protest anthems of the past. For too many Americans enduring today’s all-too-real dystopia, calls to defund sound like calls to anarchy, not arguments for peaceable, sensible reforms. Second, defunding rhetoric contains an element of historical …

White Too Long: Christianity Or Nationalism?, Rachel E. Osborne Mar 2021

White Too Long: Christianity Or Nationalism?, Rachel E. Osborne

USF Tampa Graduate Theses and Dissertations

Tension, racism, and violence being enacted in the name of Christianity have brought new attention to the work of many scholars of religion who have documented and analyzed the relationship between white Christianity and racism in the U.S. In his 2020 book White Too Long, Public Religion Research Institute (PRRI) director and religious studies scholar Robert P. Jones states unequivocally that “[i]n survey after survey, white Christians stand out in their negative attitudes about racial, ethnic, and religious minorities (especially Muslims), the unequal treatment of African Americans by police and the criminal justice system, their anxieties about the changing face …

Who Protects Whom: Federal Law As A Floor, Not A Ceiling, To Protect Students From Inappropriate Use Of Force By School Resource Officers, Elsa Haag Mar 2021

Who Protects Whom: Federal Law As A Floor, Not A Ceiling, To Protect Students From Inappropriate Use Of Force By School Resource Officers, Elsa Haag

Duke Journal of Constitutional Law & Public Policy Sidebar

Over the past forty years, students in the U.S. have experienced increasingly strict school discipline policies and increased police presence in schools. Sent into schools with the aim of improving security in the wake of mass shootings, school resource officers (SROs) are sworn law enforcement regularly assigned to schools. But there is a paucity of evidence that SROs are effective in preventing mass shootings or provide other significant benefits. Instead, research shows that the presence of SROs results in students achieving less and experiencing more physical and emotional harm, with long-term implications and costs for individuals and communities. As trained …

Aspiration And Implementation: County-Level Domestic Violence Programs In A Human Rights Context, Madeline Reilly Mar 2021

Aspiration And Implementation: County-Level Domestic Violence Programs In A Human Rights Context, Madeline Reilly

Proceedings of GREAT Day

This paper analyzes and compares domestic violence policy and outcomes in municipalities in Western New York, specifically in two that have adopted resolutions recognizing freedom from domestic violence as a human right (Erie and Tompkins counties). These resolutions are based on the tragic story of Jessica Gonzales’ children who were killed by her husband and the lack of due diligence by police on behalf of the Gonzales children. Through primary research with people who work in the domestic violence field in both counties, the impact of these similar resolutions is compared and contrasted. The pair of resolutions were found to …

Intergroup Images Mediate The Relationships Between Government Abuse, Sociopolitical Orientations, And Political Action, Erin M. Kearns, Christopher Federico, Victor Asal, James Igoe Walsh, Allison E. Betus, Anthony F. Lemieux

Criminology and Criminal Justice Faculty Publications

What factors impact how people mobilize against state human rights abuses? Drawing on Image Theory, we examine how perceptions of an out-group, government abuse, and sociopolitical orientations impact political action. Using an online survey-embedded experiment with a sample of 2,932 U.S. adults, we manipulated two factors: (1) the level of government abuse and (2) the risk of punishment for taking action against the state, while also including social dominance orientation (SDO) and right-wing authoritarianism (RWA) as covariates. Participants indicated their propensity to engage in and justify both protest and violence. Participants rated the out-group as oppressive and evil. State abuse …
